    Successful unsuccessful children’s rights climate cases? Lessons learned from the Sacchi and Agostinho cases or the power of a non-judicial body

    In October 2021, the United Nations Committee on the Rights of the Child (hereinafter: CRC Committee) published its ʻlandmarkʼ decision on a complaint brought by sixteen children and young people, including iconic climate activist Greta Thunberg, against five G20 countries – Argentina, Brazil, France, Germany and Turkey. The young petitioners filed their claim to the CRC Committee under the so-called Third Optional Protocol to the UN Convention on the Rights of the Child (hereinafter: Third Optional Protocol) on a communications procedure. Although the CRC Committee ultimately found the complaint inadmissible for lack of exhaustion of domestic remedies, the decision is nevertheless groundbreaking as it established for the first time as an international human rights body that a State Party can be held accountable for the negative effects of its carbon emissions on children’s rights both within and outside its territory. The petition and the CRC Committee’s decision also confirmed that the climate crisis is also a children’s rights crisis, thus defining the scope of interpretation – and analysis – of this issue in relation to children’s rights. In April 2024, the European Court of Human Rights (hereinafter ECtHR or Court) handed down its first climate judgments, alongside two other decisions, in the case of Duarte Agostinho and Others v. Portugal and Others, brought by six Portuguese young people against 32 Council of Europe Member States, which was also eventually declared inadmissible. Despite the obvious differences between the two forum systems, the common core issues make the two decisions comparable. Despite the ‘negative’ outcome, both decisions are of crucial importance in relation to children’s rights and the environment, despite their different reasoning, merits and the different nature and attitudes of the adjudicating bodies

    The article seeks to analyze, from a historical perspective, the discursive and institutional practices established by the so-called missionary pedagogies, led by one of the five congregations that worked in the coal complex of southern Santa Catarina: the Little Sisters of Divine Providence. We will focus on the broad educational processes developed by nuns with the sons and daughters of coal mine workers living in Vila Operária Próspera, in the city of Criciúma, Brazil, between the years 1950 and 1980. The nuns, when specializing in different activities for boys and girls, even with the contestation of gender norms in some spaces in Vila Operária, they contributed in some way to the construction of differences between masculine and feminine, reinforcing inequalities.O artigo busca analisar, de uma perspectiva histórica, as práticas discursivas e institucionais estabelecidas pelas chamadas pedagogias missionárias, protagonizadas por uma das cinco congregações que atuaram no complexo carbonífero do sul catarinense: as Pequenas Irmãs da Divina Providência. Em particular, focaremos nos processos educativos amplos desenvolvidos pelas religiosas junto aos filhos e filhas dos operários de uma mina de carvão residentes na Vila Operária Próspera, na cidade de Criciúma, Brasil, entre os anos de 1950 e 1980. As freiras, ao se especializarem em atividades distintas para meninos e meninas, mesmo com a contestação das normas de gênero em alguns espaços da Vila Operária, contribuíram de alguma forma para a construção das diferenças entre o masculino e o feminino, reforçando as desigualdades

    A Congregação das Servas Franciscanas Reparadoras de Jesus Sacramentado: a reparação dos Sacrários pobres e abandonados

    This article presents the Congregation of Franciscan Servants Repairers of Jesus in the Blessed Sacrament (SFRJS). Attention is drawn to its charismatic core as a process, from its inspiration to the way it was narrated, lived, interpreted and poured into congregational practice. Its genesis dates back to the beginning of the 20th century, in Pereira, a village in the diocese of Bragança-Miranda, municipality of Mirandela. The main characteristic of it\u27s spirituality is the Eucharistic reparation that enlightens the social and apostolic works to which it dedicates itself. The contribution of the five founders of the Congregation, before and after its canonical erection in 1950, is analyzed, and the evolution of their works in the areas of “service, spirituality and mysticism” is followed. Today it is an Institute of Pontifical Right that develops its activity in Portugal, Angola, Mozambique and Brazil.Este artigo apresenta a Congregação das Servas Franciscanas Reparadoras de Jesus Sacramentado (SFRJS). Chama-se a atenção para o seu núcleo carismático como processo, desde a sua inspiração até ao modo como foi narrado, vivido, interpretado e vertido na práxis congregacional. A sua génese remonta ao início do século XX, em Pereira, aldeia da diocese de Bragança-Miranda, concelho de Mirandela. A caraterística principal da sua espiritualidade é a reparação eucarística que ilumina as obras sociais e apostólicas a que se dedica. Analisa-se o contributo dos cinco fundadores da Congregação, antes e depois da ereção canónica desta em 1950, e acompanha-se a evolução das suas obras nas vertentes de «serviço, espiritualidade e mística». Hoje é um Instituto de Direito Pontifício que desenvolve a sua atividade em Portugal, Angola, Moçambique e Brasil

This research aims to reveal the transformative potential of such integrated approaches. The findings not only provide valuable insights into effective teaching methodologies but also underline the importance of developing a new skill set that prepares learners for the challenges of the 21st century. Furthermore, this paper contributes to the ongoing discourse on educational innovation and the use of art in technology

    Fios de Silere (2024) is a sound and light installation that dives into the question: "How can silence be materialised in an audiovisual work of art?". Silence is not merely the absence of sound and has various constructions. The diversity of literature on this topic, makes it clear that no consensus is possible, thus, silence is elusive. How to materialise the elusive? This artistic research project delves into this problematic by investigating how artists materialise, write and talk about silence, and how humans experience and relate to it. Each person contacts and creates silence, alone and with others. Extending the research scope beyond the auditory world, sound and light become the vehicles for expressing our thoughts on this matter. They permeate the exhibition space with metaphorical silences, making the materiality of silence tangible and allowing it to be experienced by both body and mind

    Análise de custo-efetividade “prevenção versus tratamento de lesões por pressão”: um estudo de caso

    The cost-effectiveness analysis between prevention and treatment of pressure injuries reveals that prevention, despite its higher initial investment, reduces long-term costs, improves patients\u27 quality of life, and decreases associated complications. Pressure injuries, common in dependent elderly individuals, result from prolonged pressure on bony prominences and represent a public health problem due to their impact on healthcare costs and quality of life. In this context, the present case study was conducted through qualitative research, and its main objective was "to perform a cost-effectiveness analysis between the prevention and treatment of pressure injuries". After analysis, it was observed that, without preventive measures, treatment costs were high, with worsening of existing injuries. On the other hand, with preventive measures, there was an improvement in skin condition and less progression of the injury. Existing literature confirms that prevention programs for pressure injuries can reduce the incidence of these injuries by up to 60%, with lower treatment costs. The cost-effectiveness analysis of the approaches under study demonstrated that prevention is economically advantageous and should be encouraged to minimize the economic and health impacts of pressure injuries.El análisis coste-efectividad entre la prevención y el tratamiento de lesiones por presión, revela que la prevención, a pesar de la mayor inversión inicial, reduce los costes a largo plazo, mejora la calidad de vida de los pacientes y disminuye las complicaciones asociadas. Las lesiones por presión, comunes en ancianos dependientes, son el resultado de la presión prolongada ejercida sobre los huesos prominentes y son un problema de salud pública debido al impacto en los costos de salud y en la calidad de vida. En este estudio de caso, se observó que, sin medidas preventivas, los costos del tratamiento eran altos, con agravamiento de las lesiones existentes. Ya con medidas de prevención, hubo una mejora en la piel y menor progresión de la lesión. La literatura existente confirma que los programas de prevención y de lesiones por presión pueden reducir hasta en un 60% la incidencia de lesiones por presión, con menor coste por tratamiento. El análisis coste-efectividad entre los enfoques en estudio, ha demostrado que la prevención es económicamente ventajosa y debe ser incentivada para minimizar los impactos económicos y de salud de las lesiones por presión.L’analyse coût-efficacité entre la prévention et le traitement des lésions de pression révèle que la prévention, malgré un investissement initial plus élevé, réduit les coûts à long terme, améliore la qualité de vie des patients et diminue les complications associées. Les lésions dues à la pression, fréquentes chez les personnes âgées dépendantes, résultent de la pression prolongée exercée sur les proéminences osseuses et sont un problème de santé publique en raison de leur impact sur les coûts des soins de santé et la qualité de vie. Dans la présente étude de cas, il a été observé que sans mesures préventives, les coûts du traitement étaient élevés, avec une aggravation des lésions existantes. Avec des mesures de prévention, il y avait une amélioration de la peau et une moindre progression de la lésion. La littérature existante confirme que les programmes de prévention et de traitement des blessures par pression peuvent réduire l’incidence des blessures par pression jusqu’à 60 %, avec un coût moindre par traitement. L’analyse coût-efficacité entre les approches étudiées a montré que la prévention est économiquement avantageuse et qu’elle doit être encouragée pour minimiser les impacts économiques et sanitaires des lésions dues à la pression.A análise custo-efetividade entre prevenção e tratamento de lesões por pressão, revela que a prevenção, apesar do investimento inicial mais elevado, reduz os custos a longo prazo, melhora a qualidade de vida dos doentes e diminui as complicações associadas. As lesões por pressão, comuns em idosos dependentes, resultam da pressão prolongada exercida em proeminências ósseas e são um problema de saúde pública devido ao impacto nos custos de saúde e na qualidade de vida. Neste sentido, o presente estudo de caso foi realizado através de uma pesquisa qualitativa e teve como principal objetivo “Realizar uma análise custo-efetividade entre a prevenção e o tratamento de lesões por pressão”. Após a sua análise, observou-se que, sem medidas preventivas, os custos de tratamento eram elevados, com agravamento das lesões existentes. Já com medidas de prevenção, houve uma melhoria na pele e menor progressão da lesão. A literatura existente confirma que, programas de prevenção e de lesões por pressão, podem reduzir em até 60% a incidência de lesões por pressão, com menor custo por tratamento. A análise custo-efetividade entre as abordagens em estudo, demonstrou que a prevenção é economicamente vantajosa e deve ser incentivada para minimizar os impactos económicos e de saúde das lesões por pressão

    Porque a dislexia pura é rara: contributo para a inclusão de estudantes com dislexia e algumas comorbilidades no ensino superior

    Starting from the observation that a student diagnosed with Dyslexia will rarely have only Dyslexia, this descriptive literature review aims to contribute to a better understanding of Dyslexia and its most frequent comorbidities. The inclusion of students with Dyslexia and comorbidities, particularly in higher education, is only possible with information that clarifies what these conditions are and what it means to live with them. In addition to discussing the other side of Dyslexia, which is Dysorthographia, the article reviews literature on Dyscalculia, Attention Deficit Hyperactivity Disorder (ADHD), Specific Language Impairment (SLI), and Autism Spectrum Disorder (ASD). It addresses these topics individually and the additional challenges each brings to the already complex picture of Dyslexia. The article does not delve into the controversial issue of the comorbidity of Dyslexia with below-average IQ, although it briefly touches on the subject. It also offers suggestions for future research focusing on this issue, which could be relevant for intervention.Partindo-se da constatação de que um estudante com diagnóstico de Dislexia raramente terá apenas Dislexia, o presente artigo de revisão descritiva da literatura pretende contribuir para uma melhor compreensão da Dislexia e das suas comorbilidades mais frequentes. A inclusão de estudantes com Dislexia e comorbilidades, nomeadamente no ensino superior, apenas é possível com informação que clarifique o que são e o que é ter estas condições. Para além de abordar o outro lado da Dislexia, que é a Disortografia, o artigo apresenta uma revisão da literatura sobre a Discalculia, a Perturbação de Hiperatividade com Défice de Atenção (PHDA), a Perturbação Específica da Linguagem (PEL) e a Perturbação do Espectro do Autismo (PEA). Aborda as temáticas per se e as dificuldades acrescidas que cada uma traz ao quadro, já complexo, da Dislexia. O artigo não explora a questão, controversa, da comorbilidade da Dislexia com um QI abaixo da média, embora a aflore, mas traz sugestões para futuras investigações que se foquem nesta questão que pode ser relevante para a intervenção

    The incoming tide of an effects-based approach in EU law: a comparison between the competition and free movement case law

    The use of an economics, effects-based, approach in EU Law is normally understood within the context of the enforcement of the EU Competition provisions. It embodies the post-Modernisation shift from a formalistic application of these provisions, and particularly of Article 102 TFEU, to a method of analysis that focuses on the capability of a certain behaviour to harm competition using market dynamics and defined economic tools. This paper draws comparisons between this specialised approach and the interpretation increasingly followed by the Court of Justice in the field of free movement of goods and persons. There, the Court has moved from using a formalistic analytical framework based on the existence or absence of discrimination to one that considers the effects of a measure on the demand side of the market or in preventing or limiting access to other markets by EU migrants. The paper outlines the clear and important differences between the fields of free movement and competition law but also seeks to ascertain the existence of parallel analytical trends and the implications of these for the direction of the Single Market. It considers two themes. First, it examines the shift from a predominantly formalistic approach to specialised and general effects-based approaches, respectively, in the competition and free movement case law. Second, as these analytical frameworks have developed and their implications have become clearer, it identifies the emergence of trends in both areas towards a refinement or revision of their parameters
