Perdamaian Dalam Kasus Pidana (Kecelakaan Lalu Lintas) Melalui Hukum Adat Di Desa Timpah
The Dayak tribe is one of the communities in Indonesia that still applies customary law as a guideline in regulating the lives of its people in various matters, including in terms of resolving problems, including traffic accidents. Conflict resolution through Customary Law will better represent the feelings and desires of the community because the law itself comes from the community itself. Customary Law seeks to resolve conflicts or problems with peace for the parties. Peace is a goal that all parties aspire to. Traditional institutions play a very important role in regulating the behavior patterns of indigenous communities, especially the Dayak indigenous community. Traffic accident cases are also one of the rights and permits for Let Adat to implement, this is stated in Article 10 of Central Kalimantan Regional Regulation No. 16 of 2008. Based on this, it clearly states that the existence of the Damang Traditional Head's permission to resolve the abilities that arise in cases of traffic accidents is included in the case of giving Singer. A traffic accident that takes someone's life is called a Sahiring Customary Violation (taking someone's life). The aim of implementing problem resolution through customary law is to achieve peace between the parties and restore the disturbed balance. Singer Sahiring is a singer or fine for murder or someone who takes the life of another person "Sahiring Matei". There are policies that are taken based on considerations based on the capabilities of the guilty party. Of course, Damang will make a decision based on the agreement between the parties after hearing the opinions of each party at the internship hearing. Customary Law in resolving problems seeks peace as a goal. This is in line with the highest goal of law which is to provide benefits to the parties by creating peace. Restorative Justice has existed in Indonesian society through a customary law settlement process. With procedures and guidelines that bring together parties and stakeholders, in this case the Damang Traditional Head, in an informal forum to reach consensus in seeking restoration of the situation.Keywords: Traffic Accidents, Crime, Peace, Customary LawMasyarakat Suku Dayak adalah salah satu masyarakat di Indonesia yang masih memberlakukan Hukum Adat sebagai salah satu pedoman dalam mengatur kehidupan masyarakatnya dalam berbagai hal, termasuk dalam hal menyelesaikan permasalahan tidak terkecuali masalah kecelakaan lalu lintas. Penyelesaian konflik melalui Hukum Adat akan lebih mewakili rasa dan kemauan dari masyarakat karena hukum nya sendiri berasal dari masyarakat itu sendiri. Hukum Adat mengupayakan penyelesaian konflik atau permasalahan dengan perdamaian bagi para pihak. Perdamaian merupakan tujuan yang dicita-citakan bagi semua pihak. Lembaga adat sangat berperan penting dalam mengatur pola tingkah laku masyarakat adat, terutama masyarakat adat Dayak. Kasus kecelakaan lalu lintas juga merupakan salah satu hak dan wewenang bagi Let Adat untuk dilaksanakan, hal ini tertera pada Pasal 10 Peraturan Daerah Kalimantan Tengah No. 16 Tahun 2008. Berdasarkan hal tersebut secara jelas menegaskan bahwa adanya kewenangan Damang Kepala Adat dalam menyelesaikan perselisihan yang timbul dalam kasus kecelakaan lalu lintas termasuk dalam hal pemberian Singer. Kecelakaan lalu lintas yang sampai menghilangkan nyawa seseorang ini adalah disebut dengan Pelanggaran Adat Sahiring (menghilangkan nyawa seseorang). Tujuan dari dilaksanakannya penyelesaian masalah melalui Hukum adat adalah untuk mencapai perdamaian para pihak serta mengembalikan keseimbangan yang terganggu. Singer Sahiring adalah singer atau denda pembunuhan atau seseorang sehingga menghilangkan nyawa orang lain “Sahiring Matei”. Terdapat kebijakan yang diambil berdasarkan pertimbangan-pertimbangan yang berdasarkan kemampuan dari pihak yang bersalah. Tentunya Damang akan memberikan keputusan yang berdasarkan dari kesepakatan para pihak setelah mendengar pendapat dari masing-masing pihak yang dilakukan dalam sidang intern. Hukum Adat dalam menyelesaikan permasalahan mengupayakan perdamaian sebagai tujuannya. Hal tersebut senada dengan tujuan tertinggi dari hukum yang memberikan kemanfaatan bagi para pihak dengan terciptanya perdamaian. Restorative Justice telah hidup dalam masyarakat di Indonesia melalui adanya proses penyelesaian secara Hukum Adat. Dengan tata cara dan pedoman yang mempertemukan para pihak dan pemangku kepentingan dalam hal ini Damang Kepala Adat dalam suatu forum informal untuk mencapai mufakat dalam mencari pemulihan keadaan.

PENGARUH BUDAYA PATRIARKI TERHADAP KESETARAAN GENDER DALAM KELUARGA HINDU BALI
The study of the influence of patriarchal culture on gender equality in Hindu families focuses on the position of women due to the implementation of patriarchal culture to date. The purpose of writing this article is to understand the life of Hindu society which adheres to a patrilineal system and is influenced by patriarchal culture towards gender equality in ancient times before Science and Tecnology (IPTEK) developed and today’s increasingly advanced times. The method used is empirical or sociological and uses a literature study approach. The data obtained either through direct observation or from related literature is processed in a qualitative deckriptive manner. Various phenomena that occur in the field due to the influence of patriarchal culture show that women tend to be the ones who suffer losse. Because in term of position, women are below men. Apart from that, women’s space for movement ia also limited, as if a woman’s job is only to serve her husband and take care of the household and children. It is hoped that this research can contribute to the understanding that the implementation of patriarchal culture actually needs to be adjusted to current developments in family life. From the research carried out, the results obtained were that Hindu families who still implement patriarchal culture tend to have a bad impact. The various violence that befalls women in Hindu families, such as physical, psychological and sexual violence, cannot be separated from the negative influence of patriarchal culture. Moreover, Hindu families adhere to the patrilineal system.Pengkajian pengaruh budaya patriarki terhadap kesetaraan gender dalam keluarga Hindu menitikberatkan pada posisi perempuan dampak dari diterapkannya budaya patriarki hingga saat ini. Tujuan dari penulisan artikel ini adalah untuk mengetahui kehidupan masyarakat Hindu yang menganut sistem patrilineal dan dipengaruhi budaya patriarki terhadap kesetaraan gender pada zaman dahulu sebelum Ilmu Pengetahuan dan Teknologi (IPTEK) berkembang dengan zaman sekarang yang semakin maju. Adapun metode yang digunakan adalah empiris atau sosiologis dan menggunakan pendekatan studi kepustakaan. Data-data yang diperoleh baik melalui pengamatan langsung maupun dari literatur yang terkait diolah sedemikian rupa secara deskriptif kualitatif. Berbagai fenomena yang terjadi di lapangan dari pengaruh budaya patriarki, menunjukan bahwa pihak perempuan cenderung menjadi pihak yang dirugikan. Sebab dari segi kedudukan perempuan berada di bawah laki-laki. Selain itu, ruang gerak perempuan juga dibatasi, seakan-akan tugas perempuan hanya melayani suami dan mengurusi rumah tangga dan anak-anak saja. Penelitian ini diharapkan dapat memberikan kontribusi dalam hal pemahaman bahwa sesungguhnya penerapan budaya patriarki perlu dilakukan penyesuaian dengan perkembangan kehidupan keluarga saat ini. Mengingat hak dan kedudukan semua warga negara di mata hukum adalah sama. Dari penelitian yang dilakukan diperoleh hasil yaitu keluarga Hindu yang masih menerapkan budaya patriarki cenderung akan memberikan dampak yang tidak baik. Berbagai kekerasan yang menimpa pihak perempuan dalam keluarga Hindu, seperti kekerasan fisik, psikologis, dan seksual tidak lepas dari pengaruh negative dari budaya patriarki. Tradisi Mamapas Lewu Sebagai Perwujudan Nilai-Nilai Toleransi di Masyarakat Desa Hanjak Maju
The values contained in the mamapas lewu tradition include willingness to sacrifice, mutual cooperation, respect for God, mutual cooperation, expression of gratitude, self-purification, self-control, eliminating envy, envy and revenge and loyalty to promises. In context, other tribes may just be making small talk as an effort to bring closer relations with others. But the Dayak people need free space to express their culture and traditions. In other words, the Dayak tribe needs traditions to create space for others. If we look closely, each tribe has a different perception of seeing the same reality regarding the placement of themselves towards other people. Dayak people tend to distance themselves and withdraw, while other tribes tend to eliminate distance at the level of social relations. In this way, eating lewu can eliminate social distance between people in society. The aim of the tolerance values contained in the mamapas lewu tradition is that people adapt to a heterogeneous environment and can adapt and relativize their own views on ethnicity and religion, thereby giving space to others. Implementasi Tri Hita Karana Dalam Mengembangkan Sikap Sosial Religius Siswa Hindu Di SMPN 1 Balai Riam
Every human being needs a safe, peaceful and peaceful life. This will be possible if everyone is able to look after each other. Maintaining a harmonious relationship with God, maintaining a harmonious relationship with fellow humans and a harmonious relationship with the natural environment. In Hinduism, these three relationships are called Tri Hita Karana, namely the three causes of happiness. Understanding and implementing these three concepts needs to be done as early as possible, considering the negative impacts of technological developments that cannot be avoided. Students at SMPN 1 Balai Riam have a sufficient understanding of the Tri Hita Karana concept. You already have a good understanding of the concepts of parhyangan, pawongan and palemahan. The implementation of understanding the Tri Hita Karana concept to further develop students' social attitudes is carried out using several strategies, namely a) Carrying out prayers together and individually; b) carrying out social humanitarian activities through maintaining good relations with teachers, maintaining good relations with students, maintaining good relations between students and the community; c) Environmental Cleaning Activities carried out in accordance with the program established by the schoolSetiap manusia membutuhkan kehidupan yang aman, tentram dan damai. Hal tersebut akan dapat terwujud apabila setiap orang mampu untuk saling menjaga antar satu dengan yang laiinya. Menjaga hubungan yang harmonis dengan Tuhan, menjaga hubungan yang harmonis dengan sesama manusia dan hubungan yang harmonis dengan alam lingkungan. Ketiga hubungan tersebut dalam agama hindu di sebut dengan Tri Hita Karana yaitu tiga penyebab kebahagiaan. Pemahaman dan implementasi dari ketiga konsep tersebut perlu dilakukan sedini mungkin, mengingat dampak negatif dari perkembangan teknologi yang tidak dapat di hindari. Siswa SMPN 1 Balai Riam telah memiliki pemahaman yang cukup memadai tahadap konsep Tri Hita Karana. Pemahaman mulai dari konsep parhyangan, pawongan dan palemahan sudah dimiliki dengan baik. Implementasi dari pemahaman konsep Tri Hita Karana untuk lebih berkembangnya sikap sosial siswa dilakukan dengan beberapa strategi yaitu a) Pelaksanaan sembahyang bersama-sama maupun secara individu; b) melaksanakan kegiatan social kemanusiaan melalui Menjaga Hubungan Baik dengan Guru, Menjaga Hubungan Baik Sesama Siswa, Menjaga Hubungan Baik antara Siswa dengan Masyarakat; c) Kegiatan Membersihkan Lingkungan yang dilaksanakan sesuai dengan program yang telah ditetapkan oleh sekolah
Konsep Tuhan Dalam Tradisi Barat Serta Kritik Terhadap Pandangan Tentang Tuhan Personal Dan Non-Personal
Humans are creatures who never stop searching, various things that humans want to uncover, because humans have a uniqueness that always questions various things around them, including about God. Thus, there are various views on the concept of God. This research explores the concept of God in the Western tradition with a focus on the views of personal and non-personal God. The main objective of this research is to understand how these concepts have developed in the history of Western thought. The research method in this study is a qualitative method with a hermeneutic approach as well as literature analysis. The results show that various concepts of God are understood in Western society, such as God as a person, God the Eternal, God the Immanent and Transcendent, God is Most Kind, God the Almighty, God the Creator and so on. Then, criticism of the concept of personal God emphasises the potential for anthropomorphism, the difficulty of explaining the existence of evil and suffering, and the question of human freedom in the context of divine will. Meanwhile, criticism of the non-personal God concept highlights the potential lack of personal closeness, abstraction that is difficult to understand, and the potential lack of human moral responsibility
KETIDAKPASTIAN METAFISIKA: KETIDAKJELASAN ONTIK DAN PARADOKS SORITES
This research examines the phenomenon of metaphysical uncertainty through two main concepts: ontic vagueness and sorites paradox. Ontic vagueness refers to entities or concepts that do not have clear boundaries or definitions in reality, leading to ambiguity in interpretation and understanding. The sorites paradox, or stack paradox, is a philosophical problem that challenges the boundaries between categories by showing that repeated small changes can produce significant differences, even though there is no clear transition point. By combining these two concepts, this research aims to explore how uncertainty in the structure of reality and language can affect our knowledge and understanding of the world. Through literature analysis and a philosophical approach, this research seeks to identify the epistemological and ontological implications of metaphysical indeterminacy, as well as offer a new perspective on how to deal with and understand indeterminacy in the context of contemporary philosophy. The results of this study are expected to make a significant contribution to the discussion on the foundations of ontology and epistemology, as well as broaden insights into the role of uncertainty in human experience and science.Penelitian ini mengkaji fenomena ketidakpastian metafisika melalui dua konsep utama: ketidakjelasan ontik dan paradoks sorites. Ketidakjelasan ontik merujuk pada entitas atau konsep yang tidak memiliki batasan atau definisi yang jelas dalam realitas, yang menyebabkan ambiguitas dalam interpretasi dan pemahaman. Paradoks sorites, atau paradoks tumpukan, merupakan masalah filosofis yang menantang batasan antara kategori-kategori dengan menunjukkan bahwa perubahan kecil yang berulang dapat menghasilkan perbedaan yang signifikan, meskipun tidak ada titik transisi yang jelas. Dengan menggabungkan kedua konsep ini, penelitian ini bertujuan untuk mengeksplorasi bagaimana ketidakpastian dalam struktur realitas dan bahasa dapat mempengaruhi pengetahuan dan pemahaman kita tentang dunia. Melalui analisis literatur dan pendekatan filosofis, penelitian ini berusaha untuk mengidentifikasi implikasi epistemologis dan ontologis dari ketidakpastian metafisika, serta menawarkan perspektif baru tentang bagaimana menghadapi dan memahami ketidakjelasan dalam konteks filsafat kontemporer. Perlindungaan Hukum Terhadap Anak Korban Pemerkosaan Di Bawah Umur Perspektif Hak Asasi Manusia.
Violence against children is a form of crime that is done intentionally. One form of crime against children is sexual crime in the form of rape. Rape is a form of crime committed against women by coercion, violence or threats of violence. Legally of course this action is strictly prohibited, moreover the victims are children. So that children who are victims of rape must be given legal protection. The legal protection that must be given to children who are victims of rape is to receive rehabilitation from the government both physically and mentally, spiritually and socially, besides that their privacy must be protected, their good name is protected and maintained, their safety as well as witnesses to victims is the responsibility of the government, and children who are so the victim has the right to always know the progress of the case he is facing. Then the status of children as victims and witnesses must also be protected by law. This is clearly a human right that is the victim of Susila's crimes, especially children.Tindak kekerasan terhadap anak merupakan bentuk kejahatan yang dilakukan secara sengaja. Salah satu bentuk kejahatan terhadapa anak adalah kejahatan seksual berupa perkosaan. Tindakan Pemerkosaan adalah bentuk kejahatan yang dilakukan kepada perempuan dengan cara memaksa, kekersan ataupun ancaman kekerasan. Secara hukum tentu tindakan ini sangat dilarang, terlebihh lagi yang menjadi korban adalah anak-anak. Sehingga anak yang menjadi korban pemerkosaan harus diberikan perlindungan hukum. Perlindungan hukum yang wajib diberikan anak korban pemerkosaan adalah mendapat rehabilitasi dari pemerintah baik secara fisik maupun secara mental, spiritual dan sosial, selain itu privasinya wajib untuk dilindungi, nama baiknya dijaga dan dipelihara, keselamatannya juga sebagai saksi korban menjadi tanggung jawab pemerintah, dan anak yang jadi korban tersebut berhak untuk senantiasa mengetahui perkembangan perkara yang dihadapinya. Kemudian status anak sebagai korban dan saksi juga harus dilindungi secara undang-undang. Hal tersebut jelas merupakan Hak Asasi Manusia yang menjadi korban kejahatan Susila terlebih lagi adalah anak-anak
OPTIMALISASI PENYELESAIAN KASUS KDRT MELALUI MEDIASI
Cases of domestic violence are crimes committed by husbands against members of their family. Domestic violence (KDRT) often befalls women as wives. There are several forms or types of domestic violence including physical, psychological, sexual and economic violence. All forms of violence that occur in the household are caused by several factors such as the economy, education, socio-culture and infidelity. The act of domestic violence in some circles of society is considered normal in the household. While the impact of domestic violence can result in disruption of women's reproductive health, mental disturbance of children, divorce and also legal sanctions for the perpetrators. Domestic violence cases can be resolved through mediation. Mediation is an alternative in solving domestic violence cases. The litigants choose mediation because they think mediation can maintain confidentiality, there are no winners and losers, can fulfill a sense of justice, the process is faster and more concerned with the future of the household, family and children's future. The path of mediation in solving domestic violence cases must always be pursued by the litigants as well as by law enforcement.Kasus kekerasan dalam rumah tangga merupakan sebuah tindak pidana yang dilakukan oleh suami kepada anggota keluarganya. Kekerasan dalam rumah tangga (KDRT) sering menimpa kaum perempuan sebagai istri. Kekerasan dalam rumah tangga ada beberapa bentuk atau jenis diantaranya kekerasan pisik, psikoligis, seksual dan ekonomi. Segala bentuk kekerasan yang terjadi dalam rumah tangga disebebakan oleh beberapa faktor seperti ekonomi, Pendidikan, sosial budaya dan perselingkuhan. Tindakan KDRT disebagian kalangan masyarakat dianggap hal yang biasa dalam rumah tangga. Sedangkan dampak dari KDRT ini dapat mengakibatkan terganggunya Kesehatan reproduksi perempuan, terganggunya mental anak, perceraian dan juga sanksi hukum bagi pelakunya. Penyelesaian kasus KDRT dapat menggunkan jalur mediasi. Mediasi merupakan alternatif dalam penyelesaian kasus KDRT. Para pihak yang berperkara memilih mediasi karena menganggap dengan mediasi maka dapat menjaga kerahasian, tidak ada yang kalah dan menang, dapat memenuhi rasa keadilan, prosesnya lebih cepat dan lebih mementingkan masa depan rumah tangga, keluarga dan masa depan anak. Jalur mediasi dalam penyelesaian kasus KDRT harus selalu diupayakan oleh pihak yang berperkara maupun oleh penegak hukum
