Stabilizing Muslim Marriages: Some Reflections on Ethical Dimension of Family Law Reform

    No full text
Marriage breakdowns and family instability with their debilitating after-effects on women and children are the hallmark of greatly mechanized global community at present time. To remedy the situation, social scientists have diagnosed a multitude of variables as the precursor for the upward trends in marriage breakdowns and family disintegration. In Malaysian context, women`s financial independence, easy access to multimedia and early marriage are among the factors which account for the rising phenomenon of divorce even during the early years of marriage among Muslims.  To remedy the situation, marriage counseling, law reform and pre-marriage courses are mostly emphasized by both mainstream legal scholars and women right activists. It is my considered opinion that these formalistic approaches if not integrated with the emphasis on ethical side of Islamic law may cause more marriage breakups than enhancing families.  The bigger issues in terms of ethical management of Muslim family, such as marriage fidelity, sense of commitment to care for women and children, and spousal mutual empathy and responsibility may help a great deal in acculturating our society from early childhood to adolescence and through adulthood. The paper, therefore, argues for the more concentrated ethical approach for addressing the underlying causes of marriage disability in order to give more effect and meaning to the existing formalistic social and legal measures by reforming Muslims` mindset and outlook towards family. An Evaluation Paradox: The Issues of Test Validity in the Realm of Writing Test as the Final School Examination in the Indonesian Senior High School Milieu

Even though there are four English language skills in the Indonesia’s national curriculum at upper secondary schools, each of these skills is given an unequal emphasis since only reading and listening skills are formally tested in the national examination. Although writing competence possesses a particular stake as the determinant of students’ achievement after students undergo a three-year education at the upper secondary school level, it appears that the existing writing tests are low in terms of test validity, as demonstrated by a preliminary study. A further study is carried out to probe the issues of test validity by deploying the framework of test validity, which pertains to theory-based validity, context validity, scoring validity, criterion-related validity, and consequential validity in the scrutiny of the existing writing tests. It is revealed that the current writing tests are fraught with validity problems in all of these facets of test validity. This is corroborated by interview data in the preliminary study and the analysis of the existing writing tests. These particular issues obviously evoke an ambivalence between the exalted educational objectives in the national curricula and the edifice of English assessment. Based on the findings, several implications and directions rise for future praxis of writing assessment

Guidance to the teacher's essence is an act of giving assistance to improve his ability in running the learning process. The reason for coaching is given to the teacher is that the ability of the teacher must always be improved especially in the techniques related to the learning process that must be executed. The failure of teachers in the learning process is more due to the ability of teachers who are still low in the science of teaching. It may be that the teacher has had enough qualifications or even master's degrees, but is still weak in his teaching. So the ability of teachers in running a quality learning process is still low. Despite lacking formal form of organization like other Islamic organization in general, the members of the Tablighi Jamaat is well known for their loyalty and discipline in implementing the principles of the organization, especially regarding the organizations’ guidelines on conducting da’wa to Muslims with different religious background such as madhab affiliation. This paper, therefore, aims at explaining the strategy of performing da’wa applied by the Tablighi Jamaat in plural social settings. Findings suggest that the Tablighi Jamaat utilized the notion of equality as its most important principle of da’wa. The idea of equality is actualized through several mechanism like madhab fluidation, desacralization of madhab and demadhabization. In this context, every member of the Tablighi Jamaat has the same opportunity to be da’I (preacher) as well as to be mad’u (audience). Keywords: Tablighi Jamaat, Strategy of Da’wa, Desacralization, Demadhabization and Madhab Fluidation
