A Rhetorical-Legal Hermeneutic: Representations of Women in the Qur'an through Balaghah and Their Implications for Islamic Law

    Get PDF
This study addresses contested interpretations of women's status in Islamic law by innovatively applying Balaghah (Quranic rhetoric) to analyze gender representations in the Quran. Using rhetorical analysis of kalam khabari (declaratives), kalam insha'i (directives), and kinayah (metaphors), we systematically examine verses concerning inheritance, testimony, and women's rights. Our findings reveal that the Quran's linguistic structures consistently affirm gender equality, contradicting patriarchal readings - particularly through its deliberate use of rhetorical devices in key verses (e.g., Q 4:7, Q 2:282). The study's novelty lies in developing a Balaghah-based framework for Islamic feminist jurisprudence, demonstrating how Quranic rhetoric inherently safeguards women's dignity. This provides: (1) a new methodology for gender-sensitive Quranic exegesis, and (2) textual evidence for reforming patriarchal legal interpretations. These findings are significant for contemporary Muslim societies, offering a Quran-grounded approach to aligning Islamic law with gender justice principles

The Concept of Taʿzir in Fiqh Jinayat and Its Relevance to Traffic Ticket Sanctions in Indonesian Traffic Law

    Get PDF
This study aims to examine traffic ticket sanctions from the perspective of fiqh jinayat, with a particular focus on the concept of ta'zir as a form of punishment that is flexible and delegated to the discretion of the ruling authority (ulil amri). In the context of traffic law in Indonesia, traffic fines are implemented to enforce order and reduce violations that may endanger public safety. This study focuses on how fiqh jinayat provides a normative foundation for the enforcement of traffic sanctions and its relevance within Indonesia’s positive legal system. This study uses a qualitative normative-sociological approach to examine how taʿzir-based traffic sanctions shape public legal awareness and influence community compliance with traffic regulations. The analysis uses an explanatory method to explore the correlation between the principles of ta'zir and modern traffic law policy. The findings demonstrate that fiqh jinayat positions traffic sanctions within the framework of maslahah, aiming to protect life (hifzh al-nafs) and property (hifzh al-mal). Traffic ticket penalties in Indonesia, such as fines for not wearing helmets, license suspensions for reckless driving, or vehicle impoundment for driving without valid documents, can be classified as taʿzīr punishments. These sanctions function preventively by deterring future violations and repressively by disciplining offenders to maintain social order. This study affirms that the principles of fiqh jināyāt, particularly the concept of taʿzīr, can serve as an ethical and normative foundation for enforcing traffic ticket sanctions within Indonesia’s positive legal system. Such integration is essential for strengthening justice, promoting road safety, and ensuring collective welfare in Indonesian society. This study contributes to the development of contextual Islamic law, particularly through the integration of maqāṣid al-sharīʿah values with the modern legal system to strengthen public compliance with regulatory norms

The Role of Islamic Inheritance Law with a Maqasid al-Shariah Approach in Addressing the Challenges of Social Justice for Women

    Get PDF
Social justice is a fundamental principle in Islam, encompassing the regulation of inheritance law to ensure fair wealth distribution, particularly for women. Although inheritance rules in the Quran and Hadith grant rights to women, challenges such as patriarchal dominance, lack of legal awareness, and evolving roles of women in families often hinder the implementation of justice. Using the maqasid al-shariah framework as a theoretical approach, this study aims to analyze Islamic inheritance law's role in ensuring women's social justice. The methodology employed is a qualitative approach based on library research. It examines various Islamic legal sources, such as the Quran and Hadith, to understand women's inheritance rights and their obstacles in practice. Furthermore, this study explores solutions through ijtihad, hibah (gifting), and wasiyyah (bequests) to address these challenges. The findings indicate five key challenges women face in achieving social justice in inheritance law and four practical solutions to overcome these issues. This study seeks to contribute original insights into Islamic inheritance law's role in addressing women's social justice issues through the maqasid al-shariah approach

Teacher’s Ridha In The Ethics Of Santri Khidmah: A Hermeneutic Phenomenological Study On Pesantren’s Cultural Resistance To “Santri Slavery” Narratives In Digital Public Spaces

    Get PDF
The issue of “santri slavery” that has circulated widely on social media has distorted the meaning of pesantren education by framing the teacher–student relationship through a paradigm of power rather than spirituality. This narration obscures the moral values underlying the traditional Islamic educational system and has generated public misunderstanding of the practice of devotion (khidmah). This study phenomenologically examines the concept of teacher’s ridha as both the moral foundation of Islamic educational ethics and a form of cultural resistance against accusations of exploitation in modern public discourse. Employing a qualitative approach with a hermeneutic phenomenological design, the research was conducted in three traditional pesantren in East Java, involving 10 active students (santri), 4 teachers (ustaz), and 3 alumni as the participants. Data were collected through in-depth interviews, participatory observation, and focus group discussions (FGD), and analyzed using Interpretative Phenomenological Analysis (IPA). The findings reveal that teacher’s ridha serves as a value structure that governs the teacher–student relationship within a framework of compassion and moral responsibility rather than hierarchical domination. The practice of khidmah is understood as a form of experiential learning that cultivates sincerity, patience, and spiritual character formation. At the same time, the value of teacher’s ridha functions as a moral and symbolic mechanism of resistance to exploitation narratives by redefining devotion as an expression of inner freedom. Furthermore, pesantren have begun utilizing digital media to disseminate alternative narratives grounded in spirituality and adab (ethical conduct). Theoretically, teacher’s ridha is not merely an ethical value but also an epistemological mechanism in the formation of moral subjects, offering an alternative framework to secular paradigms by integrating spiritual legitimacy, exemplary conduct, and lived sincerity. Thus, teacher’s ridha operates as an authentic symbol of liberating Islamic education and as a form of cultural capital that enables pesantren to sustain their moral integrity amid the pressures of modernity

The Development of Reading Skill Teaching Materials Based on Prezi Artificial Intelligence

    No full text
This study aimed to develop more engaging and effective teaching materials of maharah qiroah (reading skills) for tenth-grade students in Indonesia through the utilization of the Prezi Artificial Intelligence application. The development was driven by the limitations of conventional textbooks that in many ways appeared monotonous and unengaging. Using a qualitative Research and Development (R&D) approach with the 4D model, this study employed the Qiroah Muqhatta’ah strategy, breaking texts into manageable fragments to enhance comprehension. The materials were tested on 20 students with Novice-level Arabic proficiency. The results showed a significant improvement in reading comprehension, with average scores rising from 56.3 (pre-test) to 77.5 (post-test), and 85% of students reporting increased engagement. Observations revealed greater confidence and interaction, especially with the use of visuals and zooming features. However, challenges such as limited internet access and low digital literacy among students were noted. This study suggests that while Prezi AI offers considerable benefits, its effectiveness depends on contextual factors such as infrastructure and teacher facilitation

Motivation and Satisfaction of Arabic Education Students of UIN Maulana Malik Ibrahim Malang in Accessing Arabic Content on Instagram

    No full text
This study aimed to examine the motivations and satisfaction of Arabic Education students in accessing Arabic content on Instagram by applying the Uses and Gratifications Theory (UGT). While the integration of social media into language learning has received considerable attention, particularly in informal and self-directed settings, limited research has specifically explored students’ motivations and levels of satisfaction in this context. To address this gap, a quantitative approach was adopted, involving 144 randomly selected students. Data were collected through a questionnaire designed to assess the discrepancy between gratification sought and gratification obtained across five dimensions: academic, informational, personal identity, social interaction, and entertainment. The instrument was validated by experts, and its validity and reliability were tested using the Pearson correlation with the bivariate method in SPSS. The results revealed that students were most motivated and satisfied in the academic, informational, and personal identity dimensions. Conversely, the dimensions of social interaction and entertainment did not yield a satisfactory experience. The highest level of motivation and satisfaction was attributed to Instagram’s role in enhancing vocabulary acquisition, whereas the lowest level of gratification was associated with creating Arabic content on the platform. Gender-based differences also emerged: male students reported higher motivation and satisfaction in vocabulary development, increased self-confidence, and improved listening skills, while female students showed greater motivation and satisfaction in vocabulary acquisition, grammar mastery, and reading proficiency. These results contribute theoretically by extending the application of UGT to Arabic language learning through social media. They also offer practical implications for integrating Instagram into instructional strategies and highlight policy-level considerations for acknowledging digital platforms as valid tools in formal education

    No full text
This study aims to evaluate the implementation of the PIBA program at UIN Alauddin Makassar, with a specific focus on Arabic language instruction. The evaluation covers key components such as instructional procedures, supporting facilities, student engagement, and the challenges encountered throughout the program. Employing a qualitative approach and field research methods, the study involved leaders, instructors, and third-semester PIBA students as participants. The findings showed that Arabic language teaching within the PIBA program employed a range of instructional methods and models. Although lecture and discussion formats facilitated student interaction, the limited use of interactive strategies such as simulations and technology integration reduced active student participation. Moreover, the instructional materials were not sufficiently adapted to address the diverse needs of students, indicating the necessity for more flexible and competency-based modules. Time constraints during classroom sessions also hindered in-depth exploration of the content. Based on these findings, the study recommends innovations in teaching approaches through the integration of technology, the development of adaptive learning resources, and improved time management to enhance program effectiveness. Periodic evaluations are also considered essential for ensuring continuous improvement in Arabic language education at UIN Alauddin Makassar and for positioning it as a relevant instructional model in the digital era
