DETERMINATION OF PARENTS AS GUARDIANS OF BIOLOGICAL CHILDREN WHO ARE STILL MINORS IN THE SALE AND PURCHASE OF LAND RIGHTS (Analysis of the Determination of the Semarang Religious Court Case No. 396/Pdt.P/2022/PA.Smg)
Article 47 paragraph (1) Law no. 1 of 1974 concerning Marriage states that children who have not reached the age of 18 or have never been married, are under the authority of their parents as long as they are not deprived of their authority. However, what happened in the field was that many biological parents applied to the Semarang Religious Court for guardianship because they were asked by the PPAT on the grounds that it was the basis for making a Sale and Purchase Deed required by the National Land Agency (BPN), one of them in case number 396/Pdt.P/2022/PA.Smg. The formulation of the problem in this study: (1) What is the procedure for buying and selling land rights for minors? (2) Why does BPN require parents to be the guardians of biological children who are underage in buying and selling land rights? (3) What is the basis for the judge's considerations regarding the determination of parents as guardians of biological children who are still minors in the sale and purchase of land rights in case No. 396/Pdt.P/2022/PA.Smg? The research method used in this research is normative juridical research. The specifications in this study are analytical descriptive. Data is analyzed by way of Qualitative. The results of this study are (1) The procedure for transferring land rights owned by minors, namely the stages of the procedure in PPAT and the stages that must be fulfilled are permission to determine parental authority or determination of guardianship representing minors to the court. (2) The reason BPN requires the determination of parents is because it is the basis for making a sale and purchase deed and as legal evidence for the interests of the parties in the future. (3) The basis for the judge's consideration is that the assembly grants his request with consideration based on the principle of prudence and legal certaint
IMPROVING STUDENT’S VOCABULARY USING FLASHCARDS FOR FOURTH GRADERS OF SDN PENDRIKAN LOR 02 SEMARANG
The researcher has chosen to conduct this research because it will allow him to draw some inferences regarding the level of vocabulary knowledge among students at Pendrikan Lor 02 Elementary School. This research seeks to improve the vocabulary mastery of fourth graders at Pendrikan Lor 02 Elementary School since there is a problem with their vocabulary mastery and their interest in using flashcards. In this context, the researcher used CAR to enhance vocabulary acquisition in the classroom. He combined the flashcard approach with Classroom Action Research (CAR) for a more organized investigation. The study's results for the pre-test average score is 71.40, and the development of the post-test is 95,60. The flashcard technique and CAR were effective in this trial, yielding positive outcomes. The researcher used the CAR method to understand the classroom situation and the combination of CAR and TEYL to make the research more concrete
Leadership and Employee Creativity: The Mediation Role of Intrinsic Motivation
This study aims to analyze the effect of transformational leadership, entrepreneurial leadership, and intrinsic motivation on employee creativity and to investigate the role of intrinsic motivation as a mediation. This research was conducted in the export craft industry, with a quantitative approach. Collecting data using a questionnaire distributed to 114 employees, then the data is evaluated with SmartPLS 3.2.9. The results of the analysis show that transformational leadership is related to intrinsic motivation and employee creativity. While entrepreneurial leadership is related to creativity but not related to intrinsic motivation. Intrinsic motivation has been shown to mediate transformational leadership and not to mediate entrepreneurial leadership. These results can practically provide leaders with paying attention to intrinsic motivation to increase employee creativity
Well-Being and Innovation: Investigating the Linkage among Well-Being Oriented Management, Knowledge Sharing, Innovation Climate, and Innovative Work Behavior
For businesses to survive, innovation is essential. As a result, business experts and academics engaged in extensive discussions about encouraging creativity in corporate settings. However, most of the present literature focuses on the performance management paradigm when discussing innovation. Innovation is a resource-intensive process that, while it improves corporate performance, drains employees' resources. Thus, evaluating innovation through more critical lenses is needed. Through the lenses of the Theory of Conservation of Resources and Job Demand Resources Model, this research views innovation as a job demand and well-being oriented management as human resource intervention to enhance employee well-being. This intervention provides additional resources for employees to conduct innovation through knowledge sharing and is moderated by innovation climate. Purposive sampling is employed for this research survey and yields 150 valid responses. The data is then analyzed using SEM-PLS. The result shows that well-being oriented management positively influences knowledge sharing, and knowledge sharing positively influences innovative work behavior. Furthermore, knowledge sharing is also proven to mediate between well-being-oriented management and innovative work behavior. Moreover, innovation climate does not moderate the relationship between knowledge sharing and innovative work behavior. The result implies that managers must uphold their staff members' well-being by employing well-being-oriented management
IMPLEMENTASI PENGOSONGAN SUKARELA ATAS GUGATAN PENGOSONGAN TANAH DAN RUMAH DI PENGADILAN NEGERI DENPASAR
The resolution of legal disputes in civil matters involves two main pathways: litigation and non-litigation. Voluntary eviction is one form of non-litigation resolution that involves the voluntary change of ownership status of land and houses following an eviction claim. This research explores the implementation of voluntary eviction in the Denpasar District Court, legal perspectives and community practices, changes in ownership status, as well as tax implications and related legal costs. The research methodology used is normative-empirical legal research with a legislative approach and case analysis. The findings indicate that the court plays a crucial role in approving voluntary eviction and providing legal protection. The implementation of voluntary eviction requires preparation, respect for human rights, and the involvement of law enforcement officials if necessary. Changes in ownership status involve administrative procedures, document updates, and tax obligations. It is important to consider the principles of the rule of law theory and the implementation of law in the execution of voluntary evictio
Perlindungan Hak Pasien Sebagai Konsumen Dalam Rekam Medis
Pengertian rekam medis adalah berkas yang berisikan catatan dan dokumen tentang identitas pasien, pemeriksaan, pengobatan, tindakan, dan pelayanan lain yang telah diberikan kepada pasien. Rumusan masalah: 1) Bagaimana perlindungan hak pasien sebagai konsumen dalam rekam medis, 2) Bagaimana kendala dari perlindungan hak pasien pasien sebagai konsumen dalam rekam medis Penelitian ini akan disusun dengan menggunakan tipe penelitian yuridis normatif. Sumber data yang digunakan adalah data primer dan sekunder. Data sekunder dalam penelitian ini meliputi : Bahan hukum primer, yang terdiri dari : Undang-Undang Dasar Negara 1945, KUHP, KUHAP, Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-undang nomor 36 Tahun 2009 Tentang kesehatan dan Undang-undang nomor 44 Tahun 2009 Tentang Rumah Sakit. Hasil penelitian:1). Perlindungan hak pasien sebagai konsumen dalam rekam medis adalah adanya regulasi yang mengatur dalam Undang-Undang no. 8 Tahun 1999 tentang Perlindungan Konsumen dan Peraturan perundang-undangan dan Peraturan Pemerintah Republik Indonesia Nomor 269/MENKES/PER/III/2008, 2). Kendala dalam perlindungan hak pasien sebagai konsumen dalam rekam medis adalah sebagian besar pasien tidak mengetahui bahwa isi rekam medis merupakan hak pasien yang diatur dalam undang-undang dan penjelasan tentang isi rekam medis hanya boleh dilakukan oleh dokter atau dokter gigi yang merawat pasien dengan izin tertulis pasien
Peranan Brimob Polri Dalam Pengamanan Obyek Vital
Penelitian ini tentang peranan Brimob Polri dalam pengamanan obyek vital dengan permasalahan bagaimana kedudukan dan tugas Brimob Polri dalam hukum positif Indonesia dan bagaimana peran Brimob Polri dalam pengamanan obyek vital tempat ibadah? Pendekatan penelitian ini yakni yuridis normatif yang berdasarkan data sekunder yakni teori-teori hukum pakar dari literatur, buku-buku, rujukan internet. Kedudukan Brimob Kepolisian Negara Republik Indonesia dalam Hukum Positif Indonesia, yaitu sebagai alat negara yang diberi tugas dan wewenang oleh undang-undang untuk memelihara keamanan dan ketertiban masyarakat, menegakkan hukum, serta memberikan perlindungan, pengayoman, dan pelayanan kepada masyarakat dalam rangka terpeliharanya keamanan dalam negeri dalam rangka terwujudnya tujuan hukum pidana. Peran Brimob Polri dalam pengamanan obyek vital merupakan salah satu upaya mewujudkan keamanan dalam negeri yang dilaksanakan melalui kegiatan penjagaan, sterilisasi, patroli guna mengantisipasi ancaman keamanan atau teror dengan bekerja sama dengan otoritas, pihak terkait maupun masyarakat
Konsep Perbuatan Melawan Hukum Dengan Model Pertanggungjawaban Mutlak (Strict Liability) Dalam Penyelesaian Sengketa Konsumen
Law Number 8 of 1999 concerning Consumer Protection regulates legal efforts to resolve consumer disputes through the courts. The lawsuit for damages is based on an unlawful act. The problem is how the concept of unlawful acts is a strict liability model for demanding compensation. The research method used is normative legal research. The results of this study explain that legal remedies through the concept of unlawful acts with this absolute liability model are by interpreting Article 19 paragraphs (1) and (3) of Law Number 8 of 1999. The concept of an unlawful act with a strict liability model is a plaintiff's obligation to prove the existence of a loss without having to prove a mistake. The recommendation is that the Government and the DPR immediately revise Law Number 8 of 1999 by strictly regulating unlawful acts as a legal norm in the law
PENGURANGAN KADAR KARBONDIOKSIDA (CO2) DALAM BIOGAS DENGAN BIOFIKSASI MIKROALGA Chlorella vulgaris DAN Scenedesmus obliquus
Biogas memiliki kandungan utama metana (CH4) sebesar 55-70% dan karbondioksida (CO2) sebesar 25-50%. Kadar CO2 yang tinggi dalam biogas dapat mengurangi nilai bakarnya. Salah satu teknik pengurangan kadar CO2 dalam biogas yaitu dengan biofiksasi menggunakan mikroalga. Biofiksasi merupakan penyerapan CO2 melalui proses fotosintesis. Tujuan penelitian ini adalah mengetahui tingkat penurunan kadar CO2 melalui biofiksasi menggunakan mikroalga, mengetahui pengaruh laju alir biogas dan jenis mikroalga terhadap penyerapan kadar CO2 dan mengetahui laju pertumbuhan mikroalga dalam proses biofiksasi untuk mengurangi kadar CO2 dalam biogas. Bahan baku yang digunakan dalam produksi biogas adalah eceng gondok dan kotoran sapi. Variasi laju alir biogas yang digunakan sebagai variabel pada proses pengurangan kadar CO2 oleh mikroalga ditentukan dari biogas yang terproduksi yaitu laju alir maksimum 6,85 mL/jam dan dua kali laju alir maksimum 13,7 mL/jam. Mikroalga yang digunakan yaitu Chlorella vulgaris dan Scenedesmus obliquus. Parameter yang diamati adalah kadar CO2 dalam biogas sebelum dan setelah biofiksasi, serta laju alir biogas. Pengurangan kadar CO2 dilakukan melalui tiga tahap, dimana penggunaan Scenedesmus obliquus memberikan hasil yang lebih tinggi dibandingkan dengan Chlorella vulgaris. Hasil pengurangan kadar CO2 dengan laju alir dua kali maksimum yaitu sebesar 68,8% oleh Scenedesmus obliquus dan sebesar 49% oleh Chlorella vulgaris
Do Economic Factors Dominate Happiness: A Comparison of Western and Eastern Cultures
This article explores the factors influencing happiness levels and compares them within the contexts of Western and Eastern cultures. It particularly examines the role of income in shaping happiness, with a focus on Western cultures, often associated with materialism, and Eastern cultures, frequently linked to spirituality. The analysis reveals four significant determinants of happiness: economic achievement, social support, health, and the freedom to make choices. While income, measured by per capita GDP growth, contributes to happiness, globally, freedom of choice and social support exert a more substantial influence. This holds true when comparing Europe and North America to Asia (excluding the Middle East) and when contrasting Western and Eastern cultures. The study underscores the significance of social and political factors in achieving happiness, emphasizing the need for prioritizing their development. Furthermore, it challenges the notion that Western cultures are solely materialistic and Eastern cultures entirely spiritual, highlighting the intricacies of cultural differences. In sum, these findings emphasize the need for more comprehensive and diverse research to understand variations within specific cultural and ethnic contexts
