Algunas cuestiones sustantivas y procesales en el ámbito de la violencia de género en España
Get PDFThe great challenge of the legislator in the Organic Law 1/2004, of December 28, 2004, of integral protection against gender violence, has been, without a doubt, the creation of specialized judicial bodies, the courts of violence against women. The determination of the scope of their competence is one of the main topics of debate that the practical application of this Organic Law has led to. The most common procedures in the courts of violence against women are: speedy trial (urgent proceedings) and preliminary proceedings. The work of the forensic physician is very important and necessary, complementary to that carried out by other professionals. This interrelation results in the elaboration of a quality expert report adapted to the request made in the corresponding criminal procedure. The exception or dispensation to testify to the defendant\u27s relative or spouse has the purpose of resolving the conflict that may arise for the witness between the duty to tell the truth and the bond of solidarity and familiarity that unites him/her with the defendant. Objective competence in civil order is determined by the simultaneous concurrence of three presuppositions: one of a material nature, a second of a personal nature and a third of a procedural nature.El gran desafío del legislador en la Ley Orgánica 1/2004, de 28 de diciembre, de protección integral contra la violencia de género, ha sido sin duda, la creación de órganos judiciales especializados, los juzgados de violencia sobre la mujer. La determinación del ámbito de su competencia es uno de los principales temas de debate que propicia la aplicación práctica de esta Ley Orgánica. Los procedimientos más habituales en los juzgados de violencia sobre la mujer lo constituyen: juicio rápido (diligencias urgentes) y diligencias previas. Muy importante y necesaria la labor del médico forense, complementaria a la realizada por otros profesionales. Esta interrelación da como fruto la elaboración de un informe pericial de calidad adaptado a la solicitud realizada en el procedimiento penal correspondiente. La excepción o dispensa de declarar al pariente del procesado o al cónyuge tiene por finalidad resolver el conflicto que se le puede plantear al testigo entre el deber de decir la verdad y el vínculo de solidaridad y familiaridad que le une con el procesado. Get PDFThe material presented here is an interview with Hermilo Caamal Couoh, a Mayan speaker who lives in Cobá, a farmer and chiclero by trade. It was documented on July 12, 2013, by Santiago Cortés Hernández and Berenice Araceli Granados Vázquez. This material constitutes one of the documents stored in the Repositorio Nacional de Materiales Orales richest in information about the oral tradition of the Mayan peoples and their worldview. Caamal Couoh tells a series of stories about numinous entities that inhabit the spaces of the jungle, the cornfield, the mountains, the town, the thoughts and behaviors of men and women of the past and present, as well as the rituals for “negotiate with them.” He also talks about the history of the founding of his town and the surrounding archaeological zone. Caamal Couoh\u27s interview constitutes a valuable discursive unit of knowledge, which is important to analyze in its entirety, since only then does the cultural mechanism that activates the narrator\u27s thinking and that affects all areas of his life become visible.El material que aquí se presenta es una entrevista a Hermilo Caamal Couoh maya hablante que vive en Cobá, de oficio agricultor y chiclero. Fue documentada el 12 de julio de 2013, por Santiago Cortés Hernández y Berenice Araceli Granados Vázquez. Este material constituye uno de los documentos resguardados en el Repositorio Nacional de Materiales Orales más ricos en información sobre la tradición oral de los pueblos mayas y su cosmovisión. Caamal Couoh narra una serie de relatos en torno a entidades numinosas que habitan los espacios de la selva, la milpa, los montes, el pueblo, los pensamientos y las conductas de hombres y mujeres del pasado y del presente, así como sobre los rituales para “negociar con ellas”. También habla sobre la historia de fundación de su pueblo y de la zona arqueológica aledaña. La entrevista de Caamal Couoh constituye una valiosa unidad discursiva de conocimiento, que es importante analizar en su totalidad, pues sólo así se hace visible el mecanismo cultural que activa el pensamiento del narrador y que incide en todos los ámbitos de su vida

Get PDFThis paper intendes to analyse the presence of the ATU 804 type tale in different countries of the western Mediterranean, starting with Spain, to then focus on the Italian variants, especially those that appear in a series of unpublished sound recordings of great documentary value. The objectives are: through different variants and versions, to study which are the most frequent and stable characteristics in a peculiar protagonist; to establish which other types of tales are usually combined with ATU 804 and to suggest some reasons why the great majority of the people who tell this story are women.En este artículo, analizo la presencia del cuento tipo ATU 804 en distintos países del Mediterráneo occidental, empezando por España, para después centrarme en las variantes italianas, sobre todo en las que aparecen en una serie de grabaciones sonoras inéditas de gran valor documental. Los objetivos son: a través de variantes y versiones distintas, estudiar cuáles son las características más frecuentes y estables en una protagonista peculiar; establecer qué otros tipos de cuentos suelen combinarse con ATU 804 y sugerir algunas razones por las que la gran mayoría de las personas que cuentan este relato son mujeres.

Get PDFHistorical information about the chronology of Burgos’s medieval wall has never been ratified by urban archaeology in the city, while its construction was neither linear nor took place at a single time. This article presents the archaeological study carried out at the gates of San Juan and San Martín, the entrance and exit of the French Way of St James in the medieval city. The funerary use of the former came to an end in the late Middle Ages, when a section of the wall was built. At the latter, at least three building phases are known and supported by the stratigraphic sequence, the mineralogical comparison of the mortars and a 14C AMS date. Profound renovation of the urban plan in the fourteenth century has been demonstrated at both sites.Las noticias históricas sobre la cronología de la muralla medieval de Burgos no han sido aún ratificadas por la arqueología urbana de la ciudad, al tiempo que su evolución constructiva no fue ni lineal ni unitaria. Se presentan los resultados de las intervenciones arqueológicas realizadas en las puertas de San Juan y de San Martín, entrada y salida del Camino de Santiago francés en esta ciudad medieval. En la primera desaparece el uso funerario del espacio a comienzos de la Baja Edad Media, cuando se edifica un tramo de muralla. En la segunda se constatan al menos tres fases constructivas avaladas por la secuencia estratigráfica, los resultados químico-mineralógicos del estudio de morteros de cal y la datación 14C AMS. En ambos contextos queda demostrada la profunda renovación del urbanismo en el siglo XIV
Devenir histórico del turismo de playa en México, una revisión crítica
Get PDFCoastal tourism in Mexico has been promoted by the state but shaped by the global economy, which has the potential to use capital surpluses to continue with the expanded production of capital in this service sector. In this sense, the aim of this paper is to show the intimate connection between the development of Mexican tourism and the influence of international organizations and transnational capitals. It is thought that this influence led to the organization and reorganization of the state (normative-legal, institutional, and administrative frameworks) under competitiveness, economic growth, and investment ideals. The use of the dialectical method seeks to explain this process in the context of three historical periods: incipient or genesis, heyday or dispatch, and consolidation. Moreover, it allows us to understand the tourism phenomenon as a complex, multi-categorical, and relational study object. On the one hand, the state promotes sustainable planning, but on the other hand, it offers benefits to private tourist groups and companies contributing to the contradiction between economic-political sustainability and socio-ecological unsustainability. This paper concludes that coastal tourism in Mexico along with the internationalization of tourism conceals the dispossession, violence, fraud, corruption, exploitation, looting, and private appropriation that affects nature as well as traditional ways of life. Therefore, it is not only necessary to prioritize sustainable tourism projects (endogenous, community, and low impact) but also to rethink the dominant tourism model and solve the problems generated by it in consolidated tourist centers.En México, el turismo de costa ha sido impulsado por el Estado, pero condicionado por el contexto de la economía global la cual encuentra dentro del sector servicios las posibilidades de reubicar y reutilizar excedentes de capital para continuar con la reproducción ampliada de ganancias. Por ello, el objetivo de este artículo es mostrar la estrecha conexión entre el desarrollo turístico mexicano y la influencia de organismos internacionales y capitales del ramo. Mismos que han incidido en la organización y reorganización del Estado en pro de la competitividad, crecimiento e inversión. Mediante el método dialéctico, se busca dar cuenta de ello a partir de tres etapas históricas: incipiente, auge/despegue y consolidación, donde el turismo aparece como un fenómeno y objeto de estudio complejo, multicategorial y relacional. Aunque el Estado aboga por la planeación sustentable, ofrece beneficios a grupos privados contribuyendo a la contradicción entre sostenibilidad económico-política e insustentabilidad socio-ecológica. Se concluye que el turismo de litoral en México al margen del programa de internacionalización del turismo oculta procesos de despojo, violencia, fraude, corrupción, explotación, apropiación privada tanto de la naturaleza como de las formas de vida tradicionales. Por lo que, no sólo es necesario priorizar proyectos turísticos sustentables desde lo endógeno, comunitario, un bajo impacto, sino replantear el modelo turístico dominante y atender las problemáticas generadas por éste en los centros turísticos consolidados
La (re)presentación identitaria de género en el retrato. Análisis del binarismo hegemónico desde la indagación poética
Get PDFIn antiquity, identity was bound to the word. In contemporary times, the \u27self\u27 becomes an image. Aware of this shift, we position the portrait as a pedagogical and aesthetic tool to analyze the relationship between the signifier and the signified body. In this regard, the present study examines the use of the portrait as a strategy for (re)presenting identity. This research analyzes, from the perspective of gender studies and the intersectional approach, the presence of hegemonic binary in the discursiveness of the image. This research reinterprets, from a poetic perspective, an artistic-educational experience carried out in four educational centers on the island of La Palma (Canary Islands) and draws data from 109 students in Compulsory Secondary Education. To analyze visual and discursive grammars, various strategies are combined based on visual methodologies as a reliable means of data collection and analysis. The results obtained indicated the presence and persistence of gender archetypes and dichotomous "masculine" and "feminine" roles. On the other hand, it was observed that the journey through the different portraits invites opening up other ways of telling new stories. It proposes a critical perspective that deconstructs hegemonic visual narratives and enables the generation of counter-discourses.En la antigüedad la identidad estaba sujeta a la palabra, en la contemporaneidad el “yo” deviene imagen. Conscientes de este desplazamiento, colocamos el retrato como herramienta pedagógica y estética para analizar la relación entre el significante y el cuerpo significado. A este respecto, el presente trabajo estudia el uso del retrato como estrategia de (re)presentación identitaria y analiza, desde la perspectiva de los estudios de género y el enfoque interseccional, la presencia del binarismo hegemónico en la discursividad de la imagen. Esta investigación resignifica, desde una mirada poética, una experiencia artístico-educativa realizada en cuatro centros educativos de la isla de La Palma (Islas Canarias) y toma los datos de 109 estudiantes de Educación Secundaria Obligatoria (ESO). Para analizar las gramáticas visuales y discursivas se conjugan diversas estrategias basadas en metodologías visuales como medio fiable de recogida y análisis. Los resultados obtenidos indicaron la presencia e insistencia de los arquetipos de género y los roles dicotómicos “masculino” y “femenino”. Por otro lado, se pudo observar que el recorrido por los distintos retratos invita a abrir otras maneras de contar nuevos relatos. Propone una mirada crítica que deconstruye las narrativas visuales hegemónicas y posibilita el generar contradiscursos
