    Polemik Pelaksanaan Putusan Pengadilan Tata Usaha Negara

    The State Administrative Court is expected to be able to give a fair and enforceable decision. However, in reality, there are decisions of the State Administrative Court that are not implemented by the parties who are ordered to implement the judge's decision. With the formulation of the problem of how to implement the execution of the decision of the Palembang State Administrative Court Number 25/G/2022/PTUN. PLG; and how to sanction defendants who do not implement the Court's decision. This article was prepared using the normative juridical method. conclusion that the execution effort is based on the decision of the Palembang State Administrative Court Number 25/G/2022/PTUN. PLG that is not carried out by the defendant can be done by, then an active role of the Plaintiff is required, because it must submit an application to the court. Meanwhile, sanctions can be given to the Village Head (defendant) who does not implement the decision of the Palembang State Administrative Court Number 25/G/2022/PTUN. PLG is a gradual administrative sanction from written reprimand to dismissal based on the provisions of Law number 6 of 2014 concerning Villages and Law Number 30 of 2014 concerning Government Administration, and the parties involved in the mechanism of sanctioning the defendant Village Head involve the Village Consultative Body, Sub-district Head, District Inspectorate, Village Community Empowerment Office, Regent and Palembang State Administrative Court

    This study explores the song The Messenger by Linkin Park through the lens of Halliday's Language Metafunction theory, aiming to uncover its underlying ideology and emotional messages. Utilizing qualitative and descriptive research methods, the analysis focuses on the song's lyrics, examining their Ideational, Interpersonal, and Textual meanings. The results highlight the prominence of specific language processes, including Mental, Material, and Relational, which collectively convey powerful themes of love, hope, and resilience. The Ideational metafunction reveals how the song portrays love as a vital force in overcoming life's adversities, while the Interpersonal metafunction demonstrates how empathetic and supportive language fosters a connection between the singer and the audience. Additionally, the Textual metafunction underscores the structured and cohesive organization of the lyrics, amplifying their emotional impact. The study concludes that The Messenger embodies an ideology that positions love as a source of emotional empowerment and solidarity, providing listeners with comfort and motivation during challenging times. This research contributes to understanding how music serves as a cultural and linguistic artifact that facilitates shared emotional experiences and reinforces resilience

    Penelitian ini membahas permasalahan hukum terkait praktik klinik kecantikan ilegal dengan studi kasus Ria Beauty Clinic. Meningkatnya pertumbuhan industri kecantikan di Indonesia tidak diiringi dengan kepatuhan terhadap regulasi hukum, khususnya dalam bidang kesehatan dan perlindungan konsumen. Praktik medis tanpa izin, penggunaan tenaga medis tidak profesional, dan ketiadaan informed consent menjadi sorotan utama dalam kasus ini. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan terkait, seperti Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Hasil penelitian menunjukkan bahwa praktik Ria Beauty Clinic melanggar berbagai ketentuan hukum kesehatan dan dapat digugat berdasarkan perbuatan melawan hukum (onrechtmatige daad). Penelitian ini merekomendasikan peningkatan pengawasan dan edukasi hukum bagi pelaku usaha di sektor kecantikan untuk melindungi hak-hak konsumen dan mencegah praktik yang merugikan masyarakat

    The challenges faced by Notaries and Land Deed Officials (PPAT) in managing the Land and Building Rights Acquisition Tax (BPHTB) are significant within Indonesia's land administration and taxation system. A major challenge is determining the accurate BPHTB amount due to discrepancies between the recorded Sale Value of Tax Objects (NJOP) and the actual market value of the property. Since NJOP often does not reflect the true market value, it complicates the calculation of BPHTB, impacting accuracy and compliance with tax regulations. Frequent changes in tax policies, such as BPHTB rate adjustments and new administrative procedures, further complicate the tasks of Notaries and PPAT. To address these issues, they must take several strategic steps: regularly updating their knowledge through training and seminars (as per Law No. 30 of 2004 on Notarial Positions), utilizing digital resources like official tax authority websites, and maintaining effective communication with local tax authorities. Additionally, adopting integrated information systems that can be updated with the latest policies is crucial. Joining professional associations like the Indonesian Notaries Association (INI) or the Association of Land Deed Officials (IPPAT) provides valuable updates and training, as outlined in Government Regulation No. 37 of 1998 on the Regulation of Land Deed Officials. Regular internal training and collaboration with tax consultants who have access to the latest information will enhance their ability to adapt to policy changes. By implementing these measures, Notaries and PPAT can better manage policy changes, ensure regulatory compliance, and deliver accurate and reliable services. Their role is essential in supporting transparent tax administration and maintaining the integrity of the land and tax system in Indonesia, thus contributing to sustainable economic development and legal certainty

    Perlindungan Hukum Terhadap Hak Milik Atas Tanah Yang Hilang Akibat Abrasi

    A natural phenomenon known as abrasion can eliminate or reduce land area, especially in coastal areas. The purpose of this research is to find out the legal protection of land ownership rights lost due to abrasion. This article will discuss the legal protection of property rights to land lost due to abrasion, both from the point of view of agrarian law and the practice of Notaries. Legislation, cases, and concepts are used in normative juridical research. The results of the study show that there is a need for more specific and clear arrangements regarding soil abrasion in Indonesian agrarian law, given the uncertainty faced by landowners. Legal protections should be clearly formulated to determine the status of land ownership lost to abrasion and the appropriate mechanism for filing claims or obtaining compensation.  Likewise, the role of Notaries cannot be denied, considering that notaries function as a liaison in legal processes related to land. By providing legal certainty through authentic documents, notaries can help reduce disputes that arise due to loss of property rights

    Kewenangan ASEAN Political-Security Community dalam Menghadapi Klaim Nine-Dash Line China

    This research analyzes the jurisdictional limitations of the ASEAN Political-Security Community (APSC) in addressing China's Nine-Dash Line claim in the South China Sea. Through a qualitative approach examining policy documents and recent academic literature, this study evaluates the effectiveness of instruments developed by APSC such as the Declaration on the Conduct of Parties (DOC) and the Code of Conduct (COC) negotiation process. The findings indicate that APSC's authority is constrained by several fundamental factors: the principles of non-intervention and consensus-based decision-making that create structural weaknesses, limitations in UNCLOS implementation due to China's rejection of the 2016 arbitration ruling, the dilemma of balancing "ASEAN centrality" with the need to involve external powers, and the absence of effective enforcement mechanisms. Based on these findings, this research recommends: (1) development of a regional dispute resolution mechanism based on UNCLOS that can overcome jurisdictional limitations, (2) implementation of a "minilateralism" model involving directly affected ASEAN countries to address consensus barriers, and (3) strengthening APSC's institutional capacity through establishing dedicated monitoring bodies, rapid response protocols for maritime incidents, and integrating non-traditional security approaches as starting points for building trust among conflicting parties

    Increasing Customer Loyalty through Customer Relationship Management, Product Quality, and Digital Marketing

    This study aims to determine the effect of Customer Relationship Management, product quality, and digital marketing on customer loyalty at PT. Tugu Beton Semesta Abadi Semarang. The population used in this study were all companies or organizations that use services from PT. Tugu Beton Semesta Abadi Semarang had 562 companies, while the sample size was 85 respondents. The sampling technique used was purposive sampling. The data source used was primary data, with data collection using a questionnaire. The data analysis technique used was multiple linear regression analysis. The results of the hypothesis test showed that Customer Relationship Management, product quality, and digital marketing had a positive and significant effect on customer loyalty. The coefficient of determination value was 0.655, meaning that Customer Relationship Management, product quality, and digital marketing can explain the variation in customer loyalty variables by 65.5 percent, so it still requires follow-up with further research, especially regarding customer loyalty. The study concludes that CRM, product quality, and digital marketing also have a positive effect on customer loyalty. The suggestions for managers are must increase the technology utilization, improve product innovation development, and enhance digital marketing

    Legal Protection of Health Workers from a Criminal Law Perspective during the Health Crisis in Indonesia

    This study aims to analyze the legal protection of health workers in Indonesia, particularly in light of the enactment of Law No. 17 of 2023 concerning Health. Using a normative juridical approach with statutory and conceptual analyses, the research examines the extent to which existing legal frameworks uphold the principles of legal certainty, due process, and the protection of human rights in the health sector. Legal materials include primary (laws and regulations), secondary (legal literature and expert opinions), and tertiary sources (legal dictionaries and encyclopedias). The findings indicate that Law No. 17 of 2023 offers significant normative progress by explicitly mandating state responsibility for the welfare, safety, and professional development of health workers. It encompasses both preventive and repressive legal protections, aligning with Philipus M. Hadjon’s theory of legal protection. However, practical implementation remains uneven, particularly during health crises such as the COVID-19 pandemic, where health workers experienced verbal abuse, legal threats, and inadequate support. The research concludes that while the legal substance has been improved, the effectiveness of protection depends on concrete implementation mechanisms, such as detailed regulations, supervisory systems, reporting mechanisms, and institutional support at local levels. It recommends the issuance of derivative regulations granting limited legal immunity in emergencies, establishment of legal aid units in health facilities, legal literacy training for health professionals, and a stronger culture of state and societal protection. These steps are essential to ensure that health workers can fulfill their roles safely and ethically, especially during increasingly complex public health emergencies

    Living in an area or moving just for a vacation to another place makes a person feel stressed and confused if they don't know how to face and overcome when they can't adapt. It's called culture shock. Culture shock is the feeling of disorientation experienced by someone who is suddenly confronted with an unfamiliar culture, way of life, or attitude. It can happen when someone who lives in another place has a different culture. This research is based on a film entitled Culture Shock Experienced by Dre Parker where Dre Parker as the main character experiences this culture shock. This study also refers to Oberg who stated the aspects, factors, and phases experienced by Dre. This research was conducted using qualitative methods with observation and documentation to see the film, hear the voice or dialogue and search for scripts related to this film on the internet. The results of the study show that culture shock is not so bad to experience, as long as a person is able to survive and adapt well and correctly in his new environment or culture. Key words: Culture, culture shock, experience

    An Analysis of Code-Mixing in The Indah G Show YouTube Channel

    The common social media platform YouTube has encountered an increase in the practice of code-mixing, which is the use of two or more languages in one conversation. Understanding the function of language in communication, managing language difficulties, intercultural disruptions, and TCK identity crisis in a global environment also relies on code-mixing, a critical sociolinguistic phenomenon. The primary objectives of the study are to look into various types of code-mixing and the reasons why people use it in the video Language Barriers, Culture Shock & TCK Identity Crisis ft. Mella Carli on the Indah G Show YouTube channel. This study used a qualitative approach, with data collected through video transcription. This study used content analysis, focusing on examining all possible types of code-mixing as defined by Muysken and the reason for using code-mixing that was argued by Hoffman. The results of this research, firstly the types of code-mixing which were divided into insertion, alternation, and congruent lexicalization. Secondly, the reasons for using code-mixing which divides into talking about a particular topic, being emphatic about something, quoting somebody else, repetition used for clarification, intentions of clarifying the speech content for the interlocutor and expressing group identity. According to the results, alternation is the most common type of code-mixing, and talking about particular topic for the reason.Â
