AKIBAT HUKUM PERJANJIAN JUAL BELI ATAS TANAH YANG BERSTATUS KEPEMILIKAN ASET BEKAS MILIK ASING/TIONGHOA (STUDI KASUS PUTUSAN NOMOR 806 PK/Pdt/2017
Pada tahun 1967, aset Perkumpulan THHK dan Hok Siang Kong diambil alih negara sebagai Aset Bekas Milik Asing/Tionghoa dan menjadi Barang Milik Daerah. Aset yang disengketakan diberikan kepada Tergugat I-VI berdasarkan SK Penguasa Dwikora Daerah Jatim No. KEP 06/2/1967 tanggal 11 Februari 1967, dan diserahkan oleh Kementerian Keuangan kepada Pemkot Mojokerto pada 25 Januari 2011. Tahun 1990, aset tersebut diperjualbelikan dengan status tanah HGB No. 96 dan Hak Pakai, meskipun masa berlakunya telah habis sejak September 1980. Penggugat mengajukan gugatan di Pengadilan Negeri Mojokerto pada 2013 hingga Peninjauan Kembali pada 2017. Rumusan masalah yang diangkat meliputi: 1). Bagaimana Status aset yang berupa tanah atas kepemilikan aset bekas asing/tionghoa yang termasuk dalam organisasi Esklusif Rasial; 2). Bagaimana dasar pertimbangan hakim terhadap kasus jual beli atas tanah yang berstatus kepemilikan Aset Bekas Milik Asing/Tionghoa; 3). Apa akibat hukum dari kasus jual beli atas tanah yang berstatus kepemilikan Aset Bekas Milik Asing/Tionghoa. Dalam penelitian ini digunakan pendekatan yuridis normative,penelitian mempergunakan data sekunder dalam bentuk bahan hukum primer dan sekunder. Hasil penelitian ini: 1) status aset berupa tanah bekas milik asing/Tionghoa yang termasuk dalam organisasi eksklusif rasial telah ditetapkan sebagai tanah negara dan diserahkan kepada Pemerintah Kota Mojokerto, sebagaimana ditegaskan dalam Keputusan Menteri Keuangan tahun 2011; 2)Â Mahkamah Agung dalam peninjauan kembali tidak menemukan kekeliruan yang nyata dalam putusan kasasi. Oleh karena itu, pertimbangan yang diajukan oleh Pemohon Peninjauan Kembali dianggap tidak beralasan. Hak atas tanah objek sengketa telah berakhir sejak 23 September 1980. Oleh karena itu, jual beli yang dilakukan setelah tanggal tersebut dianggap cacat hukum karena pihak penjual tidak memiliki hak untuk mengalihkan tanah tersebut. 3) Akibat hukum terhadap Status Jual Beli Aset Bekas Milik Asing/Tionghoa Mahkamah Agung berpendapat bahwa tanah sengketa telah ditetapkan sebagai barang milik Negara berdasarkan Keputusan Menteri Keuangan dan SK Penguasa Pelaksana Dwikora Daerah Jawa Timur sebagai Aset Bekas Milik Asing/Tionghoa, sehingga hak atas tanah tidak dapat dialihkan melalui jual bel
Interplay between Income Inequality and Corruption in ASEAN
Corruption contributes to rising income inequality by worsening access to social services, education, and economic opportunities. This study aims to examine the relationship between corruption and income inequality. Panel data was used to analyze six ASEAN countries over the period 2013-2022 with the main variables including Gini Ratio, economic growth, government spending, population, tax revenue, government effectiveness, and Corruption Perception Index (CPI). The results show that income inequality and corruption significantly affect each other. High inequality increases the risk of corruption, while corruption worsens income distribution. Other variables such as population, tax revenue, and government effectiveness also contribute to this dynamic. The study highlights the importance of effective redistribution policies and strengthened governance to reduce inequality and corruption, creating greater social and economic stability. Therefore, an integrated and complementary policy approach between reducing inequality and fighting corruption is key in creating cleaner and fairer governance
Integration of Pancasila Values in Industrial Relations: A Trade Union Perspective in Multinational Companies
 This article analyzes the role of the Unit Leadership Council (PUK) of SP LEM SPSI at PT Steel Center Indonesia in developing industrial relations based on Pancasila values. The study emphasizes the integration of ideological foundations and practical strategies in advocating for workers' rights and fostering harmonious work relations. A qualitative descriptive method is employed, gathering data through observation, interviews, and document study. The findings reveal that PUK functions not only in normative roles within Collective Labor Agreement (CLA) negotiations but also as a transformative social agent through economic advocacy programs and social collaboration. Pancasila values are implemented through organizational activities such as bipartite communication, cadre consolidation, and cooperative management. These results demonstrate that trade unions can become a collective force not only to protect rights but also to promote social justice and sustainable welfare in the workplace
PEMANFAATAN LIMBAH TATAL ALUMINIUM DALAM PRODUKSI GAS HIDROGEN DENGAN KATALIS NAOH
Abstrak Krisis energi global dan peningkatan emisi gas rumah kaca mendorong pencarian sumber energi alternatif yang bersih dan berkelanjutan. Namun, produksi hidrogen yang konvensional masih bergantung pada bahan bakar fosil, sehingga diperlukan metode yang lebih efisien dan ramah lingkungan. Hidrogen sebagai sumber energi bersih berpotensi mengurangi emisi karbon dan mendukung target net zero emission (NZE), sejalan dengan Kebijakan Energi Nasional yang menargetkan 23% bauran energi dari sumber terbarukan pada 2025. Salah satu pendekatan yang menjanjikan adalah pemanfaatan limbah tatal aluminium sebagai sumber hidrogen. Limbah ini banyak dihasilkan dari industri manufaktur, terutama dari proses pengecoran, pemotongan, dan pembubutan aluminium. Dengan memanfaatkan limbah tatal aluminium untuk produksi hidrogen, tidak hanya menyediakan sumber energi alternatif, tetapi juga membantu mengurangi volume limbah padat yang mencemari lingkungan. Reaksi antara aluminium dan air dapat menghasilkan gas hidrogen, namun reaksi ini terhambat oleh adanya lapisan oksida pelindung pada permukaan aluminium. Untuk mengatasi hambatan ini perlu menggunakan katalis agar dapat mempercepat reaksi dengan melarutkan lapisan oksida tersebut dan meningkatkan laju pelepasan hidrogen. Penelitian ini mengkaji produksi gas hidrogen melalui reaksi limbah aluminium dengan NaOH, dengan variasi suhu dan massa aluminium. Hasil menunjukkan bahwa suhu reaksi berpengaruh signifikan terhadap laju dan volume hidrogen yang dihasilkan. Yield tertinggi sebesar 5,96% dicapai pada suhu 90°C dan 20 gram aluminium. Reaksi lebih efisien pada suhu tinggi, namun peningkatan massa aluminium tidak selalu meningkatkan yield karena keterbatasan NaOH dan terbentuknya lapisan pasif. Pemanfaatan limbah aluminium terbukti menjanjikan sebagai solusi energi alternatif dan pengurangan limbah padat. Kata Kunci : Hidrogen; Aluminium; NaOH; Gas Hidroge
LAW ENFORCEMENT OF 2024 ELECTION OFFENCES IN CONSTITUTIONAL LAW PERSPECTIVE: A CASE STUDY
Research discusses the challenges and problems faced in law enforcement related to offences of the 2024 simultaneous general elections in Indonesia with a focus on Central Java Province. Through a constitutional law approach, this study explores how Badan Pengawas Pemilu (Bawaslu) plays a role in enforcing the law and preventing offences. The method used in this research is normative juridical with empirical and statutory approaches. Data were collected through a qualitative method by analyzing cases of offences that occurred in Central Java. The results showed that in law enforcement against election offences, Bawaslu Central Java Province focuses on efforts to prevent election offences, with handling offences as the last step if prevention fails. Handling of election offences can come from two sources: namely supervision by election supervisors and reports from the public. If the offence is registered, Bawaslu conducts clarification and if proven, the criminal case is forwarded to the police and the Gakkumdu center, while code of ethics offences are submitted to DKPP and for administrative offences, Bawaslu holds an examination hearing that results in a binding decision. Bawaslu in handling election offences is faced with three challenges, namely multi-interpretive election rules, criminal allegations and a culture of people who are reluctant to report. Constitutional law plays a role in setting clear procedures, such as clarification by Bawaslu, investigation by Sentra Gakkumdu and examination hearings for administrative offences. In practice, justice and consistency in the application of sanctions are still needed, strengthening firmer regulations, increasing institutional capacity and legal protection for reporters
The Influence of Culinary Quality and Café Atmosphere on Repurchase Intention: The Medition role of Consumer Satisfaction
This study aims to determine the effect of culinary quality and café atmosphere on repurchase intention, directly and indirectly through consumer satisfaction. The population used is all consumers who have made purchases at the Makan Minum Khu Mijen Semarang cafe, with a sample size of 85 respondents. The sampling technique used is accidental sampling. The data source used is primary data, with a data collection method using a questionnaire. The data analysis technique used is path analysis and the Sobel test. The results of the hypothesis test obtained that culinary quality has a positive and significant effect on consumer satisfaction, and café atmosphere has a positive and significant effect on consumer satisfaction. Culinary quality has a positive and significant effect on repurchase intention, café atmosphere has a positive and significant effect on repurchase intention, and consumer satisfaction has a positive and significant effect on repurchase intention. The results of the Sobel test show that consumer satisfaction can mediate the effect of culinary quality and café atmosphere on repurchase intention. The conclusion states that culinary quality and café atmosphere positively affect consumer satisfaction and repurchase intention. Managers should involve the variable of culinary quality in the promotion on social media marketing
TRANSFORMASI TEKNOLOGI INFORMASI DALAM MENDUKUNG PROSES PEMILIHAN KEPADA DAERAH YANG DEMOKRATIS
Regional Head Elections are one of the main pillars of democracy in Indonesia. A fair, transparent, and efficient regional election process is very important to ensure legitimacy and public trust in the results of general elections because currently the election process is often considered not transparent so that the results are considered less than satisfactory. Therefore, innovation and breakthroughs are needed that can support the regional election process, which can increase the number of people participating in casting their votes, and the results can be received as well as possible. Information technology (IT) has great potential in supporting the implementation of democratic regional elections by improving various aspects, starting from voter registration, including updating the voter list, to the final stage of vote counting. This study aims to explore how information technology can be used to support democratic regional elections. The main focus of this study is on the identification and analysis of technology that can increase transparency, accountability, public participation, and security of the regional election process. This research method uses a qualitative approach with a literature review method. Data was collected from various sources, including scientific journals, news articles, and comparative studies of IT implementation in elections in various countries
Urgensi Penerapan Sistem Identifikasi Sidik Jari Nasional dalam Penegakan Hukum di Indonesia
This study examines the urgency of implementing a national fingerprint identification system in law enforcement in Indonesia. The research problem is the lack of a comprehensive and integrated fingerprint database in Indonesia, hindering effective criminal investigation and identification. This study uses a normative juridical approach, analyzing relevant laws and regulations related to fingerprint identification and criminal justice systems. The study found that a national fingerprint identification system is crucial to improve the accuracy and efficiency of criminal investigations, prevent identity fraud, and enhance national security. The implementation of such a system will significantly benefit law enforcement agencies in identifying suspects, tracking criminals, and solving crimes
Employee Retention Factor at IT Startup Company: Job Satisfaction as Mediating Variable
This study analyzes factors that have implications for employee retention in IT-Startup companies. This study aims to explain factors that contribute to employee retention with job satisfaction as a mediating variable. Employer branding, psychological contract, organizational commitment and job environment are predictors of employee retention. This quantitative study applied a purposive sampling technique, involving 350 employees in IT startup companies as respondents. They were employees who have worked for the company for at least 3 years, held at least a staff-level position, and work in an IT startup company. Data were analyzed using Structural equation modeling (SEM) to depict the direct and indirect effects of the factors on employee retention. Job satisfaction was examined as the mediating variable. The study showed that the employer branding, organizational commitment, and job environment directly affected employees’ job satisfaction. These three variables also indirectly affected employee retention. Meanwhile psychological contract was found not to directly affect employees’ job satisfaction and not to indirectly affect the employee retention IT startups are recommended to improve their psychological contract in order to enhance the employees’ job satisfaction. Employees’ professionalism and contribution are pivotal in improving the company’s business quality. Organizations should be able to meet employees’ need comprehensively according to the business achievement
Legal Analysis of Marriage Agreements After the Constitutional Court Decision Number 69/PUU-xiii/2015
This study aims to analyzes changes in the legal status and legal protection of prenuptial agreements before and after Constitutional Court Decision Number 69/PUU-XIII/2015. A comparative approach is used to evaluate the impact of this decision on the regulation of joint property, the rights and obligations of husband and wife, and the legal validation mechanism and legal protection for injured parties. The results show that the Constitutional Court decision expanded freedom of contract by allowing prenuptial agreements to be drawn up during the marriage, thereby strengthening flexibility and legal certainty. Furthermore, the validation mechanism now involves notaries and courts to ensure legality and protection for the weaker party and children. The implications of this decision not only increase justice and gender equality in marriage but also positively impact the business and banking worlds through the separation of personal and joint property. However, challenges such as a lack of publicity and technical guidelines still need to be addressed for this decision to be optimally implemented in family law practice in Indonesia
