    Analysis of The ITE Law and Criminal Acts of Carding and Phishing in Indonesia

    Introduction to the Problem: The advancement of information and communication technology in Indonesia has increased cybercrimes such as carding and phishing. Although the Electronic Information and Transactions (ITE) Law No. 19 of 2016 regulates sanctions, it lacks specificity in addressing the evolving methods of cybercrime, making law enforcement and public protection more difficult.Purpose/Study Objectives: This research evaluates the effectiveness of the ITE Law against carding and phishing, analyzes its implementation, and offers recommendations to make adaptive regulations to new cybercrime methods.Novelty: It offers a critical analysis of legal and implementation gaps related to carding and phishing, emphasizing the urgency of law reform and the integration of preventive strategies.Methodology: This study uses a mixed-method approach, combining legal document analysis and empirical surveys to assess the effectiveness of the ITE Law and identify challenges in tackling carding and phishing crimes.Results/Findings: The results show that while the ITE Law offers a legal foundation, it lacks sufficient detail to address new cybercrime methods. There is a need for more specific regulations, stronger inter-agency cooperation, improved digital literacy, and stricter sanctions. Preventive efforts such as education, stronger security, and collaboration are essential to reduce risks and close legal gaps

    EKSISTENSI RISALAH AL-QADHA DALAM PENYELESAIAN SENGKETA EKONOMI SYARIAH DI INDONESIA: PELUANG DAN TANTANGAN

    Agama Islam merupakan rahmatan lil alamin yang berarti rahmat bagi semesta alam. Islam mengatur pula semua sendi kehidupan manusia, tidak terkecuali hubungan antara manusia dengan manusia. Hubungan antar manusia terkait dengan permasalahan atau sengketa harus diselesaikan dengan cara yang terbaik. Islam mengaturnya dalam Al Quran dan Hadits, dan dalam perkembangan terdapat Prinsip atau Risalah Al Qadh yang termahsyur yang dikemukakan oleh Khalifah Umar bin Khattab R.A. Penulisan artikel ini ditujukan untuk menemukan bagaimana eksistensi prinsip-prinsip dalam Risalah Al Qadh dalam penyelesaian sengketa Ekonomi Syariah di Pengadilan Agama di Indonesia, serta lebih lanjut menentukan peluang dan tantangan dalam mengimplementasikan prinsip-prinsip Risalah Al Qadh dalam Hukum Acara Perdata khususnya di Pengadilan Agama di Indonesia. Penelitian ini dilakukan dengan pendekatan yuridis normatif yang bersifat deskriptif analitis. Berdasarkan hasil penelitian, disimpulkan bahwa, pertama, risalah Al Qadha adalah sangat relevan dan diimplementasikan dalam penyelesaian sengketa ekonomi Syariah di Indonesia, yang terbukti diadopsi dalam Hukum Acara Perdata di Pengadilan Agama, khususnya Perma No. 14/2016 yang dapat dianggap sebagai kodifikasi modern dari Risalah Al Qadha, yang merupakan transformasi dari filososfis hukum ke teknis-yuridis. Kedua, terdapat peluang yang siginifikan untuk mengembangkan penyelesaian sengketa bisnis Syariah yang lebih efektif dengan konsisten mengimplementasikan risalah Al Qadha, walaupun dengan tantangan tersendiri terkait dengan hakim bersertifikasi Ekonomi Syariah yang jumlahnya masih terbatas di Pengadilan Agama Indonesia

    Introduction to the Problem: The development of fintech in Indonesia marks a significant milestone in accelerating the national digital economy. As a solution to the limitations of conventional financial services, fintech supports more efficient business processes, particularly for small and medium enterprises. However, the integration of fintech in e-commerce depends heavily on consumer personal data, which is vulnerable to misuse without consent, potentially harming consumers as data owners.The problem formulation discussed is the protection of consumer personal data in fintech-based e-commerce transactions in Indonesia.Purpose/Study Objectives: This study aims to identify and analyze the legal provisions for protecting consumer personal data within fintech based e-commerce transactions in Indonesia.Novelty: It specifically examines the application of Indonesia's newly enacted Personal Data Protection Law as a legal foundation for this context, linking fintech operations directly to consumer data privacy mandates.Methodology: This research is descriptive and analytical, conducted using normative legal methods, and the data obtained is analyzed qualitatively and legally.Results/Findings: The study confirms that several Indonesian regulations, particularly the Personal Data Protection Law, provide a robust legal framework for protection. However, these existing regulations require consistent enforcement and monitoring to ensure proper implementation

    Preventing Duplication of Civil Cases: Integrating Res Sub Judice into Indonesian Procedural Law

    Indonesian civil procedure law does not yet regulate the res sub judice doctrine, which risks leading to duplicate lawsuits and different decisions because the HIR and RBg only contain provisions on relative and absolute competence. To analyze the comparative regulation of sub judice and res sub judice and to offer an ideal concept for their application in Indonesian civil procedure law. It offers a normative framework to fill legal gaps and prevent forum shopping, an issue that has not been studied in depth before. This study conducts normative legal research using a statutory, conceptual, and comparative approach, referencing practices in India, the UK, Canada, and Kenya. The principle of sub judice protects the judiciary from external influence, while the principle of res sub judice ensures efficiency and legal certainty by prohibiting the double examination of the same dispute. Its integration into Indonesian civil procedure law is necessary through the judge's obligation to declare a double lawsuit inadmissible (niet ontvankelijk verklaard) and the plaintiff's obligation to attach a statement confirming the absence of a similar lawsuit to maintain legal certainty and support the principles of fast, simple, and low-cost justice

    Land Use Conversion in Indonesian Food Security Policy: Environmental Impacts and Sustainable Food Land Provision Strategies

    Introduction to the Problem: The state is obligated to ensure food security and environmental protection. In Indonesia, this is pursued through the food estate program to increase food production. However, land conversion in forest and peatland areas causes environmental degradation and sustainability risks, raising legal issues regarding compliance with environmental and sustainable land management regulations.Purpose/Study Objectives: This study analyzes the environmental impacts of land conversion under the food estate program and identifies legally sustainable strategies for food land provision within Indonesian environmental and agrarian law.Novelty: This research proposes a sustainable legal framework that prioritizes strengthening the protection of Sustainable Food Agricultural Land and Protected Rice Fields, alongside utilizing the Land Bank mechanism as more environmentally responsible alternatives to large-scale land clearing.Methodology: The research employs a normative juridical approach by examining legal doctrines, statutory regulations, and policy documents on land conversion, food security, and environmental protection, complemented by focus group discussions with key informants to clarify practical legal issues.Results/Findings: The study finds that the designation of food estate areas, particularly in forest and peatland ecosystems, has caused significant environmental harm, including ecosystem degradation, biodiversity loss, hydrological disruption, and increased disaster risks that undermine long-term food security goals

    Analisis Pembatalan Izin Pembangunan PLTU Tanjung Jati A Berdasarkan Perubahan Iklim dan Pembangunan Berkelanjutan

    Pemanfaatan Pembangkit Listrik Tenaga Uap (PLTU) di Indonesia begitu krusial untuk pemenuhan energi. Di sisi lain, terdapat kekhawatiran terhadap kualitas lingkungan dan kesehatan, salah satunya masyarakat Cirebon yang terdampak oleh pembangunan PLTU Tanjung Jati A. Emisi karbon dioksida yang dihasilkan PLTU berkontribusi terhadap perubahan iklim dan penurunan kualitas hidup. Penelitian ini bertujuan menganalisis pembatalan izin pembangunan PLTU Tanjung Jati A sebagai langkah preventif melindungi lingkungan dari kerusakan dan mengkaji implikasinya terhadap komitmen Indonesia dalam Tujuan Pembangunan Berkelanjutan (SDGs). Penulis menggunakan pendekatan yuridis normatif, dengan menganalisis data sekunder berupa peraturan perundang-undangan, buku, dan artikel terkait. Hasil penelitian menunjukkan praktik litigasi lingkungan yang ditempuh Penggugat atas Gugatan Pembatalan Izin Pembangunan PLTU Tanjung Jati A ke PTUN Bandung menjadi mekanisme hukum untuk mencegah terjadinya kerusakan ekologis meskipun masih berbentuk potensi. Implikasi pembatalan izin ini memperkuat komitmen Indonesia terhadap SDGs 7, SDGs 13, mendorong transisi energi menuju sumber daya terbarukan, dan menjadi preseden penting bagi perlindungan lingkungan hidup serta pembangunan berkelanjutan di Indonesia.     The Implementation of Scientific Evidence in Resolving Environmental Criminal Disputes in Court

    Environmental criminal cases in Indonesia face significant challenges, particularly in legal proof involving scientific evidence. This study aims to analyze the types of scientific evidence admissible in court and evaluate the challenges of its implementation in judicial proceedings. Using normative-legal and empirical approaches, the research examines regulations, case studies, and judicial decisions to understand the role of scientific evidence in establishing causality between the perpetrator’s actions and environmental damage. The findings reveal that scientific evidence is pivotal in strengthening proof by providing objective and reliable data. However, its application in court often faces barriers such as limited access to credible data, technical constraints, and insufficient judicial understanding of scientific methodologies. To address these challenges, the study recommends strengthening legal frameworks for evidence admission, providing technical training for judges, and fostering collaboration with accredited scientific institutions. These findings contribute significantly to promoting the integration of science into environmental law enforcement for more effective justice

    The Impact of the Words 'Digawa' and 'Digawa' in Customary Law in Cirebon

    The study starts from the perception established in Cirebon society regarding ex-husbands bringing back their belongings during a divorce. The discussion focuses on the impact of the meanings of ‘digawa’ and ‘kegawa’ on the handover tradition of the bride and groom in Cirebon on divorce. Not much is known, the meaning of ‘digawa’ and ‘kegawa’ at the handover ceremony of the bride and groom turns out to show a marriage agreement, the legal consequences of which can be seen at the time of a divorce. A qualitative study with the perspective of ‘digawa’ and ‘kegawa’ with a marriage agreement on the handover tradition of the bride and groom. The discussion of the meanings of ‘digawa’ and ‘kegawa’ found the basis for justification for the actions of the ex-husband, bringing back the luggage when it was given at the handover ceremony of the bride and groom, the comments that occurred, showed limited knowledge of the handover tradition of the bride and groom which contained a marriage agreement. Likewise, with its legal position, there are no deviations from the marriage agreement which are concluded in the meaning of ‘digawa’ and ‘kegawa’

    The Use of Istifadhah Witnesses in Marriage Validation Cases in Indonesian Religious Courts

    This study discusses the use of istifadhah witnesses in marriage isbat cases in Religious Courts following the issuance of Supreme Court Circular Letter No. 10 of 2020 (SEMA). The study compares judges' considerations regarding the criteria for using istifadhah witnesses in such cases, both before and after the issuance of SEMA. The findings indicate that istifadhah witnesses provide testimony based on widely disseminated information within the community. Initially, the use of these witnesses was inadmissible as evidence in civil cases because istifadhah testimony was deemed contrary to Article 1907 of the Civil Code (KUHPerdata), which requires that witness testimony must be based on direct knowledge of the matter in question. Following SEMA, the use of istifadhah witnesses has been recognised in the validation of unregistered marriage cases involving marriages conducted long ago. The use of istifadhah witnesses, before and after SEMA, is positioned as preliminary evidence that requires corroborative evidence to support the judge's presumption. Judges consider several criteria for the use of istifadhah witnesses: first, the absence of living witnesses who can testify directly; second, the use of istifadhah witnesses must be supported by qarinah (indications or circumstantial evidence) that can reinforce the judge's presumption towards forming a conviction

    Reformulasi Kepastian Hukum Arbitrase Internasional terhadap Penguatan Peran Indonesia sebagai Arbitration Hub Pasca Putusan MK No. 100/PUU-XXII/2024

    Selama lebih dari dua dekade, ambiguitas definisi putusan arbitrase internasional dalam Pasal 1 angka 9 Undang-Undang Nomor 30 Tahun 1999 telah mendistorsi kepastian hukum nasional serta memicu fenomena pelarian sengketa (flight of disputes) ke yurisdiksi asing akibat risiko eksekusi yang tidak terprediksi. Penelitian ini bertujuan menganalisis implikasi yuridis Putusan Mahkamah Konstitusi No. 100/PUU-XXII/2024 dalam merekonstruksi kepastian hukum arbitrase serta mengkaji kontribusinya terhadap penguatan peran Indonesia dalam peta kompetisi penyelesaian sengketa regional. Dengan menggunakan metode penelitian yuridis normatif melalui pendekatan perundang-undangan dan konseptual, penelitian ini menemukan bahwa pembatalan frasa multitafsir oleh Mahkamah Konstitusi secara fundamental telah mengembalikan supremasi prinsip teritorialitas, menyederhanakan prosedur penentuan forum yang sebelumnya tumpang tindih, serta mentransformasi paradigma peradilan menjadi lebih suportif. Penelitian menyimpulkan bahwa rekonstruksi norma ini bukan sekadar koreksi tekstual, melainkan berfungsi sebagai penyeimbang strategis (great equalizer) yang meruntuhkan hambatan struktural, menurunkan biaya transaksi, serta memberikan modalitas yuridis bagi Indonesia untuk menawarkan jaminan safe seat guna merebut kembali pasar sengketa domestik dan memperkuat daya saing sebagai Arbitration Hub yang kompetitif
