    Judicial Interpretation of Waqf Land Validity in Indonesia: A Comparative Analysis of Positive Law and Islamic Law through Case Decision No. 453/Pdt.G/2020/PA.Kdi

    Waqf has long functioned as both a religious act of worship and a social instrument that sustains community development in Muslim societies. Nevertheless, disputes frequently arise concerning the legal validity of waqf land, particularly when the procedures deviate from statutory regulations. This study examines the judicial reasoning behind Decision No. 453/Pdt.G/2020/PA.Kdi of the Religious Court of Kendari, which involved a conflict between two nazhirs claiming authority over the same waqf land. Employing normative legal research with a case approach and drawing on secondary legal materials, the study analyzes the intersection between Indonesian positive law—represented by Law No. 41/2004 on Waqf, Government Regulation No. 42/2006, and the Compilation of Islamic Law—and Islamic legal principles concerning waqf validity. The findings reveal that the court invalidated the first waqf due to the absence of an authentic deed, thereby prioritizing procedural formalities under statutory law. However, from the standpoint of Islamic law, the waqf remained valid as it fulfilled the essential pillars of waqf, namely waqif, mauquf, mauquf ‘alaih, and sighat. This divergence underscores the tension between formal legal certainty in positive law and the substantive validity emphasized in Islamic jurisprudence. The article contributes to scholarly debates on legal pluralism in Indonesia, offering insights into how judicial decisions navigate between state law and Islamic legal doctrines in resolving waqf disputes

    Abrogation Without Replacement in the Qur’an: Rethinking al-Tadarruj fi al-Tashrī‘

    This article critically examines the concept of nasakh (abrogation) in the Qur’an, with a particular focus on cases where a ruling is interpreted as being abrogated without a clearly defined substitute (nasakh bilā badal). Rather than understanding such cases as definitive cancellations, this study proposes that they should be read through the framework of al-tadarruj fi al-tashrī‘ (gradual legislation), which conceives of legal revelation as a phased and pedagogical process aligned with the intellectual and spiritual development of the Muslim community. Using a qualitative library-based research design and critical content analysis, the article re-examines key verses—including Q.S. al-Mujādilah [58]:12–13, Q.S. al-Baqarah [2]:184–185, and Q.S. al-Nisā’ [4]:15—in their historical and exegetical contexts. The findings demonstrate that these transitions reflect deliberate stages of moral and legal formation rather than normative discontinuity. By foregrounding contextual, historical, and maqāṣid-based dimensions of revelation, the study advances a new interpretive model that reconceptualizes nasakh as part of a dynamic and purposive framework of legal development. This approach offers a crucial corrective to rigid classical classifications and contributes to contemporary Qur’anic studies by affirming the continued relevance of divine law in addressing shifting socio-historical realities

    Penelitian ini membahas kekeliruan berbahasa pada penderita Afasia Broca pascastroke dari perspektif psikolinguistik. Afasia Broca merupakan gangguan produksi bahasa yang sering terjadi akibat kerusakan otak di area Broca, terutama pada penderita stroke. Studi ini menggunakan metode kualitatif dengan data yang diperoleh dari wawancara dan observasi terhadap seorang informan laki-laki berusia 62 tahun yang tinggal di panti asuhan. Penelitian ini mengidentifikasi kata-kata yang sulit diucapkan oleh informan, strategi komunikasi yang digunakan, dan mekanisme produksi bahasa yang terganggu. Hasil penelitian menunjukkan bahwa informan mengalami kesulitan dalam pengucapan kata, sering membuat kekeliruan fonologis, dan menggunakan strategi berkomunikasi seperti gesture dan parafasia untuk menyampaikan maksudnya. Kekeliruan berbahasa terutama terjadi pada kata-kata yang kompleks secara fonologis, seperti "soto" yang menjadi "toyo". Informan juga memanfaatkan strategi bahasa tubuh untuk mendukung komunikasi ketika gagasan sulit diutarakan secara verbal.     The poem Hendak Jadi “Orang Besar?” by Bung Usman is a literary work that delivers profound social criticism and moral admonition. This study adopts a stylistic approach using a descriptive qualitative method to analyze linguistic elements such as metaphors, irony, and satire that create a critical tone in the poem. Data were obtained through library research and analyzed based on the poet's choice of words, structure, and linguistic style to convey the intended message.The findings indicate that the poem Hendak Jadi “Orang Besar?” by Bung Usman employs metaphors to depict the negative impact of uncontrolled ambition, irony to highlight the emptiness of achievements without morality, and satire to critique selfish behaviors that disregard social values. The poem sharply illustrates the social realities of its time while inviting readers to reflect on values such as integrity, responsibility, and humanity in achieving true success. The moral messages conveyed in this poem remain relevant today, making it a meaningful social reflection worthy of appreciation

    Penelitian ini bertujuan untuk mengeksplorasi pemanfaatan media video sebagai sarana pembelajaran teks argumentasi dalam meningkatkan motivasi belajar siswa. Dalam era digital, media pembelajaran berbasis audiovisual memiliki potensi besar untuk menjadikan proses belajar lebih menarik dan bermakna. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan subjek siswa kelas XI di salah satu SMA Negeri. Data dikumpulkan melalui observasi, wawancara, dan angket motivasi belajar. Hasil menunjukkan bahwa penggunaan video dalam pembelajaran teks argumentasi tidak hanya memperjelas struktur dan ciri-ciri teks, tetapi juga mampu meningkatkan partisipasi aktif, antusiasme, dan kepercayaan diri siswa dalam mengemukakan pendapat. Dengan demikian, media video layak dijadikan alternatif strategis dalam pembelajaran teks argumentasi di kelas. Tujuan penelitian ini untuk mengetahui eksplorasi media pembelajaran berbasis video pada teks argumentasi untuk meningkatkan motivasi belajar siswa di SMAN 4 TUALANG.     A Legal Framework for Social Forestry Management that Provides Access Rights to Communities in Forest Resource Utilization

    This study aims to explore and establish a national legal framework that provides a legal basis for community access rights in the utilization of forest resources. This study emphasises the importance of shifting the paradigm from entirely state-based forest management, to community-based forest management that will strengthen state forest management. This research uses normative legal research methods with qualitative juridical analysis of legal materials. The results show that there is a strong legal framework both at the level of the constitution, Constitutional Court decisions, and laws and regulations, up to the level of technical regulations in the Minister of Environment and Forestry Regulation. Social Forestry policy and its implementation can provide legal certainty and justice for community access rights in forest resource utilization. However, Social Forestry in its implementation also contains a number of challenges that need to be addressed

    Media Framing and Digital Democracy: A Study of 2024 Election Reporting on Metro TV's Q&A Show

    Penelitian ini menganalisis framing pemberitaan Pemilu 2024 yang ditayangkan dalam program Q&A Metro TV dengan menggunakan model analisis framing Robert N. Entman. Studi ini menyoroti bagaimana narasi dalam program tersebut membentuk persepsi publik tentang proses demokrasi digital. Dengan fokus pada tiga episode Q&A dari Februari hingga Juli 2024, ditemukan bahwa framing berita mencerminkan krisis kepercayaan publik terhadap transparansi dan netralitas penyelenggaraan pemilu, serta dugaan kecurangan yang melibatkan aktor politik dan kelembagaan. Hasil analisis menunjukkan bahwa Q&A Metro TV menggunakan elemen framing seperti identifikasi masalah, interpretasi penyebab, evaluasi moral, dan rekomendasi solusi untuk membingkai isu secara kritis. Program ini juga menciptakan kesadaran publik tentang pentingnya pengawasan masyarakat, reformasi sistem pemilu, dan adopsi teknologi sebagai langkah modernisasi. Namun, framing yang tajam dan provokatif berpotensi memperdalam polarisasi diskursus publik. Penelitian ini menyimpulkan bahwa media memiliki peran strategis dalam membentuk diskursus politik, tetapi perlu menjaga keseimbangan antara fungsi pengawasan dengan objektivitas untuk memfasilitasi dialog demokrasi yang konstruktif.   Kata Kunci : Framing, Demokrasi Digital, Pemilu 2024, Media, Q&A Metro T

    Komunikasi Antarpribadi Dai dalam Pembinaan Mualaf di Kota Medan

    Penelitian ini bertujuan untuk menggambarkan dan menganalisis bentuk komunikasi antar pribadi yang dilakukan oleh para dai dalam proses pembinaan mualaf di Kota Medan. Pendekatan kualitatif dengan metode studi kasus digunakan untuk memperoleh pemahaman mendalam mengenai interaksi yang terjalin antara dai dan mualaf, serta faktor-faktor yang mempengaruhinya. Hasil penelitian menunjukkan bahwa komunikasi antar pribadi yang dilakukan para dai bersifat empatik, terbuka, dan intensif, dengan penekanan pada pendekatan persuasif dan spiritual. Komunikasi ini berperan penting dalam memperkuat keimanan mualaf, menumbuhkan rasa aman dalam lingkungan baru, serta membantu mereka beradaptasi dengan ajaran dan praktik keislaman. Faktor kepercayaan, kesamaan latar belakang, serta komitmen dai menjadi elemen penentu keberhasilan komunikasi dalam pembinaan tersebut

    ARCS (Attention, Relevance, Confidence, Satisfaction) Model as Extrinsic Motivation in Arabic Language Learning: Teachers' Perspectives and Experiences

    This study aims to explore the perspectives and experiences of 32 Arabic language teachers in West Sumatra in providing extrinsic motivation through the ARCS (Attention, Relevance, Confidence, Satisfaction) model and its effectiveness, as well as the obstacles they face in the practice. This study is motivated by the view that intrinsic motivation alone is not sufficient; students also need extrinsic motivation as a reinforcement and driver in the Arabic language learning process. Using a phenomenological approach, data were collected through observation and online interviews, then analyzed using the Miles and Huberman model, which includes data condensation, data presentation, and conclusion drawing. The results showed that: (1) the majority of teachers perceive the importance of extrinsic motivation and apply it through various strategies that can be categorized in the ARCS model (Attention, Relevance, Confidence, Satisfaction), and also by Piaget's developmental theory of teaching Arabic language materials from easy to difficult; (2) The main obstacles in implementing extrinsic motivation in the form of the ARCS model include internal factors such as low interest and negative perceptions of students towards Arabic, as well as external factors such as limited support from schools and families; (3) the majority of teachers consider extrinsic motivation in the form of the ARCS model to be effective in increasing enthusiasm, creativity, long-term interest, as well as students' learning abilities and achievements. However, its effectiveness is still assumptive and contextual because it has not been tested quantitatively. This study provides practical implications for Arabic language teachers in designing learning strategies that integrate extrinsic motivation effectively, especially through the application of techniques in the ARCS model, thoroughly and contextually

    The Social Rhetoric of the Qur’an: A Thematic Stylistic Approach

    This study explores the way the Qur’an conveys social criticism through its distinctive rhetorical style. Employing a thematic stylistic approach, the research analyzed selected verses representing criticism of social inequality (Q.S. Al-Isra’: 26–27), human and environmental exploitation (Q.S. Al-Qasas: 4; Q.S. Ar-Rum: 41), and moral deviation (Q.S. Al-Hujurat: 11; Q.S. An-Nisa’: 58). The method applied was qualitative-descriptive, using critical textual reading focusing on the thematic and stylistic features of the verses. The analysis drew on al-Sakkaki’s theory of al-Ma‘ani to identify the rhetorical forms and their social meanings. The findings indicate that in Q.S. Al-Isra’: 26–27, the Qur’an employs Uslub al-Amr as a form of ethical motivation; Uslub Khatimah Maw‘iẓiyyah to frame prohibition with theological condemnation; Uslub Siyaq wa Sibaq to balance commands and prohibitions; and Uslub Taqdīm wa Ta’khīr to emphasize social priorities in the distribution of rights. In Q.S. Al-Qasas: 4, rhetorical devices include Uslub Ta’kīd, Taqdīm wa Ta’khīr, Iṭnāb, and the use of Fiʿl Muḍāriʿ in Maqām Zamm. In Q.S. Ar-Rum: 41, the text contains Ta’kīd, causality style (‘Illah/Ta‘līl), Maqām Taḍmīn, Fiʿl Muḍāriʿ in contextual emphasis, and further Iṭnāb. In Q.S. Al-Hujurat: 11, the styles include Uslub Nidā’, Taqdīm wa Taʾkhīr, At-Tikrār, and Tahdīd. In Q.S. An-Nisa’: 58, rhetorical devices identified are Ta’kīd, Tarkīb Fiʿlī Muḍāriʿ, Kalimah Syarṭiyyah, numerical reinforcement, and Khatimah Ilahiyyah. This study introduces the concept of “Qur’anic Social Rhetoric,” a stylistic perspective that highlights the interrelation between the Qur’an’s rhetorical structures and their socio-ethical functions. It demonstrates that the Qur’anic style not only embodies aesthetic and linguistic excellence but also serves as a medium of social critique, moral guidance, and transformation, ultimately reflecting the Qur’an’s essential role in shaping public ethics and social justice
