The Development of the Application of the Law on Child Custody Post-divorce

    No full text
Lawsuits regarding child custody post-divorce are frequently filed in religious courts. In practice, after a divorce, each spouse who wishes to have custody of their child files a child custody lawsuit in the Religious Court. The Compilation of the Islamic Law (KHI) is one of the legal bases for the judges’ decisions. Currently, judges are experiencing many changes and developments in determining child custody. The decision about who will care for the child is no longer solely based on the normative provisions in Article 105, letter A of the KHI. This research explores the development of the application of child custody law post-divorce. This study is classified as library research since the data used is obtained from the secondary sources of legal and written materials. The nature of this research is descriptive, as it presents data qualitatively and narratively. The results of this research indicate that the development of the application of child custody law post-divorce includes the following: The first application is the enforcement of legal norms regarding the custody of underage children, which is entrusted to the biological mother. The second application is the enforcement of legal norms that consider the welfare and best interests, as well as the peace and comfort of the child. The third application is the enforcement of legal norms that consider the behavior and good faith of the child custodian. The fourth application is the enforcement of legal norms that consider children who have reached the age of discernment (mumayiz) in determining custody choices. The fifth application is the enforcement of legal norms that consider the apostasy of parents, whether the father or mother, as a reason for losing custody rights

Teachers’ pedagogical competence in doing assessments is essential to improve learning quality. It is a must for teachers to give learning experiences with 4C. However, teachers have not integrated the students’ 4C skills clearly in doing psychomotor assessments. The teachers have not identified the elements of 4C integrated with psychomotor assessment. It will impactthe result of psychomotor assessment, which is subjective, less valid, and less transparent. This research aims to know (1) the technique and instrument of psychomotor assessment implemented by teachers, (2) teachers’ pedagogical competence in doing psychomotor assessment integrated with 4C, and (3) teachers’ obstacles in doing psychomotor assessment integrated with 4C. The research method uses a qualitative approach. The research subjects are teachers at three public junior high schools SMPN in East Java. The research procedure consists of giving a questionnaire, doing interviews, and doing observation. The triangulation method (interview, observation, and documentation) becomes the basic element to explain the findings. The data analysis is done through data reduction, data display, and data verification. The findings show that (1) the techniques of psychomotor assessment used by teachers are the product (13%), project (16%), practice (40%), and observation (23%); most of instruments used are rubric (98%), checklist (2%). (2) Teachers’ pedagogical competence in psychomotor assessment shows that the teachers are less optimal in giving the result of psychomotor assessment to determine the learning completeness integrated with 4C, the teachers are less optimal in communicating the result of psychomotor assessment to the stakeholders, the teachers are less optimal in taking benefit from the result of psychomotor to improve the learning quality. (3) The obstacles faced by teachers in the implementation of psychomotor assessment integrated with 4C, as most of the teachers less understand the characteristics and steps of technique in psychomotor assessment; most of the teachers less understand the elements of 4C; teachers find difficulty in arranging the criteria of learning completeness of learning purposes; the teachers do not give detail task to the students for the activity of 4C as the base of psychomotor assessment. In conclusion, this research states that there is less optimal teachers’ pedagogical competence in applying psychomotor assessment integrated with 4C, so it needs an application model for psychomotor assessment to improve teachers’ pedagogical competence integrated with 4C based on a database. Application based on technology is used for helping teachers to do psychomotor assessments in a valid, transparent, measurable, and well-documented way. Teachers’ pedagogical competence has impact on the improvement of learning quality and psychomotor learning outcomes

    No full text
The number of divorce cases filed in religious courts has been steadily increasing every year. Many of these cases arise from couples who do not genuinely desire a divorce and the respondent makes every effort to preserve their marriage, even resorting to legal avenues in their divorce cases. Many parties experience a change of heart and reconcile with their spouse after the first-instance decision is read in an open court session, which can be considered as occurring at the level of legal efforts. When reconciliation happens, how do parties achieve peace in divorce cases at the regular legal level? This study uses library research involving a series of activities related to the examination of library data. The nature of this research is descriptive and the data is presented qualitatively, aiming to provide an illustration of situations or events. The data source is secondary data, obtained through a review of legal materials. Data sources refer to the subjects from which data can be obtained. Legal materials include both primary and secondary legal sources. The results of this study indicate that peace in divorce matters at the level of regular legal efforts can be implemented in practice, ensuring that the parties consistently pursue regular legal measures so that the case is not legally binding, thus preventing the issuance of divorce certificates

Before the COVID-19 pandemic, residents of Mayangsari Village actively worked to improve environmental quality, particularly by addressing waste management issues. These efforts also supported the development of river-based tourism, a newly introduced initiative in the area. This study analyzes how community-based waste management contributes to enhancing environmental quality in Mayangsari Village. Data were collected through in-depth interviews, observations, and documentation involving residents of Kampung Mayangsari, Kalipancur Village, in Semarang City. Using a qualitative descriptive analysis, the study showed that initial public awareness of proper waste disposal was low. Many residents disposed of garbage directly into the river, and waste was managed individually using outdated, informal methods. However, as environmental initiatives led by the village government took hold, especially those linked to optimizing the river for tourism, community awareness began to grow. Community-based waste management is well-developed through the education process carried out by the Rukun Warga (RT) and Rukun Tetangga (RT) institutions and several local social groups. Key steps included providing trash bins for each household, establishing waste disposal regulations and sanctions, and introducing waste sorting and recycling. These efforts have not only improved cleanliness but also turned recycling materials into valuable goods
