ANALISIS PENERAPAN PRINSIP GOOD GOVERNANCE: EFEKTIVITAS PELAYANAN PENGADUAN MASYARAKAT DI SEKRETARIAT JENDERAL DPR REPUBLIK INDONESIA
Public service is a form of realization in conducting government administration. In this case, the public complaint service carried out by the Secretariat General of the DPR RI as a support for the DPR RI institution has tried to carry out its duties as much as possible. However, it cannot be denied that the condition of the complaint service certainly has obstacles or challenges in implementing and achieving effectiveness according to the principles of good governance. Therefore, the purpose of this research is to find out the extent to which the conditions of public complaints services have been carried out, see the effectiveness in accordance with the principles of good governance, and evaluate any challenges that become obstacles in realizing the principles of good governance. This research uses an empirical juridical method with a socio legal research approach conducted at the Public Complaints Section at the Secretariat General of the DPR RI, and obtains primary and secondary data to be analyzed with a qualitative descriptive method. The results and discussion show that the current governance condition of the implementation of public complaints services has been running well according to the legal basis that regulates it, its effectiveness with the principles of good governance has also been realized even though through several challenges, but these challenges become a form of evaluation for future service progress to be more optimal
Perlindungan Hukum Bagi Kreditur Dalam Perjanjian Kredit Yang Terjadi Wanprestasi Di BPR Muncul Artha Sejahtera Semarang
One of the efforts made by creditors to address non-performing loans is through the auction of collateral secured or encumbered by a mortgage right. This study raises two main issues: fisrt how is legal protection provided to creditors in credit agreements that experience default with collateral in the form of mortgage rights at BPR Muncul Artha Sejahtera Semarang? And second What obstacles are encountered in the implementation of legal protection for creditors in such credit agreements, and what are the solutions? This research employs a normative legal research method with a descriptive-analytical specification, aiming to describe applicable legal norms and assess their implementation without drawing general conclusions. The findings indicate that legal protection for creditors in defaulted credit agreements with mortgage collateral at BPR Muncul Artha Sejahtera Semarang is implemented through several stages: rescheduling, reconditioning of interest burden, restructuring, and the sale of the mortgage collateral. The bank encounters obstacles in executing the sale of mortgage collateral, but continues to inform the debtor, in accordance with the credit agreement, that the collateral will be sold to fulfill the debtor’s obligation to repay the debt. As a solution, the debtor is given the opportunity to settle the debt or sell the collateral independently
Descriptive Analysis of the Fear of Missing Out (FOMO) Phenomenon: The Bitcoin Trading Decisions of Students in Semarang City
The Fear of Missing Out (FOMO) phenomenon in crypto asset trading activities such as Bitcoin is increasingly prevalent among the younger generation, especially students. This study aims to describe the level of FOMO experienced by students in Semarang City who actively trade Bitcoin and the factors that influence it. The research method used is a quantitative approach with a descriptive survey design. Data collection was carried out by distributing Likert-based questionnaires to 100 students aged 17 to 23 years spread across various universities in Semarang City. The results showed that most respondents experienced moderate to high levels of FOMO, which were triggered by social media factors, peer influence, and market price volatility. This study is expected to be the basis for wiser digital financial education among students
Implementation of Criminal Sanctions as Ultimum Remedium in Article 100 of Law Number 32 of 2009 concerning Environmental Protection and Management
Criminal law enforcement against environmental violations serves as the last step (ultimum remedium) used when administrative sanctions are proven to be unable to stop violations. This study aims to analyze the application of the principle of ultimum remedium and assess the suitability of the application of Article 100 paragraphs (1) and (2) in Law Number 32 of 2009 concerning Environmental Protection and Management in cases of environmental pollution carried out by PT. Trisan Abadi. This study uses a normative juridical method with a case study approach. The results of the study show that the relevant agencies have first issued administrative sanctions through Decree Number 660.31/Kep.412-DLH/2020. However, because business actors do not comply with the sanctions and violations occur again, criminal sanctions are then imposed. The application of the articles used has met the elements of the law, including the imposition of responsibility on corporations as legal subjects. These findings show that although the principle of ultimum remedium has been implemented in accordance with the provisions, its effectiveness still needs to be improved through stricter supervision, training for law enforcement officials, and inter-agency synergy. These measures are important to have a deterrent effect and ensure sustainable environmental protection
Optimization of Land Certificates Through Tax Settlement in the PTSL Program in Central Maluku
This study analyzes the effectiveness of these mechanisms in supporting land certification optimization in Central Maluku Regency. Using an empirical juridical approach, the research combines legal analysis with field data from interviews and document studies. Findings indicate that obstacles to tax settlement include unclear tax calculations, limited public understanding of taxes beyond Land and Building Tax (PBB), low-income community conditions, difficulties with online payments, and discrepancies between tax data and SPPT. Despite these challenges, PPh and BPHTB settlement can be carried out through two main mechanisms: payment at the Tax Office (KPP) or the Regional Revenue Office (Dispenda) according to applicable formulas. Once taxes are validated and registered at the land office, land certificates can be issued and utilized for economic purposes. Beyond serving as proof of ownership, land certificates can act as collateral for financing, enabling owners to improve productivity and access economic opportunities. Overall, land certification not only provides individual benefits but also contributes to economic stability and sustainable development
Tinjauan Hukum Ekonomi Islam Terhadap Pelacakan Status Industri Produk Halal
The halal industry has grown rapidly, with approximately 1.8 billion global consumers and an annual transaction value reaching USD 650 million. Demand for halal products is increasing, making halal certification, halal standards, and halal traceability systems key factors in ensuring the halal status of food products. Indonesia, with an 87.2% Muslim population, has a large halal market and the potential to become a global halal economic hub. In this context, a halal traceability system is a crucial element in ensuring the integrity of halal products throughout the supply chain, from raw materials to consumers. Accurate information technology and documentation are key enablers in implementing this system. This study aims to examine the dynamics of the implementation of a halal traceability system and evaluate its role in halal product assurance in Indonesia, taking into account the contribution of Islamic economic law. The study also explores the challenges in implementing this system and how it can support the growth of the halal industry. Using a normative and analytical legal approach, this study hopes to provide policy recommendations to strengthen the halal assurance system, in accordance with Sharia principles, and support Indonesia as a major player in the global halal industry
The Threat of Artificial Intelligence to the Accounting and Management Profession: The Vital Role of Higher Education Institutions in Indonesia
The rapid development of Artificial Intelligence (AI) has raised global concerns about the automation of white-collar jobs. In Indonesia, this debate is urgent due to the high volume of standard clerical and cognitive jobs that are vulnerable to automation. This study aims to identify and analyse the threat mechanisms of AI to two strategic professions in accounting and management, and to formulate a comprehensive curriculum transformation agenda for higher education institutions. This study uses a literature review approach by reviewing literature from academic databases, industry reports (WEF, McKinsey, PwC, WordBank), and local data (e.g., the World Bank's Indonesia's Online Vacancy Outlook) from 2018 to 2025. The data was analysed using qualitative descriptive method. The results indicate that the threat of AI is shifting from total professional substitution to automation of routine tasks, which risks eliminating entry-level positions. The findings confirm that successful professions are those that transformation from compliance-based to AI-powered strategic advisors. This transformation requires accounting and management curricula to focus on data analytics, AI ethics, and critical thinking, moving away from the focus on basic calculations or procedures
ANALISIS RISIKO HUKUM DALAM BISNIS AGEN UMROH TIDAK BERIZIN DAN STRATEGI PENANGGULANGANNYA MENURUT HUKUM POSITIF INDONESIA
Indonesia sebagai negara dengan populasi Muslim terbesar di dunia memiliki peran strategis dalam penyelenggaraan ibadah haji dan umrah. Antusiasme masyarakat terhadap ibadah umrah yang meningkat setiap tahun telah membuka peluang besar bagi biro perjalanan, namun sekaligus memunculkan praktik ilegal oleh agen umrah tidak berizin. Fenomena ini menimbulkan berbagai persoalan hukum, seperti penipuan, kegagalan keberangkatan, hingga pelanggaran hak jamaah. Regulasi dalam Undang-Undang Nomor 8 Tahun 2019 dan Peraturan Menteri Agama Nomor 6 Tahun 2021 telah mengatur penyelenggaraan umrah secara normatif, implementasi di lapangan masih menemui berbagai hambatan, baik struktural maupun kultural. Penelitian ini bertujuan untuk mengidentifikasi risiko hukum dari praktik agen umrah ilegal, mengevaluasi efektivitas perlindungan hukum yang tersedia bagi jamaah, serta menawarkan strategi penanggulangan berdasarkan hukum positif Indonesia. Dengan menggunakan pendekatan yuridis normatif dan analisis empiris, studi ini menyoroti kesenjangan antara norma hukum (das sollen) dan praktik sosial (das sein), serta pentingnya reformulasi kebijakan hukum yang lebih komprehensif. Artikel ini memberikan kontribusi teoritis dalam penguatan literatur hukum perlindungan konsumen dan praktis dalam upaya peningkatan sistem perlindungan hukum bagi jamaah umrah di Indonesia
The Importance of Money in Shaping Employee Intention to Stay In Small Businesses: The Moderating Roles of Growth Mindset and Caring Climate
Employee retention is a critical challenge for small and medium enterprises (SMEs), particularly in developing economies like Indonesia, where financial constraints and high turnover rates jeopardize organizational stability. This study investigates the relationship between monetary importance and intention to stay, moderated by caring climate and growth mindset. Using purposive sampling, data were collected through an online survey from 198 employees of small businesses in Central Java, all of whom had worked for their organizations for at least one year. The data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) to test the proposed hypotheses. The results revealed that monetary importance did not have a significant direct effect on intention to stay. However, caring climate positively moderated this relationship, enhancing retention through a supportive and empathetic workplace environment. In contrast, growth mindset negatively moderated the relationship, suggesting that employees with a strong growth orientation prioritize non-financial motivators such as professional development opportunities. These findings highlight the importance of tailoring retention strategies to individual and contextual factors, combining financial incentives with non-monetary approaches. This study contributes to the literature on retention strategies by integrating organizational and psychological perspectives within the SME context
KONTRIBUSI HUKUM ADAT DALAM PEMBAHARUAN DAN PEMBANGUNAN HUKUM WARIS NASIONAL
Indonesia sebagai Negara yang berpenduduk muslim terbesar di dunia mempunyai problematika yang unik. Dalam kehidupan masyarakat ada sebagian orang yang menggunakan sistem kewarisan adat, hukum kewarisan barat dan ada pula yang menggunakan kewarisan Islam. Dalam pembentukan hukum waris nasional di Indonesia, kiranya kita tidak dapat memungkiri bahwa bangsa Indonesia adalah bangsa yang kaya akan adat istiadat yang sangat bermacam-macam dan dalam hukum adat itu telah mempunyai aturan atau ketentuan-ketentuan mengenai hukum kewarisan juga, sehingga perlu dalam pembaharuan hukum kewarisan nasional di Indonesia hendaknya tidak mengesampingkan aturan kewarisan adat. Hal ini dikarenakan masyarakat Indonesia masih sangat menjunjung tinggi adat istiadat mereka yang merupakan warisan dari para leluhur mereka.Â
