    Rights in Conflict: Examining Investment Treaty Arbitration and Intellectual Property Rights in the Wake of Russia’s Invasion of Ukraine

    This article examines how the armed Ukraine-Russia conflict opened a doorway for a wave of international arbitration via corporate actions against Russia for violating BIT obligations. To provide context for the suggested BIT arbitration against Russia, this article begins with a brief discussion of the historical background of this conflict and investor-state treaty arbitration. This article next pivots to analyze the applicability of investor-state treaty arbitration to compensate lost IP investments in three parts. Part I considers how investor-state treaty arbitration function with ongoing armed conflict and which investors may initiate investor-state treaty claims. Next, Part II reports on the status of Russia\u27s existing BIT obligations and the effect of Russia\u27s decision to suspend IP rights of “unfriendly states.” In articulating how the suggested BIT claims would lead to successful results, Part III details the enforcement routes of arbitration awards if Russia declines to pay. This article concludes with remarks on the role of investor-state arbitration as a diplomatic tool extending beyond other legal remedies to disincentive illegal international conduct

    Too Much of a Good Thing? Exploring Affective Commitment’s Negative Impact

    Strategies to increase organizational commitment in employees to increase retention, productivity and performance are common approaches used by leaders facilitated by human resource departments. In the past two years, there has been a surge of resignations by employees re-evaluating their relationship with employers. The employee exits have focused employers on increasing employee commitment to their organization by deploying human resource management (HRM) strategies. Organizations must reflect on the negative impact high commitment can have on employees and the companies in which they work. This paper is an exploration of the negative impact of affective organizational commitment on employees and employers. The paper examines literature highlighting organizational commitment\u27s positive and negative impact. There is an emphasis on the detrimental impact of high affective commitment on employees\u27 personal and professional lives, such as stress, burnout, work-life imbalance, guilt, and behaviors that put organizations at risk. The examination concludes with recommendations for future research

    Mandated sexual violence prevention in higher education: a quantitative analysis of student response to sexual harassment and violence through a framework of organizational culture

    Sexual violence (SV) is a global public health crisis of pandemic proportions. Sexual harassment (SH) and violence are pervasive on college campuses, negatively impacting students, faculty, and staff. To address this, U.S. universities are required by federal law to implement EBP programs to foster awareness, knowledge, attitudes, and skills/behaviors (competencies) to prevent or mitigate sexual misconduct. Improving these competencies can increase students’ capacity to respond to SH and SV they experience or witness positively impacting retention, health, wellness, and graduation outcomes. Additionally, recent empirical evidence has linked organizational culture (i.e., values, shared beliefs, and artifacts) and competencies to effectively responding to institutional crises such as SV. This quantitative study analyzed state university disaggregated data from a 2016 Title IX student survey through a framework of organizational culture. Specifically, the study explored differences between rural-urban and undergraduate graduate students’ competencies (i.e., awareness, knowledge, attitudes, skills/behaviors) and the values, artifacts, and beliefs stated in state university policy and procedures. Further research should consider the likely effects of organizational culture on the implementation of SH and SV prevention programs

    Impact of supervisors’ person-centered listening on sense of belonging among occupationally minoritized healthcare professionals

    Significant gender and racial disparities are evident when comparing the composition of the U.S. healthcare workforce to the general U.S. population. Latinx individuals are underrepresented across all professions, while non-White individuals and women are occupational minorities in executive roles and in physician, surgeon, and advanced practitioner roles. Lack of diversity poses problems for underrepresented healthcare professionals, their organizations, and their patients. While diverse professionals experience various forms of microaggression, discrimination, prejudice, and diminished sense of belonging in their fields, these conditions can compromise communication among the various healthcare professionals involved with a patient, in turn, potentially threatening patient safety and diminishing the quality of care. Supervisors’ behaviors affect the organization individually and collectively. Therefore, supervisors play central roles in whether an underrepresented individual feels a sense of belonging. This study investigated the impact of supervisor listening behaviors on diverse healthcare professionals’ sense of inclusion. Data gathering occurred via semi-structured interviews with 14 physicians, advanced practitioners, or leadership-level individuals who are occupational minorities in their profession working and living in the United States. Participants were asked about their experiences of inclusion and lack of inclusion, the contributors to those experiences, and the role supervisors’ behaviors, specifically listening behaviors, in those experiences. Study data were reviewed using content analysis. Study data were reviewed using content analysis. Study findings indicated that critical supervisory behaviors for enhancing inclusion among occupational minorities are seeking to understand and engage subordinates and actively supporting subordinates’ development. Person-centered listening was found to improve inclusion through a variety of intrapersonal, interpersonal, team, and organization-level impacts. Based on these findings, organizations are advised to create and deliver person-centered listening based cultural sensitivity and inclusiveness training and to institute accountability and enforcement measures to ensure that inclusion is actively and deliberately achieved
