Doktrin Pendidikan Islam Di Dayah Salafi Aceh Besar dan Implikasinya Terhadap Ukhuwah Islamiyah
Doktrin sebagai suatu bentuk ajaran, asas suatu aliran keagamaan yang bersifat absolut, sebagai suatu prinsip atau kepercayaan yang dianggap benar dan satu-satunya yang dapat diterima telah menjadi tradisi di dunia dayah. Dayah sebagai lembaga pendidikan tradisional Islam yang sampai saat ini masih eksis di Aceh seharusnya tidak mempersempit pemahaman fikih dan tauhid didalam pembelajarannya. Tetapi kenyataannya dayah hanya mengajarkan fiqh mazhab Syafi’i dan tauhid Asy’ari serta menanamkan doktrin-doktrin tasawuf kepada santrinya. Hasil dari penelitian menunjukkan bahwa tujuan dayah mendoktrin santrinya agar santri lebih mencintai ajaran agamanya, dibidang tauhid adalah agar keimanan santri lebih kokoh dan kuat sehingga tidak mudah goyah saat berhadapan dengan pemahaman tauhid yang sesat atau pemahaman tauhid yang berbeda dengan mereka. Diarahkannya santri kepada mazhab yang satu dalam mempelajari fikih agar santri lebih terfokus dan terarah dalam memahami hukum agama Islam, serta mewujudkan persatuan dan kesatuan dalam masyarakat Aceh. Tujuan dayah menerapkan doktrin tasawuf adalah agar terhindar dari pemahaman tasawuf yang sesat dan untuk membina akhlak santri dengan sifat terpuji
MODERASI BERAGAMA SEBAGAI SOLUSI DALAM MEMBENDUNG BAHAYA ISLAMOPHOBIA UNTUK MENJAGA KEHARMONISAN NEGARA KESATUAN REPUBLIK INDONESIA
Religious moderation is an effort to preserve traditions and foster friendly religious ideas. In other words, the idea of religious moderation is actually an option to preserve Indonesia's diversity without having to uproot existing traditions and cultures. In the case of Islamophobia, it is necessary to change a person's mindset or mindset so that there is no bad prejudice against other religions. It is undeniable that Islamophobia can make people devoid of morals or become immoral. Because he makes excessive fear so that negative views arise against fellow Muslims. To stop the spread of Islamophobia, it is necessary to apply the concept of religious moderation in order to maintain the harmony of the Unitary State of the Republic of Indonesia. This can be done in theological, political, sociological, and judicial frameworks. This harmony between the people and the Indonesian state is guided by the agreement, Pancasila, the 1945 Constitution, Bhineka Tunggal Ika, and the unitary state of the Republic of Indonesia (four pillars), which must be upheld as supporters. As a diverse country, what we really want is to live in harmony in a diverse atmosphere, but this is not just a dream for each of us to participate. Of course, differences must be positioned as assets to build harmony itself
MEDIASI PERKARA PERSELISIHAN DALAM RUMAH TANGGA PADA PERADILAN ADAT ACEH (Studi Kasus di Kota Sabang)
Traditional institutions in the Acehnese community function as a vehicle for community participation in the administration of government, development, and society. This shows that the traditional institutions of Aceh play a role as executive, legislative and judicial. Based on the above background, the problem in this research is to find out how the mediation process is, how effective the mediation is, what are the supporting and inhibiting factors of the mediation process at the Customary Court in Sabang City. The method used in this research is the Juridical Empirical approach and data collection is used through interviews, observations and literature studies. The result of this study is that the role of customary institutions in society has its own pattern and approach, which has been recognized by the Government of the Republic of Indonesia, as an alternative for resolving disputes/conflicts in the community. Studies related to customary institutions have so far discussed the existence of traditional institutions in contemporary times and their position as mediators in resolving conflicts and also as supporters of the implementation of Islamic law. Aceh Qanun No. 9 of 2008 concerning the Guidance of Customary Life and Customs Conflicts related to marriage, domestic violence, inheritance and land ownership can be resolved by customary institutions if there are parties who report, either one of the conflicting parties or both parties who conflicted. The procedure for reporting cases of conflicts/disputes that occur in the community is by reporting to Ule Jurong and some directly to Keuchik. The place for reporting to the Keuchik is not determined because the Acehnese consider the Keuchik not only a formal leader but also an informal leader. So that most cases of conflict disputes that occur in the community are often reported directly to the Keuchik's house instead of the Keuchik's office. and regarding the supporting and inhibiting factors, namely internal and external factors
Konstruksi Epistemologi Islam (Studi Komparasi Konsep Mushawwibah dan Mukhaththiah dalam Ushul Fiqh)
Fast traslate Icon translate In this paper the author tries to explore how the construction of Islamic epistemology, through a study in the field of fiqh and fiqh proposals regarding the theory of Mushawwibah and Mukhaththiah in Ushul Fiqh. An understanding of this issue is very important, considering that currently there are so many groups calling for the need for knowledge in the field of fiqh and proposals of fiqh due to the overflowing invasion of Western social sciences. We are required not to rush to reject new ones and also not to leave the treasures of classical Islamic scholarship, before understanding them properly and correctly with the Mushawwibah and Mukhaththiah Theory in this Ushul Fiqh. Ushul Fqh is better able to enter the sides of legal issues related to the behavior of Muslims. So that for followers of the Mushawwibah theory it is explained that all the different conclusions, which are not one true, may even be all true. That is if all the mujtahids present a frame of mind that is in line with the ushul-fiqh path. Meanwhile, followers of mukhaththiah argue that all the many conclusions are correct, only one, especially if some of these conclusions have contradictory values. This research found that Islam studies all texts both implied in the Koran and al-Hadith, both in the form of zhanni (allegations), thus the meaning that emerges from the text is always formulated in different conclusions, meaning that it is still mukhtalaf fih or dissent. In the study offered by the Mushawwibah theory, it is explained that all the different conclusions, which are not one, may even be all true. This is the case if the mujtahids present a frame of mind that is in line with the rules of ushul-fiqh. In contrast to the mukhaththiah theory which argues that all the many conclusions mentioned earlier, only one is correct, this is because if several conclusions exist have contradictory values. Such judgments arise because ushul fiqh or fiqh thinking framework makes use of subjective reasoning and qualitative paradigms. This type of reasoning lacks some degree of truth. The truth of ushul fiqh is considered contrived and its true nature is speculative
Pemamfaatan Barang Gadai Ditinjau Menurut Prinsip Ekonomi Syariah
Muamalah dalam bentuk transaksi gadai merupakan suatu hal yang sering terjadi di dalam masyarakat, pelaksanaa pinjam meminjam uang yang lebih mudah dan cepat dengan jalan gadai dibandingkan dengan meminjam uang di bank, maka dalam prinsip ekonomi syariah kita dianjurkan untuk saling tolong menolong dalam kebajikan, salah satu prinsip yang diatur di dalam ekonomi syariah yang berkaitan dengan transaksi gadai yaitu pemamfaatan barang gadai secara keseimbangan tidak mergikan salah satu diantara rahin dan murtahin, dalam penelitian ini penulis menjelaskan riil prinsip ekonomi syari’ah terhadap pemanfaatan barang gadai dan dampak dari pemanfaatan barang gadai yang diatur dalam prinsip ekonomi syariah dengan menganalisa beberapa teori dasar pijakan prinsip ekonomi syariah terhadap judul penelitian. Metode yang digunakan dalam penelitian ini adalah penelitian kualitatif dengan pendekatan menelaah konsep-konsep prinsip ekonomi syariah dalam berbagai literatur yang relevan. Hasil penelitian dapat diketahui bahwa Pemanfaatan barang gadai yang diatur dalam prinsip ekonomi syariah harus memberikan rasa tolong menolong antara rahin dengan murtahin, memberikan rasa kesejahteraan dan menpunyai rasa keadilan dengan tidak menzalimi salah satu pihak. Prinsip ta’awwun, maslahah dan keadilan dalam pemanfaata barang gadai yang diatur dalam ekonomi syariah lebih sesuai, bahwa barang jaminan hutang tersebut di manfaatkan oleh rahin karena dengan memberikan hak pemanfaatan lebih tertolong, terbantu dan juga lebih maslahaha untuk kesejahteraan kehidupan rahin. Dampak dari pemanfaatan barang gadai oleh si rahin sebagaimana diatur dalam prinsip ekonomi syariah dapat membantu pihak yang berhutang atau rahin dalam proses pembayaran hutang dengan cara memanfatkan barang jaminan hutang tesebut untuk pertumbuhan ekonomi, bagi pihak pemberi hutang atau murtahin juga tidak dirugikan sedikitpun ketika barang gadai dimanfaatkan oleh pihak yang berhutang karena pihak yang memberi hutang boleh menjualnya jika sudah jatuh tempo pembayaran hutang dan belum di tuanaikan hutang tersebut
Dispensasi Kawin Di Mahkamah Syariyah Pasca Lahirnya Perma No 5 Tahun 2019
Dispensasi kawin sebagai solusi hukum karena para pelaku dispensasi nikah kebanyakan mereka yang belum memiliki legalitas formal untuk menikah, sehingga kemudian mengambil ikhtiar hukum agar pernikahan yang dilakukan dapat diakui. Penelitian ini bertujuan mengetahui Bagaimanan dispensasi kawin dalam pendekatan hukum Islam dan bagaimana pelaksanaan dispensasi kawin menurut Perma No 5 Tahun 2019, serta bagaimana keadaan perkara di wilayah hukum Mahkamah Syar’iyah Aceh tahun 2020. Metode yang digunakan adalah normative law reserach dengan sumber data primer dari Undang-Undang Perkawinan, Perma, Kitab Fiqh dan sedangkan data sekunder adalah buku-buku, jurnal, majalah yang terkait dengan dispensasi nikah.Hasil penelitian ini menemukan bahwa Hukum Islam tidak mengatur khusus dispensasi kawin karena mayoritas ulama hanya menyebutkan balig sebagai syarat menikah seseorang dan tidak menentukan minimal usia perkawinan, sedangkan berdasarkan Revisi UUP Pasal 7 ayat (1) UU No.1 Tahun 1974 menjadi UU No. 16 Tahun 2019 dinyatakan bahwa perkawinan hanya diizinkan jika pihak pria berusia minimal 19 tahun dan pihak wanita minimal 19 tahun. Kemudian pasca lahirnya Perma No. 5 Tahun 2019 tentang Pedoman Mengadili Permohonan Dispensasi Kawin, maka Mahkamah Syar’iyah berpijak dan berpatokan dalam proses penangannya, selanjutnya seorang hakim harus mempunyai persangkaan dan mempertimbangakan manfaat dan mudharat dalam menetapkan permohonan dispensasi kawin. Perkara dispensasi kawin di Mahkamah syariyah pasca lahirnya Perma No 5 tahun 2019 meningkat drastis perkara yang masuk sejak Januari sampai dengan Desember 2020 sejumlah 957 perkara sedangkan perkara yang di putus sejumlah 879 perkara

PENERAPAN MODEL PEMBELAJARAN KOOPERATIF TIPE JIGSAW UNTUK MENINGKATKAN HASIL BELAJAR MATEMATIKA SISWA KELAS X PADA MAN 2 PIDIE JAYA TAHUN 2019
This study is entitled "The Implementation of Jigsaw Type Cooperative Learning Model to Improve Mathematics Learning Outcomes of Class X MAN 2 Pidie Jaya in 2019". This study aims to determine whether the application of a jigsaw cooperative learning model can improve student learning outcomes in mathematics learning in class X MAN 2 Pidie Jaya. This type of research is quantitative research. The design of this study is planning, design, implementation, evaluation, and reporting. Data analysis was performed descriptively. The results of the data analysis showed that the acquisition of the pre-test results of students 'mathematics learning with an average of 60. Furthermore, the researchers treated them by applying a jigsaw cooperative learning model for three meetings, at the end of the study the researchers gave a post-test evaluation to see the students' abilities after applying the cooperative learning model jigsaw. The results of data analysis showed that the acquisition of the pre-test results of students' mathematics learning with an average of 84.4. It can be concluded, the Jigsaw cooperative learning model can improve student learning outcomes, and the teacher always improves his expertise in using the Jigsaw cooperative learning model so that students are not bored and are more eager to follow the lessons and understand mathematics learning
Decisions And Authority Of The Religious Courts On Sharia Economic Disputes
This article discusses one of the court products focused on the verdict. The presentation of the decision is divided into three sub-discussions, namely the understanding of court decisions, types and developments of court decisions in sharia economic cases, and legal remedies against sharia economic decisions. This article aims to find out how the decisions of Religious Courts regarding sharia economic disputes are used. The method used in this article is normative juridical, which is carried out qualitatively. The materials in this article come from laws, decisions of the Constitutional Court, decisions of the Supreme Court, books, scientific articles from journals, internet websites and so on related to the theme being studied, namely Religious Court decisions on sharia economics disputes. The data analysis technique used content analysis techniques. The results of the analysis show that the court’s decision is the final result or conclusion in written form, which is decided by a state official (judge) who is given the authority to end or settle a lawsuit because there is contention between the disputing parties in court which must be submitted in a hearing.
