Inclusive Justice During Emergencies: Covid-19 Reflections on The Right to Education for Children with Disabilities
As a State party to the International Covenant on Economic, Social and Cultural Rights (ICESCR), Convention on the Rights of the Child (CRC), and the Convention on the Rights of Persons with Disabilities (CRPD), Indonesia is obligated to ensure the right to education for all children including children with disabilities in time of crisis. . In response to the Covid-19 pandemic, Indonesia implemented a learning-from-home (BDR) policy through online platforms and provided free internet quotas. However, complex constraints in implementing this policy to children with disabilities preventing them from fully enjoying their right to education. This raises questions regarding Indonesia’s compliance with its international human rights obligations and the measures required to ensure effective fulfilment of this right during crises. This research employs a socio-legal approach, combining a review of relevant literature, analysis of legal instruments, in-depth interviews, and field studies conducted at Special Needs Schools (Sekolah Luar Biasa/SLB). The findings indicate that although the fulfilment of the right to education for children with disabilities during the pandemic was suboptimal, it does not necessarily constitute a violation of Indonesia’s obligations under international law. Nevertheless, stronger coordination and supervision involving local governments, schools, and parents are essential. The study further suggests that sanctions against local governments that fail to take maximum available measures, as required by law, should be considered
Konflik Tata Ruang dalam Proyek Strategis Nasional: Studi Kasus Proyek Surabaya Waterfront Land di Kota Surabaya
Proyek Surabaya Waterfront Land (SWL), sebagai Proyek Strategis Nasional (PSN), memicu konflik tata ruang serius. Meskipun bertujuan meningkatkan ekonomi pesisir, implementasinya bertentangan dengan Rencana Tata Ruang Wilayah (RTRW) Kota Surabaya (2014–2034) dan Provinsi Jawa Timur (2023–2043). Inkonsistensi ini mencakup pelanggaran zona konservasi, potensi kerusakan lingkungan, dan marginalisasi nelayan lokal di Surabaya. Penelitian hukum normatif ini menemukan bahwa fleksibilitas PSN dalam Peraturan Pemerintah No. 42 Tahun 2021 berkonflik dengan kerangka hukum tata ruang, mengganggu keseimbangan tujuan pembangunan. Implikasi hukumnya meliputi potensi sanksi administratif, gugatan masyarakat terdampak, serta pelanggaran hak lingkungan. Studi ini merekomendasikan harmonisasi kebijakan tata ruang, peningkatan partisipasi publik, dan penegakan regulasi lingkungan untuk mencapai pembangunan perkotaan yang berkelanjutan dan adil.

PENGUATAN PERLINDUNGAN HUKUM KONSUMEN ANAK SEBAGAI PENGGUNA TEKNOLOGI INFORMASI DI ERA DIGITAL
Era digitalisasi mengharuskan penggunaan komunikasi melalui teknologi. Anak dalam hal ini dapat dikatakan sebagai konsumen teknologi informasi dikarenakan dalam melakukan kegiatan sehari-hari. Teknologi Informasi saat ini memang menjadi alat bantu yang dapat mengubah kebiasaan hidup manusia menjadi lebih mudah, namun dapat menjadi pisau bermata dua dengan potensi timbulnya kejahatan yang lebih meluas. Metode penulisan yang digunakan dalam artikel ini adalah yuridis normatif, yaitu penelitian kepustakaan sebagai data sekunder yang didukung oleh data lapangan sebagai data primer. Spesifikasi penelitian yang digunakan adalah deskriptif analitis dengan metode pendekatan yuridis kualitatif. Anak dengan menggunakan gadget tanpa adanya pengawasan seringkali membuka banyak fitur atau aplikasi yang tidak sesuai dengan usia anak tersebut, sehingga akan sangat rawan terhadap penyimpangan moral pada dunia internet. Pemerintah telah mengatur peraturan perundang-undangan yang berkaitan erat dengan perlindungan hukum secara preventif terhadap anak, seperti Undang-Undang Perlindungan Anak dan Pornografi, namun akar permasalahan saat ini ada pada digitalisasi (internet dan sosial media). Hukum harus bersifat responsif dan progresif dalam menghadapi permasalahan perlindungan anak yang dinamis pada era digitalisasi. Satjipto Rahardjo menekankan bahwasannya hukum diciptakan untuk manusia dan bukan sebaliknya, sehingga hukum harus berada dalam proses terus menerus (law as process, law in the making). Pemerintah dalam hal ini melakukan perubahan pada UU ITE 1/2024 untuk mencegah terjadinya permasalahan pada anak sebagai konsumen teknologi informasi. Perubahan tersebut terdapat pada Pasal 16 UU ITE 1/2024 untuk penggunaan teknologi informasi dimana dalam hal ini penyelenggara harus lebih selektif dalam melakukan verifikasi penggunaan social media pada anak
A Juridical Analysis of Insurance Claims in Aircraft Lease Agreements: Challenges and Legal Remedies
Aircraft operating lease agreements provide a practical solution for airlines to reduce initial investment burdens. However, insurance claims within these agreements often face challenges that may lead to disputes between lessees and lessors, such as disagreements over the rightful claimant, inconsistencies between insurance provisions and the lease contract, and complicated claim procedures. This study employs a normative juridical approach to analyze these issues. The findings highlight the necessity of clear contractual clauses and the harmonization of national regulations with international standards, such as the Cape Town Convention 2001, to ensure legal certainty and efficient dispute resolution. Therefore, improving regulations and insurance claim mechanisms in aircraft operating leases is essential to support the smoothness and security of leasing transactions in the aviation sector
The Impact of Mergers and Acquisitions on the Potential Anticompetitive Behaviors of a Firm: An Economic Legal Analysis
Mergers and acquisitions are common strategies for business expansion, but they also carry the risk of enabling anti-competitive practices. This paper analyses the potential of engaging in anti-competitive practices before a company engages in M&A, such as predatory pricing, so that the competitor has no other option, but to sell the company to the dominant or superior firm. Vertical integrated firms can further exacerbate the impacts caused by the anticompetitive actions; due to the higher leverage it has to absorb the losses. This paper established its research by using normative legal analysis method and comparative and case-based approach. The objective of this research is to examine the legal gap in Indonesian competition law concerning pre-merger anti-competitive behavior, particularly predatory pricing, and to propose legal reforms to ensure more comprehensive oversight of merger activities. The case of Amazon-Quidsi is used as a comparative case, highlighted the importance of the supervision of anti-competitive actions during pre-merger, in which the current Indonesian Law No. 5 1999 only highlights the anti-competitive possibilities during post-M&A. Therefore, this paper has established that pre-merger anticompetitive practices, such as predatory pricing, pose a threat to fair competition and is insufficiently regulated under current Indonesian competition law. Based on this analysis, the paper proposes specific legal reforms, targeting to minimize the regulatory gaps to ensure efficient oversight of merger activities from pre-merger stage
Implementasi Prinsip Good Corporate Governance dalam Pencegahan Tindak Pidana Korupsi di BUMN
Good Corporate Governance (GCG) memiliki peran penting dalam mencegah praktik korupsi di lingkungan Badan Usaha Milik Negara (BUMN). Meskipun regulasi telah diterapkan, masih terdapat berbagai kasus korupsi yang menunjukkan lemahnya implementasi prinsip tata kelola perusahaan. Artikel ini bertujuan untuk menganalisis peran GCG, core values AKHLAK, serta sistem whistleblowing dalam mencegah dan menanggulangi tindak pidana korupsi di BUMN. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan sistem hukum. Data yang digunakan merupakan data sekunder yang diperoleh dari regulasi, literatur ilmiah, serta laporan kasus terkait. Analisis dilakukan secara deskriptif kualitatif untuk menelaah keterkaitan regulasi dengan praktik di lapangan. Hasil penelitian menunjukkan bahwa meskipun telah ada regulasi yang mengatur GCG dan sistem pengawasan internal, masih terdapat kelemahan dalam penerapan yang memungkinkan terjadinya korupsi. Oleh karena itu, diperlukan penguatan mekanisme pengawasan dan akuntabilitas yang lebih ketat, termasuk optimalisasi sistem whistleblowing serta peningkatan transparansi dalam laporan keuangan dan kinerja BUMN
LEGAL COMPLIANCE OF MSMES WITH INTERNATIONAL PRODUCT STANDARDS FOR CONSUMER PROTECTION IN CROSS-BORDER TRADE
The growth of cross-border trade has opened international market access for Indonesian micro, small, and medium enterprises (MSMEs). However, entering the global market requires compliance with international product standards that function not only as trade technicalities but also as instruments of consumer protection. This article explores how Indonesian MSMEs, especially in the cosmetics sector, respond to the legal obligations imposed by the European Union and the United States regarding labeling, certification (e.g., halal, safety), and toxicology testing. Using a normative-juridical method and a comparative approach, this paper examines how international product standards reflect consumer protection norms and evaluates the extent to which Indonesian MSMEs are legally prepared to comply. Failure to meet these standards may lead to sanctions such as product bans, recalls, or even legal suits. This study argues for a stronger regulatory framework and legal assistance to support MSMEs’ internationalization while ensuring global consumer safety
The Effectiveness of REDD+ in Forest Conservation Efforts is Linked to Sustainable Development Aspects
The REDD+ scheme is a global incentive mechanism for countries that are able to protect their forests. Through this REDD+ mechanism, it is hoped that aspects of sustainable development can be realized for future generations. There are several obstacles in implementing REDD+, including the mechanism for returns from carbon sales that will be obtained by forest managers. Through this article, it is hoped that the public will understand, comprehend and apply the REDD+ program. The approach used in writing this article is a normative juridical approach. The implementation and effectiveness of this program cannot be said to have been carried out well, because the mechanism for providing incentives is not simple, and outreach to the community has not been optimal, so that the main target of this program as an instrument in protecting forest areas while increasing the welfare of forest area communities has not been achieved
The Phenomenon of Groomer Manipulation of Children; Initiating Law Concerning Child Sexual Grooming
Grooming is a process of manipulation carried out by the groomer on the child so that the child believes that the groomer is worthy of admiration, trust, and love. If an emotional connection has been created, the groomer will easily commit sexual crimes against children. This research discusses the relationship patterns between groomers and victims, crimes targeted by groomers, and the urgency of drafting a law on child sexual grooming. It is normative juridical research that examines the emptiness of norms regarding child sexual grooming. The groomer builds an emotional relationship with the victim, both offline and online grooming, even starting with online grooming and continuing with offline grooming to realize the target of his actions. Targeted crimes can include obtaining pornographic photos and videos of the victim for the satisfaction of the perpetrator, using the victim's photos to humiliate, oppress and intimidate or take revenge on the victim, obtaining pornographic material to be sold to porn site users, and doing sexual intercourse with children. Unfortunately, Indonesia does not yet have a law on child sexual grooming, so pre-sexual violence is not a criminal offense. Criminalizing the Law on child sexual grooming will increase children's sensitivity to sexual violence
Rahasia Dagang sebagai Non-Registrable Intellectual Property dalam Perspektif Penjaminan Kekayaan Intelektual
Pelindungan Rahasia Dagang yang bersifat non-registrable menjadi tantangan bagi rezim Kekayaan Intelektualuntuk dapat memperoleh penjaminan berbasis Kekayaan Intelektual. Terdapat benturan antara aspek publisitasjaminan fidusia dan unsur kerahasiaan atas suatu informasi rahasia yang bernilai ekonomis. Hal ini menjaditantangan tersendiri mengingat Rahasia Dagang merupakan aset potensial dan bahkan dapat sebagai aset utama bagi suatu bidang teknologi maupun kegiatan usaha yang apabila memperoleh suntikan dana atau akses permodalan berprospek besar untuk memberikan kontribusi positif terhadap perekonomian nasional. Disamping itu pula, setelah diundangkannya Undang-Undang Nomor 24 Tahun 2019 tentang Ekonomi Kreatif dandisusul dengan peraturan pelaksananya melalui Peraturan Pemerintah Nomor 24 Tahun 2022, faktanya, hinggasaat ini masih terdapat kekosongan hukum dalam hal aturan teknis dan prosedural sehingga hal ini menghambat sinergitas antara para pihak. Penulisan artikel jurnal ini menggunakan metode penelitian yuridis-normatif yang mengkaji persoalan penjaminan Kekayaan Intelektual di Indonesia berdasarkan keilmuan hukum dan peraturan perundang-undangan. Diperlukan adanya pergerakan baik dari segi regulasi maupun kolaborasi antara para pihak baik itu pihak pemerintah, lembaga keuangan perbankan maupun non-bank, pelaku ekonomi kreatif, serta para akademisi agar dapat terjadi akselerasi dalam implementasi penjaminan Kekayaan Intelektual
