PENERAPAN KEWENANGAN PENGAWASAN MAJELIS PENGAWAS DAERAH (MPD) TERHADAP PELAKSANAAN CUTI NOTARIS DI KOTA PALEMBANG
Artikel yang berjudul “Penerapan Kewenangan Pengawasan Majelis Pengawas Daerah (MPD) Terhadap Pelaksanaan Cuti Jabatan Notaris di Kota Palembangâ€, bertujuan untuk menganalisis tentang bagaimana prosedur dan apa yang menjadi pertimbangan dari MPD) dalam pemberian izin cuti jabatan Notaris, apa yang menjadi batas pengawasan MPD terhadap pelaksanaan cuti jabatan Notaris di kota Palembang, serta bagaimana bentuk pengawasan dan pemeriksaan yang dilakukan oleh MPD terhadap pelaksanaan cuti jabatan Notaris di Kota Palembang. Hasil dari penelitian ini yaitu: (1)Prosedur pelaksanaan cuti jabatan Notaris terkhusus dikota Palembang sebagaimana ketentuan yang ada dalam peraturan perUndang-Undangan yang berlaku, namun dalam proses pelaksanaan cuti ada hak dan kewajiban dari seorang Notaris yang tidak terpenuhi sebagaimana diatur dalam pasal 32 UU Jabatan Notaris yaitu tentang serah terima protokol jabatan dan dalam hal pemberian izin cuti jabatan kepada Notaris sejauh ini tidak ada tolak ukur khusus atas batasan-batasan alasan pengajuan permohonan cuti tersebut. ;(2) dalam hal batasan pengawasan MPD dalam pelaksanaan cuti jabatan sejauh ini penerapan wewenang pengawasan terhadap pelaksanaan cuti jabatan tidak ada, pengawasan hanya dilakukan pada pelaksanaan jabatan Notaris, yang mana saat tengah melaksanakan cuti seorang Notaris di anggap bertindak atas nama dirinya pribadi bukan dalam jabatannya sebagai pejabat umum (Notaris). ;(3)adapun bentuk pengawasan serta pemeriksaan yang dilakukan oleh MPD terhadap pelaksanaan cuti jabatan Notaris di Kota Palembang sejauh ini tidak ada tindakan khusus sebagai implementasi dari kewenangan MPD
KEWENANGAN KOMISI PENGAWAS PERSAINGAN USAHA DALAM PENEGAKAN HUKUM ANTIMONOPOLI
Undang-Undang Anti Monopoli No 5 Tahun 1999 memberi arti kepada monopolis sebagai suatu penguasaan atas produksi dan atau pemasaran barang dan atau atas penggunaan jasa tertentu oleh satu pelaku usaha atau kelompok pelaku usaha (pasal 1 ayat (1) Undang-Undang Anti Monopoli). Berhubung dengan kewenangan KPPU yang begitu besar, ada ketentuan pasal lain yang menjadikan kewenangan/kekuasaan begitu tumpul yaitu Pasal 44 ayat (2): pelaku usaha dapat mengajukan keberatan kepada Pengadilan Negeri selambat – lambatnya 14 hari setelah menerima pemberitahuan putusan tersebut. Pada pasal 44 ayat (4) bahwa pelaku usaha tidak menjalankan secara sukarela terhadap putusan KPPU tersebut, maka Komisi menyerahkan putusan tersebut kepada penyidik untuk diadakan penyidikan, dan Pasal 44 ayat (5) menyatakan putusan komis tersebut hanya merupakan bukti permulaan bagi penyidikan oleh penyidik. PERLINDUNGAN HUKUM TERHADAP PENGEMUDI TAKSI (MITRA) BERBASIS ONLINE PADA PT. GRAB INDONESIA
Hasil penelitian menunujukkan bahwa hubungan antara PT. Grab dan driver merupakan hubungan kemitraan. Isu hukum yang akan dibahas dalam tesis ini: 1) Apa legalitas dan konstruksi hukum (status, kedudukan, hak, dan kewajiban) para pihak PT. Grab dan Pengemudi taksi dalam perjanjian pengangkutan jalan berbasis online, 2) Apakah legalitas dan konstruksi hukum perjanjian pengangkutan jalan berbasis online telah memberikan perlindungan hukum terhadap pengemudi taksi berbasis online, 3) Bagaimanakah konsep perlindungan hukum terhadap pengemudi taksi dalam pelaksanaan perjanjian jalan berbasis online dimasa yang akan datang. Metode yang digunakan dalam penelitian ini adalah penelitian normative yang bertujuan untuk menghasilkan argumentasi, dan teori. Teknik analisis yang digunakan adalah metode deskriptif kualitatif yang bertujuan untuk memperoleh pengertian keterkaitan badan hukum dengan yang lainnya sehingga dasar hukum yang digunakan adalah Kitab undang – undang Hukum Perdata (KUH Perdata) dan pelaksanaan teknis operasional didasarkan atas Peraturan Menteri Perhubungan No. 108 Tahun 2017, pengaturan hukum belum memberikan perlinungan hukum terhadap driver karena aturan yang belum secara spesifik mengatur hubungan antara penyedia aplikasi seperti PT. Grab dan driver. Dan konsep perlindungan hukum terhadap pengemudi taksi dalam pelaksanaan perjanjian transaksi online diawali dengan pembentukan badan hukum yang menjadi para driver. Penulis berharap kiranya tesis ini dapat memberikan masukan bagi akademisi dan bagi usaha jasa pelayanan aplikasi berbasis online.
Legal Aspects of Zakat Empowerment In Indonesia
Zakat is a number of certain assets that the Muslim people have to give to the persons who are in need. However there are some problems in the zakat management in Indonesia. The objective of this article is to provide for a brief picture of the zakat management in Indonesia. The findings of the research conducted that it was found in 2011 that the Zakat agencies have been able to manage up to ten billion rupiahs which distribution covers the whole parts of Indonesia. Nevertheless, in Indonesia zakat has a big potential, by having 87% of Muslim populations and 20% of them are assumed as the zakat givers (muzakki). Therefore as it was reported in 2011 that the potential value of zakat was around Rp 217 trillions. In addition, the zakat added with infaq calculated around Rp 1.5 trillion per year. Meaning that the zakat collected has not reached even more than 1 percent of the potential zakat per year. Even though the number of Muslim people in Indonesia is very significant, the problems centered in the management of the zakat which is still in traditional pattern where the zakat givers (muzakki) give directly to the persons who has the right to receive zakat (mustahik). It is suggested that it need revolutionary improvement in the zakat management, there must be a mindset changing from traditional management to modern zakat management where the zakat officer (amil zakat) must be a professional one, and permanent job basis. Legal Reasons Underlying Demonopolization by State-Owned Enterprises in Indonesia
Demonopolization policy towards PT. PLN (Persero) and PT. Pelindo (Persero) conducted by the Indonesian government is aimed at enhancing efficiency, the effectiveness of state-owned enterprises (SOEs), as well as global competitiveness. The rationale in determining the demonopolization policy towards the two SOEs is based on the concept of neo-liberalism market economy, which promotes efficiency and effectiveness on free market competition. The concept of neo-liberal economics is contrary to the concept of democratic economics. The concept of democratic economics based on the 1945 Constitution of the Republic of Indonesia prioritizes fair efficiency. It is the reason for the Constitutional Court to return monopoly rights to PT. PLN (Persero) as an electricity provider in Indonesia. The argue of monopoly policy or demonopolization policy of SOEs is the main problem that will be elaborated through normative research methods (documentary research) by using secondary data as the main data. Problem analysis was done by qualitative juridical through of statute approach, philosophy approach, and history of law approach. This paper provides the reason of the policy of monopoly exemption on SOEs business activities, as well as the foundation of SOEs demonopolization policy taking into consideration the constitutional basis of Article 33 of the 1945 Constitution. The concept of demonopolization of SOEs is a new one that has never been described in the Indonesian literature. As a result, the demonopolization of SOEs does not divert SOEs into private companies but rather attempts to present competitors to SOEs to be able to compete in fair competition. In another side monopoly of SOEs can be implemented towards managing important production branches that control the livelihoods of many people. Separation of Powers Under the 1999 Nigerian Constitution: The Core Legal Dilemmas
At the core of Nigeria's constitutional practice lies the doctrine of separation of powers. The application of the principle is such that power under Nigeria's presidential cum federal system is delineated both horizontally and vertically. Even though the doctrine has a major feature of every constitution in the world, its implementation does not seem satisfactory given the insults that have been carried out by successive governments. This paper examines the doctrine of separation of powers and its complicatedness as regards to its practice in Nigeria's constitutional democracy. Reflecting on the history of Nigeria, this paper will discuss the eroded implementation of the principle of separation. As a result, it seems to be that the concept of "separation" is not going well and tends to fuse the function of executive and legislative institutions. In this situation, the principle is in a dilemma. This paper further offers a flicker of hope by pointing to the fact that all hopes do not appear lost, as the Judiciary still maintains some level of ‘separateness,' except that only time will tell as to how much this lasts
PENGATURAN HUKUM PERSETUJUAN SIRKULER LINTAS NEGARA PEMEGANG SAHAM PT PMA DALAM PERJANJIAN KREDIT NOTARIAL
Abstrak: Investasi baik yang berasal dari dalam negeri maupun asing sangat diperlukan untuk menunjang roda pembangunan dan perekonomian di Indonesia. Dalam menggerakkan pembangunan tersebut, seringkali investor perlu mendapat suntikan pembiayaan kredit dari perbankan. Bagi investor vang berbentuk PT yang mendapat fasilitas kredit dari perbankan, persetujuan pemegang saham adalah salah satu dokumen wajib yang harus dipenuhi. Kendala pemenuhan dokumen tersebut seringkali ditemui pada PT PMA, yang biasanya pemegang saham PT PMA berdomisili di luar negeri. Sebagai solusinya, pemegang saham PT PMA akan memberikan persetujuan melalui keputusan sirkuler yang ditandatangani di negara asal pemegang saham. Dalam Perseroan Terbatas (PT), Rapat Umum Pemegang Saham Perseroan (RUPS) merupakan organ tertinggi yang mewakili kepentingan seluruh pemegang saham dalam PT tersebut. PT yang mendapatkan pembiayaan kredit dari perbankan, biasanya akan dimintakan persetujuan dari pemegang saham terkait fasilitas yang diperoleh PT. Hal ini yang bisa menjadi salah satu alasan diadakannya RUPS. RUPS dapat dilaksanakan secara konvensional dan secara sirkuler. RUPS secara konvensional dilakukan dengan cara mengumpulkan seluruh pemegang saham secara bersamaan. Seringkali juga ditemukan kesulitan untuk â€mengumpulkan†para pemegang saham di saat yang bersamaan, dan untuk mengatasi hal tersebut dapat dilaksanakan pengambilan keputusan secara sirkuler, sebagaimana diatur dalam pasal 91 UU No. 40/2007 tentang Perseroan Terbatas (PT). Pada prakteknya, keputusan sirkuler ini dapat dibuat dan ditandatangani oleh pemegang saham PT yang berkedudukan di luar wilayah Indonesia (luar negeri), keputusan sirkuler inilah yang sering disebut sebagai Keputusan Sirkuler Lintas Negara. Atas dasar Keputusan Sirkuler inilah nantinya akan dituangkan dalam akta perjanjian kredit yg dibuat secara notarial.Abstract:Both domestic and foreign investments are needed to support the wheels of development and the economy in Indonesia. In driving the development, investors often need to get credit financing injections from banks. For PT investors who obtain credit facilities from banks, shareholder approval is one of the mandatory documents that must be met. Constraints on the fulfillment of these documents are often encountered at PT PMA, which is usually the shareholder of PT PMA domiciled abroad. As a solution, the shareholders of PT PMA will give their approval through a circular decision signed in the country of origin of the shareholders. In a Limited Liability Company (PT), the General Meeting of Shareholders of the Company (GMS) is the highest organ that represents the interests of all shareholders in the PT. PT that obtains credit financing from banks, usually will be asked for approval from shareholders related to the facilities obtained by PT. This could be one of the reasons for the holding of a General Meeting of Shareholders. RUPS can be held conventionally and circularly. GMS is conventionally conducted by gathering all shareholders together. It is also often difficult to "gather" shareholders at the same time, and to overcome this a circular decision can be made, as provided for in article 91 of Law No. 40/2007 concerning Limited Liability Companies (PT). In practice, this circular decision can be made and signed by PT shareholders domiciled outside the territory of Indonesia (overseas), this circular decision is often referred to as the Cross-Country Circular Decision. On the basis of this Circular Decree, it will later be contained in a notarial deed of credit agreement
Konsekuensi Hukum Atas Konsep Jaminan Dalam Fatwa DSN Terhadap Pembiayaan Mudharabah
Abstrak: Dalam setiap pembiayaan atau kredit, jaminan adalah salah satu aspek yang menjadi pertimbangan terhadap dikabulkan atau tidaknya suatu pembiayaan/kredit. Dalam sistem perbankan (konvensional) jika nasabah dalam perjalanan waktu perjanjian ternyata tidak mampu membayar maka bank dapat menggunakan jaminan tersebut melalui mekanisme eksekusi untuk menutup utang dari debitur berdasarkan peraturan yang berlaku. Hal ini berbeda dengan jaminan dalam mudharabah. Jaminan dalam mudharabah bukan sebagai penjamin atas utang piutang sebagaimana dalam bank konvensioanal tetapi berkedudukan sebagai penjamin agar pelaku usaha usaha tidak melanggar akad yang telah disepakati.Berdasarkan latar belakang tersebut, fokus kajian dalam tulisan ini adalah bagaimana konsekuensi hukum atas konsep jaminan dalam fatwa DSN nomor 07/DSN-MUI/IV/2000 terhadap pembiayaan mudharabah pada lembaga keuangan syariah? Penelitian ini termasuk penelitian hukum normatif, sedangkan spesifikasi penelitian ini adalah deskriptif analitis. Pendekatan utama yang ditempuh adalah doktrinal.Jaminan dalam sistem hukum perbankan pada umumnya merupakan sarana pembayaran substitusi jika debitur melakukan gagal bayar (wanprestasi) terhadap utang atas kreditur. Hal ini berbeda dengan akad pembiayaan mudharabah. Perjanjian mudharabah tidak lahir atas dasar utang-piutang antara kreditur dan debitur, melainkan sebagai mitra antara bank syariah sebagai shohibul maal, dan nasabah penerima fasilitas (nasabah debitur) sebagai mudharib, sehingga jaminan dalam mudharabah adalah bukan sebagai penjamin atas utang piutang tetapi berkedudukan sebagai penjamin agar pelaku usaha usaha tidak melanggar akad yang telah disepakati. Meskipun dalam realitasnya praktek jaminan dan agunan bank syariah masih juga menggunakan norma hukum jaminan yang digunakan dalam sistem hukum positif. Kata Kunci: Hukum, Jaminan, Mudharabah Abstract: In any financing or credit, collateral is one aspect that is considered whether or not a credit is granted. In the banking system (conventional) if the customer in the course of the agreement turns out to be unable to pay, the bank can use the guarantee through an execution mechanism to cover debts from debtors based on applicable regulations. This is different from collateral in mudharabah. The collateral in mudharabah is not a guarantor for debts as in conventional banks but is a guarantor so that business operators do not violate the agreed contract.Based on this background, the focus of the study in this paper is how the legal consequences of the concept of collateral in the DSN fatwa number 07 / DSN-MUI / IV / 2000 on mudharabah financing in Islamic financial institutions. This research is normative legal research, while the specification of this research is analytical descriptive. The main approach taken is doctrinal.Collateral in the banking legal system is generally a means of substitution payment if the debtor defaults on debts against the creditor. This is different from the mudharabah. Mudharabah agreements are not born on the basis of debts between creditors and debtors, but rather as partners between Islamic banks as shohibul maal, and facility recipient customers (debtor customers) as mudarib. So that collateral in mudharabah is not as collateral the guarantor for the debts but is domiciled as a guarantor so that the business actor does not violate the agreed contract. Although in reality the practice of collateral and collateral of Islamic banks still uses guarantee legal norms that are used in the positive legal system. Keywords: Law; Collateral; Mudharaba
Implikasi Perubahan Pengaturan Badan Usaha Milik Negara Indonesia Terhadap Relasi Negara Dengan Badan Usaha Milik Negara
State Owned Enterprise (SOE) is a strategic business entity in Indonesia, or in other countries. Since 1945, laws on Indonesia SOE had been changed 4 times, in four periods namely, 1945-1960 period, 1960-1969 period, 1969-2003 periode, and 2003-now. The law change has been driven Indonesia’s SOE concentrates on two principles profitable and cost-benefit recovery principles. Kerjasama Internasional Dalam Upaya Pemberantasan ‘Illicit Arms Trafficking’ di Kawasan Asia Tenggara
Advanted in science and technology in this globalization era have a profound influence on every human’s activities in this world. Dispite its benefits, globalization has its negative im pacts, like as dependency of human on technology, until led to a progressively increasing number of transnational crime. Based on the results of this research, we know that ASEAN as a regional international organization, have not been able to maintain the security of this area, and also it’s because strategical policy is not comprehensive, because some crimes don’t have any legal instruments that bind every ASEAN states. One of the crimes that have not been regulated in ASEAN is “Illicit Arms Traffickingâ€. Borrowing the definition used by the United Nations, illicit trafficking is the movement of weapons that is “contrary to the laws of States and/or international law.†This phenomenon is of growing concern because it has the potential to undercut government efforts at establishing stability and order. Governments in Southeast Asia are worried about the growing illicit trade in small arms because a number of factors have allowed it to flourish steadily such as inadequate controls against illicit weapons production, exports and imports at the national level due to poorly trained and/or corrupt officials, financial and technological difficulties in implementing effective controls, lack of coordination and cooperation among regional states in monitoring the circulation and supply of weapons from within and outside of the region; and, non-existence of international or regional agreements on controlling the small arms trade (licit and illicit). Other obstacles that the breadth of water areas in Southeast Asia that so complicate ASEAN to kept an eye on any potential occurrence of transnational crime, including Illicit arms traffickin
