    Limites en la atención a discapacitados intelectuales y psicosociales en la actividad notarial en Ecuador

    The evolution of disability law has advanced substantially at the international level as well as in national legislation. The highest point is the approval of the International Convention on the Rights of Persons with Disabilities in 2006, whose main contribution is the recognition of the right to exercise the legal capacity of persons with intellectual and psychosocial disabilities. In Ecuador, despite having ratified this international instrument in 2008, the internal legislation continues to be obscure, incompatible, contradictory and inapplicable, leading to a theoretical conflict of a civil nature and above all practical in the exercise of notarial activity. Precisely the difficulty that represents the Ecuadorian notary to pay attention to this group of people despite the existence of international and national legislation that advocates the right to act of the intellectually and psychosocial disabled, constitutes the main object of this work. To carry out an adequate analysis and interpretation of the pertinent legal norms, we use legal methods: exegetical and legal hermeneutic. The result is a global vision, updated and presented from the point of view of the notary public. Its approach after 15 years since the approval of the aforementioned international Convention and its not yet clearly adequate in Ecuadorian legislation justify the importance of its study in matters of Social Law for the disabled and Ecuadorian Notarial Law.La evolución en materia de derecho de discapacidad ha avanzado sustancialmente a nivel internacional como en legislaciones nacionales. El punto más álgido es la aprobación de la Convención Internacional sobre los Derechos de las Personas con Discapacidad en el 2006, cuyo principal aporte es el reconocimiento del derecho de ejercicio de la capacidad jurídica de las personas con discapacidad intelectual y psicosocial. En Ecuador, a pesar de haberse ratificado este instrumento internacional en el 2008, la legislación interna sigue siendo oscura, incompatible, contradictoria e inaplicable acarreando un conflicto teórico de naturaleza civil y sobre todo práctico en el ejercicio de la actividad notarial. Precisamente la dificultad que representa al notario ecuatoriano prestar la atención a este grupo de personas, no obstante, de la existencia de legislación internacional y nacional que propugna el derecho de obrar del discapacitado intelectual y psicosocial, constituye el objeto principal de este trabajo. Para la realización de un adecuado análisis e interpretación de las normas jurídicas pertinente, utilizamos los métodos jurídicos: exegético y hermenéutico jurídico. El resultado es una visión global, actualizada y presentada desde la óptica del notario público. Su abordamiento tras 15 años desde la aprobación de la mencionada Convención internacional y su aún no adecuación de forma clara en la legislación ecuatoriana justifican la importancia de su estudio en materia de Derecho Social de los discapacitados y del Derecho Notarial ecuatoriano

    In Ecuador, international principles of Environmental Law are set out in the Constitution and are developed in the Organic Environment Code and its Regulations. This research performs a qualitative analysis of the normative development of each principle and of the international conventions that Ecuador has signed in environmental matters in order to develop a proposal for classification between fully developed principles, principles with insufficient regulatory development and principles without regulatory development or with regressive local regulations. In conclusion, it was found that the principle of access to information, participation and justice has no normative development in Ecuador; that the precautionary principle has regressive rules; that three conventions on the principle of cooperation have no local normative development. On the other hand, it was found that the principles of sustainable development, in dubio pro natura, better technology, solidarity, comprehensive reparation, effective protection and imprescriptibility of environmental responsibility have sufficient normative development to be implemented in EcuadorEn Ecuador, los principios internacionales del Derecho Ambiental se enuncian en la Constitución y se desarrollan en el Código Orgánico del Ambiente y su Reglamento. Esta investigación realiza un análisis cualitativo del desarrollo normativo de cada principio y de los convenios internacionales que Ecuador ha suscrito en materia ambiental, a fin de plantear una propuesta de clasificación entre principios cabalmente desarrollados, principios con desarrollo normativo insuficiente y principios sin desarrollo normativo o con normativa local regresiva. En conclusión, se encontró que el principio de acceso a información, participación y justicia no tiene desarrollo normativo en Ecuador; que el principio precautorio tiene normas regresivas; que tres convenios sobre el principio de cooperación no tienen desarrollo normativo local y que los principios de desarrollo sostenible, in dubio pro natura, mejor tecnología, solidaridad, reparación integral, tutela efectiva e imprescriptibilidad de la responsabilidad ambiental tienen suficiente desarrollo normativo para ser aplicados en Ecuador

    Consecuencias de la ausencia de regulación del financiamiento por terceros en el arbitraje comercial en Ecuador

    It is a fact that there is no express regulation regarding the TPF in Ecuador and in several countries of the world. This absence has led to various arbitration experts raising issues that may arise when using this method. On the other hand, there is another current that proposes that establishing strict regulation would limit the development of the TPF. However, after analyzing the positions and problems regarding the TPF, this paper proposes that it would be more beneficial and efficient to regulate the TPF in the regulations of each arbitration center, through general recommendations that do not establish too many barriers to the operation of this method. Ecuador has a legal system that is friendly to the TPF, since this method is not contrary to public order, and the parties can act under the principle of autonomy of the will in the absence of an express prohibition.Es un hecho que no hay regulación expresa respecto del TPF en Ecuador y en varios países del mundo. Esta ausencia ha generado que varios expertos del arbitraje planteen problemas que pueden presentarse al utilizar este método. Por otro lado, existe otra corriente que propone que establecer una regulación estricta, limitaría el desarrollo del TPF. Sin embargo, tras analizar las posturas y problemas que respectan al TPF, se propone que sería más beneficioso y eficiente regular el TPF en los reglamentos de cada centro de arbitraje, a través de recomendaciones generales que no establezcan demasiadas barreras al funcionamiento de este método. El Ecuador, tiene un ordenamiento jurídico amigable con el TPF, dado que este método no es contrario al orden público, y las partes pueden actuar bajo el principio de la autonomía de la voluntad ante la ausencia de prohibición expresa

    This article examines the constitutional limits of popular consultation, which is recognized in article 104 of the Ecuadorian Constitution. In order to do so, this paper first addresses the importance of popular consultation as well as some of its disadvantages, which may question its effectiveness as a true citizen participation mechanism. Subsequently, this article justifies the need for a systematic interpretation of the Constitution in order to determine the scope of popular consultation and analyzes its limits on the basis of a comprehensive reading of the constitutional text and a critical look at the Constitutional Court"™s jurisprudence.El presente artículo analiza los límites constitucionales de la consulta popular, reconocida en el artículo 104 de la Constitución ecuatoriana. Para ello, primero se examina la importancia de la consulta popular, pero también se identifican algunas de sus desventajas, que nos llevan a cuestionar su eficacia para hacer realidad la participación ciudadana. Posteriormente, se justifica la necesidad de realizar una interpretación sistemática de la Constitución para poder determinar el alcance de la consulta popular y se analizan los límites materiales de este mecanismo de participación, sobre la base de una lectura integral del texto constitucional y de una mirada crítica a la jurisprudencia de la Corte Constitucional

    Within the several emerging measures issued in Ecuador, since the declaration of Covid-19 as a worldwide pandemic, there is an interpretative provision rule for fortuitous event and force majeure, in order to regulate its application regarding the termination of individual employment contracts, according to the recent entry into force of the Organic Law of Humanitarian Support. The interpretative provision establishes a single application parameter for this causal, based on a situation of absolute impossibility or definitive cessation of the productive activity of the employer. This article seeks to identify the main factual and legal assumptions that this provision has ignored, in comparison with those that have indeed been considered and developed in Ibero-American Comparative Law; assumptions that in essence, should also be inherent to said provision, which in conclusion will demonstrate that all the normative and regulatory shortcomings have not been sufficiently solved by said Humanitarian Support Law. Finally, this article will attempt to demonstrate the need to incorporate the theories of subjective and objective civil liability, regarding the imputability of the employer in the determinative equation of the factual and legal assumptions of the causal in reference. All of which, becoming even more necessary, due to the increasing number of contractual terminations and dismissals, in the midst of a critical situation such as the current pandemic.Dentro de las varias medidas emergentes emitidas en el Ecuador, a partir de la declaratoria del Covid-19 como pandemia, consta la disposición interpretativa a la causal de fuerza mayor o caso fortuito, para la terminación de los contratos individuales de trabajo, con la reciente entrada en vigencia de la Ley Orgánica de Apoyo Humanitario. La disposición interpretativa consiste en establecer un único parámetro de aplicación de dicha causal, relativo a una situación de imposibilidad absoluta o cese definitivo de la actividad productiva del empleador. El presente artículo busca identificar los principales presupuestos fácticos y jurídicos que dicha disposición ha ignorado y que, por otro lado, han sido considerados y desarrollados en el Derecho Iberoamericano Comparado que, por esencia, deberían también serle inherentes. De igual manera, el presente artículo pretende exponer las limitaciones y falencias normativas, existentes en el sistema laboral ecuatoriano, tanto en lo subjetivo como en lo procedimental de la norma, cuestión que tampoco ha sido suficientemente solucionada por dicho cuerpo normativo. Finalmente, se expondrá la necesidad de incorporar la teoría de la responsabilidad civil subjetiva y objetiva, respecto a la imputabilidad del empleador en la ecuación determinativa de la causal en referencia. Todo lo cual, volviéndose aún más necesario, por el creciente número de terminaciones contractuales y despidos, en medio de una situación crítica como la actual pandemia

    This legal essay has the purpose of carrying out a national, international, and doctrinal normative analysis, regarding how the Court of Arbitration for Sport (CAS) has the power to resolve controversies in sports matters for Ecuadorian professional soccer teams. This submission to arbitration arises from the compulsory and imposed consent, thanks to the power of international professional football regulatory bodies. For this reason, this type of sports arbitration has been involved in criticism, having lost one of the essential elements for arbitration, consent. This deformation of consent causes the parties to question the powers of the CAS, legal security and even its impartiality. Therefore, it is necessary to understand how an alternative justice has become the only path to access justice in controversies related to football. Consequently, a distorted arbitration is the result, maintaining only its procedural form, but losing its essence.El presente ensayo jurídico tiene la finalidad de realizar un análisis normativo nacional, internacional y doctrinal, respecto de cómo el Tribunal Arbitral del Deporte (TAS) tiene potestad para la resolución de controversias en materia deportiva para equipos de fútbol profesional ecuatorianos. Este sometimiento al arbitraje nace del consentimiento obligado e impuesto, gracias al poder de organismos internacionales reguladores del fútbol profesional. Por esto, este tipo de arbitraje deportivo se ha visto envuelto en críticas, habiendo perdido uno de los elementos esenciales para el arbitraje, el consentimiento. Esta deformación del consentimiento causa que las partes cuestionen las potestades del TAS, la seguridad jurídica e incluso su imparcialidad. Por lo tanto, es necesario entender como una vía alternativa se ha convertido en la única vía para acceder a la justicia en controversias relacionadas con el fútbol.     Alterum non laedere, neminem laedere, also known as the duty not to harm, has historically generated discussions regarding its existence, recognition, and scope. The main critic made to this institution is about its incidence on the principle of legal certainty since its absolute recognition would imply that everything and any damage is compensable. On the other hand, if it were not recognized, the victims of unjust damages not typified would be left defenseless. Therefore, first, this article will seek to understand the alterum non laedere through its concept, historical development, and its main criticisms. Second, the legal nature of the duty not to harm will be analyzed to understand its scope. Finally, its recognition will be evaluated based on the Ecuadorian regulations and jurisprudence, in contrast to the system of Spain and Argentina. Thus, it is intended to give some lights to the application of alterum non laedere, in such a way that its maximum effectiveness is reached.El alterum non laedere, neminem laedere o también conocido como el deber general de no dañar, históricamente ha generado discusiones en cuanto a su existencia, reconocimiento y alcance. La principal crítica que se le hace es sobre su incidencia en la seguridad jurídica, ya que su reconocimiento absoluto implicaría que todo y cualquier daño es indemnizable. Por otro lado, si no se lo reconociese, se estaría dejando en indefensión a las víctimas de daños injustos no tipificados. Por ello, primero, se buscará entender al alterum non laedere a través de su concepto, desarrollo histórico y sus principales críticas. Segundo, se analizará la naturaleza jurídica del deber de no dañar para entender su alcance. Por último, se evaluará su reconocimiento a partir de la normativa y jurisprudencia ecuatoriana, en contraste con el sistema de España y Argentina. Así, se pretende dar luces para la aplicación del alterum non laedere, de tal manera que se alcance su eficacia máxima

    Embezzlement of official property by a public official is one of the most controversial crimes in the field of Ecuadorian Criminal Law. It is typified in the Ecuadorian legal system in Article 278 of the Organic Criminal Code, its relevance is fundamentally in two aspects: the special characteristics of the active subject and the legal asset that it protects. To enter to study the subject of this article, it is first necessary to define other concepts that are of utmost importance to understand this essay, such as perpetrator, joint perpetrator, accomplices and the communicability of the circumstances. This will allow us to comprehend that, although a certain quality is required from the perpetrator to be considered an author, the person without the qualification required by the type, who sometimes intervenes with essential acts for its consummation, cannot be left unpunished or with a lesser penalty. However, the complexity of the subject makes it necessary to observe two highly relevant figures that are: the intraneus and extraneus. Both will contribute to the deepening of the analysis, which together with the support of the Ecuadorian jurisprudence will justify the relevance of the exposed subject. Therefore, the purpose of this essay is to analyze and present the different jurisprudential criteria used by the different Ecuadorian courts and tribunals to convict the private party as co-perpetrator of the crime of embezzlement despite not having the qualification required by the crime.El peculado es uno delitos de los más controvertidos en el ámbito del Derecho Penal ecuatoriano. Se encuentra tipificado en el ordenamiento jurídico ecuatoriano en el Art. 278 del Código Orgánico Integral Penal, su relevancia se encuentra fundamentalmente en dos aspectos: la calidad del sujeto activo y el bien jurídico que protege. Para entrar a estudiar el tema que es materia de este artículo, primero es necesario definir otros conceptos que son de suma importancia para la comprensión de este trabajo, tales son el sujeto activo calificado, la autoría, coautoría, cómplices y la comunicabilidad de las circunstancias. Esto permitirá entender que, a pesar de que se exige cierta calidad al sujeto activo para ser considerado autor del delito de peculado, no se puede dejar sin castigo o con una pena menor a la persona que, sin la calificación exigida por el tipo, interviene con actos principales para su consumación. Sin embargo, la complejidad del tema lleva a que sea necesario observar dos figuras de suma relevancia que son: el intraneus y extraneus. Ambas contribuirán a la profundización del análisis, que en conjunto con el sustento de la jurisprudencia ecuatoriana justificarán la relevancia que tiene el tema expuesto. Por lo que, en el desarrollo de este ensayo se expondrán los diferentes criterios jurisprudenciales utilizados por las diferentes cortes y tribunales ecuatorianos para condenar al privado como coautor del delito de peculado, a pesar de no tener la calificación requerida por el ilícito

    Exclusión del requisito de representación gráfica en el régimen marcario de la Comunidad Andina de Naciones

    In the area of industrial property, there are ambiguous interpretations regarding the trademark"™s legal definition, which by recognizing the graphic representation as a conceptual component of it, have given this graphic element an unnecessary role. Notwithstanding this, the Andean Community of Nations"™ trademark regime clearly defines trademarks solely based on their distinctive aptitude and requires graphic representation only as a registration"™s procedural requirement. This requirement is based on the attributive system, and its requirement makes sense if it allows a precise determination of the trademark"™s object of protection. However, graphic representation hinders the registration of non-visual trademarks that, despite fitting the trademark"™s legal definition, cannot be graphically represented, but could be represented according to the available technology. Thus, graphical representation has become an obsolete requirement since it is incapable of fulfilling its main and essential objective of precision. Consequently, the Andean trademark regime must allow representation in any way that allows the public to precisely determine the trademark"™s object of protection granted to its owner.En el ámbito de propiedad industrial, existen interpretaciones ambiguas respecto a la definición jurídica de una marca, las cuales al reconocer a la representación gráfica como un componente conceptual de la misma, le han dotado de un protagonismo innecesario a este elemento gráfico. Sin perjuicio de ello, es claro que el régimen marcario de la Comunidad Andina de Naciones define a las marcas únicamente a partir de su aptitud distintiva y exige a la representación gráfica únicamente como un requisito procedimental de su registro. Este requisito se fundamenta en el sistema atributivo, y su exigencia tiene sentido mientras permita determinar de una manera precisa el objeto de protección de las marcas. Ahora bien, la representación gráfica obstaculiza el registro de marcas no visuales que, a pesar de encajar en la definición de marca, no pueden ser representadas gráficamente, mas podrían ser representadas según las herramientas tecnológicas disponibles en la actualidad. Por ello, la representación gráfica se ha convertido en un requisito obsoleto, pues es incapaz de cumplir con su principal y esencial objetivo de precisión.     Since the recognition of indigenous justice in the Ecuadorian constitution of 1998, a series of debates concerning its scope, limits, and practices have emerged. The social and political implications of the indigenous peoples\u27 customs have such transcendence that they challenge a Constitutional State of Laws concept. This paper proposes an analysis of the conflicts that arise from the convergence of two systems of justice within the same territory. Furthermore, it offers a study on the evolution of the Rule of Law\u27s concept linked to plurinationalism and multiculturalism. To conclude, it analyzes the violation of these communities\u27 right to culture due to the constitutional limitations on indigenous justice.A partir del reconocimiento de la justicia indígena en la constitución de 1998, surgieron una serie de debates acerca de su alcance, límites y prácticas. Las implicaciones de las costumbres aplicadas por los pueblos y nacionalidades tienen tal trascendencia que discuten el concepto mismo de Estado constitucional de derechos establecido en la constitución de 2008. El presente escrito propone un análisis de los conflictos derivados de la convergencia de dos sistemas de aplicación de justicia en un mismo territorio. Además, plantea un estudio de la evolución del concepto de estado de derecho ligado a las nociones de plurinacionalidad y pluriculturalidad contemporáneas. Para concluir esboza un análisis acerca de la limitación de la justicia indígena como una vulneración a su derecho a la cultura reconocido internacionalmente
