Approaching the Maqashid Sharia of Marriage from the perspective of Al-Qur'an Fiqh
Placing marriage from the perspective of divine norms (Fiqh al-Qur'an) is a logical and spiritual reference that is always relevant for humans. According to the Qur'an, desires are paired with the instincts of all creatures, including humans. The confirmation is in surah Yasin/36: 36 and al-Zariyat/51: 49. The repetition of the word "marriage" in the Qur'an along with three other words that are equivalent in meaning to the word marriage (zauj, istimta', and ma 'aqadat aymanukum) establishes five meanings in the word marriage, namely sexual intercourse, strong bond, pairing, uniting, and gathering. The use of the word marriage in the Qur'an is only directed at humans. Before the hijrah, the marriage verses that came down talked more about the philosophical meaning and purpose of marriage. After the hijrah, the marriage verses talked more about technical matters of marriage, such as details about which women could and could not be married. In addition, three main things are maqashidunnikah according to the Qur'an, namely: 1) A means of channelling lust that is permitted by religion/sharia; 2) A way to maintain human descendants on earth so that their civilisation remains sustainable and is protected from extinction; 3) A medium to achieve peace of life (sakinah) and happiness in the world and the hereafter. This finding is relevant to the theory of maqashid sharia that marriage is part of hifzhuddin, hifzhunnafs and hifzhunnasl, all of which are included in daruriyyat for humans. This paper contribute to reinterprets the meaning of marriage in the Qur'an as an integration of spiritual, social, and maqashid sharia values in human life.Keywords: Maqashid Sharia, Marriage, al-Qur'an Fiq
Analisis Hukum Kepemilikan Saham Non-Muslim Pada Perusahaan Syariah Menurut Pandangan Imam Syafi’i
This study examines Imam al-Shafi'i’s perspective on non-Muslim share ownership in Muslim-owned companies through a library research method. The primary focus is to explore classical fiqh views on modern economic phenomena, particularly regarding the concept of syirkah (partnership) and interfaith share ownership. Data collection was conducted through a critical review of primary sources, including Imam al-Shafi'i’s classical fiqh texts, and secondary sources consisting of contemporary literature discussing Islamic economic thought. The research applies a qualitative approach using descriptive-comparative analysis to interpret Imam al-Shafi'i’s views in the context of modern muamalah (economic transactions). Data analysis was carried out using content analysis by identifying, categorizing, and interpreting fundamental concepts in Imam al-Shafi'i’s thought related to partnership and share ownership. The findings show that Imam al-Shafi'i offers a comprehensive approach to non-Muslim share ownership, considering core Sharia principles, business integrity, and economic impact. He emphasizes the importance of evaluating business objectives, ownership proportions, and fairness in interfaith business transactions. This research contributes to the development of contemporary fiqh understanding in Islamic economics, especially within the increasingly complex context of economic globalization. This research aims to determine the Arabic speaking ability of Ma'had Al-Jami'ah IAIN Kendari students. This research uses a qualitative method with a descriptive qualitative approach. Data was collected using interview techniques, observation, tests and documentation. Data analysis in this research was carried out in three stages, namely: data reduction, data presentation, and drawing conclusions. Checking the validity of the data in this research was carried out using the following steps: source triangulation, technical triangulation, and time triangulation. The results of this research show: (1) speaking learning at Ma'had Al-Jami'ah IAIN Kendari is carried out by carrying out association and identification exercises and conversation exercises in the form of questions and answers, memorizing dialogue models and free conversation. 2) indicators of female students' speaking ability class of 2020, namely mastery of pronunciation, mastery of language structure, mastery of vocabulary, fluency in speaking and ability to understand the person you are speaking to. 3) There are 2 factors that influence speaking ability, namely internal factors which include physical factors and motivation, and external factors which include teaching methods, teachers who teach and the environment
PERAN KANTOR URUSAN AGAMA (KUA) DALAM PEMBINAAN DAN PELESTARIAN KELUARGA MUSLIM
Penelitian ini bertujuan untuk mengetahui peran, metode, faktor pendukung dan penghambat KUA dalam pembinaan dan pelestarian keluarga muslim. Jenis penelitian ini adalah kualitatif deskriptif. Hasil penelitian menunjukkan bahwa, peran KUA dalam pembinaan dan pelestarian keluarga muslim yaitu sebagai pengelola sistem data, melakukan inisiasi awal pembentukan keluarga muslim, melakukan pembinaan pra nikah melalui kursus calon pengantin dan pasca nikah dilakukan bimbingan kegiatan keluarga sakinah dan menjadi mediator konsultasi keluarga, pembinaan pelestarian keluarga melalui kegiatan keagamaan yaitu majelis ta’lim, ceramah dan pengajian. Metode pembinaan dan pelestarian keluarga muslim dilakukan melalui dua jenis metode pembinaan yaitu pembinaan individu dan kelompok. Faktor penddukung pembinaan dan pelestarian keluarga muslim, yaitu adanya rumah ibadah/masjid, lengkapnya fasilitas kantor, tokoh-tokoh agama, adanya kegiatan rutin, dan antusiasme masyarakat untuk mengikuti kegiatan dan bimbingan untuk pembinaan keluarga muslim. Faktor penghambatnya yaitu lembaga BP4 yang belum berfungsi dan belum adanya SK kepengurusan, tidak adanya fasilitas kendaraan yang disediakan untuk operasional kerja, kurangnya bantuan Al-Qur’an dan tugas atau surat tugas lainnya yang diberikan kepada penyuluh
PERAN PENYULUH AGAMA ISLAM DALAM MENCEGAH MOMBOLASUAKO (KAWIN LARI) PADA MASYARAKAT DESA TAWAINALU, KABUPATEN KOLAKA TIMUR
Penelitian ini bertujuan untuk mengetahui bagaimana peran penyuluh agama Islam dan program yang dilakukan dalam mencegah mombolasuako (kawinlari) pada masyarakat Desa Tawainalu Dusun IV Kec Tirawuta Kab Kolaka Timur serta faktor penghambat dan pendukung penyuluh dalam program pencegahan praktik kawin lari. Jenis penelitian yang digunakan oleh penulis pada penelitian ini adalah penelitian kualitatif. Hasil penelitian ini menunjukkan bahwa tiga peran penyuluh agama islam dalam mencegah mombolasuako yaitu peran informatif dan edukatif, peran konsultatif serta peran advokatif dengan menggunakan berbagai metode penyuluhan seperti sosialisasi, ceramah agama di majelis ta’lim dan pemberian nasihat-nasihat saat acara pernikahan. Faktor pendukung penyuluh agama Islam dalam mencegah kawin lari adalah adanya kerjasama pemerintah setempat dan penyuluh yang memiliki kompetensi memenuhi standar penyuluhan untuk turun di masyarakat. Dan faktor penghambat adalah kurangnya jumlah penyuluh sehingga membutuhkan waktu yang lama dalam menyelesaikan masalah yang ada di masyarakat
A Translation Study of Manipulation Speech Acts in WandaVision and Doctor Strange in the Multiverse of Madness
Manipulation is a form of utterance that has hidden intention (illocutionary force), which is included in a branch of pragmatics. When performing manipulative speech, the speakers influence their victims’ minds so that they can respond the way the speakers want. Therefore, the speakers use manipulation strategies to achieve their intentions. This study aims to identify the manipulation strategies used by the characters in the WandaVision drama series and Doctor Strange in the Multiverse of Madness movie. It also examines the translation aspects of the subtitles from English to Indonesian based on translation techniques theory by Molina and Albir (2002), as well as the rule of translation quality assessment made by Nababan, et al (2012). Data analysis in this study uses the document analysis method and Focus Group Discussion involving three raters who are experts in pragmatics and translation theories. The results show that the characters in WandaVision drama series and Doctor Strange in the Multiverse of Madness movie used all 13 manipulation strategies, whose theory was initiated by George K. Simon (2010). Meanwhile, in terms of translation, the translator chose to be more orientated towards the target language, as proved by the dominance of techniques used, such as established equivalence, variation, implisitation, and paraphrase. The overall quality of the translation results is considered very good by the raters, and there are only two types of translation shifts found. The study hopes to serve as a reference for manipulation speech acts, offering valuable insights regarding the strategies to do manipulation and how the topic of manipulation in fictional works can be studied through a translation perspective
The Influence of Spiritual Leadership and Self Efficacy on Work Engagement Mediated by Character Building in Students' Islamic Boarding School Organizations
This study was conducted with the aim of analyzing and determining the effect of spiritual leadership and self-efficacy on work engagement mediated by character formation in Islamic boarding school student organizations. This study is a quantitative study with an explanatory type with a hypothesis formulation between variables. The population of the study was students of the Al-Hikmah Al-Fathimiyyah Merjosari Islamic Boarding School in Malang City. The sampling technique used was purposive sampling technique totaling 60 people. Data collection techniques used were interviews, observations, questionnaires and documentation. Data analysis used descriptive statistical analysis and SmartPLS 4.0 application techniques. Based on the hypothesis in this study, the results of the study showed that spiritual leadership had an effect but was not significant on work engagement. But for self-efficacy, it had a significant effect on work engagement. TAGUVESTASI: Revolutionizing Halal Agriculture Through Blockchain-Integrated Sharia P2P Lending Platform for Sustainable Green Economy Development
This study introduces Taguvestasi, an innovative blockchain-integrated digital platform that addresses critical challenges in Indonesia's agricultural sector through Sharia-compliant Peer-to-Peer (P2P) lending. With 38.23 million people (29.76% of the workforce) engaged in agriculture yet facing persistent poverty due to limited capital access and marketing constraints, there is an urgent need for technological intervention aligned with Islamic principles. Through qualitative descriptive analysis, this research examines how Taguvestasi's blockchain-integrated platform optimizes halal agriculture while promoting green economy principles. The platform incorporates eight key features: funding applications, portfolio management, training programs, halal certification assistance, agricultural news, technical support, marketplace integration, and smart contract implementation. Our findings demonstrate that Taguvestasi successfully bridges the gap between farmers and investors through Sharia-compliant P2P lending, while its blockchain integration ensures transparent, secure transactions and smart contract execution. The platform's innovative approach not only addresses capital accessibility issues but also promotes sustainable agricultural practices, contributes to farmer empowerment, and advances green economy objectives. This research contributes to the growing body of knowledge on Islamic financial technology's role in sustainable agricultural development and provides practical insights for implementing blockchain-based Sharia-compliant financing solutions
Evaluating the Compliance of Shopee Paylater and Shopee Paypinjam with Islamic Finance Principles: Ethical Challenges and Opportunities in Fintech
This study analyzes the operational mechanisms of Shopee Paylater and Shopee Paypinjam to evaluate their compliance with Islamic finance principles. The research aims to address critical concerns regarding interest rates, late fees, and transparency, which challenge adherence to Sharia ethics. A qualitative approach was employed, utilizing case studies and semi-structured interviews with users, supported by secondary data analysis. Findings reveal significant non-compliance with Islamic finance principles due to the imposition of interest and late payment penalties, both considered forms of riba. Furthermore, ambiguous repayment terms and hidden fees undermine the clarity and fairness central to Islamic financial practices. The study highlights that while these fintech services offer convenience and accessibility, they fail to align with the ethical requirements valued by Muslim consumers. The research contributes to the understanding of fintech’s role in Islamic markets, emphasizing the need for profit-sharing models, enhanced transparency, and Sharia-compliant regulatory frameworks. These findings have practical implications for fintech providers aiming to design ethical financial products, as well as policymakers and Sharia boards seeking to foster trust and inclusion in digital financial ecosystems. Future studies are encouraged to explore comparative analyses across regions and the perspectives of diverse stakeholders
EFL Students’ Communication Strategies Used in Online and Face-to-Face Contexts: A Narrative Review
ABSTRACTThe English language is widely spoken worldwide and is the primary medium of cross-communication in international and intercultural contexts. This study is intended to analyze (1) the types of communication strategies (CSs) used by EFL students when they face the communication problem with the interlocutors and (2) the most frequent CSs used by EFL students when they interact in both face to face (F2F) and online contexts. This research applied a narrative review study with analysis content as a qualitative methodological approach. In total, there were 38 relevant articles reviewed, which consisted of 30 articles for F2F and 8 articles for online context. The current study used typology by and Nakatani, (2014) to analyze the CSs’ types. The results revealed that EFL students employ 34 various CSs; however, fillers strategy is the most frequent CSs used in the F2F environment. Meanwhile, the code-switching strategy is the most commonly used in an online environment. Thus, this research has implications for foreign language teaching in higher education for both lecturers and students. Lecturers may design activities and lessons that focus on practicing and developing students' proficiency in using various CSs.Keywords: Communication strategies; EFL students; face-to-face environment; online contex
