Between Protection and Permissiveness: A Fiqh Siyasah Reexamination of Marriage Dispensation in Indonesia
Child marriage is still an ongoing systemic problem in Indonesia, reflected in the high number of marriage dispensation applications in the Religious Courts each year. Although various studies have addressed this issue from the perspective of legal reform, procedural law, and Islamic legal theories such as maqāṣid al-sharī'ah and sadd al-dharī'ah, not many studies have highlighted the issue of justice within the framework of fiqh siyasah. This article aims to examine whether the regulation of marriage dispensation in Indonesia has reflected substantive justice for children, using a normative-critical approach through an analysis of three main legal instruments: Law No. 16/2019 on Marriage, Supreme Court Regulation No. 5/2019, and Child Protection Law No. 35/2014. Basing the analysis on the principles of fiqh siyasah-such as benefit, prevention of harm, and justice in legal governance-the study found a fundamental contradiction between the ideal of child protection and a legal structure that is permissive of the practice of child marriage. The administrative nature of the marriage dispensation mechanism and the lack of clear reasons tend to legitimize social and family failures rather than address them. This study recommends a reinterpretation of dispensation regulations within the ethical-political paradigm of Islamic law as well as systemic harmonization of family law regulations in Indonesia to ensure maximum protection for children
Adultery Offenses in Indonesia's New Penal Code: Examining the Influence of Islamic and Customary Law
This study examines the influence of Islamic and customary law on the formulation of adultery provisions in the newly recodified Penal Code. The revision of the Criminal Code has sparked controversy, particularly regarding the regulation of adultery, with critics arguing that the new provisions are heavily influenced by Islamic and customary legal principles. This research investigates the extent of this influence through a qualitative methodology employing a normative legal approach. The findings reveal that while Islamic and customary law have significantly shaped the recodification process, their impact is less substantial than initially presumed. The previous Penal Code penalized only married individuals engaging in extramarital sexual relations, whereas the revised Code extends criminal liability to all individuals, irrespective of marital status. This shift redefines adultery from a private ethical concern to a public legal matter. However, the new Penal Code does not fully integrate Islamic or customary law in its classification of criminal offenses. Unlike Islamic and customary law, which treat adultery as a public offense, the new Penal Code operates on the principle of a complainant-based offense, requiring a formal complaint for prosecution. These findings contribute to the broader discourse on the intersection of legal traditions in contemporary criminal law reform
Potential-Based Islamic Education
Potential-based Islamic education is an approach that emphasizes the development of individual potential in accordance with human nature that has been instilled by Allah since birth. Potential-based Islamic education is also in line with the main goal of education in Islam, namely to form a perfect human being who has a balance between faith, knowledge, and charity. Deviations often occur as in cases of malpractice "Malpractice is a medical practice that is carried out incorrectly or inappropriately, violating laws or codes of ethics. The library research method in the context of potential-based Islamic education involves the collection, analysis, and synthesis of information that already exists in various literature sources. The following are the steps and important aspects in this method: problem identification, data collection, source analysis and recommendations. Allows researchers to gain an in-depth understanding without having to conduct field research that takes time and resources in the utilization of Islamic religious education. This approach is expected to be able to produce a generation of Muslims who are not only intellectually intelligent, but also have a strong character and are able to carry out their role as caliphs on earth well
Manajemen Risiko Penyaluran Dana Zakat pada Badan Amil Zakat Nasional (BAZNAS) Kabupaten Pasaman Barat
This research is motivated by the importance of risk management for BAZNAS West Pasaman Regency which must be implemented in order to achieve the goals of BAZNAS to determine the risk management of the distribution of zakat funds is appropriate andk reaches the target or not. This type of research is field research with a qualitative approach. The data source is primary data with interview and documentation collection techniques. The result of the research is that the risk management applied by BAZNAS still adheres to the holy QurÔÇÖan leeter At-Taubah verse (60), the ap[licable zakat law, the BAZNAS program and SOP, always evaluates and is audited by an externalpublic accountant. Basically, the commonly known risk are pure risk and speculative risk, here the distribution of zakat funds is categorized as pure risk because if the distribution of zakat funds is not on target, the risk that is likely to occur is that the mustahik who receives zakat is not right. Risks that are classified according to levels in the form of moderate risk of a decrease between raising muzakki and beneficiaries and the realization of mustahik/beneficiaries based on programs (people), health, low risk with word of diatribe, lack of gratitude both to BAZNAS and to the distribution of zakat funds, moderate risk with delays in the distribution of zakat funds at BAZNAS West Pasaman Regency
Exploring the Cultural Da'wah Strategy of Hadrah Al-Jiduri Art: A Phenomenological Study on Character Building
The Hadrah Al-Jiduri art, rooted in the local Islamic tradition of ahlussunnah wal jama'ah, serves as a cultural da'wah strategy that not only preserves religious values but also fosters character building. This study aims to explore how the Hadrah Al-Jiduri community applies collective leadership, regional coordination, youth involvement, routine gatherings, and major religious events to shape moral traits such as humility (tawadhu'), consistency (istiqomah), love for the Prophet Muhammad SAW, tolerance, discipline, and spiritual awareness. Using a qualitative descriptive method with a phenomenological approach, data were collected through interviews, observations, and document analysis, then analyzed using Miles and Hubermans interactive model with triangulation for validity. The findings show that the structured and participatory practices of Hadrah Al-Jiduri effectively integrate local cultural wisdom into da'wah activities, providing a replicable model for strengthening religious character and communal harmony.
Interactive Video-Based Experiential Learning for Junior High School StudentsÔÇÖ Understanding of Salat
This study aims to improve students' understanding of salat material through the implementation of the Experiential Learning model based on interactive video. The research employed a Classroom Action Research (CAR) method conducted in two cycles, each consisting of planning, implementation, observation, and reflection stages. The subjects were 26 seventh-grade students of class VII D in the 2024/2025 academic year. Data were collected through observation, written tests, and documentation, using instruments such as lesson implementation observation sheets, student activity sheets, and comprehension tests. Results showed an increase in lesson implementation scores from an average of 40.33 (good) to 47 (very good), student activity from 42.33 (fair) to 52.5 (very good), and understanding of salat from an average score of 75.53 (46.15% mastery) to 89.5 (100% mastery). The improvement in student comprehension reached 53.85%. These findings demonstrate that the interactive video-based Experiential Learning model is effective in enhancing the quality of Islamic Religious Education.┬á┬
Persepsi Orang Tua tentang Kesiapan Anak Memasuki Sekolah Dasar dalam Teori Kognitif Vygotsky
Perceptions of readiness for elementary school are parents' views, understanding, and assessments of their children's abilities, such as cognitive, social-emotional, language, motor, and independence aspects. The purpose of this study is to explore parents' perceptions of their children's readiness for elementary school, focusing on the differences in perceptions between fathers and mothers in one family and exploring the cognitive abilities of children. This study uses a case study approach, with the research subject being the parents of an 8-year-old boy with the initials RD. Data was collected through in-depth interviews, observation, and documentation. The results show that there are differences in perception between RD's father and mother regarding the child's readiness to enter elementary school. These differences in perception are influenced by three factors, namely (1) each parent's understanding of the concept of school readiness, (2) their personal experiences in undergoing education in the past, and (3) their expectations for RD's future education. The findings of this study are that parents' perceptions of their children's readiness to enter elementary school are subjective and influenced by internal and social factors, and that open communication and collaboration between parents in making decisions about their children's education are important. RD is a gifted child with academic abilities above the average of his peers. RD's discomfort and demotivation in elementary school arose because his learning needs as a gifted child were not optimally met in a regular school environment.Persepsi kesiapan memasuki sekolah dasar adalah pandangan, pemahaman dan penilaian orangtua terhadap kemampuan yang dimiliki anak seperti aspek kognitif, sosial emosional, bahasa, motorik maupun kemandirian. Tujuan penelitian ini untuk menggali persepsi orangtua terhadap kesiapan anak memasuki sekolah dasar, fokus pada perbedaan persepsi ayah dan ibu dalam satu keluarga dan menggali kemampuan kognitif yang dimiliki anak. Penelitian ini menggunakan pendekatan studi kasus, subjek penelitian adalah orangtua dari anak laki-laki usia 8 tahun berinisial RD. Data dikumpulkan melalui wawancara mendalam, observasi dan dokumentasi. Hasil menunjukkan bahwa terdapat perbedaan persepsi antara ayah dan ibu RD terkait kesiapan anak memasuki sekolah dasar. Perbedaan persepsi ini dipengaruhi oleh tiga faktor yaitu (1) pemahaman masing-masing orangtua terhadap konsep kesiapan sekolah, (2) pengalaman pribadi mereka dalam menjalani pendidikan masa lalu, dan (3) harapan mereka terhadap masa depan pendidikan RD. Temuan penelitian ini adalah persepsi orangtua terhadap kesiapan anak memasuki sekolah dasar bersifat subjektif dan dipengaruhi oleh faktor internal dan sosial, pentingnya komunikasi terbuka dan kolaborasi antara orangtua dalam mengambil keputusan pendidikan anak. RD anak berbakat (Gifted) dengan kemampuan akademik diatas rata-rata teman sebayanya dan timbulnya ketidaknyamanan dan demotivasi RD ke sekolah dasar karena tidak terpenuhinya kebutuhan belajar RD sebagai anak berbakat secara optimal di lingkungan sekolah reguler
Developing MEGA: A Geometry-Based Educational to Enhance Logical Thinking Skills And Visual-Spatial Skill
The development of logical thinking skills and spatial visual intelligence in children aged 4ÔÇô5 years is essential for fostering early understanding of geometric concepts. Many children at this stage still experience difficulties recognizing basic geometric shapes such as squares, rectangles, triangles, and circles, along with identifying concrete examples from their surroundings. This study aims to develop and examine the MEGA (Media Edukasi Geometri Anak) application as a varied alternative learning medium to stimulate these abilities. The research applies a Research and Development (R&D) model with a one-group pretest-posttest design. A total of 25 children aged 4ÔÇô5 years from Kindergarten Muslimat Kabuh were involved, with data gathered through observational research activities. The effectiveness of the application was analyzed using the N-gain test. Results indicate that the application effectively enhances logical thinking, enabling children to better recognize and distinguish geometric shapes. Furthermore, spatial visual intelligence develops, as children become able to identify colors, name vertical and horizontal lines within geometric drawings, and relate real-world objects to their geometric forms. These findings highlight meaningful improvements in childrenÔÇÖs cognitive and spatial abilities after engaging with the MEGA application, showing its potential as an alternative learning medium in early childhood educational settings.┬
Development of the GIMALONG Interactive Video to Promote Prosocial Behavior and Digital Literacy in Early Childhood
Prosocial behavior and digital literacy are critical domains in early childhood development but remain under-stimulated due to limited instructional media. This study evaluates the feasibility and effectiveness of the GIMALONG interactive video, designed to foster sharing, collaboration, and helping behaviors while enhancing digital literacy in children aged 5ÔÇô6 years. Using a Research and Development (R&D) approach with the ADDIE model, the product underwent expert validation and was tested through individual (2 children), small group (8 children), and large group (25 children) trials. Data were collected via observation, questionnaires, and pretest-posttest instruments, then analyzed using the N-Gain formula. The results showed high effectiveness, with N-Gain scores for prosocial behavior and digital literacy consistently in the high category across all phasesÔÇöindividual (0.8617; 0.8574), small group (0.8853; 0.8376), and large group (0.8394; 0.8142). These findings support the use of GIMALONG as a feasible and impactful tool to support character and digital competency development in early learning environments.┬á┬
The Effect of Storytelling Method on Children’s Cognitive Development at the Age of 5–6 Years
Cognitive ability is one of the essential aspects of early childhood development that must be stimulated through approaches aligned with the children’s developmental stages. This study aims to determine the effect of the storytelling method on the cognitive abilities of children aged 5–6 years. The research employed a quantitative approach with a pre-experimental design of the one-group pretest-posttest type. The study involved 14 children from Group B as research subjects. Data were collected through observation, interviews, and documentation, using observation sheets, assessment rubrics, and interview guidelines as instruments. The data were analyzed descriptively and inferentially using a paired sample t-test. The results revealed a significant improvement in the aspects of retelling stories, answering questions, and identifying story settings and characters after the implementation of the storytelling method. This improvement was reflected by an increase in the “Very Well Developed” category and a notable decrease in the “Not Yet Developed” category. The t-test results showed a significance value of < 0.05, indicating a significant effect of the storytelling method on children’s cognitive abilities. These findings confirm that the storytelling method is an effective learning approach to actively, enjoyably, and meaningfully stimulate children’s cognitive development in the context of early childhood education
