Prostorsko načrtovanje na ustavnem sodišču
Z odločbo v začetku leta 2002 je ustavno sodišče razveljavilo celotno pravno ureditev prostorskega načrtovanja. V prispevku sem želel obrazložiti motive sodišča, predvsem pa ugotovitve, ki osvetljujejo proces prostorskega načrtovanja. Prostorsko načrtovanje postaja predvsem pravna kategorija, kjer je ustrezna razdelitev pristojnosti med vejami oblasti ter državo in lokalno skupnostjo odločilna za delovanje sistema. Ekonomska analiza prava nam pri tem nudi metodološko pomoč pri razumevanju obnašanja sodišča ter ostalih deležnikov v postopku prostorskega načrtovanja in urejanja prostora nasploh
Zakon o davčnem postopku v okviru odprave administrativnih ovir - med cilji in prakso
Zakon o davčnem postopku je ključni predpis za urejanje razmerij med udeleženci postopkov pri pobiranju davkov. Zato je bil v zadnjih letih že večkrat bolj ali manj korenito spremenjen, med drugim v sklopu vladnega programa odprave administrativnih ovir (OAO). Postopki se skušajo poenostaviti, tako za zavezance kot za davčni organ. Avtorica v prispevku obravnava nekaj izbranih institutov, ki naj bi bili uvedeni s tem ciljem, denimo odmera dohodnine z informativnim izračunom, navadno vročanje, zavezujoča informacija itd. Prek statističnih podatkov o pogostnosti uporabe teh (novih) institutov v letih 2006, 2007 in 2008 avtorica preverja, ali oziroma do katere mere zastavljeni cilji sprememb regulacije davčnega postopka v praksi dosegajo cilj. Ugotavlja, da kljub nekaj izjemam večina obravnavanih institutov res pomeni realizacijo programa OAO
Seznanjenost javnega in zasebnega sektorja z ukrepi odprave administrativnih ovir v Sloveniji
Ukrepi odprave administrativnih ovir so del ukrepov izboljšanja kakovosti regulative. Z raziskavo, opravljeno leta 2010 tako v javnem kot zasebnem sektorju, smo želeli preveriti, ali ukrepe javni in zasebni sektor različno zaznavata ter ugotoviti, ali oba sektorja opredeljujeta isto skupino regulative kot najbolj obremenilno. Rezultati so pokazali, da je informiranost o ukrepih odprave administrativnih ovir v Sloveniji slaba, posebej v zasebnem sektorju, ki naj bi bil glavni deležnik teh ukrepov. Kljub temu zasebni sektor ugotavlja, da se je regulativa za mala in srednje velika podjetja izboljšala v času izvajanja ukrepov odprave administrativnih ovir. Javni sektor regulativo s področja javnih naročil ocenjuje kot najbolj obremenjujočo, medtem ko zasebni sektor na prvo mesto uvršča regulativo s področja zaposlovanja
How Much Law Does the School System Need?
In its ideal form, the law is a guardian of the freedom and autonomy of the school system. On the other hand, the school system must, as part of its responsibility, establish a respectful and responsible attitude toward the rule of law. In Slovenia, practice deviates from such ideal to too great an extent. Excessive and inappropriate legal regulation reduces the freedom and autonomy of the school system. The consequences within this system are: partly ignored legal regulations, and the resulting ineffectiveness; excessive legal administration in schools; increased teachers’ opposition to the law; a lack of teachers’ motivation; and, as a consequence, worsened quality of the educational process. The law, however, is only a part of the problem. The latter has its roots mainly in a general disorientation of society with regard to its values. In order to establish the right measure and manner of the legal regulation of the school system, the moral and common sense basis of society must first be healed and strengthened
Kompetence za ekonomsko diplomacijo in mednarodno poslovanje; konvergenca ali divergenca?
Članek ugotavlja ali so kompetence, ki jih potrebuje sodobni ekonomski diplomat, podobne ali različne od tistih, ki jih potrebuje mednarodni poslovnež, ter ali so se ekonomski diplomati z obstoječimi kompetencami sposobni soočati z izzivi tektonsko spreminjajočega se okolja. Priče smo obojestranski konvergenci potrebnih kompetenc; ekonomski diplomati prevzemajo vse več vrlin mednarodnih poslovnežev, ti pa morajo biti vse boljši diplomati. Posebna pozornost je namenjena zvezi med notranjimi in mednarodnimi ekonomskimi odnosi, globalni naravnanosti, vlogi varnosti ter dolgoročnega planiranja ter toleranci do napak. Ugotavlja se, da so kompetence ekonomskih diplomatov malih držav razlikujejo od tistih iz velikih držav in da sta med ključnimi kompetencami radovednost in pripravljenost na spremembe. Da bi zadovoljili potrebe, bi morali tudi spremeniti izobraževanje tako ekonomskih diplomatov kot mednarodnih poslovnežev
Total Quality Management in the Implementation of Tasks of The Local Community: The Case of Pre-School Education
The paper presents the challenge of establishing a substantial governance framework of local government provision of tasks and services. The assumption that this end is highly dependent on the implementation of total quality management paradigm has led us to base our work on the Common Assessment Framework model. The research discusses the case of pre-school education. The main research question is how the representatives of the municipality, responsible for pre-school education, understand their role and accountability in the process of the provision of local government genuine services and tasks. As the main methodological result of the research is approved that the questionnaire based on the CAF model can help to discover the main opportunities for improvement of governance of genuine local government tasks. The results of the survey on pre-school education show that local governments are in control of financial matters and that their strategic focus is limited to the investment aspect. The accountability for quality management was approved as a key opportunity for improvement of local government governance
Decision Model for the Media Selection
The article presents the decision model for choosing the media in the performance of public relations (PR). The core of the model lies in the use of modern information methods with the accent on the artificial intelligence methods in decision-making processes which allow transparency and simple explanation of the decision knowledge and of the decision itself. The framework of the solution is the description of the realization of the model with the support of the DEXi system. The model covers the qualitative and the quantitative measures for the final choice. This allows a more wholesome overview of the media and of the goals the decision aims to achieve. The determined fundamental elements of the model are: the target public, the goals the organization aims to achieve via public relations, the resources assigned to the public relations, the messages to transmit to the public, etc. The criteria which form constituent parts of the decision model have been designed on the basis of public relations literature study and the practical experience of the Faculty
Motivation and Life Satisfaction of Employees in the Public and Private Sectors
Work motivation is the steering of human activity towards a desired objective by means of motives generated internally in a person or in his or her environment, on the basis of his or her needs. The aim of this research was to verify whether the different types of work motivation employees reported in their work were influenced by sector, job, gender and education, and to assess how the different types of motivation are linked to life satisfaction. The research involved the participation of 288 employees – 153 in the private sector and 116 in the public sector (19 did not specify). The results show that among all employees the most distinctly expressed factor is intrinsic motivation. No differences in any type of motivation were observed between sectors; between managers in the public and private sectors there were no statistically significant differences in either extrinsic motivation or intrinsic motivation or in life satisfaction
The Impact of the Financial and Economic Crisis on Public Private Partnerships
The primary purpose of this paper is to contribute to the current debate on the impact of the economic and financial crisis on public-private partnerships (PPPs). The crisis has caused a substantial fall in the PPP market. PPPs have been exposed to both financial and real impacts of the crisis. High interest rates and limited access to finance have been seen as the main factors reflecting the impact of the financial crisis on PPPs. In addition, due to the recession the decreased revenues of PPP projects have reduced their feasibility or impacted on their overall profitability. Measures adopted to help the PPP market in the analysed countries reveal that they mostly involve some form of government support. Further, the paper also critically examines the deficiencies of PPPs
Self-Concept of Leaders in Administrative Units
Within the leadership process, the positive self-concept of a leader can have an impact on quality reciprocal relations with subordinates and on the conduct of the leader and the subordinates. The results of the research into the selfconcept of administrative unit leaders indicate that the most poorly expressed areas of self-concept were the social and physical self-concept, while the highest was the general self-concept. Since it is important for leaders to have well developed skills, especially social skills and skills for working with people, the result of the research into the social self-concept of leaders in central government bodies (administrative units) is an important indicator of leaders’ concepts of their own social image. The paper focuses on the self-concept of administrative unit leaders and presents results of research carried out in that field
