    Analisis Asas Domitus Litis dan Penghentian Penuntutan Berdasarkan Keadilan Restoratif dalam Perspektif Perjak No 15 Tahun 2020

    The Indonesian Criminal Procedure Code's rules of the game are known as KUHAP. It follows an integrated criminal justice system that includes police, prosecutors, courts, and correctional facilities. The prosecutor's office is an institution that prosecutes people. The principle of dominus litis is inherent in this prosecution, which means that the prosecutor's office has absolute authority to prosecute in court. According to Prosecutor's Office Law No. 16 of 2004, the Attorney General has the authority to set aside cases in the public interest. As a result, the Prosecutor's Office Regulation of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice was issued, which entails the settlement of criminal cases involving perpetrators, victims, families of perpetrators/victims, and other related parties to jointly seek a fair solution by emphasizing recovery returns to the state of all, rather than retaliation. The requirement for enforcing these provisions is that the suspect commits the crime for the first time, with a fine or imprisonment of no more than 5 (five) years.   Abstrak: Aturan KUHAP menganut sistem peradilan pidana terpadu, yang meliputi: pengadilan, kejaksaan, kepolisian, serta pemasyarakatan Status kejaksaan sebagai organisasi yang menangani penuntutan. Asas dominus litis, yang menyatakan bahwa kejaksaan mempunyai yurisdiksi ruang sidang eksklusif, melekat dalam penuntutan ini. berdasarkan UU No 16 Tahun 2004 mengenai Kejaksaan dikatakan bahwa Kejaksaan berwenang bagi memberhentikan perkara dengan alasan bagi kepentingan umum. Peraturan Kejaksaan RI No 15 Tahun 2020 mengenai Penghentian Penuntutan sesuai Keadilan Restoratif diterbitkan sebagai kelanjutan. Peraturan ini mengamanatkan jalan keluar perkara pidana yang mencantumkan pelaku, korban, keluarga pelaku ataupun korban, dan pihak terkait lainnya dengan bantu membantu mencari jalan keluar yang seimbang yang mengutamakan penyembuhan semula keadaan seluruh pihak daripada pembalasan. Agar ketentuan itu dapat ditegakkan, tersangka harus baru awal kali melaksanakan tindak pidana dengan risiko pidana denda ataupun pidana penjara dengan lamanya lima tahun

    This paper aims to analyze the principles and concepts that must be done with the reform of Criminal Law in Indonesia and an overview of maqasid al-sharì'ah upon this reform. At the end of the paper, two things are concluded. First, to welcome the discussion on the Bill of the Criminal Code, several points of thought need to be considered: The adjustments to human rights and respect for freedom of expression based on the needs of modern times and should accommodate the existence of customary law. It also should emphasize that justice must take precedence over legal certainty. The Bill should emphasize that "the principle of no crime without fault" is a condition for sentencing, in addition to the "principle of vicarious liability" and "principle of strict liability" if determined by law. Second, in the view of Islamic Law, the formation of the Bill has fulfilled the principles of maqasid al-sharì'ah, in the form that the law aims to realize the benefit of humans, which is achieved by obtaining benefits for humans and rejecting everything that damages life, both in this world and the hereafter.   Abstrak: Tulisan ini bertujuan untuk menganalisa: (1) hal-hal yang harus dilakukan dengan pembaharuan Hukum Pidana di Indonesia, dan (2) tinjauannya dalam maqasid al-sharì’ah. Di akhir tulisan disimpulkan dua hal. Pertama, bahwa dalam rangka menyongsong pembahasan RUU KUHP, ada beberapa pokok-pokok pikiran yang perlu dipertimbangkan, sebagai berikut: (1) penyesuaian dengan hak asasi manusia dan penghormatan kebebasan berekspresi yang sesuai dengan perkembangan zaman selain serta mengakomodir eksistensi hukum adat, (2) perlunya penekanan bahwa keadilan harus lebih diutamakan daripada kepastian hukum, (3) perlunya penegasan bahwa “asas tiada pidana  tanpa kesalahan” sebagai syarat pemidanaan, disamping “asas vicarious liability” dan “asas strict liability” jika ditentukan oleh undang-undang. Kedua, dalam pandangan Hukum Islam pembentukan R-KUHP telah memenuhi prinsip-prinsip maqasid al-sharì’ah, berupa bahwa hukum bertujuan untuk mewujudkan kemaslahatan manusia yang dicapai dengan cara memperoleh kemaslahatan bagi manusia dan menolak segala hal yang merusak kehidupan, baik di dunia maupun di akhirat.

    This research was conducted to analyze cases that occured with the FPI object, in order to get a bright spot on law enforcement. The murder case of 6 members of the FPI group is still in the process of being investigated, so there are several possibilities for law enforcement that might apply. Prior to this case, FPI was also often involved in extreme anarchist acts, and the people who saw it would call it aradical group. Based on a series of cases that occurred which of course involved FPI with residents, the community, and security forces. There are 3 possible articles of law enforcement in Indonesia that will apply according to UU, namely article 383 of the Criminal Code regarding accidental disappearances, and Article 340 of the Criminal Code regarding premeditated murder, as well as Article 170 of the Criminal Code regarding acts of violence. The perspective that the writer will aim at is the perspective of Jinayah Jurisprudence. So, if the law enforcement is brought to the realm of the jinayah, there are also several kinds of choices of law, namely qis}a>s} if it is proven to kill deliberately and deliberately.     Konsepsi Fiqh Jinayah dalam Merumuskan Sanksi Hukum Pembunuhan Mutilasi

    Among the serious problems facing society is murder accompanied by mutilation. This paper aims to describe the jinayah fiqh conception of mutilation and its legal sanctions. The results of this paper indicate that mutilation is murder which is followed by dismembering the limb of the victim. In positive criminal law, mutilation is charged under Article 340 of the Criminal Code with the threat of alternative sanctions, namely the death penalty or life imprisonment, or for a specified period of up to twenty years. Murder of mutilation in the concept of jinayah fiqh is classified as deliberate killing (qatl al-'amd), this is based on the existence of an element of intentional intention (intention) as a key element for determining the radius of deliberate killing (qatl al-'amd). The punishment formulated for the perpetrator of deliberate murder is qisas, which is the death penalty as retribution for the perpetrator

    Abstracts: The criminal policy against the crime of adultery in the Positive Criminal Law is contained in Article 284 of the Criminal Code, which criminalizes anyone who has sexual intercourse if one of the perpetrators or both of them is married. Adultery in this article is not comprehensive and fulfills a sense of justice for some people who think that adultery is not limited to that because it is not following the values ​​of the Indonesian people's customs and Islamic law, in which the majority of Indonesian people are Muslims. The Criminal Policy in the RKUHP includes an expansion of the meaning of adultery which criminalizes a person who commits adultery with the unconditional condition that one of the perpetrators or both of them is married, the RKUHP also includes cohabitation adultery and incestuous adultery (family ties). This writing does not only make a comparison between the criminal policies regulated in the Positive Criminal Law, namely Article 284 of the Criminal Code and the RKUHP, with Islamic Criminal Law. the problem of poverty which causes prostitution activities to still occur and religious marriage activities that are not registered by the state are carried out by some Indonesian people.     Telaah Kritis Konsep Radd dalam Waris Islam Menurut ‘Aly al-Sabuny

    This study describes and explains the concept of radd and its settlement method in Islamic inheritance according to the thought of 'Aly al-Sabuny. The method used is library research with a conceptual approach. The results of the study explain that the additional portion received by the heirs is beyond furud al Muqaddarah. Sheikh 'Aly al-Sabuny classifies cases based on the existence of the husband/wife in the case. First, the origin of the problem is taken from the number of heirs receiving radd or their shares if there is no husband/wife. Second, if there is one of the husband/wife, then the origin of the problem is taken from the denominator number of the husband/wife share. After being given the husband/wife share, the percentage is divided based on the number of heirs or the share value of the radd recipient's heirs.   Abstrak: Kajian ini akan menguraikan dan menjelaskan konsep radd dan metode penyelesaiannya pada kasus waris islam menurut pemikiran ‘Aly al-Sabuny. Metode yang digunakan adalah library research dengan pendekatan konseptual. Hasil kajian menjelaskan bahwa radd bagian tambahan yang diterima oleh ahli waris di luar furud al Muqaddarah. Syekh ‘Aly al-Sabuny mengklasifikasikan kasus berdasarkan keberadaan suami/istri dalam kasus. Pertama, angka asal masalah diambil dari jumlah ahli waris penerima radd atau sahamnya apabila tidak ada suami/istri. Kedua, apabila dalam kasus ada salah satu dari suami/istri, maka asal masalah diambil dari angka penyebut bagian suami/istri, dan sisa setelah diberikan bagian suami/istri dibagi berdasarkan jumlah ahli waris atau nilai saham ahli waris penerima radd.

    The study aims to find out the arrangements for pawning collateral in the rahn contract at the Sampang Sharia Pawnshop Unit Robatal and the mechanism for handling auctions in rahn guarantees at the Sampang Sharia Pawnshop Unit Robatal. It is empirical research, so obtaining the data is done by observation and interviews. The results of this study are twofold. First, Islam allows debt agreements, which are the essence of a pawn agreement. This pawn agreement in Islamic law is a "jaiz deed" (something that is permissible), both according to the provisions of the Qur'an, Sunnah and consensus of 'Ulama. Second, the procedure for auctioning pawn collateral items at the Sampang Robatal Unit Sharia Pawnshop is in accordance with Islamic law because, in practice, it is in accordance with the demands of the Qur'an and hadith. This is by paying attention to its implementation, such as how to display goods, influence prospective buyers, do the bargaining, consent, deliverance, and hand over the goods. Abstrak: Tujuan dari penelitian ini adalah: (1) untuk mengetahui pengaturan jaminan gadai dalam akad rahn di Pegadaian Syariah Sampang Unit Robatal, dan (2) untuk mengetahui mekanisme penanganan lelang dalam jaminan rahn di Pegadaian Syariah Sampang Unit Robatal. Penelitian ini merupakan penelitian empiris, sehingga untuk memperoleh datanya dilakukan dengan observasi dan wawancara. Hasil dari penelitian ini ada dua. Pertama, bahwa Islam memperbolehkan perjanjian utang piutang, yang pada dasarnya merupakan inti daripada perjanjian gadai, yang artinya bahwa perjanjian gadai ini dalam syari’at Islam merupakan “perbuatan jaiz” (sesuatu yang diperbolehkan), baik menurut ketentuan Alqur’an, Sunnah maupun ijma’ Ulama. Kedua, bahwa prosedur  pelelangan barang jaminan gadai di Pegadaian Syariah Unit Robatal Sampang sudah sesuai dengan syariat Islam, dikarenakan dalam praktiknya sudah sesuai dengan tuntutan al-Quran dan hadits, hal ini dengan memperhatikan pelaksanaannya seperti cara memperlihatkan barang, cara mempengaruhi calon pembeli, cara melakukan tawar menawar, cara melakukan ijab dan qabul serta melakukan penyerahan barang.

    The condition of the pluralistic Indonesian society and various mass organizations raises various views regarding the determination of the beginning of the lunar month. This view is caused by differences in understanding and interpretation of verses and hadiths relating to the beginning of the lunar month. In Indonesia there was a case where when the new moon was below the criteria there was someone who testified to see the new moon and dared to take an oath. In essence, this is contrary to the view of astronomy and civil law in Indonesia. This research is included in the literature research with a qualitative approach. The results showed that astronomically and the procedural law of the religious courts, a person who testifies to seeing the new moon will be validated in astronomy through field data obtained as well as by the procedural law of the religious courts by fulfilling the requirements and criteria that apply in Indonesia, weather conditions that allow it to be seen. hilal, and in accordance with the Decree of the Supreme Court of the Republic of Indonesia Number KMA/095/X/2006

    Abstract:  In this article, the researcher presents the development of the Islamic world in Libya and beginning by talking about the entry of Islam into Libya and focusing on the Maliki school, which is one of the most prominent elements of this development, and then presents the role of the Senussi movement. It turns out that the entry of Islam to Libya and its development was early since the Islamic conquest of it in the first century AH and the seventh AD in the time of Caliph Omar bin Al-Khattab, and Libya embraced in the period of the Islamic conquest has the remains of some companions, may God be pleased with them, who were martyred in order to spread Islam in this country, the most famous of which are Al-Munaidher Al-Afriqi in the city of Tripoli, Ruwaifa Al-Ansari in the city of Al-Bayda, Abu Sajeef bin Qais in the city of Misrata, Zuhair Al-Balawi, Abu Mansour Al-Farsi and Abdullah bin Righteousness and both three in the city of Derna, and the development of Islam with the spread of the Maliki school and the emergence of scholars who contributed to its dissemination not only in Libya but in all countries of the Arab Maghreb, such as Sheikh Ali bin Ziyad Trabelsi, where the Maliki school was among the foundations in the development of Islam in Libya, and was associated with various aspects and formed an identity for Libyans throughout the ages, and the Senussi method formed a significant role in the development of Islam in Libya and played an essential role in spreading Maliki jurisprudence and the pure Sufi way far away On heresies and superstitions and in the dissemination of Maliki jurisprudence, as well as in the jihad movement against the Italian colonizer. Keywords: evolution, world, sect, Islam, Libya. الملخص: في هذه المقالة يعرض الباحث لتطور العالم الإسلامي في ليبيا والبداية بالحديث عن دخول الإسلام لليبيا ومركزا على المذهب المالكي الذي يعد من أبرز عناصر هذا التطور ثم يعرض لدور الحركة السنوسية. يتبين أن دخول الإسلام لليبيا وتطوره بها كان مبكرا منذ الفتح الإسلامي لها في القرن الهجري الأول السابع الميلادي في زمن الخليفة عمر بن الخطاب ، واحتضنت ليبيا في فترة الفتح الإسلامي لها رفات بعض الصحابة رضي الله عنهم الذين استشهدوا في سبيل نشر الإسلام في هذا البلد من أشهرهم المنيذر الأفريقي في مدينة طرابلس، ورويفع الأنصاري في مدينة البيضاء، وأبو سجيف بن قيس في مدينة مصراته، وزهير البلوي وأبو منصور الفارسي وعبد الله بن بر وكلا الثلاثة في مدينة درنة، وتطور الإسلام بانتشار المذهب المالكي وبروز علماء ساهموا في نشره ليس في ليبيا فقط بل في كل أقطار المغرب العربي مثل الشيخ علي بن زياد الطرابلسي، حيث كان المذهب المالكي من بين الأسس في تطور الإسلام في ليبيا، وارتبط بالنواحي المختلفة وشكل هوية لليبيين على مر العصور، كما شكلت الطريقة السنوسية دورا كبيرا في تطور الإسلام في ليبيا ولعبت أدورا مهما في نشر الفقه المالكي والطريقة الصوفية النقية البعيدة عن البدع والخرفات وفي نشر الفقه المالكي وكذلك في حركة الجهاد ضد المستعمر الإيطالي. الكلمات المفتاحية: تطور، العالم، المذهب، الإسلام، ليبيا

    Telaah Pemikiran Muhaddithin dan Usuliyyin terhadap Hadith al-Jinayah sebagai Hujjah dalam Memutuskan Hukum Pidana Islam

    Al-hadith positions as the foundation of Islamic law does not cover all kinds and types of al-hadith, even though the Qur'an has shown its validity. The Ulama attitude toward al hadits is influenced by several factors. Some take all hadith as the basis for Islamic law (including determining the provisions of Islamic jinayah/criminal punishments), and some do not. Some ulama are critical of al-hadith as a rationale of the Islamic shari'ah argument, some are merely positive, and some reject a part of al-hadith as a basis. According to Ulama Muhaddistsun and Ushuliyyun, al-hadith al-maqbullah must be based on various criteria. It must be narrated by a narrator who is fair and dabit, there is no 'illah al-qadihah, and the narration is not experiencing shudud. Muhaddithun took the attitude to accept all hadith, whether authentic, hasan or da'if, all to be practised. On the other hand, the ushuliyyun take the basis of istinbat only on the proposition of hadith shahih or hasan as ma'mul bih. This attitude extends to al-hadith ghayr al-mutawatirah, which provides benefits for yaqin. According to them, if the hadith is ghayru ma'mul bih, it is rejected.
