PENGELOLAAN HARTA BAITUL MAL DAN KEMASLAHATAN UMAT: KAJIAN MASA PEMERINTAHAN KHULAFAUR RASYIDIN
This study discusses the management of Baitul Mal asset and the benefit of the people. Baitul Mal is an institution that carries out the economic and social functions of an Islamic state that cannot be separated from the function of the caliph who has a special task of managing all the assets of the people, both in the form of income and expenses for the state. This study will discuss how the management of Baitul Mal funds during the Khulafaur Rasyidin era. This research is a library research using a descriptive method approach. By getting data from primary sources, namely texts or books that will provide an overview of the management of baitul mal funds during the reign of Khulafaur Rasyidin. The results of this study are; a) Caliph Abu Bakr Ash-Siddiq applies the concept or principle of Balance Budget Policy (equality) in the matter of living necessities and policies on Baitul Mal assets that have been collected are not allowed to accumulate in the long term, must be immediately distributed to all Muslims; b) When Umar bin Khattab became caliph, the wealth or cash owned by the state in Baitul Mal increased very significantly. Umar succeeded in expanding his territory, establishing al-Diwan, appointing a clerk for the state, setting salaries for government employees, as well as making and budgeting budgets for the armed forces in order to strengthen national defense; c) At the time of Caliph Uthman bin Affan, the wealth of the state was increasing compared to the previous caliph. Ustman also applied the principle of equality in meeting the basic needs of the community as was applied by Caliph Umar. Caliph Ustman also provided different assistance at a higher level; and d) Caliph Ali bin Abi Talib in terms of the distribution of assets applies the principle of equity. In addition, all state income stored in the Baitul Mal must be immediately given to the Muslims without any remaining or reserve funds
ANALISIS HADIS AL-WALAD LI AL-FIRĀSY DENGAN METODE ASBĀB AL-WURŪD, DAN PENALARAN LUGHAWIYAH
The problem of the position of children born out of wedlock is a classic problem which is still interesting to study and discuss the benefits that will arise from the problems that will be faced in accordance with changing times. Basically, many parties want to study the benefits of the position of illegitimate children using the maqasid al-syari'ah method with the aim of protecting the child's life, living a decent life and growing well, and getting rights like children born in generally. In fact, children born out of wedlock, whether sirri marriage, li'an or adulterous children, are not assigned to their father or their father's family, which causes a child not to have equal rights compared to children in general. This study tries to examine from the perspective of analysis the asbāb al-wurūd al-hadīts, lughawiyah, ta'līliyah and istiṣlāhiyah methods. With this analysis it is hoped that it can answer the problem and become a solution for the legal position of children born out of wedlock
Penanganan Banjir di Kabupaten Aceh Barat; Kajian Kewilayahan dan Kebijakan
Artikel ini mengkaji penanganan banjir di Kabupaten Aceh Barat dari kajian kewilayahan dan kebijakan. Penulisan ini bertujuan untuk mengetahui permasalahan banjir dan bagaimana solusi yang diajukan berdasarkan kajian kewilayahan dan kebijakan. Metode pengumpulan data dalam artikel ini adalah menggunakan studi kepustakaan (library research). Data sekunder diperoleh dengan melakukan data bencana banjir serta literatur yang terkait dengan artikel ini. Selain itu digunakan juga berupa telaah artikel jurnal ilmiah, telaah pendapat para ahli dan studi dokumen, yang secara khusus berkaitan dengan masalah yang ditulis yaitu banjir dan kebijakan di Aceh Barat. Adapun dampak banjir terhadap masyarakat tahun 2020 sebanyak 5.935 Jiwa mengungsi yang tersebar di 8 Kecamatan. Adapun faktor-faktor yang menyebabkan terjadinya banjir di Kabupaten Aceh Barat terjadi karena beberapa hal, yaitu: tingginya limpasan dan aliran permukaan akibat akumulasi aliran permukaan dari daerah atasnya, kondisi saluran drainase yang rusak sehingga tidak dapat berfungsi dengan optimal, dan kurangnya kapasitas saluran drainase. Tingginya aliran permukaan di daerah perkotaan terutama yang masuk di kawasan dengan topografi yang datar pada elevasi yang rendah di kawasan pesisir menjadi penyebab utama banjir genangan.
TAKHARUJ ADALAH PENDEKATAN DALAM MEMBAGI HARTA WARISAN SECARA ADIL
This article discusses the division of inheritance based on the concept of takharuj. Takharuj is a legal term that refers to the freedom of heirs to reject the portion of inheritance they should receive. This article explains the concept of takharuj in the context of inheritance law, including its background, objectives, and application. Inheritance division is a complex and sensitive process, and the concept of takharuj provides an alternative for heirs who may have strong reasons to refuse the inheritance. Reasons such as high debts, family disputes, or financial considerations can be factors in the heirs' decision to reject the inheritance. The article also describes some issues that may arise in the implementation of the concept of takharuj, including its impact on fair inheritance distribution and inheritance tax obligations. Various legal systems have different approaches in applying the concept of takharuj, and the article provides a general overview of these differences. Justice and the public interest should be the foundation for regulating and implementing the concept of takharuj in inheritance division. In conclusion, this article emphasizes the complexity and importance of the concept of takharuj in inheritance division. This concept provides flexibility for heirs to make decisions that align with their needs and interests. However, the implementation of the concept of takharuj should be done carefully and in accordance with the principles of justice, to ensure fair inheritance distribution and safeguard the interests of all parties involved. Etika Guru dalam Meningkatkan Mutu Pendidik: Studi Komparatif Az-Zarnuji dan Hasyim Asyari
Talking about ethics in education cannot be separated from the teacher. As Az-Zarnuji and Hasyim Asy'ari said, teacher ethics affect the quality of education. Regarding teacher ethics, the explanation has been published in the books of Ta'lim Muta'allim and Ādāb al-'ālim wa al-muta'allim. The purpose of this study was to determine teacher ethics according to Az-Zarnuji and Hasyim Asy'ari in the books of Ta'lim Muta'allim and Ādāb al-'ālim wa al-muta'allim, in improving the quality of educators. Types of research in the form of literature and field. The library as a basis with the main literacy (documentation) is in the form of the book of Ta'lim wal Muta'alim and the book of Ādāb al-'ālim wa al-muta'allim. Methods of data analysis with content analysis (content analysis) or content review. The results showed that an ethical and quality teacher according to al-Zarnuji was someone who had intelligence (alim), kept a clean heart (wira'i), had more experience in terms of education, had a high spirit of piety, both social and spiritual, and patient, according to Hasyim Asyari teachers who are ethical and of good quality who put more emphasis on the personality of teachers who have religious character and emphasize the path of Sufism include asceticism, wara', sakinah, and devotion to God. According to Az-Zarnuji and Hasyim Asy'ari, the implementation of the quality of educators cannot instantly form the desired quality of educators, because the quality of educators cannot be developed quickly and immediately, there needs to be long, careful, and systematic stages and processes.Berbicara mengenai etika dalam pendidikan, tidak akan terlepas dari Guru Seperti halnya Az-Zarnuji dan Hasyim Asy‟ari menyampaikan bahwa etika Guru mempengaruhi terhadap mutu pendidikan. Berkaitan tentang etika guru, penjelasannya telah dimuat dalam kitab Ta’lim Muta’allim dan Ādāb al-‘ālim wa al-muta‘allim. Tujuan penelitian ini adalah untuk mengetahui etika guru menurut Az-Zarnuji dan Hasyim Asy‟ari dalam kitab Ta’lim Muta’allim dan Ādāb al-‘ālim wa al-muta‘allim, dalam meningkatkan mutu pendidik. Jenis penelitian berupa kepustakaan dan lapangan. Kepustakaan sebagai dasar dengan literasi (dokumentasi) utama berupa kitab Ta’lim wal Muta’alim dan kitab Ādāb al-‘ālim wa al-muta‘allim. Metode analisis data dengan Analisis isi (content analysis) atau kajian isi. Hasil penelitian menunjukkan Guru yang beretika dan bermutu menurut al-Zarnuji adalah sosok yang memiliki kepandaian (alim), menjaga kebersihan hati (wira’i), lebih berpengalaman dalam hal pendidikan, memiliki jiwa keshalehan tinggi, baik sosial maupun spiritual dan penyabar, menurut Hasyim Asyari guru yang beretika dan bermutu yang lebih menekankan pada kepribadiaan guru yang berkarakter religius dan menekankan pada jalan kesufian meliputi sikap zuhud, wara’, sakinah, dan khusyuk kepada Allah. Impelmentasi Mutu pendidik menurut Az-Zarnuji dan Hasyim Asy’ari tidak secara instant dapat membentuk Mutu Pendidik yang diinginkan, karena Mutu Pendidik itu tidak dapat dikembangkan secara cepat dan segera, perlu adanya tahapan-tahapan dan proses yang panjang, cermat dan sistematik
PENERAPAN KONSEP RESTORATIVE JUSTICE DALAM PENYELESAIAN PERKARA TINDAK PIDANA RINGAN DI ACEH
Humans who commit an act that deviates from the rule of law, then in a state of law that person must be legally responsible for his actions. This is in accordance with the provisions of Article 271 paragraph (1) of the 1945 Constitution which obliges all citizens to uphold the law and government without exception. The special criminal justice system for children certainly has specific goals for the future interests of children and society in which the principles of restorative justice are contained, the definition of restorative justice itself is not uniform, because there are many variations of models and forms that develop in its application. How is the Law on Misdemeanor Crimes in Indonesia? How is the Restorative Justice Concept Implemented in Misdemeanor Crimes? How effective is the concept of Restorative Justice in Misdemeanor Crimes in Aceh? Legal arrangements regarding minor crimes have basically been regulated in the KUHAP and the Criminal Code and PERPU. even in the Supreme Court Regulation (PERMA) Number 2 of 2012 concerning Adjustments to the Limits of Minor Crimes and the amount of fines in the Criminal Procedure Code. The arrangement for restorative justice so far has been regulated by SE Kapolri No. SE/8/VII/2018 of 2018 concerning the Implementation of Restorative Justice in the Settlement of Criminal Cases; Chief of Police Regulation No. 6 of 2019 concerning Investigation of Criminal Acts; Prosecutor's Regulation No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice; and Decree of the Director General of the Supreme Court of the Republic of Indonesia No.1691/DJU/SK/PS.00/12/2020 concerning Enforcement of Guidelines for the Implementation of Restorative Justice. The concept of settling cases in Aceh is carried out by Ule Jurong, Tuha Peut, Keuchiek, Imams in every gampong. And if it doesn't finish at the gampong level it goes up to the Mukim level. The Judge is Imeum Mukim. Meanwhile, the implementation of customary sanctions varies greatly, according to the case and the level of cases resolved. where the implementation of customary sanctions will be carried out immediately after the decision is delivered by the village head (Keuchik), especially regarding customary sanctions in the form of advice, warnings and apologies. for compensation sanctions, the implementation of the decision is looser, that is, it depends on the offender's economic ability to provide said compensation. Likewise, in the case of customary sanctions in the form of expulsion from the gampong, however, the implementation is not carried out immediately after the decision is made, instead, the violators of the customary norms will be given sufficient time to prepare to leave the Villages. STUDI KOMPARATIF TENTANG MODEL PENGELOLAAN ZAKAT ANTARA RUMAH ZAKAT DAN BAITUL MAL ACEH
This study focuses on a comparative study of the zakat management model between Rumah Zakat and Baitul Mal Aceh. This study aims to determine the management of zakat carried out by Baitul Mal Aceh, also to find out the management of zakat carried out by Rumah Zakat Aceh and to find out the differences and similarities in the management of zakat between the two institutions. This study is qualitative research using a qualitative approach. The results of the study show that the management of zakat in Baitul Mal Aceh is carried out by implementing the best management, by conducting training, both inside and outside the city of Banda Aceh for human resources, also inviting third parties from Jakarta to assist and assess performance where there are still deficiencies so that there are always improve, evaluate each employee in order to find out how far the work that has been given can be carried out properly, all of this is seen from the annual evaluation. The management of zakat at RZ Aceh is to implement management that is carried out in accordance with the central command, everything that will be done has an SOP, and this applies to all RZ branches throughout Indonesia, such as muzakki who are always registered in the system. The rules that are implemented thus make the central RZ and branch RZ have a very strong relationship, where there is always control through the implemented system, every evening there is always a recap or data report by employees. While the differences and similarities in zakat management between the two institutions are both engaged in the collection, management and distribution. Besides that, other similarities are the principles of openness, volunteerism, integration, professionalism, and independence, the difference is in the field of programs, where Baitul Mal Aceh distributes its zakat through God's command in the Al-Quran Surah At-Taubah verse 60 while RZ distributes it through the program. Urgensi Konteks Sejarah Asbab al-Nuzul al-Wurud dalam Tafsir dan Syariah Hadits
Al-Quran or hadith is a guide and guide for mankind to find answers and solutions to various problems faced in everyday life. The purpose of this paper is to understand in detail Asbab al-Nuzul-Asbab al-Wurud and how important it is to understand the Qur'an and hadith. The method used in this paper is library research, namely research that focuses more on literature by analyzing the content of the existing literature and descriptive-critical-historical related to Asbab al-Nuzul-Asbab al-Wurud. The result is a fact that asbab al-Nuzul and asbab al-Wurud both have an important position and ease of understanding the verses of the Qur'an and hadith. Asbab al-Nuzul becomes an important instrument in understanding the meaning of the verse according to the context, and asbab al-Wurud is a requirement for understanding the hadith contextually. Al-Quran atau hadis merupakan petunjuk dan pedoman bagi umat manusia guna menemukan jawaban dan solusi dari berbagai problematika yang di hadapi dalam kehidupan sehari-hari. Tujuan tulisan ini adalah untuk memahami secara detail Asbabun Nuzul-Asbabul Wurud dan seberapa pentingnya dalam memahami Al-Quran dan hadis. Metode yang dipakai dalam tulisan ini merupakan penelitian kepustakaan (library research), yaitu penelitian yang lebih menitikberatkan pada literatur dengan cara menganalisa muatan isi dari literatur-literatur yang ada dan bersikap deskriptif-kritis-historis terkait dengan Asbabun Nuzul-Asbabul Wurud. Hasilnya adalah suatu fakta bahwa asbab al-Nuzul maupun asbab al-Wurud sama-sama memiliki kedudukan yang penting dan mempermudah memahami ayat-ayat Al-Quran dan hadis. Asbab al-Nuzul menjadi instrumen penting dalam memahami amksud ayat sesuai dengan konteksanya, dan asbab al-Wurud merupakan syarat untuk memahami hadis secara kontekstual
Tinjauan Hukum Islam Terhadap Jual Beli Pupuk Kandang: Analisis Terhadap Persepsi dan Praktik Masyarakat Blok 15 Aceh Singkil
Penelitian ini bertujuan untuk mendiskripsikan jual beli pupuk kandung yang dipraktikkan masyarakat blok 15 Kecamatan Gunung Meriah Kabupaten Aceh Singkil Provinsi Aceh. penelitian ini menggunakan penelitia kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa praktik jual beli pupuk kandang ini ada di kampong Blok 15 dan telah memenuhi rukun dan syarat jual beli dengan hukum islam, karena telah ada ijab qabul , penjual dan pembeli , telah mummayiz , dan terdapat barang atau objeknya. Persepektif hukum Islam terhada Jual Beli Pupuk Kandang di Desa Blok 15 Kecamatan Gunung Meriah Kabupaten Aceh Singkil telah memenuhi rukun dan syarat jual beli.
Analisis Pertanggungjawaban Kepala Daerah Yang Melanggar Protokol Kesehatan Covid 19 di Masa Kampanye (Studi Di Badan Pengawas Pemilu Kota Bandar Lampung)
Masa Kampanye merupakan saat dimana setiap calon Kepala Daerah dapat turun langsung kelapangan untuk meyakinkan masyarakat bahwa dia layak untuk menjadi calon kepala daerah dengan menjelaskan visi dan misi ke depan untuk daerah tersebut, namun pada pemilihan calon kepala daerah Tahun 2020 metode kanpanye yang di terapkan akan berubah dikarenakan terjadinya wabah Covid 19 yang melanda seluruh dunia termasuk indonesia, kampanye yang seharusnya bisa dilakukan secara tatap muka, kali ini harus dilakukan secara online atau melalui media mass namun pada kenyataan masih banyak Calon Kepala Daerah yang tidak mendengarkan himbauan dari KPU untuk melakukan kampanye secara online dan lebih suka kampanye langsung secara tatap muka kepada masyarakat tanpa mengindahkan pandemi Covid-19 yang sedang terjadi maka bagaimana pertanggungjawaban kepala daerah yang melaksanakan kampanye secara langsung diengah pandemi Covid-19
