Civil Liability for Artificial Intelligence in Electronic Contracts: A Conceptual Framework in Indonesian Law
The integration of Artificial Intelligence (AI) into electronic contracts introduces new legal challenges, particularly regarding civil liability for losses caused by algorithmic errors or system failures. This study aims to examine the mechanisms for enforcing such liability within the Indonesian legal framework by analyzing both tort-based responsibility and contractual liability arising from electronic transactions. Using a normative juridical method supported by statutory, conceptual, and comparative approaches, this research evaluates the relevant legal provisions, liability principles, and international practices. Under Article 1365 of the Civil Code, parties controlling or benefiting from AI may be held liable if negligence leads to harm. Meanwhile, the electronic information and transactions Law and Government Regulation 71 of 2019 provide the foundation for contractual claims, including obligations related to system reliability, data integrity, and digital audits. The findings show that enforcing liability requires clear causal proof, algorithmic transparency, and the ability to assess both material and non-material losses. Comparative cases such as Deloitte Australia, DoNotPay, and OpenAI demonstrate the global relevance of due diligence, algorithm auditing, and human accountability. This study concludes that Indonesia’s existing legal framework offers adaptive mechanisms for addressing AI-related losses, while emphasizing the need to strengthen regulatory clarity and accountability standards in the digital era

This research examines the prevalence of online fraud in e-commerce transactions conducted through the social media Facebook. Legal protections, as outlined in the Consumer Protection Law and the ITE Law, play an important role in addressing this challenge by providing avenues for victims to obtain redress and hold perpetrators accountable. Preventive measures, including public awareness campaigns and platform accountability, are critical to mitigating risks. This study underscores the need for collaborative efforts between government agencies, e-commerce platforms, and consumers to create a safer digital marketplace. The research contributes to the understanding of the dynamics of online fraud and offers insights to improve legal frameworks and enforcement strategies to protect consumers. Peran Syahbandar dalam Melaksanakan Persetujuan Berlayar terhadap Keselamatan Pelayaran
Syahbandar memiliki peran yang sangat penting dalam menjaga keselamatan pelayaran di Indonesia, salah satunya adalah melalui mekanisme penerbitan Surat Persetujuan Berlayar (SPB). Pemberian SPB kepada kapal-kapal yang akan berlayar merupakan bagian dari upaya untuk memastikan bahwa kapal tersebut memenuhi persyaratan teknis dan administratif yang telah ditetapkan. Penelitian ini bertujuan untuk mengkaji lebih dalam peran Syahbandar dalam melaksanakan persetujuan berlayar dan dampaknya terhadap keselamatan pelayaran. Metode yang digunakan dalam penelitian ini adalah studi literatur dan wawancara dengan sejumlah pihak terkait di bidang pelayaran. Hasil penelitian menunjukkan bahwa meskipun peran Syahbandar sangat krusial dalam menjamin keselamatan pelayaran, terdapat beberapa tantangan dalam implementasinya, seperti keterbatasan sumber daya dan kurangnya koordinasi antar instansi terkait. Oleh karena itu, perlu adanya peningkatan kapasitas sumber daya manusia serta perbaikan infrastruktur pelabuhan guna mendukung tugas-tugas Syahbandar dalam memastikan kapal berlayar dengan aman dan memenuhi standar keselamatan yang berlaku
Prospects for Regulating a Dog Meat Consumption Ban in Indonesia: A Comparative Study with Taiwan
The rapid development of the pet industry in Indonesia has been accompanied by an increase in unethical dog trade practices, ranging from exploitation in breeding to cruelty in distribution and slaughter. This study aims to examine how the form and substance of regulations prohibiting the consumption of dog meat based on the Taiwan Animal Protection Act (TAP) are implemented in Taiwan and how they can be applied in Indonesia. The normative legal method used in this study is an approach comparing Indonesian and Taiwanese regulations. The results of this study show that the TAP explicitly prohibits the consumption, sale, and killing of dogs. They also impose heavy criminal and administrative sanctions and enforcement mechanisms used by animal protection inspectors and local government agencies. In contrast, law enforcement in Indonesia relies on Article 302 of the Criminal Code and Law Number 18 of 2009 concerning Animal Husbandry and Health because there is no clear law regulating the consumption of dog meat. Therefore, Indonesia needs to implement special regulations such as TAP or laws to close legal loopholes and improve animal welfare protection, especially for protection against the sale of dog meat consumption
Analisis Yuridis Terhadap Implementasi Jaminan Kesehatan Nasional (JKN) dalam Perspektif Hukum Kesehatan di Indonesia
Indonesia's healthcare system underwent a significant transformation with the launch of the National Health Insurance Program (JKN) in 2014. JKN aims to ensure equitable access to healthcare for all citizens, in accordance with the principles of social justice and the right to health. While the program offers a solution to address disparities in healthcare services, its implementation faces challenges, such as limited health facilities, delays in claim payments, and perceived lower quality of care for JKN participants. These issues raise questions about the effectiveness of existing regulations and their impact on equity in access to health services. This study uses a normative juridical approach to analyse regulations and provide recommendations for improvements in JKN implementation. By understanding the existing legal and administrative constraints, it is hoped that JKN can function more optimally in realizing the health welfare of the Indonesian people
Environmental Crime Enforcement in Indonesia: Ultimum and Primum Remedium Perspectives
Environmental law enforcement in Indonesia continues to face significant challenges despite severe ecological and socio-economic impacts caused by environmental degradation. A key issue is the tendency to treat criminal law as primum remedium, leading to excessive criminalisation, whereas environmental law principles emphasise criminal sanctions as ultimum remedium. This imbalance weakens the role of administrative and civil instruments that are essential for achieving effective environmental restoration. This study aims to critically analyse the appropriate positioning of ultimum remedium and primum remedium within Indonesia’s environmental law enforcement framework and to identify the challenges encountered by law enforcement officials. Using a normative juridical method, it adopts a conceptual and legislative approach while examining legal doctrines and selected court decisions on environmental crimes. The findings indicate that although criminal sanctions remain crucial as deterrents, prioritising them as the main enforcement tool may undermine more substantive efforts toward ecological recovery. Strengthening administrative and civil mechanisms offers a more proportional and sustainable approach. The study concludes that Indonesia must clarify parameters for applying criminal sanctions and enhance synergy across legal instruments to realise effective environmental protection and ecological justice
The Role of ESG (Environmental, Social, Governance) on Dividends and Firm Value: The Moderation Effect of Audit Quality
This research will examine the influence of ESG (Environmental, Social, Governance) and its components on dividends and firm value. Furthermore, the quality and credibility of information in the market will also influence stakeholder assessments. The important role of audit quality in providing assurance on this information is needed. By using multiple linear regression on 252 firm years from companies listed in IDX 2020-2023 that meet the sample criteria, it was found that ESG has not been able to significantly influence dividends and firm value. However, environmental can influence dividends in a positive way, while governance can influence firm value in a negative way. Even though dividends and audit quality can influence firm value in a positive way, audit quality still cannot increase the influence of dividends on firm value. Audit quality also cannot increase the influence of ESG on dividends. In this case, inefficient ESG practices followed by poor audit quality are the main factor of this insignificant influence. It takes time for ESG investments to influence company performance, which has an impact on high dividend payout ratios and firm value
BUDAYA HUKUM PADA PENGEMUDI KENDARAAN BERMOTOR TERHADAP KESELAMATAN LALU LINTAS
Keselamatan berlalu lintas merupakan kebutuhan dasar manusia yang berkaitan dengan hak untuk hidup dan merasa aman. Namun, tingginya angka kecelakaan lalu lintas di Indonesia menunjukkan masih rendahnya budaya hukum pengemudi. Penelitian ini bertujuan untuk menganalisis potret budaya hukum pengemudi kendaraan bermotor di Indonesia dan faktor-faktor yang mempengaruhinya terhadap keselamatan lalu lintas. Metode penelitian yang digunakan adalah dengan pendekatan yuridis sosiologis dan memanfaatkan Teori Sistem Hukum Lawrence M. Friedman. Hasil penelitian menunjukkan bahwa budaya hukum pengemudi di Indonesia masih rendah, ditandai dengan kurangnya pengetahuan dan pemahaman hukum lalu lintas, sikap yang mengabaikan keselamatan, serta perilaku yang cenderung melanggar aturan. Faktor-faktor yang mempengaruhi budaya hukum pengemudi meliputi faktor internal (usia, jenis kelamin, tingkat pendidikan, pemahaman agama, dan pengalaman berkendara) dan faktor eksternal (lingkungan sosial, penegakan hukum, kondisi infrastruktur jalan, dan akses terhadap informasi serta edukasi lalu lintas). Upaya perbaikan budaya hukum pengemudi perlu dilakukan secara komprehensif dan berkelanjutan melalui peningkatan efektivitas penegakan hukum, optimalisasi program edukasi dan sosialisasi, penguatan peran serta masyarakat, pemanfaatan teknologi, serta kerjasama antar stakeholder
Peran Pemerintah Dalam Mengatasi Penyalahgunaan Dana Aspirasi Dan Dampaknya Terhadap Kesejahteraan Masyarakat Di Kabupaten Pati
This study discusses the strategic role of the government in overcoming the misuse of aspiration funds and its impact on the welfare of the community in Pati Regency. Aspiration funds, which should be used for development and public services, are often misused for personal or certain group interests, thereby hindering equitable development and lowering public trust in the government. Through a qualitative approach with interviews and observations, it was found that the misuse of aspiration funds had a negative impact in the form of financial losses, development inequality, and degradation of public participation. This research highlights the importance of strengthening regulations, harmonizing policies, increasing transparency and accountability, and active community involvement in supervision. In addition, innovative solutions such as the implementation of information technology and the establishment of an independent supervisory team are key in creating clean and effective governance of aspiration funds. This research recommends synergy between the government, the community, and supervisory institutions for the realization of accountable public fund management that is in favor of the welfare of the people
