Pertanggungjawaban Pidana Korporasi (Studi pada Putusan Pengadilan Negeri Unaaha Nomor 114/Pid.B/LH/2020/PN Unh)
Penambangan telah menjadi kegiatan yang diminati sejak dahulu karena Indonesia memang kaya akan sumber daya. Dalam pemanfaatannya, sumber daya harus digunakan sebesar-besarnya untuk kemakmuran rakyat, selaras dengan pasal 33 ayat 3 Undang-undang Dasar (UUD) 1945. Telah banyak pengaturan mengenai kegiatan penambangan ini, tetapi masih tetap banyak terjadi pelanggaran khususnya di Indonesia. Salah satunya dapat dilihat dalam Putusan Pengadilan Negeri Unaaha Nomor 114/Pid.B/LH/2020/Pn.Unh. PT Natural Persada Mandiri (PT NPM) mendapatkan izin untuk melakukan kegiatan penambangan secara lisan dari PT Bososi Pratama. Dalam prosesnya, terjadi pelanggaran dan direktur utama dari PT NPM dimintai pertanggungjawaban di pengadilan. Penelitian ini bertujuan untuk mengetahui konsep pertanggungjawaban pidana korporasi yang terjadi dalam Putusan Pengadilan Negeri Unaaha Nomor 114/Pid.B/LH/2020/Pn.Unh dan urgensi dari diberlakukannya konsep pertanggungjawaban pidana korporasi
Quo Vadis Kejahatan Konservasi Satwa Dilindungi Penyu Hijau berdasarkan Prinsip Ultimum Remedium
Penurunan populasi satwa liar, khususnya satwa yang dilindungi di Indonesia, menjadi tantangan serius dalam upaya konservasi sumber daya alam hayati. Hadirnya Undang-Undang No. 5 Tahun 1990 jo Undang-Undang No. 32 Tahun 2024 (UU KSDAHE) telah memberikan pembaharuan dalam konteks hukum perlindungan konservasi sumber daya alam hayati di Indonesia. Penelitian ini hadir dengan fokus pada kasus kejahatan terhadap Penyu Hijau pada Putusan Pengadilan Negeri Raba Bima. Metode penelitian menggunakan pendekatan yuridis normatif dengan studi kasus putusan pengadilan terkait kejahatan konservasi. Hasil penelitian menunjukkan bahwa eksploitasi satwa dilindungi dipicu oleh permintaan organ satwa untuk kebutuhan obat dan status sosial, serta kesenjangan ekonomi. Meskipun regulasi telah diterbitkan, penegakan hukum belum sepenuhnya efektif dalam menjangkau masyarakat luas. Penerapan prinsip ultimum remedium dalam konteks konservasi masih menghadapi kendala dalam memberikan efek jera. Oleh karena itu, diperlukan penguatan mekanisme penegakan hukum dan edukasi publik untuk menjaga keseimbangan ekosistem secara holistik dan berkelanjutan
Early Warning System in The Supervision of Village-Owned Enterprise (BUMDes) Management: A Legal Perspective and its Implementation in Bali Province
The growing involvement of Village-Owned Enterprise (BUMDes) administrators in legal cases indicates that the early warning system intended to prevent corruption and abuse of authority has not functioned effectively. This reflects limited understanding of regulatory provisions and internal control mechanisms. This study aims to analyze the effectiveness of the early warning system in BUMDes governance in Bali and to propose preventive strategies based on collaboration between local governments and law enforcement agencies. The novelty lies in combining normative legal analysis with an institutional governance approach. Using a normative legal method through statutory analysis, case studies, and conceptual review, the findings reveal that low legal literacy, ineffective reporting mechanisms, and weak inter-agency coordination hinder early prevention efforts. Strengthening preventive strategies through anti-corruption education, governance training, and integrated oversight systems is essential to reduce legal violations and preserve the strategic role of BUMDes in improving rural welfare in Bali.Tingginya keterlibatan pengurus BUMDes dalam perkara hukum mengindikasikan lemahnya sistem peringatan dini untuk mencegah korupsi dan penyalahgunaan wewenang. Rendahnya pemahaman terhadap regulasi pengawasan turut memperburuk kondisi ini. Pemerintah daerah, kejaksaan, hingga pemerintah pusat telah berupaya menekan pelanggaran hukum dalam pengelolaan BUMDes. Provinsi Bali menempati posisi penting dengan kepemilikan BUMDes di atas 90%, bahkan Kabupaten Jembrana dan Badung mencapai 100%. Jumlah ini menunjukkan potensi besar bagi pertumbuhan ekonomi desa, namun juga diikuti tingginya kasus hukum, terutama yang melibatkan BUMDes dan LPD dalam bentuk korupsi dan pelanggaran lainnya. Idealnya, masalah tersebut dapat dicegah melalui pengawasan optimal dan sistem deteksi dini. Penelitian ini menggunakan pendekatan hukum normatif melalui analisis peraturan, studi kasus, dan telaah konseptual. Hasil penelitian menekankan perlunya pembenahan sistem peringatan dini, peningkatan literasi hukum, pelatihan pengelolaan organisasi, dan penguatan sistem bisnis. Upaya tersebut harus dilaksanakan secara berkelanjutan oleh pemerintah daerah bersama aparat penegak hukum, dengan menitikberatkan pencegahan, bukan hanya tindakan represif, guna menjaga peran strategis BUMDes dalam meningkatkan kesejahteraan masyarakat desa di Bali
Protection of Vulnerable Consumers in The Perspective of Economic Law and Sustainable Development
The protection of vulnerable consumers constitutes an essential component of social economic law, reflecting the state’s role in correcting market imbalances and safeguarding disadvantaged groups. This study examines the relationship between economic law, consumer protection, and sustainable development, positioning consumer protection not merely as a market-regulating mechanism but as a legal instrument to promote social justice and inclusive growth. Vulnerable consumers, including children, women, the elderly, and low-income communities, face structural inequalities, limited access to justice, and heightened exposure to unfair business practices. This research employs a normative qualitative approach through doctrinal analysis and secondary data review to assess Indonesia’s consumer protection framework in relation to the Sustainable Development Goals (SDGs). The findings show that responsive consumer protection laws contribute to sustainable development by supporting poverty reduction, gender equality, responsible consumption, and access to justice. The integration of sustainability principles refers to embedding long-term social and economic considerations, ethical business conduct, and protection of vulnerable groups within consumer protection policies. The study concludes that revising Indonesia’s Consumer Protection Law is essential to strengthen legal protection and align national policies with international best practices
EXISTENCE OF COMPLETE SYSTEMATIC LAND REGISTRATION IN CENTRAL SULAWESI PROVINCE
Land certification is something that needs to be done by the community in obtaining legal clarity and authentic evidence regarding ownership of their land. Complete Systematic Land Registration (PTSL) is a government program that aims to accelerate and facilitate land certification for people throughout Indonesia. This program aims to provide legal certainty over land ownership, reduce agrarian conflicts, and increase public access to banking and economic services through the use of land certificates as collateral. This study analyzes the implementation of PTSL carried out by the Land Office in Palu City, Donggala Regency, and Sigi Regency, focusing on the results of annual achievements, challenges faced, and their impact on the community. This research was conducted using a research method with empirical juridical analysis with the aim of analyzing the implementation of the PTSL program at the Land Office in three regions, namely Palu City, Donggala Regency, and Sigi Regency. The research population is the land ownership that is the target of PTSL during the implementation period of 2022-2023. Based on annual data, the PTSL program shows positive results in increasing the number of certified land, although there are still obstacles such as lack of resources and low public awareness in some areas. Through several suggestions, such as increasing socialization, simplifying administrative processes, and adequate budget support, it is hoped that the effectiveness of PTSL can be more optimal. With community involvement and sustainable government support, PTSL has the potential to become a strategic solution in realizing legal certainty and encouraging community economic development
Deed of Settlement (Dading) For Muslim Inheritance: The Principle of Ijbari Vs Civil Code
Introduction to the Problem: In practice, the settlement of inheritance disputes among Muslims is often carried out through a Dading Deed before a notary, the substance of which is not always consistent with Islamic inheritance law.Purpose/Study Objectives: This study aims to analyze the conformity of the Dading Deed as a means of inheritance distribution for Muslims from the perspective of both the Civil Code and Islamic inheritance law.Novelty: The uniqueness of this research lies in its comparative approach between the two legal systems.Methodology: Employing a descriptive and normative-empirical method, the study utilizes both primary and secondary data. Primary data were obtained through interviews with Notary X in Bantul Regency, while secondary data were derived from literature, legal instruments, and three Dading Deeds documents analyzed in this study.Results/Findings:The findings indicate that the Dading Deed made by Notary X does not fully comply with applicable regulations, as it contains clauses equating it with a Settlement Agreement ratified by the court (Acte van Vergelijk). Moreover, it overlooks the principles of Ijbari and Ishlah in Islamic inheritance law, since it fails to include a clause confirming that the heirs understand and acknowledge their respective shares according to Islamic provisions
The Prosecutor as Dominus Litis in Controlling Case Under the Draft of Criminal Procedure Code (RKUHAP)
Introduction to the Problem: The application of The Dominus Litis principle in the Criminal Procedure Code (KUHAP) is not yet optimal, resulting in the role of prosecutors as public prosecutors being less than maximal.Purpose/Study Objectives: This study discusses the application of the Dominus Litis principle in the Indonesian criminal justice system, where prosecutors as public prosecutors have a crucial role in controlling the criminal case process. The Dominus Litis principle grants authority to prosecutors to control the criminal case process from investigation to prosecution.Novelty: This study recommends revising the Criminal Procedure Code (RKUHAP) to fully and comprehensively apply the Dominus Litis principle to the Prosecution. Thus, the ultimate goal of criminal procedure law can be achieved, namely justice and legal certainty for all parties.Methodology: This study uses a normative juridical research method with a statutory approach and a conceptual approach.Result/Findings: The results show that the application of the Dominus Litis principle by the Prosecution in law enforcement in Indonesia is not yet fully effective. Therefore, it is necessary to strengthen the institutional capacity of the Prosecution and the role of prosecutors as Dominus Litis to ensure the validity of evidence and justice for defendants and victims
Hospital IPO, Between Financialization and the State’s Duty to the Right to Health
Introduction to the Problem: The role of the private sector, particularly hospitals conducting an Initial Public Offering (IPO), raises a dilemma because profit orientation often conflicts with the constitutional mandate requiring the State to provide health services for all citizens.Purpose/Problem Statement: To address the legal issues surrounding hospitals that go public and to formulate a framework ensuring that the business orientation of hospitals continues to guarantee the right to health for the wider community.Novelty: The idea of integrating the ownership of public hospitals by nonprofit institutions as controlling entities and developing a Social Stock Exchange (SSE) in Indonesia as an alternative social financing instrument.Methodology: Normative juridical research with a conceptual approach. The analysis focuses on two main concepts: the State’s responsibility in ensuring the right to health and the legal form of hospitals as business entities.Results/Findings: Hospitals that go public must maintain share ownership by nonprofit legal entities, and Indonesia needs to establish an SSE as a platform for hospitals to obtain additional capital through traded instruments
The Plant Variety Protection Commission's Role in Fostering Breeders'Creativity
Plant Variety Protection is an intellectual property with a sui generis regulatory nature. The state grants this right to a variety that meets the requirements, namely new, unique, uniform, stable, and named to increase biological resources that can produce new plant varieties for the sake of increasing the agricultural sector in Indonesia. For this, it is necessary to optimize the Center for Plant Variety Protection and Agricultural Licensing as the manager of plant variety protection to increase the number of applications for plant variety protection rights. Part of the management office that provides input in the management of plant variety protection is the Plant Variety Protection Commission. This commission until now does not have detailed authority regulations in the Plant Variety Protection Law. Through normative legal research methods with analytical descriptive research specifications and qualitative legal data analysis techniques, it is known that plant breeders have the right to obtain plant variety protection rights in a faster and more efficient manner. For this, it is necessary to change the regulations in Law 29 of 2000 concerning the composition and authority of the Plant Variety Protection Commission in Indonesia regarding the results of the examination of the requirements for plant varieties that are granted rights by involving all stakeholders. The consultation procedure in the form of recommendations for changing claims is used to increase efficiency in obtaining plant variety protection rights for plant breeders in Indonesia
Menelaah Greenwashing: Perlindungan Hukum Konsumen di Tengah Tren Produk Ramah Lingkungan
Fenomena greenwashing kian marak seiring meningkatnya kesadaran masyarakat terhadap pentingnya konsumsi produk ramah lingkungan. Pelabelan yang menyesatkan, penggunaan istilah hijau tanpa dasar yang sah, serta minimnya pengawasan hukum berkontribusi terhadap kerugian konsumen baik secara ekonomi maupun ekologis. Artikel ini bertujuan untuk menganalisis bentuk dan dampak greenwashing terhadap konsumen serta mengkaji efektivitas perlindungan hukum konsumen dalam menghadapi praktik tersebut. Melalui pendekatan normatif, artikel ini menelaah peraturan perundang-undangan yang berlaku serta menganalisis tantangan regulatif dan edukatif dalam konteks perlindungan konsumen di Indonesia. Hasil kajian menunjukkan bahwa meskipun telah terdapat kerangka hukum dasar, namun masih terdapat kekosongan dalam regulasi khusus mengenai klaim lingkungan, lemahnya pengawasan, dan rendahnya literasi konsumen. Oleh karena itu, diperlukan upaya penguatan regulasi dan edukasi yang terpadu untuk melindungi hak konsumen secara efektif
