    Correlation between Afrofuturism and science fiction in Space is the Place: praxis or paradox?

    In this paper, I use the culture studies approach to investigate how themes such as the space age, psychedelia and the creation of a post-apocalyptic black colony in the film Space is the Place (Coney 1972), interweave with Darko Suvin\u27s (1974) concept of cognitive estrangement and novum. I specifically study how these relate to science fiction, with the goal of subverting the stereotype of blackness as uncivilised and Luddite. I propose to critically review the general categorization of the film as Afrofuturist and argue that what is positioned in the film as a novelty and salvation is, in fact, constructed in a problematic way. As such, positioning the film just as Afrofuturist, as demonstrated, may contradict the genre’s goals. Instead, I follow David Seed’s proposal to use an interdisciplinary reading method for film analysis based on deconstructing the relation of the film within the two framings: Science fiction and Afrofuturism

    Unlike their European counterparts, Portuguese lawmakers set out rules on the joint liability of the online marketplace operator in case of non-conformity of the goods, services or online content purchased through the platform. The text approaches how such domestic rules could be reasonably construed, in light of the rationale and critical ap‑ praisal of the academic model rules that inspired them. Ao contrário dos seus congéneres europeus, o legislador na‑ cional consagrou um regime de responsabilidade contratual solidária do prestador do serviço de mercado em linha para o caso de não conformi‑dade dos bens, serviços ou conteúdos fornecidos através da plataforma. Com base na análise das propostas académicas que inspiraram o regime de responsabilidade instituído – na fundamentação e na crítica que lhes foi dirigida –, o presente artigo procura uma interpretação razoável para o regime nacional.&nbsp

    Eficácia das intervenções não farmacológicas promotoras do sono na pessoa em situação crítica: uma revisão sistemática

    Introduction: Critical ill patients experience sleep disturbances, making it crucial to implement non-pharmacological interventions that promote sleep. Objectives: Identify non-pharmacological sleep-promoting interventions in critical ill patients, studied with an experimental approach; identify the most effective non-pharmacological interventions. Search methods: Systematic Review of Effectiveness according to JBI’s methodology, through PICOS strategy: P- people over the age of 18 in Intensive Care Unit or Emergency care Unit; I- non-pharmacological sleep-promoting interventions; O- objectiveor subjective sleep quality; S-studies of an experimental nature. Were considered as exclusion criteria: People in internment care within less of 24h, people with obstructive sleep apnea, dementia, terminal illness or palliative illness. International electronic databases as well as RCAAP were used throughout the research phase, that occurred between august and october of 2020. The descriptors were selected by research in DeCS e MeSH. Studies in English, Spanish, Portuguese and French were included with full available reading. The time frame was defined between 2014 and 2020, date of publication of the review that was updated with the present study. The studies were analysed by two independent revisers. We performed the evaluation of the quality about the studies that were included. To summarize the results obtained, we proceeded to the narrative analysis of the data. Results: We included six studies in this review, of the 2540 found in databases with a total of 229 participants. Five non-pharmacological sleep-promoting interventions were identified: music therapy, “quiet routine” protocol, ear plugs and eye masks,aromatherapy and virtual reality meditation. The outcome measured was sleep quality in both objectively and subjectively terms. Conclusions: Aromatherapy and meditation through virtual reality interventions proved to be effective with strong evidence. Music therapy intervention appears to have some effectiveness but with a weak strength of evidence, further studies would be beneficial to ascertain its credibility. Regarding the ear plugs and eye masks intervention, as well as the quiet time protocol, they were not effective.Introdução: A pessoa em situação crítica (PSC) experimenta perturbações do sono, tornando-se fundamental a implementação de medidas não farmacológicas que promovam uma melhoria do sono. Objetivos: Identificar as intervenções não farmacológicas promotoras do sono na PSC, estudadas com abordagem experimental; identificar as intervenções não farmacológicas mais eficazes. Materiais e métodos: Revisão Sistemática de Eficácia segundo a JBI através da estratégia PICOS: P – participantes maiores de 18 anos internados em UCI ou SU; I – intervenções não farmacológicas promotoras do sono; O – qualidade do sono objetivo e/ou subjetivo; S – estudos de natureza experimental. Foram considerados como critérios de exclusão: Pessoas com internamento inferior a 24h, pessoas com síndrome de apneia obstrutiva do sono (SAOS), demência, doença terminal ou paliativa. Selecionadas fontes de pesquisa bases de dados eletrónicas internacionais indexadas e Repositórios Científicos de Acesso Aberto de Portugal (RCAAP). A pesquisa decorreu entre agosto e outubro de 2020. Os descritores foram selecionados por pesquisa em DeCS e MeSH. Foram incluídos artigos em inglês, espanhol, português e francês, com texto integral disponível gratuitamente. O friso temporal foi definido ente 2014 e 2020, data de publicação da revisão que foi atualizada com o presente estudo. Os estudos foram selecionados por dois revisores independentes. Realizada a avaliação da qualidade metodológica dos artigos incluídos. A análise dos dados foi de abordagem narrativa. Resultados: Foram encontrados 2540 artigos nas bases de dados dos quais incluímos 6 estudos, com um total de 229 participantes. Foram identificadas cinco intervenções não farmacológicas promotoras da qualidade do sono: musicoterapia, protocolo quiet routine, tampões auriculares e vendas oculares, aromoterapia e meditação por realidade virtual. O outcome mensurado foi a qualidade do sono de forma objetiva e de forma subjetiva. Conclusões: A intervenção de aromoterapia e de meditação por realidade virtual mostraram-se eficazes e com forte força de evidência. A intervenção de musicoterapia parece ter alguma eficácia, porém com fraca força de evidência, mais estudos seriam benéficos para averiguar a sua efetividade. Em relação à intervenção de tampões auriculares e vendas oculares, bem como o protocolo quiet time, não se mostraram eficazes

    In the relation between human and machine vision, as mediators of a world understanding, there are differences associated with the subjective point of view (inherent to humans) and the objective point of view (inherent to machines). How machine vision contributes to our global awareness, even if it represents perspectives that are not accessible to us? The use of technologies thus influences our knowledge and, although we can obtain answers and solutions through them, such as when we use artificial intelligence, the meaning of this knowledge always requires a creative approach, a critical thinking.     Hate speech by politicians in the caselaw of the european court of human rights

    This paper examines how, in cases concerning hate speech by politicians, the European Court of Human Rights resolves the dilemma of, on the one hand, providing a high level of protection to political speech and, on the other, protecting persons/groups from discrimination and intolerance. The Court applies two distinct approaches: sole application of Article 10 and (in)direct recourse to Article 17. It conciliates the high-level protection of political speech with the unprotectedness of hate speech by: (1) accepting that it may be necessary to apply hate speech restrictions to politicians in order to combat discrimination and intolerance, but (2) carefully scrutinising the necessity of such restrictions to ensure that the democratic process is not undermined. However, careful scrutiny is arguably better achieved through the sole application of Article 10

    Patent Portfolios and Competition Law: Some Reflections After the Recent RPSA Cases

    In the pharmaceutical sector, firms often build patent portfolios in order to better protect their innovations, but also to strategically exploit the cluster to prevent entry by generic competition. In fact, once patent protection on the main invention expires, originator firms adopt a two-tiered strategy, centred on the enforcement of secondary patents composing the portfolios. At first, originators threaten generic companies of patent infringement, in a way to discourage entry by generic companies. Secondly, they push generics to enter a patent settlement (in order to compose the very same infringement proceeding), often paying them to stay out of the market: hence, prolonging their exclusivity time, to the detriment of consumers and society at large. While EU institutions have made clear that the latter behaviour is in plain contrast with competition law provisions prohibiting agreements in restraint of trade, RPSAs are only the tail of a multifaceted conduct which deserves closer scrutiny

    Marketing digital na promoção da atividade de fotógrafo em Portugal

    The greatest evolution of marketing took place with the advent of the internet, and photography was not far from this evolution, from analog to digital, it changed the way of working. Professionals had to keep up with the changes, adapting to new technologies to survive and stand out in this new scenario. Thus, this study aims to identify the most used digital marketing tools in the dissemination and the most effective for promoting the activity of photographer in Portugal. For data collection, a quantitative approach was used. Twenty websites were analyzed and an online questionnaire was applied to Portuguese photographers. The sample had 99 people participating and the data were processed using SPSS version 27. The main results showed that photographers mostly use digital media to publicize and promote their activities and the most used tools are digital marketing (media and social networks, websites, online ads and marketing emails). According to these professionals, the most effective ones for business are social networks and websites. It was found that some tools and techniques are little used or unknown (backlinks, site positioning techniques - SEO and web analytics) and others need more attention, such as updating content on websites and communicating with the customer. The study showed at what point in this transformation process the Portuguese photographers participating in the questionnaire are inserted, and which points deserve more attention, thus bringing a perspective little investigated and analyzed by photography professionals in Portugal.A maior evolução do marketing deu-se com o advento da internet, e a fotografia não ficou distante desta evolução, de analógica a digital, mudou a forma de trabalho. Os profissionais tiveram que acompanhar as mudanças, adaptando-se às novas tecnologias para sobreviverem e destacar-se neste novo cenário. Assim, este estudo tem como objetivo identificar as ferramentas de marketing digital mais utilizadas na divulgação e as mais eficazes para a promoção da atividade de fotógrafo em Portugal. Para a recolha de dados utilizou-se uma abordagem quantitativa. Foram analisados 20 websites e aplicado um questionário online a fotógrafos portugueses. A amostra contou com 99 participantes e os dados foram tratados através do SPSS versão 27. Os principais resultados mostraram que os fotógrafos utilizam maioritariamente os meios digitais para divulgar e promover as suas atividades e as ferramentas mais utilizadas são do marketing digital (medias e redes sociais, websites, anúncios online e e-mails marketing). Segundo estes profissionais as ferramentas mais eficazes para o negócio são as redes sociais e os websites. Constatou-se que algumas ferramentas e técnicas são pouco utilizadas ou desconhecidas (os backlinks, as técnicas de posicionamento de site - SEO e a web analytics) e outras precisam de maior atenção, como a atualização dos conteúdos nos websites e a comunicação com o cliente. O estudo mostrou em que ponto deste processo de transformação estão inseridos os fotógrafos portugueses participantes no questionário, e quais os pontos que merecem mais atenção, trazendo desta forma, uma perspetiva pouco investigada e analisada pelos profissionais da fotografia em Portugal
