It appears that within national judicial systems the lower level courts have in recent years shown more and more willingness to apply directly the ECHR norms and the ECtHR jurisprudence, raising the question in the eyes of the highest national courts ‘who is the master in the house?’

No full textSemiotical system in the functional sense has dual effect on the subject: on the one hand, it directs and constrains the subject through collective semiotic tools, on the other hand – it provides symbolic resources for subject\u27s semiotic autonomy. This duality may be presented as a relation of systemic power. Explicit and implicit collective meaning structures act as an external coercive power in relation to subjects. Regulative function of the semiosphere manifests itself through various social suggestions which attempt to direct and constrain subject\u27s activity. In contrast, individual semiotic autonomy is realized through the use of signs in the process of self-regulation and autocommunication. Contacting with the semiotically autonomous subject, these social suggestions may catalyze variety of responses. In the article a typology of modes of response are presented. Distancing, resistance, compliance and creative synthesis are generated in the interplay of external catalyzers on one hand, and unreflective and reflective processes within the subject, on the other. A semiotic mechanism of their generation and several theoretical models which explain the probability of specific mode of response are described. Possible application of the model in the analysis of intergroup power relations (e.g. in explanation of the phenomenon of reactive identity) has been demonstrated

No full textThis is the first publication of a previously unknown version of Osip Mandel’shtam’s poem “Ia vernulsia v moi gorod, znakomyi do slez...” (1930, 1932), which survived in the archive of the famous Russian scholar Arkady Dolinin (1883—1968) (currently located in the Manuscript Division of the National Library of Russia). It has come to us in the spisok (copy) made by an unknown person, who almost certainly met Mandel’shtam in the period between late December 1930 and early January 1931. Although the name of the copyist cannot be established, the text as such is remarkable in the way it differs from the final version.

The author shows all branches of powers co-existing with three main branches and analyzes the mechanisms of separation as well as of cooperation of powers. The article suggests measures to improve the checks and balances system for state authorities in the Russian Federation.
Voters as Nontrivial Machines:Valuation of Political Actors by the Press and Estonian Voters’Preferences from 1999 to 2007
No full textBy employing a constructivist approach and conceptualising media effects as contingent change, this article examines the impact of the valuation of different political parties by the media on forming people’s election preferences in Estonia over an eight year period. Research indicates that valuations serve the structural coupling of the mass media with consciousness systems and with other social domains and perform an important role in the formation of public opinion and election preferences. More frequent valuations of an actor or event in media messages trigger the valuation of that same actor or event among the public, which, in turn, is the basis for people’s preferences and decisions. The valuation of political actors by the press is an essential means of orientation that enables people to organise their experiences and interact. For political actors, their valuation is the basis of their legitimacy.
