    PELAKSANAAN PENDAFTARAN TANAH SECARA ELEKTRONIK PADA BADAN PERTANAHAN NASIONAL DAN PEJABAT PEMBUAT AKTA TANAH

    Peraturan Pemerintah Nomor 18/2021 menyatakan bahwa penyelenggaraan dan pelaksanaan pendaftaran tanah dapat dilakukan secara elektronik. Berdasarkan hal tersebut terdapat Permen ATR/BPN Nomor 3/2023 tentang Penerbitan Dokumen Elektronik dalam Kegiatan Pendaftaran Tanah yang mengatur mengenai pendaftaran tanah secara elektronik melalui Sistem Elektronik. Sistem pendaftaran tanah maupun pemeliharaan data pendaftaran tanah dilakukan secara sistem elektronik. PPAT wajib melakukan alihmedia dokumen, namun dalam menerapkan Sistem elektronik ini diperlukan Kesiapan Pemerintah dan PPAT. Adapun Identifikasi Masalah yang akan diangkat sebagai berikut: 1) bagaimanakah kesiapan Kementerian Agraria dan Tata Ruang / Badan Pertanahan Nasional dalam Menerapkan Sistem Pendaftaran Tanah Elektronik dan 2) bagaimanakah Pendaftaran Tanah Secara Elektronik Menjamin Kepastian Hukum Menurut Permen ATR/BPN Nomor 3 Tahun 2023 Tentang Dokumen Elektronik. Metode penelitian yang digunakan berupa pendekatan yuridis normatif dengan metode analisis data yuridis kualitatif. Hasil penelitian menunjukkan bahwa implementasi dari aturan mengenai pendaftaran tanah secara elektronik memberikan pengaruh secara langsung pada bidang tanah yang akan dan yang telah didaftarkan melalui Sistem Elektronik, yang berkaitan dengan Kementerian ATR/BPN dan PPAT, di mana bagi PPAT yang telah terverifikasi di Aplikasi Mitra akan dapat melakukan upload akta dan dokumen persyaratan lainnya, PPAT juga menyerahkan akta dan dokumen persyaratan ke Kantor Pertanahan. PPAT wajib untuk meng-scan dokumen persyaratan dan meng-upload akta pada website. Dokumen pendukung dalam pendaftaran tanah secara elektronik juga sudah dijamin kepastian hukumnya.     An in rem lawsuit, as regulated in the Draft Law on Criminal Asset Forfeiture, is a legal procedure involving the revocation of asset ownership without imposing punishment, processed through the civil justice system. Although it resembles general civil procedural law, it differs in several key aspects, including the parties involved, legal relationships, procedural timing, burden of proof, and legal remedies. These distinctions aim to address the legal needs of society, particularly in recovering state losses from corruption. However, given that civil procedural law functions as formal "rules of the game" (spelregels), it is essential to evaluate whether the specific regime of in rem lawsuits aligns with the broader principles of civil procedural law. Not all developments in civil procedural law conform to these general principles, so the unique aspects of in rem lawsuits require careful scrutiny. This research uses a normative juridical approach and descriptive analysis, drawing on the academic paper of the Asset Forfeiture Bill, the general principles of Indonesian civil procedural law, and a comparative analysis of civil procedural law with the specific characteristics of the asset forfeiture regime. &nbsp

    Tech Giants' Non-Negotiable Privacy Policies Strategy versus Indonesian Competition Law

    This article aims to explore the tension between non-negotiable privacy policies of giant tech companies and Indonesian competition law. It scrutinizes the prevalent practice of imposing standard agreements on users, which often leads to an erosion of privacy and market competition. This article employs a normative legal research methodology complemented by Reform-Oriented Research. This method is used to evaluate the practice of non-negotiable privacy policies against the suitability of existing competition law regulations and to recommend changes to the regulations as deemed necessary. The study queries whether such non-negotiable privacy policies constitute an exploitative abuse of dominance under Article 25 of Law 5/1999. The analysis delves into the relationship between personal data exploitation and competition law, suggesting that the accumulation and control of user data by giant techs may strengthen their market dominance, potentially resulting in anticompetitive practices. The research offers insights into the intersection of data protection and competition law, advocating for an integrated approach to address the challenges of the digital economy. It recommends policy changes, including the adoption of Codes of Conduct, data mobility, and open standards to foster competition. Furthermore, the manuscript suggests leveraging the Small But Significant And Non-Transitory Decrease In Quality (SSNDQ) method for market analysis in the digital domain. In conclusion, this research calls for Indonesian competition law to adapt and proactively respond to the use of non-negotiable privacy policies and the complex dynamics of data-centric digital market business models, ensuring that markets remain competitive and consumer rights are protected

    Indonesia telah mencanangkan program menuju Net Zero Emission (NZE) pada visi RPJPN 2025-2045 yang menjadi salah satu fokus pemerintah dalam transisi energi pada proyek-proyek EBT. Kendati demikian, pengembangan sektor EBT di Indonesia masih merekam beberapa daftar kendala yang cukup signifikan. Keterbatasan akan dana dan daya tarik investasi menjadi urgensi utama pemerintah dalam pengembangan teknologi EBT yang memadai. Berbagai upaya kebijakan dikeluarkan pemerintah dalam rangka mendukung peningkatan ekosistem investasi dan akselerasi proyek strategis nasional, seperti melalui Undang-Undang Cipta Kerja dan Peraturan Pemerintah No. 79 Tahun 2014 tentang Kebijakan Energi Nasional (PP KEN). Untuk mengatasi kendala tersebut, penanaman modal dari pihak asing berupa Foreign Direct Investment (FDI) menjadi solusi penting pendanaan sektor EBT yang besar.     ANALYZING THE PRACTICE OF MATERIAL ADVERSE CHANGE: A POST PANDEMIC MERGER AND ACQUISITIONS CONTRACT NON-PERFORMANCE CLAUSE FROM THE PERSPECTIVE OF UNIDROIT PRINCIPLES OF INTERNATIONAL COMMERCIAL CONTRACT

    The uncertain conformity between the characteristics of the condition attributable to the inability of mergers and acquisition contract performance due to COVID-19 and the characteristics of force majeure and hardship leads to the use of material adverse change (MAC) as an alternative clause for contract non-performance as a perennial consequence of COVID-19 pandemic in the post pandemic era. This study aims to analyze the implications of COVID-19 pandemic with the use of MAC according to the laws of the nations and the adherence of MAC as a clause with UNIDROIT’s six general principles of international contract during and post pandemic as issued in UNIDROIT Principles of International Commercial Contract. The method of writing used was normative juridical approach with descriptive analytical research specifications. The writing process taken in drafting this study was through a process of literature review from primary, secondary, and tertiary sources. Data analysis method used in this study was through qualitative juridical normative method. The outcome of the analysis shows that the use of MAC as an alternative clause for contract non-performance differs between one national law to another; one of the outstanding characteristics is that the basis of the use of MAC depends on the agreed definition and the burden of proof of MAC set forth in the contract. The use of MAC as an alternative clause for contract non-performance in mergers and acquisitions is compliant with UNIDROIT’s principles of international contract, with considerations of the limitations and exceptions of the international contract principles

    PROFIT SHARING INSTITUTIONS FROM AN ISLAMIC LEGAL PERSPECTIVE AND CUSTOMARY LAW IN INDONESIA

    Humans are creatures who like to socialize, they like to socialize with each other, and are called social creatures. In life, humans as social creatures are citizens of a living unit, acting as members of indigenous communities and citizens. Each individual must be willing to sacrifice personal rights for the sake of the common good, including in implementing profit sharing institutions. The problem is, how are profit sharing institutions implemented in Indonesia, viewed from Islamic Law and Customary Law? The aim of the research is to get an overview of the implementation of profit sharing institutions in Indonesia and viewed from Islamic Law and culture. This research uses a normative juridical approach, namely by researching and testing library materials or what is called secondary data with the aim of studying and analyzing the Profit Sharing institutions. The analytical method is research carried out based on statutory regulations which apply as positive legal rules and is presented without using formulas or numbers. The results of the research show that the implementation of profit sharing institutions in Indonesia has various and universal methods, one of which is in activities Syariah banking. Meanwhile, profit sharing institutions are reviewed from Islamic law, and indigenous communities are used in cultivating land, as a form of profit sharing agreement. The advice given is that the implementation of profit sharing institutions in Indonesia is still not yet balanced, it is necessary to apply the principle of justice.     Optimizing Village-Owned Enterprises as Legal Entities in Efforts to Enhance Cooperation and Asset Management

    Village-Owned Enterprises (BUM Desa) is a business entity that carries out business in the economic sector and/or public services. The status of BUM Desa is confirmed as a legal business entity in the Law on Job Creation. This article discusses efforts that can be made to optimize the legal entity status of BUM Desa after the enactment of the Law on Job Creation to increase cooperation and management of BUM Desa assets after the enactment of the Job Creation Law. The research method used is normative juridical, namely research based on legal sources and their findings. The research results show that first, determining the legal entity status of BUM Desa has implications for optimizing the intensity of cooperation with third parties. Clarity on the legal entity status of BUM Desa can optimize opportunities for BUM Desa cooperation with third parties, because third parties will feel more secure in collaborating with legal entities as legal subjects who have separate assets. Second, after the establishment of BUM Desa as a legal entity, it is necessary to manage BUM Desa assets separately from Village assets, based on the statutory regulations governing BUM Desa, Good Corporate Governance Principles, and internal regulations of BUM Desa, as well as cooperation agreements with third parties if the object of cooperation is BUM Desa assets

    Tulisan ini menganalisis aspek yuridis pelanggaran pemanfaatan ruang dalam proyek pembangunan simpang jalan di kawasan Stasiun Batutulis, Kota Bogor. Proyek ini merupakan bagian dari paket pekerjaan Direktorat Jenderal Perkeretaapian (DJKA) berupa pembangunan perlintasan tidak sebidang JPL.10 dan penataan Stasiun Batutulis lintas Bogor-Sukabumi. Pembangunan tersebut berdampak langsung pada kerusakan infrastruktur Jalan Saleh Danasasmita dan peningkatan risiko bencana longsor di kawasan sekitar. Penelitian difokuskan pada bagaimana sistem pengendalian pemanfaatan ruang terutama melalui ketentuan umum peraturan zonasi terkait sistem jaringan jalan, kawasan rawan bencana, dan sistem drainase diterapkan atau justru diabaikan dalam praktik pembangunan. Metode yang digunakan adalah pendekatan yuridis normatif, dengan menelaah peraturan perundang-undangan nasional dan daerah serta relevansinya terhadap kasus Jalan Saleh Danasasmita yang mengalami kerusakan akibat pembangunan tidak sesuai tata ruang. Temuan menunjukkan lemahnya pengawasan dan perencanaan teknis, khususnya dalam penyediaan sistem drainase yang layak di kawasan lereng curam, yang menjadi faktor utama longsor berulang. Hal ini menandakan kegagalan implementasi pengendalian ruang yang seharusnya menjamin keselamatan dan keberlanjutan lingkungan

    THE IMPORTANCE OF ARBITRATION AGREEMENT IN WRITING: INTERNATIONAL, INDONESIA, AND NEW ZEALAND

    International commercial arbitration has been one of the popular means to solve a dispute, including in Indonesia and New Zealand. In the event the cross-border commercial parties intend to utilize arbitration to solve its present or future dispute, the regarding parties need to provide the basis for international commercial arbitration: arbitration agreement. One of the matters that the parties need to pay attention in regards to the arbitration agreement is formal validity. Formal validity is ruled through Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958; UNCITRAL Model Law on International Commercial Arbitration; as well as the majority of national arbitration laws. However, different instruments serve different definitions on “arbitration agreement in writing” as the valid form. There is still a conflicting stance on what is internationally agreed as the valid form of arbitration agreement. Consequently, the issue arises from how important it is for the parties to own arbitration agreement in writing based on the perspectives on international arbitration law, Indonesia, as well as New Zealand. This writing utilizes the comparative juridical research between international instruments (Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 and UNCITRAL Model Law on International Commercial Arbitration) as well as the national arbitration law of Indonesia and New Zealand. As a result, the writer has concluded that according to international arbitration law as well as the national arbitration law of Indonesia and New Zealand, the arbitration agreement in writing, as a valid form, is important and highly valued

    Testing The Suitability of The Indonesian and Vietnamese Baselines under UNCLOS

    The method for drawing baselines for the determination of maritime areas has been regulated in UNCLOS through three legal baselines, namely Normal Baselines, Straight Baselines, and Archipelagic Baselines. Respectively these approaches have been modified to suit the typical geographic features of a coastal state. However, the determination of baselines by several states is inconsistent with applicable regulations and has the potential to cause disputes with neighboring states. Indonesia has established straight baselines based on archipelago theory, on the other hand, Vietnam has established straight baselines. This article tries to identify the suitability of determining the baseline from Indonesia and Vietnam based on UNCLOS provisions and concludes that there was a violation of Article 7 of UNCLOS by Vietnam
