    Non-refoulement cases before the ECtHR and CAT : A case study on women alleging gender-based violence at the hands of private actors

    This study aims to analyze if the assessment of the European Court of Human Rights and Committee Against Torture in cases concerning women alleging violation of the principle of non-refoulement takes gender into consideration. Therefore, this study compares four cases from the Court and the other four cases from the Committee with feminist legal theory analysis. The method chosen for this study is a comparative legal method and textual analysis to investigate the research problem. The findings of this study are that the Committee's evaluation is more in line with the intersectionality perspective than the Court's. Further, the Court showed stereotypes and gender discrimination with their assessments. Although the Committee is also lacking in considering gender as far as the observed cases the Committee is more advanced with the intersectionality lens. The Court frequently depends on the "male or social network," which is another distinction between the two monitoring organizations. Because the Court does not mention "male network" to European women alleging domestic violence, this contributes to the already discriminations refugee and asylum seeker women experience. The thesis concludes that women seeking asylum or refugee cases experience the most discrimination before the Court, though occasionally before the Committee as well. The refugee law still has a long way to go before it can assist women who claim that private actors have abused them.

    The right to participation for children exposed to violence : An interview study at Barnahus in Eskilstuna on the implementation of Article 12 on children's right to participation of the Convention on the Rights of the Child

    This study aimed to investigate how Barnahus in Eskilstuna has implemented Article 12 on children's right to participate in the Convention on the Rights of the Child in their work with children exposed to violence, as well as the challenges that may arise. In order to investigate the implementation at Barnahus within the municipality, interviews were conducted with representatives of collaborating authorities and Region Sörmland. By analyzing the results based on Harry Shier's participation model, the concepts of child perspective and children's perspective, the study came to the following conclusions. The study shows that children are listened to, but that some children do not get the opportunity to come to Barnahus due to a lack of resources, long waiting periods and that other matters must be prioritized. Children are supported in expressing their opinions, but challenges emerge in the ability to adapt to different cultures and children's disabilities which can affect that children's perspectives does not get recognized. The study also shows a lack of time for the child's representative to prepare for a case, which can affect the ability to adopt a child perspective on the child's best interest. Children's views are taken into account in most parts of the process at Barnahus, but it is primarily the informants' views on the best interest of the child that guides the work. The scope for children's participation depends on their age, maturity and the authority's legal obligations.Denna studie syftade till att undersöka hur Barnahus i Eskilstuna implementerat barnkonventionens artikel 12 om barns rätt till delaktighet i deras arbete med våldsutsatta barn samt eventuella utmaningar som kan uppstå. För att undersöka implementeringen på Barnahus inom Eskilstuna kommun genomfördes intervjuer med representanter för samverkande myndigheter och Region Sörmland. Genom att analysera resultatet utifrån Harry Shiers delaktighetsmodell, begreppen barns perspektiv och barnperspektiv kom studien fram till följande slutsatser. Studien visar på att barn blir lyssnade till men att vissa barn inte får möjligheten att komma till Barnahus på grund av resursbrist, långa väntetider och att andra ärenden måste prioriteras. Barn stöttas i uttryckandet av sina åsikter men utmaningar framkom i förmågan att anpassa sig till olika kulturer och barns varierande funktion som kan påverka att barns perspektiv inte kommer fram. Studien visade även på brist på tid för den särskilda företrädaren att läsa på om ärenden vilket kan påverka förutsättningar att inta ett barnperspektiv om vad som är barnets bästa. Barnets åsikter beaktas i de flesta delar av ärendeprocessen men det är främst informanternas barnperspektiv om barnets bästa som styr arbetet. Vilket utrymme barns delaktighet får beror också på dess ålder, mognad och myndighetens rättsliga skyldigheter

    A political National Day speech: Swedish values, citizenship & Swedish language : A critical discourse analysis of Ulf Kristersson’s National Day Speech from 2023 based on an otherization process

    Denna studies syfte var att identifiera vilka diskurser som blev synliga samt hur och om dessa diskurser bidrog till en process av andrefiering i Ulf Kristerssons nationaldagstal från år 2023. För att utföra studien användes två frågeställningar vars syfte var att identifiera diskurser som kan kopplas till andrefiering, samt hur dessa kan förstås utifrån en process av andrefiering. I mitt resultat och analys användes van Dijks kritiska diskursanalys och diskursstrukturer samt teorier om andrefiering och van Dijks “ingroup-outgroup-polarization”. I resultatet identifierades tre diskurser: diskurs om medborgarskap, diskurs om det svenska språket och diskurs om svenska värderingar, som kunde kopplas till en andrefiering. Ett “vi” och “dem” identifierades genom diskursstrukturer. “Viet” symboliserades med svenska värderingar, tolerans, normer och medborgarskap, till skillnad från “dem” som symboliserades som kriminella, lögnare och med avvikande värderingar. “De andra” målades upp som annorlunda “oss”. Slutsatsen i min studie är att det kunde identifieras en direkt men oftast indirekt andrefieringsprocess i Ulf Kristerssons nationaldagstal.  The purpose of this study was to identify which discourses became visible and how and if these discourses contributed to a process of otherization in Ulf Kristersson's National Day speech from the year 2023. To accomplish the study, two questions were used whose purpose was to identify discourses that can be linked to otherization, as well as how these can be understood based on a process of otherization. In my results and analysis I applied van Dijk's critical discourse analysis and discourse structures as well as theories of otherization and van Dijk's ingroup-outgroup polarization. In the result, three discourses were identified: discourse about citizenship, discourse about the Swedish language and discourse about Swedish values, which could be linked to an otherization. The study identified an "us" and "them" through discourse structures. “Us” was symbolized with Swedish values, tolerance, norms and citizenship, in contrast to "them" who were symbolized as criminals, liars and with deviant values. "The others" were portrayed as different from "us". The conclusion of my study is that the process of otherization in Ulf Kristersson's National Day speech was direct but mostly indirect.

    Spiritual Health in a Swedish contemporary organizational and leadership context

    Spiritual health has an impact on physical, mental and social health. Working life is one of the Swedish public health arenas. The aim of this essay was to conduct an inductive and exploratory study into how leaders, in large organizations, freely reason based on a extended concept of health and the concept of spiritual health in an organizational and leadership context. Spiritual health and health as a resource were expressed by several leaders to be synonymous with what the organization strives for and what good leadership is and aims for. But the concept expresses it in a new and valuable way. The leaders linked many of the results created through their organizational and leadership development to the eight aspects of spiritual health. They see matters of meaning as important and topical. There was a strong belief among the leaders that the degree of Employee Engagement is high in their organiza­tions, that they create spiritual health through their work and that it positively affects the business profitability and competitiveness. The analysis gives the overall assessment that life and working life influence each other. It shows great potential from a public health perspec­tive as well as a socio-economic and business perspective. The analysis also points in the direction of a possible future model for research as well as several initiatives and work areas. For the psychology of religion, as a research topic, an opportunity arises for new research models, connect to other research areas, and contribute to an expanded political analysis

    This essay is based on a case of a Swedish student with dyslexia who was denied the right to his aid during the national exam in Swedish. The purpose of the study is to shed light on the problems in how practice is interpreted and how future cases can behandled. In order to examine the current law in discrimination that dyslectics experience within the school system. The study has used the legal dogmatic method,the right as it is “de lege lata'' as well as “de lege ferenda”, as the right should be. The study has concluded that even if the student is not denied the right to a free education,the study wishes to draw attention to the fact that the student may have been exposed to discrimination based on the European Convention Art.14. What the study has discovered by analyzing the material is that the adaptations offered to the student did not compensate for the absence of the compensatory aid for the national test

    This paper delves into the significance of land disposal to indigenous rights and Settler-Colonies. Specifically, it examines land use regulations for forestry management and Forest Sami villages. Through interviews with practicing forest reindeer herders, it has been revealed that forestry practices in Sweden have dramatically altered the landscape, posing significant challenges to the continuation of reindeer herding. In the context of Settler-Colonialism, the analysis of these findings shows that land use regulations align with the "logic of elimination," which seeks to remove the native population to secure settlers’ access to land

    In April 1919, the publication of the first part of the edited collection Det andliga nutidsläget och kyrkan ("The Contemporary Spiritual Condition and the Church") caused an intense debate within the Church of Sweden and in the daily press. The editors of the book were driven by ideals of open and honest dialogue about religious and ethical reformation in a time of deep spiritual distress and invited contributions from academia and lay people as well as clergy. Some of the contributions have been analyzed in previous research, as examples of contemporary theological debates. This article presents an analysis of the contributions of the books and of the most salient themes in the debate, covering 192 newspaper articles between April 1919 and May 1920. The analysis contributes to previous research by the additional new material concerning how theological issues were connected to contemporary political and cultural debate. This concerns the implications of modernization in contemporary Sweden, such as individualization, social justice, and secularization. Furthermore, the debate in the newspapers, previously not thoroughly researched, highlights how the book became a locus for issues such as participation of the laity in theological debate, and the role of the Church as a public authority in a secular, modernized society. These themes present fruitful openings for further research on the role of Christian actors in new forms of public debate shaping modernity in Sweden

    Many Christians believe in a future with eternal life, some say it will be “in heaven”. What kind of existence do they imagine? Do they think that the risen Christian congregation will have physical bodies like we have here in our lives on Earth today? Or will it be a spiritualexistence? Bible scholar and former Anglican bishop NT Wright asserts that Christianity’s most distinctive idea is bodily resurrection and he also defense a literal resurrection of Jesus.1 He claims that most Christians don’t understand the meaning of the “Christian hope” – that of a bodily resurrection and a new creation. What is the theological statement on resurrection from bishops in the Swedish Lutheran Church? Which message about the Christian hope do they advise, especially when it comes to funerals? What kind of eschatological tracks are to be found in the main manual Kyrkohandbok för Svenska kyrkan? Is the afterlife to be seen as a spiritual existence or one with physical bodies? And does it really matter? The main purpose in this essay is to find out what kind of eschatological guidance there is for priests officiating funerals. With starting point in the theology of NT Wright, in comparison with the advice from Swedish bishops, the essay is studying which words and formulation could be used to talk truthfully about the Christian hope
