Consentimento informado em pesquisa científica: o que devemos saber?
Informed consent is a pillar of the research and imperative in an ethical dimension. Given its inherent principles in an increasingly rigorous and responsible investigation, this process is complex, making it challenging to reflect on its validity from an ethical and deontological perspective. We are witnessing the fast development of knowledge in biomedicine intrinsic to unprecedented technological innovation, with increased complex studies and repercussions on consent. Among them, the simplification and validation of information to be transmitted to the participant, the possibility to extend the period for clarifying possible doubts, the use of support tools, and optimization of the communication by researchers. Overly technical terms, difficult interpretation of the information, little explanation, different cultures, and sociopolitical ideologies affect the researchers’ differentiation. Given the several legal dimensions of consent, the relevance of free and informed exercise of the rights provided by law for scientific development in health was demonstrated. In addition to an opportunity for effective communication, informed consent must be based on a trust relationship between the investigator and the participant, based on ethical principles. These are essential to the development of rational and robust research, somehow guiding the work to be carried out by researchers, including the principles of beneficence, non-maleficence, justice, autonomy, and precaution. Therefore, the participant assumes an active role in the success or suspension of the investigation, and the investigators are responsible for respecting the informed and free decision.O consentimento informado é um dos pilares da investigação e considerado imperativo numa perspetiva ética. Atendendo aos respetivos princípios e ao processo de investigação cada vez mais rigoroso, responsável e complexo, torna-se desafiante a reflexão sobre a sua validade na perspetiva ética e deontológica. Assistimos ao rápido desenvolvimento do conhecimento na biomedicina e, associado a uma inovação tecnológica sem prece- dentes, verifica-se uma maior complexidade dos estudos e, consequentemente, do consentimento informado. Considera-se, portanto, a simplificação e validação das informações a serem transmitidas ao participante, a possibilidade de prorrogação do prazo para esclarecimento de possíveis dúvidas, a utilização de ferramentas de apoio e a otimização da comunicação por parte dos pesquisadores. Outros aspetos a ter em linha de conta pelos investigadores são os termos excessivamente técnicos, as informações de difícil interpretação, esclarecimento resumido, culturas diferentes e as ideologias sociopolíticas. Dadas as várias dimensões jurídicas do consentimento, demonstra-se a relevância do exercício livre e informado dos direitos previstos na lei, no desenvolvimento científico em saúde. Além de ser uma oportunidade de comunicação efetiva, o consentimento informado deve ser baseado numa relação de confiança entre o investigador e o participante, baseada em princípios éticos. Estes são essenciais para o desenvolvimento de investigações racionais e robustas, orientando de alguma forma o trabalho a ser desenvolvido pelos investigadores, baseando-se nos princípios da beneficência, não maleficência, justiça, autonomia e precaução. Assim, o participante assume um papel ativo no sucesso ou inviabilidade da investigação, cabendo aos investigadores respeitar uma decisão livre e esclarecida

Será que o Direito Português confere melhor proteção aos consumidores vulneráveis que o Direito da União Europeia no contexto de cláusulas abusivas em contratos de consumo? Uma análise jurídica e económica
This article compares the European Union and Portuguese approaches to the regulation of unfair contract terms in consumer contracts, analysing their ability to protect vulnerable consumers. Drawing on both legal and economic grounds, the article supports four theses: (1) The system of European Union law sometimes requires assessing the transparency of a term from the perspective of vulnerable consumers; (2) This higher level of protection should be applied when the level of protection offered to average consumers operating in the market does not create a “herd immunity” that sufficiently covers vulnerable consumers; (3) In the same situations, Portuguese law offers better protection to vulnerable consumers; (4) The level of protection afforded under Portuguese law could be further enhanced by introducing a comparative element in the duty of clarification under Article 6(2) of the General Contractual Terms Regime.Este artigo compara as abordagens da União Europeia e de Portugal no que concerne à regulamentação das cláusulas contratuais abusivas nos contratos de consumo, analisando a sua capacidade de proteger os consumidores vulneráveis. Baseando-se tanto em razões jurídicas como económicas, o artigo suporta quatro teses: (1) O sistema do direito da União Europeia exige, por vezes, avaliar a transparência de uma cláusula da perspetiva dos consumidores vulneráveis; (2) Este nível de proteção mais elevado deve ser aplicado quando o nível de proteção oferecido aos consumidores médios que operam no mercado não cria uma «proteção de grupo» que cubra de forma suficiente os consumidores vulneráveis; (3) Nas mesmas situações, o direito português oferece uma melhor proteção aos consumidores vulneráveis; (4) O nível de proteção concedido pelo direito português poderia ser ainda mais elevado através da introdução de um elemento comparativo no dever de esclarecimento nos termos do artigo 6.º, n.º 2, do Regime das Cláusulas Contratuais Gerais (Regime das CCG)

For years, the Angolan government addresses the overcrowded classrooms, teachers\u27 poor qualifications, lack of proper facilities, and supplies challenges that impact the students´ writing, reading, and mathematics proficiency. Based on that, this emic approach study reflects on the strategy that eight Cabinda public primary schools implemented to promote students\u27 academic success. The finding indicates (1) to address overcrowded classrooms challenges; the schools selected games and quizzes to improve students\u27 proficiency. However, in-classroom, teachers mainly use the blackboard and the textbooks to share information. So, the researcher suggested the usage of grouping strategies, personal or local stories and games; (2) Related to teachers\u27 poor qualifications, the teachers skip the biweekly Zones of Pedagogical Influence meetings for family reasons or already knowing the content. To change that, in a group, teachers can discuss and lesson plan, as well as practice games; (3) Related to proper school facilities and school supplies, the schools keep supplies, such as storybooks and games inside closed boxes. So, to revise the content, the researcher suggested taking aside some time for the students to read the storybooks or play games.Há anos, que o governo angolano debate-se com a superlotação de salas de aulas, fracas competências dos professores, infraestruturas inadequadas e falta de recursos de ensino que influenciam no desenvolvimento das competências de escrita, leitura e numeracia dos alunos. Assim sendo, o presente estudo baseado na abordagem émica identifica como oito escolas públicas do ensino básico, da província de Cabinda, promovem o sucesso académico dos alunos. Os dados coletados indicam, (1) Na superlotação de salas, as escolas selecionaram os jogos e questionários. Contudo, constatações indicam que, o quadro e manual escolar como os recursos usados na partilha de informações. Assim, sugeriu-se a formação de pequenos grupos de alunos, uso de narrativas pessoais ou locais e jogos típicos; (2) Nas fracas competências dos professores, registaram-se ausências nas ZIPs, por razões familiares ou domínio do conteúdo. Sugeriu-se que em grupo, os professores planificassem aulas e exercitassem os jogos; (3) No aspeto das infraestruturas inadequadas e falta de recursos de ensino, os livros infantis e jogos permanecem encaixotados. A pesquisadora sugeriu que, revisões de aulas dê-se espaço para a leitura e prática dos jogos
A Ordem dos Frades Menores no Portugal moderno: uma visão global
This paper introduces the entities of the Order of Friars Minor created in Portugal during the Modern Age, in the Kingdom and overseas: 12 provinces, 6 custo-dies, 5 seminaries of apostolic missionaries, 3 commissariats and 1 mission. It also indicates the number of friars and the location of the friaries of these entities in 1739 according to data collected by Fr. Apolinário da Conceição. Furthermore, the paper transcribes a manuscript of 1680/1682, revealed by the Author in 1997, containing a list of friars and friaries of the provinces of the Kingdom, discriminated by categories: clerics, lay brothers, preachers or lecturers and novitiates, colleges, or infirmaries.Este artigo apresenta as entidades da Ordem dos Frades Menores criadas em Portugal durante a época moderna, no Reino e nos espaços ultramarinos: 12 províncias, 6 custódias, 5 seminários de missionários apostólicos, 3 comissariados e 1 missão. Indicam-se também o número de frades e a localização dos conventos dessas entidades em 1739, segundo os dados recolhidos por Fr. Apolinário da Conceição. Ademais transcreve-se um manuscrito de 1680/1682, dado a conhecer pelo Autor em 1997, com o elenco dos frades e conventos das províncias do Reino, discriminados por categorias: clérigos, leigos, pregadores ou leitores e noviciados, casas de estudo ou enfermarias

In Erased (2021) Paulo Simão evokes Erased De Kooning Drawing by Robert Rauschenberg and, by manipulating a set of images from the US Library of Congress, reframes the archive and develops a series that invites us to a myriad of questions and reflections. With his intervention Paulo Simão creates a kind of anti-evocative monument and, by isolating the plinth, he opens a new perspective and approach to the artistic work, moreover, emphasizes the importance and role that the artist, the artistic work and, in this particular project, the evocative public art piece assumes by validating certain values, knowledge, historical events or collective memories
Contributos para abordagens interseccionais na Casa Comum
This text aims to emphasize the relevance of the concept of intersectionality to the discursive construction of the “Common Home” mentioned by Pope Francis. This wish implies the challenge to build contextual theologies in which multiple voices, in particular, women’s voices are present. The text assumes the need of an attitude that is both humble and willing to hear in face of the various forms of suffering, of exclusion and of invisibility of those that Pope Francis mentions as the “disposable”. The text draws attention to what seems to be a lack of knowledge of feminist theologies, even when women are mentioned, and refers some key points of the emergence of those theologies in the Catholic Church in the aftermath of the Second Vatican Council. The issue of the «blind spots» in the Common Home, especially in Portuguese theologies is also mentioned, as well as the need to accept the challenge of intersectionality. This approach allows room for crossing theological issues with realities, situations and problems that require a complex, contextual and critical approach. The first step in that direction requires a self-analysis of theology. The text considers that the intersectional path is able to develop a cautious discourse in times and places where both religion and the “gender” problematic become an instrument of political manipulation.Este texto pretende abordar a relevância da interseccionalidade para a construção discursiva da «Casa Comum», de que fala o Papa Francisco. Este desiderato passa pelo desafio de construir teologias contextuais, nas quais se façam ouvir múltiplas vozes, nomeadamente, vozes de mulheres. Reconhece-se à partida a necessidade de adoção de uma atitude de escuta e de humildade perante as diversas formas de sofrimento, exclusão e invisibilização dos «descartáveis», de que fala o Papa. Chama-se a atenção para aquilo que parece uma ausência de conhecimento das teologias feministas, mesmo quando se fala das mulheres, e procura-se mencionar alguns pontos-chave dessas teologias, nascidas, na Igreja Católica, na senda do Concílio Vaticano II, exercendo-se igualmente uma crítica acerca de «pontos mortos» na Casa Comum, em particular da ausência de uma construção teológica em Portugal que aceite o desafio interseccional. Esta permite o cruzamento das temáticas teológicas com temáticas, realidades, situações que reclamam abordagens complexas, contextuais, críticas, nas quais a teologia começa por fazer uma análise de si própria. Acredita-se que este caminho interseccional poderá levar a Igreja a um discurso mais prudente num tempo e nos lugares em que tanto a religião como a própria problemática do «género» são apropriadas e manipuladas politicamente
Harmonising dawn raids in a global village: the ECN+ directive and negotiating legal certainty within fragmented european administrative procedure
Administrative procedure remains largely unharmonized in the European Union. One area where the divergent national procedures are particularly visible are unannounced inspections or ‘dawn raids’. They are carried out by national competition authorities to enforce both national competition laws and the corresponding EU provisions, notably Articles 101 and 102 of the Treaty on the Functioning of the European Union. Provisions that are similar or even identical are thus being enforced under different procedural rules within the Union. Minimum harmonisation of competition law enforcement is underway with Directive 2019/1 or “ECN+”, as it became known in the early stages of the work towards the actual Directive. This article looks at different views to harmonisation and uneven enforcement and public statements from six EU Member States about the national amendments to implement Directive 2019/1. Dawn raids are always a balancing act between the public interest in uncovering competition infringements and fundamental and human rights, such as the right of defence. This article argues fragmentation poses a threat to legal certainty and does so in an area that routinely overlaps with fundamental and human rights. What is more, the ECN+ Directive may not level the playing field as intended. The current harmonisation efforts may, instead, carry a risk of merely shifting the existing imbalance to other areas of enforcement
