Get PDFThis article discusses the legal status of a child born from an embryo transfer from a woman who donors the egg to another woman who provide the womb. From Islamic law perspective, a child born from embryo transfer to another woman's womb belongs to the mother who gave birth to her, even though the egg is not from her. This then impacts on the inheritance status whereby the child can inherit from the mother who gave his/her birth, and vice versa. Meanwhile, positive law regards the child is the legal heirs of the parent who have the seed because they are the legal parent of the child pursuant to the agreement that has been agreed by the partie

Get PDFThe development of science grows rapidly. However, this phenomenon raises a huge impact for Muslims. It has been our behavior that distinguish between Moslem Science and other knowledge. There is a discriminative treatment against the two types of science. Muslims are divided into those who have positive perception of the Islamic sciences, and negative to other, or vice versa. Based on the reality, Al-Faruqi says that there is no other way to raise Islam, except to reassess the culture of Islamic scholarship in the past, present and modern scholarship as well, and then process them into scientific to be a mercy to the world through what called "integrated science". From the background, the purposes of this study are 1) To know the concept of science integration Ismail Raji al-Faruqi sight. 2) To know the method implementation of the science integration concept in Ismail Raji al-Faruqi sight. This research uses descriptive-analysis method. Descriptive method tries to explain the concepts of Ismail Raji al-Faruqi thought about the science integration. While the analysis technique used is a combination among deductive, inductive, and interpretation. After the research completed, it could be concluded that the Science Integration Concepts in Ismail Raji al-Faruqi sight shows us that science is not value-free and must be based on the method of monotheism. Tauhid principle should be the basic or the main foundations in the development of science in Islam. So that, it shows us to the development of community beneficial. The idea of science Islamisation is one solution to overcome the people problems. The ideas are implemented in 12- work plan steps in Science Islamisation program

Teaching English as A Foreign Language at Madrasah Ibtidaiyyah: Facts and Challenges
Get PDFThe mastery of English as a tool of communication among nations, cultures, and people around the globe is an undeniable fact. This is just like an unstoppable virus spreading worldwide. It is rather difficult to emerge new languages to stop or even just to slow down the wide use of English. Islam world also needs to follow this by equipping its people with English as a communication tool. As Arabic is used for the communication inside Islam, English is needed to communicate Islam to other people around the earth both to Muslims or Non-Muslims. Teaching English has become an increasingly significant element in Islamic education. For this, the issue of teaching English at madrasah is an important concern for practitioners in the area of TEFL in Islamic institutions. This paper will explore the writer’s ten-year experience in teaching English at a madrasah ibtidaiyyah in Cirebon, West Java-Indonesia. The conditions that will be pictured are the culture, the students, the teaching and learning process, and the outcome of the current practices in madrasah ibtidaiyyah, mainly in the area of TEFL. Then, all these conditions will be contrasted to up to date research findings and theories so that the facts and the challenges can be clearly seen. This will also be seen from the perspective of current curriculum in Indonesia, namely curriculum 2013, which bears contradictions with the presence of it. In fact, the curriculum 2013 eliminates English as a subject learned at primary school level. What madrasah ibtidaiyyah will do in the next coming years can direct the expected outcome of the teaching of English at this level. Kinds of program that can be designed to empower the state of English mastery are an essential case to discuss. This all facts and challenges can provide insights so that people working in and with madrasah ibtidaiyyah understand and are ready to face the global communication era
The Effect of Transcribing on Elementary Iranian EFL Learners’ Listening Comprehension
Get PDFThis study is motivated by the gap existing between theory and practice in teaching listening. Most of the techniques used to teach listening put more emphasis on top-down processing while listeners’ problems are more of perceptive ones (bottom-up). In order to address the pervasive decoding problem in listening, this study suggests using transcribing exercise as an input enhancement device and investigates its effect on beginning learners’ listening ability. To this end, 31 learners participated in the study. The control group did not have any transcribing practice while the experimental group received transcribing exercise. In the data analysis step, an independent samples t test was employed to compare the two groups. The results show that transcribing has a significant positive effect on beginning learners’ listening comprehension. The findings of the study as well as advantages of transcribing exercise are discussed. Implications of the study and scope for future research are also addressed

Get PDFMeskipun para mahasiswa menganut agama Islam dan sudah mempelajari serta memahami tentang ilmu faraid/fiqh mawaris, namun di sisi lain, mereka juga mempelajari Hukum Perdata yang tentunya cara pembagiannya berbeda dengan cara yang ada dalam hukum kewarisan Islam. Di samping itu, para mahasiswa tersebut juga berasal dari latar belakang suku yang berbeda, sehingga kemungkinan besar juga akan sangat berpengaruh terhadap cara pandang mereka dalam menganalisis dinamika hukum kewarisan yang ada di Indonesia.Berdasarkan latar belakang tersebut, maka rumusan masalah dalam penelitian ini adalah: Bagaimanakah pandangan mahasiswa Program Studi Hukum Keluarga (HK) Jurusan Ilmu Syariah Fakultas Syariah IAIN Samarinda terhadap dinamika hukum kewarisan yang ada di Indonesia ?Untuk menjawab masalah di atas, maka dilakukanlah penelitian lapangan (field research). Penelitian ini menggunakan pendekatan yuridis normatif sosiologis. Penelitian ini merupakan penelitian kualitatif, oleh sebab itu maka teknik pengumpulan data yang dilakukan adalah teknik observasi dan wawancaraHasil penelitian menunjukkan bahwa ada tiga (3) pandangan mahasiswa terhadap dinamika hukum kewarisan yang ada di Indonesia; Pertama; sebagian mahasiswa menganggap meskipun ada dinamika hukum kewarisan di Indonesia, tetapi mereka tetap berkeyakinan bahwa hukum kewarisan berdasarkan hukum Islam adalah yang lebih adil. Kedua; Sebagian mahasiswa menganggap bahwa setiap warga negara Indonesia dapat memilih di antara ketiga cara tersebut dalam menyelesaikan permasalahan kewarisan dalam keluarga mereka sesuai dengan kesepakatan di antara ahli waris dan dianggap adil menurut mereka. Tetapi yang paling baik itu adalah bagi warga negara yang beragama Islam, hendaklah membagi harta warisan berdasarkan hukum Islam. Kalau mereka ingin membagi harta warisan berdasarkan hukum adat maupun KUH Perdata/BW, hendaklah setiap ahli waris harus terlebih dahulu mengetahui bagiannya masing-masing berdasarkan hukum Islam, agar tidak ada yang merasa dirugikan. Ketiga, sebagian mahasiswa menganggap bahwa adanya dinamika hukum kewarisan di Indonesia ini adalah sebuah keniscayaan. Intinya adalah musyawarah mufakat. Kalau mereka sudah mencapai sebuah kesepakatan, maka pembagian warisan dapat dilakukan
DUMPING DALAM PERSPEKTIF HUKUM DAGANG INTERNASIONAL DAN HUKUM ISLAM
Get PDFThis paper discusses the views of international commercial law and Islamic law against the practice of dumping. Dumping is the practice of selling a product in export destination countries at a price below the normal price which aims to dominate the market abroad. Dumping is often made by a country to capture the international market, so it is the case that is high figure in international trade. Indonesia is ranked five on charges of dumping. Dumping is the practice of dishonest trading, but the dumping was not prohibited by the WTO. Importing countries can apply anti-dumping duties against dumping of products to prevent or reduce the effects of serious losses on similar domestic products. Islam recognizes the term dumping by the term 'siyasah al-ighraq' or slam the price. In contrast to world trade law, Islam prohibits the dumping as in the provision of the Prophet hadith, because it will cause misery or bankruptcy of producers of similar goods

No full textTidak dipungkiri adanya orang yang mampu menggunakan banyak bahasa, orang yang memahami lebih dari satu bahasa dikenal dengan nama “bilingualism” ( ,)اsementara itu, orang yang mampu berkomunikasi dengan lebih dari satu bahasa dikenal dengan nama “bilingualitas” ( اCD). Menurut para ahli, bahwa orang yang menguasai dua bahasa atau bilingualism tidak semuanya mampu menggunakannya dalam komunikasi sehari-hari. Oleh karena itu, seorang penutur dua bahasa hanya mampu menggunakan satu bahasa dengan baik selama dia dalam kondisi atau tempat tertentu, dan akan mampu berkomunikasi dengan bahasa kedua ketika berada di tempat lain (daerah atau negara penuturnya), apakah dia berada di daerah tersebut dalam waktu singkat ataupun dalam waktu yang lama. Maka kelompok bilungualisme akan mampu berkomunikasi dengan dua bahasa (bilingualitas) setelah melalui latihan dan pembiasaan dalam beberapa tahun.Kata Kunci: Bilingualism, Bilingualitas, Dua Bahas

Polarized Discourse in the Egyptian News: Critical Discourse Analysis Perspective
Get PDFThe aim of this study is to investigate ideological structures of polarized discourse coded in the reports of two online news websites: egyptindependent and ikwanweb . The study focuses on online news reports relating to three interrelated events: the issuing of a constitutional declaration by Egyptian president, the aftermath clashes outside presidential palace and the issuing of the Egyptian draft constitution. The analysis of these reports is conducted within the framework of Critical Discourse Analysis. The features of the ideologies of polarized discourse are traced through: Quotation patterns and Labeling. The study concludes with a discussion of how both websites establish a dichotomy of we versus them. In addition, the reports of each website marginalize the other through what is termed as ' Absent News'
