The purpose of this study is to answer the question of how the analysis of Islamic Civil law regarding wills in the Supreme Court Decision Number: 379 K/AG/2009. A will is made with the aim that the heirs cannot know whether the inheritance left by the testator will be inherited by his heirs or whether it will be inherited by another party who is not at all |heirs until the time comes to read the will. In particular, testamentary items must not exceed 1/3 of the assets of the testator, if this is the case then it could be considered not in accordance with the will rules. The results of this analysis found that the will does not have an absolute position to be carried out/executed. This can happen if the execution of the will is obstructed by the owner of the object of the will. Therefore, it can be said that a will made as a last will is not necessarily a last will, because it can be canceled or annulled by law. Cancellation is carried out if the disputing party submits the matter to the court, then the position of the will becomes not absolute to be implemented if the will is an nulled or an nulled by law incourt. The importance of a will in estate planning lies not only in the distribution of assets, but also in the arrangement of issues such as dependents and obligations. Thus, a will becomes a vital legal instrument in protecting a person’s interests and wishes after death

The Implementation of Semitic Rhetorical Analysis on QS. Al-Ahqaf

    No full text
This article will discuss the implementation of Semitic Rhetorical Analysis to one of the surah in the Qur'an, namely Surah Al-Ahqaf. In the past scholars have also applied SRA to surah in the Qur'an to show unity and wholeness to the suras, this is done to prove Cuypers' words which say that although SRA is a rhetorical theory used to study the Bible, SRA is also able to prove the integrity of suras in the Qur'an. He stated that after he succeeded in applying the surah Al-Ma'idah and the last 30 suras in the Qur'an, he also claimed that his success in studying these surahs adequately represented that the entire surah in the Qur'an is composed by the principles of the SRA and forms a complete unity of surahs. Nevertheless, this claim must be proven by applying SRA to all surahs in the Qur'an, one of which is to surah Al-Ahqaf whose integrity is disputed by an orientalist named Richard Bell. He argues that the mention of jinn in verse 29 lacks the unity of discussion in surah Al-Ahqaf, it also makes the last few verses seem isolated from the discussion listed at the beginning of the surah. Therefore, the author tries to refute this statement by applying the SRA theory. In this case, a library research study is carried out by referring to books, paper articles related to the discussion. Then analyzed with analytical descriptive methods so that conclusions can be found. This study proves that the integrity of surah Al-Ahqaf can be seen from its arrangement in accordance with the principles of SRA, the arrangement also gives birth to interpretations that are in accordance with the ulama' tafsir

This article delved into the interplay between hadiths related to rahn (pledge or collateral) and the prophetic maqashid within the framework of Islamic finance. Addressing the gaps in existing literature, the research employs qualitative methods, combining hadith criticism and Hassan Hanafi's hermeneutics framework. Three main themes emerge: the permissibility of rahn, the utilization of rahn property, and the prohibition of owning rahn property. Hadiths regarding the permissibility of rahn showcase Prophet Muhammad's practical application of Islamic principles in economic transactions, emphasizing justice, ethical business practices, and leadership involvement. Hadiths on the utilization of rahn property emphasize compensation, tolerance, and ethical treatment of animals, aligning with Islamic values in economic activities. The prohibition of owning rahn property hadith establishes fundamental principles of justice, equality, and the protection of individual rights in economic transactions. The article concluded that these hadiths not only serve as legal guidance but also embody prophetic maqashid, contributing to the broader goals of Islam to create a just and balanced society, particularly in economics and finance. The comprehensive framework provided by these hadiths offers valuable insights for both academics and practitioners navigating the evolving landscape of Islamic finance, addressing contemporary challenges while upholding Islamic value
