Pengaruh Ratifikasi UNCAC Terhadap Kebijakan Antikorupsi di Indonesia
Get PDFPenelitian ini menganalisis pengaruh ratifikasi Konvensi Perserikatan Bangsa-Bangsa Menentang Korupsi (UNCAC) terhadap perkembangan kebijakan antikorupsi di Indonesia sejak tahun 2006. Dengan skor Indeks Persepsi Korupsi yang bertahan di angka 34/100 pada tahun 2022, Indonesia terdorong untuk mengadopsi standar internasional melalui UNCAC. Metode yang digunakan adalah yuridis normatif yang dipadukan dengan pendekatan deskriptif-analitis, dengan mengkaji dokumen hukum, regulasi kebijakan, dan laporan kelembagaan. Hasil menunjukkan bahwa ratifikasi UNCAC telah secara signifikan memperkuat kerangka hukum antikorupsi di Indonesia melalui reformasi kebijakan, penguatan lembaga seperti KPK dan PPATK, serta peningkatan kerja sama internasional dalam pemulihan aset. Namun, tantangan masih terjadi pada tahap implementasi, antara lain ketidaksesuaian regulasi, fragmentasi kelembagaan, keterbatasan kapasitas sumber daya manusia, serta budaya korupsi yang mengakar. Penelitian ini berkontribusi secara teoretis dengan menjelaskan keterkaitan antara hukum internasional dan kebijakan nasional, serta secara praktis dengan menawarkan rekomendasi untuk meningkatkan efektivitas strategi antikorupsi di Indonesia
Nexus between Cryptocurrency Markets and Hedge Funds in Period Before and During Russia-Ukraine War
Get PDFThe purpose of this study is to identify the pre- and post-war impact of the Russia-Ukraine war on the interaction between cryptocurrencies, cryptocurrency hedge funds, and traditional hedge funds. This study provides a deeper understanding of how geopolitical events can affect the behavior of financial markets involving cryptocurrencies and hedge funds. In addition, this study also seeks to fill the knowledge gap that exists in the current literature, specifically with regards to hedge fund strategies during specific geopolitical conflicts. This study utilizes secondary data involving the cryptocurrency hedge fund index, global hedge fund index, and eight proposed hedge fund strategies. The study period runs from February 2018 to July 2023. Granger Causality Test and ARDL used in this study. The finding shows that there is a significant relationship between cryptocurrency hedge funds and conventional hedge funds. Statistical analysis revealed cointegration between cryptocurrency hedge funds and conventional hedge funds, indicating a significant long-term relationship. This study identified a significant impact of changes in market behavior before and after the Russia-Ukraine war on cryptocurrency hedge funds
The Role of Consumer Trust as Mediation Between Live Streaming Shopping on Online Purchase Decisions in Sukabumi City
Get PDFThe rapid development of social media presents opportunities for business actors. Beyond serving as communication tool, social media enables businesses to build relationships and interact with potential customers to expand market reach. One popular feature is TikTok live streaming, widely used as an online marketing strategy due to its ability to reach wider audience. However, wide reach alone does not guarantee consumer trust. This study aims to examine the mediating role of customer trust in the relationship between live streaming shopping on online purchase decisions. Using a quantitative explanatory method, the study involved 238 respondents of Sukabumi City residents, selected through purposive sampling and measured using a differential semantic scale. Data were analyzed using Structural Equation Modelling (SEM-Amos 22). The results show that live streaming shopping has a direct negative and significant effect on online purchase decisions. Furthermore, the customer trust successfully mediates the relationship between live streaming shopping on online purchase decisions. This means customer trust is the most important factor during live streaming, as it can drive online purchase decisions.Therefore, live streaming based marketing strategies should focus on building positive perceptions, transparency, and credibility to establish consumer trust. Thus, the consumers trust have will drive online purchase decisions
Pertanggungjawaban Pidana Kecelakaan Lalu Lintas Akibat Pengemudi Mabuk dalam Perspektif Hukum
Get PDFTraffic accidents caused by drunk drivers are a complex legal issue in the criminal justice system in Indonesia. This study aims to analyze criminal liability for drivers who drive drunk and cause accidents, as well as review legal considerations in Supreme Court Decision Number 177 K/Pid/2022. This research uses a normative juridical method with a legal and case approach. The results of the study show that even though the defendant is proven guilty under Article 310 paragraph (3) of the LLAJ Law, the sentence imposed by the judge is lighter than the maximum threat stipulated in the law. This raises a debate about the effectiveness of sanctions in providing a deterrent effect. In conclusion, this case shows a gap in the justice system that allows for lighter sentences even though there is an element of deliberate and knowingly possible in the defendant's action

Get PDFStudi ini menyelidiki pilihan strategis antara perlindungan paten dan doktrin rahasia dagang melalui kasus ikonik Formula 7× Coca-Cola. Meskipun paten memberikan eksklusivitas selama dua puluh tahun, paten tersebut memerlukan pengungkapan penuh, sedangkan rahasia dagang dapat bertahan tanpa batas waktu asalkan kerahasiaannya terjaga. Dengan menggunakan metode yuridis normatif, penelitian ini meneliti sumber-sumber Indonesia, internasional, dan perusahaan, merekonstruksi perlindungan historis yang diadopsi oleh The Coca-Cola Company, dan mengevaluasi kompatibilitasnya dengan risiko era digital kontemporer. Temuan penelitian mengungkapkan bahwa (1) kontrol kontraktual, fisik, dan digital berlapis telah memungkinkan Formula 7× mempertahankan eksklusivitas komersial selama lebih dari satu abad; (2) hukum Indonesia telah memberikan perlindungan yang sebanding, namun penegakan dan kepatuhan dalam usaha kecil hingga menengah masih lemah; dan (3) matriks keputusan yang menyeimbangkan risiko rekayasa balik, siklus hidup produk, dan biaya pengungkapan menawarkan kepada perusahaan alat praktis untuk memilih antara paten dan rahasia dagang. Studi ini menyumbangkan kerangka kerja berskala yang dapat memandu para pembuat kebijakan dan pelaku bisnis dalam memperkuat keunggulan kompetitif sambil menyelaraskan dengan norma-norma kekayaan intelektual internasional yang terus berkembang

Get PDFThe execution of decisions in environmental crime cases, particularly those related to the management of Hazardous and Toxic Waste (B3), often faces various obstacles due to legal vacuums that hinder the implementation of penalties. Legal reform in this context becomes crucial to ensure that law enforcement against environmental violations can operate effectively and justly. This research employs a normative juridical method with an approach to legislation, case studies, and conceptual analysis. Data is obtained from legal literature reviews as well as the analysis of court decisions related to environmental crimes. This study discusses the reform efforts needed to address legal vacuums, focusing on improving regulations and decision execution mechanisms. Various challenges faced in executing decisions on environmental crimes are also outlined, including limited resources, unclear technical regulations, and lack of coordination among related institutions. With the right reforms, it is expected that there will be an increase in effectiveness in environmental protection through more stringent enforcement against violations of hazardous waste management

Get PDFThis Research with the title Authority Of State Institutions (Analysis Of Arrangement Authority General Election Organizers In Accordance Normative Proposition) examines the arrangement coordination Election Organizers according to normative proportionality. Based on Law No. 17 of 2017 concerning General Elections. This research is a type of normative or doctrinal legal research, which uses two questions, namely: invitation agreement (statute approach), and accessing history (historical approach). The source of legal material in this study was obtained from legal basis material (legislation) and secondary legal materials (opinions / interviews of related figures). The method of analysis in this study uses systematization of legal material (classification makes it easy to analyze the articles) and uses qualitative descriptive in describing the content of the legislation. The results of the study concluded, First, According to Law No. 7 of 2017 concerning General Elections, the respective authorities are as follows: KPU as Election implementers, Bawaslu as Election Implementation Supervisors, and DKPP as bodies that examine and decide complaints or report the alleged violations a code of ethics which also compensates for the decisions (checks and balances) of the performance of the KPU and Bawaslu. It's just that in practice, Election Organizers are still overlapping. This is by the author, based on a review of the data based on several factors, namely: 1) Understanding of each individual's authority, which is still lacking, 2) There is intervention and pressure from other parties, 3) There is a desire to be superior, 4) Less DKPP stated firmly in every case
Hukum dan Etika Deepfake Urgensi Regulasi Khusus atas Konten Manipulatif di Media Sosial dalam Konteks Demokrasi Digital
Get PDFThe proliferation of deepfake technology, powered by artificial intelligence, presents a growing threat to digital democracy by enabling the spread of highly realistic manipulated content that can distort public perception, undermine trust, and disrupt electoral integrity. This study critically examines the urgency of establishing specific legal regulations for deepfake content in Indonesia, where existing cyber laws remain too general to address the nuances of AI-generated disinformation. Employing a qualitative normative-legal approach and comparative analysis with legal frameworks in the United States, South Korea, and the European Union, the research identifies a significant regulatory gap and offers a multidimensional framework that integrates legal, ethical, and democratic perspectives. The findings reveal that Indonesia lacks a clear definition and legal category for manipulated content, resulting in insufficient legal protections for individuals and institutions vulnerable to digital deception. The study proposes a context-sensitive model of regulation that aligns with international best practices and responds to Indonesia’s legal and sociopolitical realities. This research contributes to the discourse on digital law by offering a novel regulatory scheme capable of addressing the ethical and democratic challenges posed by deepfake technology
The Role of Digital Marketing and Relationship Marketing in Purchasing Decisions
Get PDFThis study aims to analyze the influence of digital marketing and relationship marketing on consumer purchasing decisions on the Shopee e-commerce platform. With the development of technology and increasing internet usage, Digital Marketing has become one of the effective marketing strategies to reach consumers more widely. Meanwhile, relationship marketing plays an important role in building customer trust and loyalty. This study uses a quantitative method by collecting data through a questionnaire distributed to 76 respondents, consisting of Management and Accounting students from 2021 to 2024 at the University of 17 Agustus 1945 Semarang. Data analysis was carried out using multiple linear regression analysis through SPSS version 30 software to test the hypothesis in this study. The results of the analysis show that there is a significant positive influence of digital marketing on purchasing decisions, and relationship marketing also has a positive impact on purchasing decisions. This research concludes that digital marketing and relationship marketing have a positive and significant influence on purchasing decisions. Furthermore, the study recommended that Shopee continue to optimize its digital marketing strategy, especially through quality promotions, free shipping programs, and flash sales that have proven to attract consumer interest
PEMANFAATAN PATI KULIT SINGKONG DAN SELULOSA BONGGOL PISANG SEBAGAI BAHAN BAKU PEMBUATAN BIOPLASTIK
Get PDFPenggunaan plastik sintesis dapat memberikan dampak buruk pada lingkungan, sehingga diperlukan alternatif kemasan yang mudah terurai, seperti bioplastik. Kandungan pati pada kulit singkong dan kandungan selulosa pada bonggol pisang berpotensi untuk dibuat plastik biodegradable. Pemilihan bahan-bahan ini didasarkan pada kemampuannya untuk lebih mudah terurai di lingkungan dan ketersediaan bahan bakunya yang melimpah. Penelitian ini bertujuan untuk menghasilkan bioplastik berkualitas dari pati kulit singkong dan selulosa bonggol pisang sesuai standar SNI, serta melihat pengaruh penambahan plasticizer berupa gliserol. Tahapan penelitian meliputi persiapan pati dari kulit singkong, persiapan selulosa dari bonggol pisang, serta membuat bioplastik menggunakan campuran 5 gram pati kulit singkong, dengan memvariasikan selulosa (0%; 15%), variasi gliserol (3, 4, dan 5 ml), dan variasi suhu (105°C; 115°C). Hasil uji karakteristik bioplastik yang dihasilkan mencakup biodegradasi 83,69% dan kuat tarik 149,87 MPa pada komposisi gliserol 5 ml dan suhu 115  sudah sesuai standar SNI No. 7188. 7: 2016 sedangkan elongasi, ketahanan air, dan ketebalan bioplastik belum sesuai standar SNI. Kata Kunci: Kulit singkong; Plastik biodegradable; Selulosa bonggol pisan
