    IMPLEMENTATION OF THE BEST INTERESTS PRINCIPLE FOR CHILDREN WHO COMMIT VIOLENT CRIMES RESULTING IN THE DEATH OF CHILDREN (STUDY IN THE CENTRAL JAKARTA DISTRICT COURT)

    Children are the future generations of the nation and state, and it is essential that they receive protection to ensure their growth into fully developed human beings. However, in today's society, many children become entangled with the law, go through legal processes, and even face criminal sentences, where the principle of the best interests of the child is not yet the primary consideration for law enforcement authorities in handling cases involving children. This situation can have negative effects on a child's development. This study is a normative-empirical legal research with a legislative and case-based approach. The research findings indicate that the implementation of the best interests principle for children who commit violent crimes resulting in the death of children (a study conducted in the Central Jakarta District Court) is not yet optimally realized. During the legal proceedings, investigators and prosecutors still detain children, imprisonment remains the prosecutor's choice in the indictment, and during the trial, judges still opt for primary imprisonment as a punishment, even though there are alternative forms of sanctions such as rehabilitation, either within or outside institutions, which could be imposed on children, considering the conditions they are currently experiencing for their future well-being and development

    AbstrakIndonesia memiliki tujuan untuk mempromosikan perkembangan energi baru dan terbarukan melalui perancangan Rancangan Undang-Undang Energi Baru dan Energi Terbarukan (RUU EBET). Dalam konteks penggunaan nuklir sebagai sumber energi, perlu ada peraturan yang mengatur penggunaan energi nuklir secara khusus. Hal ini digunakan sebagai indikator kesiapan Indonesia dalam mengelola energi nuklir, dengan tetap memperhatikan kelestarian lingkungan hidup dan dampak yang mungkin timbul dari penggunaan energi nuklir untuk memenuhi kebutuhan energi nasional.Namun, dari hasil penelitian, terungkap bahwa penyertaan nuklir dalam RUU EBET tidak selaras dengan tujuan pembentukan RUU EBET itu sendiri, yang seharusnya bertujuan untuk meningkatkan penggunaan energi yang bersih dan terjangkau. Oleh karena itu, penting untuk menganalisa kesiapan Indonesia dalam mengadopsi penggunaan energi nuklir dengan cermat. Ini harus mempertimbangkan dampaknya terhadap lingkungan hidup, yang jika tidak diperhatikan dengan baik, dapat mengancam kehidupan masyarakat.Kata kunci: energi; nuklir; limbah; regulasi AbstractIndonesia has a goal to promote the development of new and renewable energy through the drafting of the New and Renewable Energy draft Bill (RUU EBET). In the context of using nuclear energy as a source of power, there is a need for specific regulations to govern the use of nuclear energy. This is used as an indicator of Indonesia's readiness to manage nuclear energy while considering environmental sustainability and potential impacts from the use of nuclear energy to meet national energy needs. However, the resultsof the research have revealed that the inclusion of nuclear energy in the RUU EBET is not in line with the intended purpose of the RUU EBET itself, which should aim to enhance the use of clean and affordable energy. Therefore, it is important to carefully analyze Indonesia's readiness to adopt nuclear energy use. This analysis must take into account its environmental impact, which, if not carefully considered, could pose a threat to the lives of the population.Keywords: energy; nuclear; waste; regulation

    ABSTRAKPelaku bisnis ingin sebuah kepastian dari segi hukum maupun keotentikan data yang memiliki peranan penting dalam transaksi bisnis, maka dari situlah peran tanda tangan digital serta sertifikat digital dalam PrivyID sebagai terobosan teknologi untuk mewujudkan keinginan sebagai pelaku bisnis. Dalam transaksi suatu keniscayaan apabila terjadi sengketa, maka diperlukan pengetahuan terkait bagaimana upaya penyelesaian sengketa tanda tangan digital dalam transaksi bisnis apabila terjadi wanprestasi. Tujuan penelitian ini mengetahui serta menganalisis mengenai kepastian hukum tanda tangan digital pada platform privyid di Indonesia, dengan menggunakan metode penelitian hukum normatif dengan pendekatan perundang-Undangan dan pendekatan konseptual, serta menggunakan bahan hukum primer, sekunder, dan non hukum. Hasil menunjukkan bahwa tanda tangan digital pada dokumen elektronik memiliki kepastian hukum sebagai alat bukti menurut hukum acara perdata yang merupakan perluasan dari alat bukti surat serta didukung keberadaan certifikat authority (CA).Kata kunci: pelaku bisnis; tanda tangan digital; wanprestasi. ABSTRACTBusiness actors seek legal certainty and data authenticity, which play important roles in business transactions. Hence, the role of digital signatures and digital certificates within PrivyID serves as a technological breakthrough to fulfill the desires of business actors. In any transaction, disputes may arise, necessitating knowledge of how to resolve disputes related to digital signatures in the event of non-performance. The objective of this research is to understand and analyze the legal certainty of digital signatures on the PrivyID platform in Indonesia. This study utilizes a normative legal research method with legislative and conceptual approaches, along with primary, secondary, and non-legal sources. The analysis reveals that digital signatures on electronic documents possess legal certainty as evidence under civil procedural law, which extends the evidentiary value of written documents and is supported by the existence of a certificate authority (CA).Keywords: business actor; default; digital signatures

    Pengaruh Buzzer Politik dalam Pemilu: Tantangan Terhadap Electoral Justice dalam Mempertahankan Prinsip Demokrasi

    Buzzer merupakan aktor paling penting dalam penggiringan opini di dunia maya. Dalam perkembangannya, buzzer tidak hanya berfungsi untuk memasarkan atau menjual suatu produk, namun juga berperan dalam suatu kegiatan kampanye politik. Dalam kontestasi politik, strategi pemasaran yang dilakukan oleh buzzer ada dua, yakni kampanye negatif dan positif. Namun, dalam kedua jenis kampanye tersebut terdapat dilematika yang harus dihadapi, yaitu antara pentingnya sebuah kejujuran dan praktik memoles citra diri.  Dilematika tersebut yang sejatinya menciptakan persaingan politik yang tidak sehat dimana hal ini tentu bertentangan dengan cita-cita demokrasi yang dimanifestasikan melalui pemilu itu sendiri. Hal ini dikarenakan, demokrasi pada dasarnya membutuhkan sesuatu yang genuine, asli, dan jujur, sedangkan hal-hal yang terkandung dalam demokrasi tersebut tidak ditemukan dalam praktik buzzer politik. Tidak sedikit kasus menunjukan bahwa buzzer dapat menggiring opini di media sosial yang seringkali dimanfaatkan demi pemenangan dalam kontestasi politik secara negatif. Untuk menjawab permasalahan tersebut, artikel ini akan membahas mengenai pengaruh buzzer politik terhadap demokrasi dan konsep electoral justice dengan menilik praktik di negara maju yang memiliki regulasi tentang buzzer politik, yang mana nantinya bisa dijadikan inspirasi bagi negara Indonesia.     JURIDICAL ANALYSIS OF MALANG REGENCY RELIGIOUS COURT JUDGMENT CONCERNING CANCELLATION OF MARRIAGE ISBAT ACCORDING TO MARRIAGE LAW AND ISLAMIC LAW

    Marriage Isbat is a validation of marriage. Not all application of marriage isbat are accepted, one of which is Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg where the Religious Court decided to cancel the marriage isbat that has been granted. The main issue in Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg is that the application of marriage isbat is formally flawed due to the lack of parties in it. The writing method used is a normative juridical method with a qualitative juridical analysis method. The purpose of this study is to find out the consideration of the Court in deciding this case and the legal consequences of the cancellation of marriage isbat according to Indonesian Marriage Law and Islamic Law. Based on the result of the study, the Judge’s consideration in Decision No. 0637/Pdt.G/2021/PA.Kab.Mlg is in accordance with the relevant regulations. Meanwhile the legal consequences of the marriage isbat cancellation is that the registered marital status is reverted to the unregistered marriage. Based on the Marriage Law, unregistered marriages have very detrimental effects for both wife and children. While based on Islamic law the legal consequences are the same as the validity of marriage based on the Marriage Law

    NAVIGATING THE LABYRINTH OF STATE-OWNED ENTERPRISES DISPUTES IN INDONESIA: A QUEST FOR EFFECTIVE RESOLUTION MECHANISMS

    This paper critically assesses the adequacy of mediation as an alternative dispute resolution (ADR) method for resolving disputes between State-Owned Enterprises (SOEs) in Indonesia. It also explores the potential of other ADR methods for more effectively resolving such disputes specifically tailored for SOEs disputes. The paper commences by providing an overview of the mediation concept as an ADR mechanism, exploring its advantages and disadvantages. It then delves into the characteristics of typical SOEs disputes and the audit concerns associated with them. Subsequently, the paper examines international and Indonesian mediation practices, scrutinising their effectiveness and applicability in the context of SOE disputes. It also identifies the potential obstacles to using mediation to resolve SOE disputes, considering the inherent concerns of SOEs in making decisions. Based on these findings, the paper recommends the adoption of adjudication as an alternative ADR mechanism for SOEs disputes, advocating for the establishment of an Adjudication Tribunal tasked with rendering fair, impartial, and efficient decisions. Finally, the paper proposes a regulatory adjustment by identifying the potential risks associated with adjudication and providing mitigation strategies

    THE VULNERABILITY OF PROVING FRAUD AS THE BASIS FOR CANCELLING AGREEMENTS IN THE DIGITAL ERA

    Civil Law grants freedom to everyone to agree on something as long as it fulfills the valid agreement requirements stated in Article 1320 of the Civil Code. The consent condition is mentioned in Article 1321 of the Civil Code. Consent is invalid if there is a mistake, coercion, or fraud. This writing discusses consent that is not valid due to fraud. Article 1328 of the Civil Code states that 'fraud is a reason for the cancellation of an agreement if the deception used by one of the parties is so obvious and clear that the other party would not have agreed if there was no deception.' It is not easy to prove fraud in an agreement that has been made, as the party that feels deceived is not in a position of 'being forced' and voluntarily signs or digitally approves the agreement with a submitted or accepted mark. More detailed regulations regarding canceling agreements due to fraud are needed to provide legal certainty and justice for the parties

    REORIENTATION OF THE ULTIMUM REMEDIUM PRINCIPLE IN HANDLING ECONOMIC CRIME REGARDING PROTECTIVE EQUIPMENT AND COVID-19 MEDICATIONS

    Applying the ultimum remedium principle to economic crimes needs to be studied from a regulatory perspective concerning the situation during the Covid-19 pandemic. The normative juridical research method combines a statutory approach with a conceptual approach. Both approaches provide a comprehensive understanding of the ultimum remedium principle in legislation and a contextual understanding of economic crimes during the Covid-19 pandemic. The results show that Emergency Law 7/1955 applies the primum remedium principle with a double-track punishment system, while Trade Law applies the ultimum remedium principle. Handling economic crimes related to providing personal protective equipment and/or medications to prevent and recover from Covid-19 infections can be considered essential goods and important commodities are given the situation and conditions during the Covid-19 pandemic in Law Number 7 2014. Applying Trade Law meets the ultimum remedium principle but does not prioritize the recovery of economic losses suffered

    Abstrak AICHR sebagai lembaga perlindungan dan penegakan HAM dibawah bendera ASEAN telah membuka secercah harapan bagi Asia Tenggara akan adanya kepastian hukum dalam bidang HAM. Namun selama 1 (satu) dekade pasca pembentukan lembaga tersebut, AICHR belum menunjukkan efek yang signifikan bagi HAM di Asia Tenggara, yang pada akhirnya menimbulkan pertanyaan apa yang menyebabkan AICHR belum efektif, dan bagaimana nasib masa depan lembaga tersebut. Dari latar belakang tersebut, tulisan ini telah menyajikan beberapa rumusan masalah yang terdiri dari, bagaimana perkembangan AICHR selama 10 (sepuluh) tahun ini. Bagaimana mekanisme kerja AICHR berdasarkan hukum yang mengatur. Apa saja kendala yang menghambat perkembangan AICHR. Dan apa yang harus diperbaiki untuk menjamin keberlanjutan AICHR. Solusi dari ini semua adalah, negara-negara ASEAN perlu menginisiasikan adanya revisi terhadap term of reference dari AICHR itu sendiri, dengan mengenyampingkan prinsip-prinsip ASEAN demi prinsip yang lebih mulia dari semua prinsip, yakni “kemanusiaan”. Kata Kunci: AICHR, ASEAN, Efektivitas, HAM, Prinsip,   Abstract The AICHR as the council for Human Rights on behalf of the ASEAN flag has opened a glimmer of hope for the Southeast Asia in having a legal certainty in Human Rights. However, after a decade of this council established, AICHR has not shown any significant impact on human rights in Southeast Asia, which give rises a question what was the causes of this ineffectivity, and how is the fate of this council. From this background, this paper presents a problem formulations which consists of, how was the development of AICHR for 10 (ten) years. How is the mechanism of AICHR based on the law. What is the problem that obstruct the development of AICHR. And what must be improved to ensure the sustainability of AICHR. The solution is, the ASEAN’s States Member needs to initiating an amendment of term of reference of the AICHR itself, by leaving aside the ASEAN principle for the sake of the most noble principle,“humanity”.     INDONESIAN ANTI-TRUST RELAXATION: URGENCY FOR IMPLEMENTATION PROVISION AND ITS CORRELATION WITH GOTONG ROYONG PRINCIPLE

    ABSTRACT During the Covid-19 pandemic, numerous jurisdictions have used Anti-Trust Relaxation, also known as Anti-Trust Immunity (ATI) in the United States, recognized as block exemption, authorization, or dispensation in other jurisdictions. Essentially, this ATI states that collaboration between business actors does not always imply an infringement in competition. There are times when cartels and teamwork can be beneficial to the environment. Many businesses have suffered enormous losses because of the Covid-19 outbreak, and they require assistance and support to survive in this unique scenario. Most likely, survival is only possible when business competitors embrace 'gotong royong' or collaboration. Anti-trust immunity, which allows collaboration-usually defined as cartel in normal situation-will be assessed and authorized accordingly by Business Competition Supervisory Commission (KPPU). Another possibility is to include this ATI in the new bill, which would be even more authoritative. On November 2020, KPPU Regulation No. 3 of 2020 on Competition Relaxation was enacted.
