KEPASTIAN HUKUM KEPEMILIKAN HAK ATAS TANAH SETELAH MENGALAMI LIKUIFAKSI TANAH : LEGAL CERTAINTY OF OWNERSHIP OF LAND RIGHTS AFTER EXPERIENCING LAND LIQUEFACTION
ABSTRAK
Likuefaksi merupakan suatu peristiwa pencairan tanah umumnya terjadi pada konsistensi tanah granula jenuh (saturated) yang lepas sampai sedang dengan sifat drainase dalam tanah Rekonstruksi tanah pasca bencana alam likuefaksi tentunya akan meninggalkan berbagai masalah yaitu terkait proses identifikasi tanah dan perlindungan hukum terhadap status kepemilikan hak atas tanah. karena hancurnya batas-batas tanah, dan hilangnya bukti-bukti atas kepemilikan tanah. Tujuan penelitian ini untuk memperoleh pengetahuan tentang akibat hukum dan kepastian hukum hak atas tanah yang mengalami likuefaksi ditinjau dari Peraturan Pemerintah No. 18 Tahun 2021. Jenis penelitian ini yuridis normatif melalui penelitian data sekunder dengan didukung oleh data primer sebagai pelengkap melalui wawancara.. Hasil penelitian menunjukkan bahwa akibat hukum tanah yang mengalami likuefaksi telah ditetapkan sebagai tanah musnah dan haknya menjadi hapus tanahnya jatuh kepada negara. Dalam memberikan kepastian dan perlindungan hukum kepada masyarakat. dengan hancurnya batas-batas tanah maupun bukti-bukti atas kepemilikan tanah yaitu dengan dilakukannya pendaftaran tanah secara sistematis.

ABSTRACT
Liquefaction is an event of soil liquefaction generally occurring in the consistency of saturated granulated soils that are loose to moderate with drainage properties in the soil. Soil reconstruction after natural disasters liquefaction will certainly leave various problems, namely related to the process of land identification and legal protection of the status of ownership of land rights. because of the destruction of land boundaries, and proof of land ownership. The purpose of this study was to obtain knowledge about the legal consequences and legal certainty of land rights that experienced liquefaction in terms of Government Regulation no. 18 Year 2021. This type of research is juridical normative through secondary data research supported by primary data as a complement through interviews. The results show that the legal consequences of land undergoing liquefaction have been designated as destroyed land and the right to annul the land falls to the state. In providing legal certainty and protection to the community. with the destruction of land boundaries as well as evidence of land ownership, namely by systematic land registration.

How Could Deportation become Illegal Deportation? (The Case of Deportation of Myanmar Nationals by Malaysia)
February 2022; Malaysia deported more than 1000 undocumented migrants from Myanmar back to Myanmar, even though a coup d’état had already occurred in Myanmar. This paper will explore the nexus between coup d’état and well-founded fear of persecution and assess the decision by Malaysia to deport Myanmar immigrants back to Myanmar with the nonrefoulement principle. This paper's findings showed a clear nexus between a coup d’état and well-founded fear of persecution to some extent; the nexus appears when the Coup creates uncertainty in citizen's live and people in a dangerous situation. Consequently, the deportation decision by Malaysia violated the non-refoulment principle, and the deportation became illegal. This paper utilized the normative method to analyze the research problem. 
ASEAN INVESTMENT DISPUTE SETTLEMENT MECHANISM THROUGH REGIONAL INVESTMENT COURT FRAMEWORK
In this paper, the authors provide an overview and comparison of the ASEAN dispute settlement mechanism (DSM) in the 2004 Protocol on EDSM and the ASEAN Comprehensive Investment Agreement (ACIA 2009) and review ASEAN's experience with investor-state dispute settlement (ISDS). The paper then examines the challenges and possibilities of restructuring ASEAN DSM through a Regional Investment Court. This includes discussing the potential benefits and drawbacks of such restructuring and its potential implications for regional integration. Finally, the paper offers some thoughts on possible future developments in this area, including the potential impact of a Regional Investment Court on the overall stability and effectiveness of the ASEAN DSM
IMPLIKASI HUKUM PEMANFAATAN OPEN APPLICATION PROGRAMMING INTERFACE TERHADAP LAYANAN PERBANKAN DIKAITKAN DENGAN KETENTUAN PERBANKAN DIGITAL
ABSTRAK Digitalisasi perbankan mendorong munculnya Open Application Programming Interface (Open API) yang memungkinkan bank untuk berkolaborasi dengan pihak ketiga yaitu fintech dan/atau e-commerce dengan membuka data transaksi nasabah. Hal ini dapat menimbulkan implikasi pada layanan perbankan dan keamanan data nasabah. Maka dari itu dilakukan penelitian ini guna untuk mencari tahu implikasi pelaksanaan Open API terhadap layanan perbankan dan upaya perlindungan data nasabah pasca berlakunya Peraturan Dewan Gubernur Nomor 23/15/PADG/2021 tentang Implementasi Standar Nasional Open API Pembayaran. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif. Penelitian ini menggunakan spesifikasi deskriptif analitis pada sumber hukum primer dan hukum sekunder. Data yang telah diperoleh selanjutnya dianalisis menggunakan metode normatif kualitatif. Berdasarkan hasil penelitian ini, diperoleh bahwa Implementasi pelaksanaan Open API terhadap layanan perbankan memberikan kemudahan dan kenyamanan dalam bertransaksi serta dapat melengkapi ekosistem produk. Ekosistem produk yang terafiliasi menjadi lebih beragam dengan adanya layanan perbankan yang dapat diakses melalui aplikasi pihak ketiga. Selanjutnya, bentuk perlindungan hukum telah diberikan guna melindungi data nasabah yang menjadi alat tukar dalam kolaborasi yang dijalin oleh bank dan pihak ketiga .Kata kunci: open api; open banking; implikasi hukum.
ABSTRACT The Covid-19 pandemic demands that all activities be carried out digitally using information and communication technology, including banking activities. Banking digitization encourages the emergence of the Open Application Programming Interface (Open API) which allows banks to collaborate with third parties, namely fintech and/or e-commerce by opening customer transaction data. This can have implications for banking services and customer data security. This study aims to explain the implications of implementing Open API for banking services and efforts to protect customer data after the entry into force of the Board of Governors Regulation Number 23/15/PADG/2021 concerning Implementation of the Payment Open API National Standard.The research method used is normative juridical research method. This study uses analytical descriptive specifications on primary and secondary legal sources. The data that has been obtained is then analyzed using qualitative normative methods. Based on the results of this study, it was found that there were implications for all financial transactions after standardization, namely PBI SNAP. So banks are required to adjust their service activities in accordance with PBI SNAP where banking as a financial institution is a PJP. Furthermore, a form of legal protection has been provided to protect customer data which is a medium of exchange in collaborations established by banks and third parties. JUDGE’S ATTITUDE TOWARDS THE MEDIATOR’S RECOMMENDATION REGARDING THE BAD FAITH PARTY AND MEDIATION FEES ISSUE
This article was the result of research in 2021 with normative research. The formulations of the problems are: 1) What is the consideration of the panel of judges on the recommendation of the mediator regarding the sanctions for payment of mediation fees for parties who are declared to have no good intentions; 2) What is the procedure for payment of mediation fees by these parties. The conclusions are: 1) There is no data on the mediator's recommendation regarding paying mediation fees. It is not immediately followed up if the panel of judges receives it. The judges continue to examine the recommendation of providing justice so that the defendant does not feel more burdened so that the recommendation is not included in the court’s product; and 2) The procedure for payment of mediation fees is carried out together with the accumulated principal costs of the case by complying with the principles of execution. This study advises the Supreme Court of the Republic of Indonesia that there should be a mechanism agreed upon by both parties to jointly consign the amount of money that is expected to be used in the mediation proces
THE MATERIAL CONTENT OF REGIONAL REGULATIONS AS THE CONCRETIZATION OF THE LIVING LEGAL SYSTEM IN SOCIETY (ADAT LAW) BASED ON ARTICLE 2 OF THE INDONESIAN PENAL CODE (KUHP) 2023
Article 2 of Law Number 1 of 2023 regarding the Criminal Code (“KUHP 2023”) not only leaves problems in the context of legality, but also includes mechanisms for the law enforcement process, particularly regarding the measurement of the applicability of Indonesian customary law (“Adat Law”) through regional regulations. One issue that has arisen is the lack of standardized content material that must be regulated in regional regulations in order to determine the applicability of Adat (criminal) Law. This article will analyze to what extent the standard of “law that applies in the place where the law lives” and to what extent the regional regulation regulating “living law” in the perspective of law enforcement prosecutes the perpetrator. The results show that regional regulation can be used as a basis for determining the recognition of Adat Law, but there is no common standard for how to recognize Adat Law under regional regulation. As the concrete of Article 2 Indonesian Penal Code 2023, regional regulation must explicitly regulate the scope of Adat Law (criminal) application related to territorial, personal and protection principles. Meanwhile, in the case of the prohibition act and penal sanction, it needs further studies because Adat Law has no separation between criminal and civil matters
VAN GOGH IMMERSIVE EXHIBITION: LESSONS & OPPORTUNITIES FOR TRADITIONAL CULTURAL EXPRESSIONS DEVELOPMENT IN INDONESIA
Van Gogh's immersive exhibition is held in more than 90 cities around the world including Berlin, Beijing, Paris, London, Madrid, Rome, Sydney, and Jakarta. Until mid-2023, the exhibition has been attended by more than 8.5 million visitors and is an example of intellectual property development. Corresponding to business, IP Development is the capitalization of ideas, creativity, and innovation in producing products or services that contain creative content through systems of human activity related to the creation, production, distribution, and consumption of goods and services that have cultural, artistic, aesthetic, intellectual and emotional values for consumers. This paper employs a descriptive-analytical approach to describe the relevant legal rules and legal theories of copyright and their application in the IP development of artworks for businesses and the opportunities for Indonesia. The finding of the study indicates that immersive technology as a platform for the development of artworks based on Traditional Cultural Expressions (TCEs) potentially creates opportunities for intellectual property legal protection and business development of Indonesia’s TCEs in the frame of Cultural Industries. The commercialization of TCEs using immersive technologies potentially helps in fulfilling two key objectives: capturing new audiences and contributing to economic profit. TANTANGAN REGULASI HALAL UNTUK PELAKU USAHA MIKRO DAN KECIL: SEBUAH STUDI SOCIO-LEGAL DI KUPANG NUSA TENGGARA TIMUR
ABSTRAKBadan Penyelenggara Jaminan Produk Halal (BPJPH) saat ini telah mengembangkan layanan sertifikasi halal berbasis web untuk UMK. Pelaku UMK memiliki peran krusial dalam perekonomian, dengan menyumbangkan hingga 61% terhadap Produk Domestik Bruto (PDB) dan menyerap 97% tenaga kerja nasional. Oleh karena itu, tujuan dari penelitian ini adalah untuk menemukan implementasi pengaturan regulasi kewajiban sertifikasi halal bagi UMK khususnya di Kupang Nusa Tenggara Timur dan merumuskan tantangan pelaksanaan regulasi kewajiban sertifikasi halal bagi UMK di Kupang NTT untuk kemudian diberikan preksripsi dari permasalahan tersebut. Penelitian dilakukan menggunakan pendekatan socio-legal yang data primernya diambil melalui pengamatan/ observasi baik terlibat secara langsung maupun tidak. Hasil penelitian menunjukkan implementasi regulasi halal di Kupang NTT masih banyak kendala dan tantangan. Selanjutnya tantangan yang dihadapi oleh pelaku UMK terkait pendapatan mereka yang minim dan tidak pasti, sehingga sulit bagi mereka untuk mengurus sertifikasi halal, kurangnya pemahaman tentang teknologi informasi juga menghambat proses pengurusan sertifikasi halal secara online. Pelaku UMK masih memiliki keterbatasan dalam fasilitas, peralatan, dan sarana yang dibutuhkan untuk memenuhi syarat produksi yang halal. Mereka juga belum memiliki dokumen-dokumen legal yang diperlukan dan pola pikir atau mindset bahwa kewajiban sertifikasi halal hanya berlaku untuk usaha dengan pendapatan besar, sehingga tidak melihatnya sebagai suatu kebutuhan yang mendesak.Kata kunci: produk halal; regulasi; sertifikasi.
ABSTRACTThe Halal Product Assurance Organizing Body (BPJPH) has currently developed a web-based halal certification service for Micro, Small, and Medium Enterprises (UMK). UMKs play a crucial role in the economy, contributing up to 61% of the Gross Domestic Product (GDP) and employing 97% of the national workforce. Therefore, the objective of this research is to identify the implementation of halal certification regulations for UMKs, particularly in Kupang, East Nusa Tenggara, and formulate the challenges faced in implementing these regulations, followed by prescribing solutions to address the issues. The research was conducted using a socio-legal approach, with primary data gathered through both direct and indirect involvement and observation. The results of the research indicate that the implementation of halal regulations in Kupang, East Nusa Tenggara, still faces numerous constraints and challenges. One of the major challenges faced by UMKs is the limited and uncertain income, making it difficult for them to afford halal certification. Additionally, the lack of understanding of information technology hampers the process of obtaining halal certification online. UMKs also have limitations in facilities, equipment, and resources required to meet halal production requirements. They also lack the necessary legal documents and have a mindset that halal certification is only for businesses with large incomes, thus not recognizing it as an urgent necessity.Keywords: certification; halal product; regulations
ANALISIS YURIDIS PERLINDUNGAN HUKUM BAGI PEMILIK MEREK TERKENAL TERHADAP TINDAKAN PENGGUNAAN MEREK TERKENAL OLEH PELAKU UMKM
Pendaftaran merek bagi UMKM memiliki peran penting untuk mendapatkan perlindungan hukum. Namun, masih banyak pelaku UMKM yang melakukan tindakan tidak bertanggung jawab. Misalnya, menggunakan merek terkenal kemudian disematkan pada produk yang sejatinya bukan bersumber dari pemilik merek tersebut. Permasalahan yang akan dibahas dalam penelitian ini adalah bagaimana perlindungan hukum terhadap pemilik merek terkenal dan bagaimana akibat hukumnya jika UMKM tidak mendaftarkan mereknya di Indonesia serta sanksinya apabila menggunakan merek terkenal tanpa seizin pemilik hak atas merek. Berdasarkan permasalahan tersebut, maka tujuan dibuatnya penelitian ini adalah untuk melakukan kajian hukum mengenai perlindungan hukum terhadap merek terkenal dan akibat hukum yang akan diperoleh oleh pelaku UMKM yang tidak mendaftarkan mereknya di Indonesia, serta sanksi apabila menggunakan merek terkenal tanpa seizin pemilik hak atas merek bersangkutan. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian menunjukkan 2 (dua) hal yaitu pertama, perlindungan hukum terhadap pemilik merek terkenal dilakukan dengan 2 (dua) cara yaitu preventif atau represif. Kedua, akibat hukum jika UMKM tidak mendaftarkan mereknya di Indonesia adalah tidak dapat menempuh jalur hukum apabila terjadi suatu sengketa. Dilemma of Competitive Equality: Transgender vs Cisgender Athletes in Women's International Sports Competition
This research aims to solve the human rights issue of the participation of transgender female athletes in international sports competitions in the women's division. The existence of transgender female athletes yields two perspectives: inclusivity as a human right for transgender female athletes and unfair competition for cisgender female athletes. This issue occurs due to the physiological advantages possessed by a transgender female athlete from the high level of testosterone they have, which creates unfairness in sports competition for cisgender female athletes, and the policies of international sports organizations that exclude the participation of transgender female athletes who have experienced puberty to take part in international sports competitions. Several controversial cases have sparked debate in the international community, such as the Tiffany Newel case in the running competition and the Lia Thomas case in the swimming competition; both are female transgender athletes who won sports competitions in the women's division. Although a transgender individual already has inherent human rights regulated through international law, these rights could not be a basis that overrides the rights and freedoms of other people. In this case, the right to equal and safe competition for cisgender women. The solution to this problem is to develop an 'open category' which aims to ensure the participation of all world athletes in sports competitions regardless of gender or gender identity
