    Looking at The Civil Suits and Court Cases Under the Justice Against Sponsors of Terrorism Act: Why it Fails?

    Terrorism remains a persistent and significant global threat, with far-reaching consequences for world peace and stability. The September 11, 2001 attacks marked a pivotal moment in the fight against terrorism, prompting governments and international organizations to adopt new strategies to counter this threat. In response to these tragic events, the United States enacted the Justice Against Sponsors of Terrorism Act (JASTA), a legislative framework designed to allow victims of terrorism to seek compensation from state sponsors of terrorism. While JASTA reflects a commitment to holding individuals and nations accountable for supporting terrorism, it has sparked controversy, with critics arguing that it undermines the principle of sovereign immunity, while others view it as a crucial tool for combating terrorism. This study examines the legal and procedural implications of JASTA, focusing on the challenges of bringing civil actions under this law. Through a literature-based research approach, the study explores anti-terrorism laws, relevant case law, and the practical obstacles of pursuing legal claims under JASTA. The findings highlight the legal complexities and political considerations involved in holding state sponsors accountable, emphasizing the need for a balanced approach that upholds international law and diplomacy while ensuring justice for terrorism victims. This research contributes to ongoing discussions on refining strategies to combat state-sponsored terrorism and offers recommendations for potential legislative reforms to enhance the effectiveness of JASTA in achieving justice

    Eradicating All Rules Through Article 42 of Law 21 of 2023 on The National Capital: A Study of Legal Norms and Morality

    Legal norms in a regulation are the face of the government in implementing a policy, norms become an important point in the purpose of the law itself, namely justice. Norm ambiguity at least has several aspects, namely: open norms, vague norms, norms that conflict with other norms. All of these aspects are a unity in ‘norm conflict’. Article 42 of Law Number 21 of 2023 on the National Capital City (IKN) explains that, if there are regulations that conflict with the IKN Law, other regulations are considered invalid. Thus, many legal academics have criticised the article as a sweeping article. Thus, this research uses a normative research method that examines the norms and politics of law in Article 42 of the IKN Law using a conceptual approach and a statutory approach. Thus, this research shows that in terms of ratio legis, it is not possible for a law to declare another law invalid, which has an equal status as stipulated in Article 7 of Law Number 12/2011 on the Formation of Legislatio

    Aset utama perusahaan adalah karyawan, sebagai pelaksana roda indutri untuk mendapatkan profit. Karyawan yang terlibat dalam pengembangan produk berpartisipasi untuk membuat invensi yang didanai perusahaan. Hasil invensi pada industri dapat menjadi paten yang memiliki nilai ekonomis. Sumber daya manusia yang terlibat dalam invensi paten dapat membuat perjanjian bersyarat untuk kepemilikan paten, sehingga dapat memiliki hak ekonomi. Permasalahan yang dibahas dalam penelitian ini, mengenai perjanjian bersyarat antara karyawan dengan perusahaan untuk mendapatkan hak ekonomis atas paten yang dibuat. Tujuan dari penelitian ini untuk menemukan perlindungan hukum bagi inventor karyawan melalui perjanjian bersyarat kepemilikan paten. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif, yaitu penelitian yang dilakukan dengan menggunakan peraturan perundang-undangan sebagai bahan hukum primer. Pendekatan menggunakan statute approach untuk memahami konsistensi peraturan perundang-undangan dengan soft law hak kekayaan intelektual. Hasil penelitian ini, berdampak meningkatkan partisipasi karyawan untuk berkontribusi pada perusahaan melalui temuannya dan invensi karyawan sebagai aset yang dapat menjadi passive income. Dimungkinkannya inventor mendapatkan imbalan dari penjualan (komersialisasi) hasil invensinya oleh investor (perusahaan) dan besaran imbalan harus dibuat dan diatur dalam suatu bentuk perjanjian bersyarat  secara terperinci baik  penetapan jumlah imbalan (royalti) yang layak, dan juga isinya antara lain agar inventor tetap  mendapatkan hak ekonomi dari hasil invesinya,  selain itu perlindungan inventor sebagai pemilik hak paten yang dihasilkannya

    Penegakan hukum deforestasi terhadap masyarakat hukum adat di Indonesia masih menghadapi berbagai tantangan, terutama dalam hal perlindungan hak-hak masyarakat adat dan upaya mitigasi terhadap perubahan iklim. Meskipun terdapat peraturan yang melindungi hutan adat, implementasinya dinilai belum memadai. Sebaliknya, Brazil telah melakukan langkah-langkah maju dalam penegakan hukum terhadap deforestasi dan perlindungan hak masyarakat adat. Penelitian ini bertujuan untuk melihat realitas penegakan hukum deforestasi serta meninjau sejauh mana efektivitas penegakan hukum di Indonesia dan dan mengambil pembelajaran dari Brazil, serta mengusulkan format ideal penegakan hukum deforestasi yang dapat diterapkan di Indonesia untuk mencapai keadilan iklim bagi masyarakat hukum adat. Metode yang digunakan adalah metode penelitian hukum normatif dengan  menganalisis peraturan hukum internasional dan nasional serta perosalan-persoalan deforestasi di kedua negara. Hasil penelitian ini diharapkan dapat memberikan pembelajaran berharga bagi pemerintah Indonesia dalam mengembangkan kerangka hukum yang lebih inklusif dan responsif terhadap kebutuhan masyarakat hukum adat serta meningkatkan efektivitas penegakan hukum deforestasi yang berkeadilan

    Reverse Evidence: A Beacon of Hope for Pretrial Reform

    Pretrial proceedings, inspired by the Habeas Corpus principle, aim to protect individuals from arbitrary coercive measures such as suspect identification, arrest, and detention. However, in practice, the burden of proof in pretrial processes falls entirely on the applicant, who must prove a negative: the illegality of the coercive action. This burden creates significant obstacles for applicants seeking redress. To address this imbalance, this research examines the concept of Habeas Corpus, the evidentiary system of reverse onus of proof in the Indonesian legal context, and the development of an ideal evidentiary model for pretrial proceedings. Using normative juridical methods, this study finds that Habeas Corpus obliges the detaining authority to justify the legality of detention; failure to do so results in the detainee's release. Similarly, reverse evidence has been applied in corruption, money laundering, and administrative cases in Indonesian courts to address challenges in uncovering organised crimes. In pretrial contexts, applying reverse evidence protects human rights, promotes transparency, and ensures accountability in the exercise of coercive state power. This approach reflects the legal principle that individuals should not be required to prove a negative, easing the applicant’s evidentiary burden. By shifting the burden of proof to the respondent (i.e., the state or its officers), it upholds the principle of equality of arms, creating a more balanced relationship between individuals and the state. Ultimately, this enhances safeguards against abuse of authority and improves fairness in the justice system

    COMPARISON OF CHEMICAL CASTRATION SANCTIONS AGAINST PERPETRATORS OF CHILD SEXUAL VIOLENCE IN IN-DONESIA AND SOUTH KOREA

    Chemical castration punishment is regulated in Law No. 17 of 2016 about Child Protection, which provides additional sanctions for perpetrators of child sexual crimes. In South Korea, it is regulated in the South Korean Bill on Prevention and Handling Perpetrator Violence Sexual to However, the implementation of this law has encountered various obstacles, including unclear implementation procedures and rejection from several medical circles. Even though there are aiming to protect children from sexual violence, criticism has emerged regarding potential human rights violations. tendency to repeat crimes. With a more structured system, South Korea has succeeded in reducing the recidivism rate through a rehabilitation approach and long-term supervision. This study uses a normative legal approach using a legislative approach, a conceptual approach and a comparative legal approach. The results of the study show that although both countries have the same goal of protecting children from sexual violence, there are significant differences in the implementation and effectiveness of chemical castration sanctions in Indonesia which carries out execution aimed at the profession doctor while South Korea was handed over to court as execution castration chemical. This study aims to provide insight into the comparison of legal policies in the two countries and their implications for the protection of child sexual violence victims. Meanwhile, South Korea became the first country in Asia to implement chemical castration in 2011.     Konflik antara Israel dan Palestina telah menghasilkan dampak yang serius, terutama bagi anak-anak yang terjebak di tengah-tengahnya. Artikel ini bertujuan untuk menguraikan dampak pelanggaran hak asasi manusia (HAM) dalam konflik Israel-Palestina terhadap anak-anak, serta untuk menyoroti kebutuhan akan perlindungan yang lebih efektif dan upaya perdamaian yang berkelanjutan. Metode penelitian yang digunakan dalam artikel ini adalah studi literatur yang mencakup analisis terhadap berbagai sumber informasi yang relevan dan terpercaya  tentang dampak pelanggaran HAM terhadap anak-anak Palestina. Hasil penelitian menunjukkan bahwa anak-anak sering menjadi korban langsung dari kekerasan fisik dan psikologis, serta menghadapi kendala akses terhadap pendidikan dan perawatan kesehatan yang memadai. Perlindungan yang lebih kuat bagi anak-anak dan upaya aktif menuju perdamaian yang berkelanjutan menjadi imperatif dalam mengatasi tantangan yang dihadapi anak-anak Palestina dalam konflik ini. Kesimpulan menekankan pentingnya komitmen bersama dari komunitas internasional, negara-negara terlibat, dan organisasi kemanusiaan untuk memastikan keselamatan, keamanan, dan kesejahteraan anak-anak Palestina, serta untuk mencapai perdamaian yang berkelanjutan dan adil di wilayah tersebut.

    Constitutional Protection of Cultural Heritage in Indonesia: The Role of Museums in Preserving National Identity and Public Welfare

    Cultural heritage is a fundamental asset in promoting cultural diversity and facilitating access to education, social values, science, technology, and tourism. Museums play a pivotal role in preserving cultural heritage and fulfilling constitutional obligations, as enshrined in the Indonesian Constitution. Protecting cultural heritage is essential for maintaining national identity and upholding citizens' constitutional rights, particularly in education and cultural participation. This study analyses the constitutional framework and government policies related to cultural heritage protection, with a specific focus on museums in Indonesia. Employing a statute-based and comparative approach, the research examines constitutional provisions such as Article 18B(1) of the Indonesian Constitution, which mandates the state’s responsibility to preserve cultural heritage and safeguard indigenous communities' rights. Despite this constitutional obligation, challenges such as limited financial resources, inadequate maintenance, and institutional constraints hinder the effective operation of museums. The findings emphasize that strengthening museums is not only necessary for heritage conservation but also for fostering national and local values that define Indonesia’s constitutional identity. The study argues that the government must implement more comprehensive policies and allocate sufficient resources to enhance museums’ role in cultural preservation, ensuring their sustained contribution to public welfare and national development

    Transformasi Kebijakan Pemidanaan Dalam Kuhp Nasional: Menuju Sistem Pemidanaan Yang Berkeadilan Dan Humanis

    Indonesia’s penal system has long been dominated by a retributive approach inherited from colonial legal traditions, where imprisonment serves as the primary punishment for criminal offenders. This model has led not only to chronic prison overcrowding but also to the dehumanization of inmates, who still possess fundamental human rights. The newly enacted Indonesian Penal Code (KUHP) marks a significant shift toward a more progressive and humanistic penal paradigm, grounded in the values of Pancasila and the principles of restorative justice. This article aims to normatively analyze the paradigm shift in criminal punishment introduced by the new KUHP and its implications for Indonesia’s penal system, particularly in encouraging the implementation of alternative punishments such as community service, probation, and fines. The study employs a normative legal approach with qualitative analysis of relevant laws, regulations, and legal literature. Findings indicate that the application of alternative sanctions offers a viable solution to prison overcrowding while aligning with the rehabilitative and reintegrative goals of the correctional system. Nonetheless, several challenges remain, including the readiness of law enforcement institutions, infrastructure limitations, and the persistence of a punitive legal culture that views imprisonment as the only legitimate form of punishment. Therefore, a comprehensive implementation strategy is required, involving strong collaboration among government institutions, law enforcement, academia, and civil society to ensure a smooth transition toward a more just, restorative, and humane penal system

    PENERAPAN MONETISASI DAN KOMERSIALISASI HAK EKONOMI DALAM KLAIM HAK CIPTA PADA PLATFORM YOUTOUBE

    Penelitian ini mengkaji secara komprehensif keberadaan perlindungan kekayaan intelektual dalam hukum hak cipta, khususnya terkait pengaturan dalam Pasal 9 Undang-Undang Hak Cipta (UUHC) dan penerapannya pada platform digital YouTube. Fokus utama diarahkan pada posisi kreator sebagai pemegang hak eksklusif atas ciptaan, serta mekanisme sistem Content ID dalam proses identifikasi, klaim, dan perolehan monetisasi atas konten yang diunggah. Dalam praktiknya, implementasi perlindungan hak cipta dan skema monetisasi di platform digital menghadapi berbagai tantangan, antara lain sengketa klaim hak cipta, misuse atau penyalahgunaan klaim oleh pihak tertentu, asimetri informasi antara platform dan kreator, serta keterbatasan regulasi positif yang secara spesifik mengatur model perlindungan dan komersialisasi konten digital. Permasalahan pokok dalam jurnal ini adalah bagaimana penerapan monetisasi dan komersialisasi dalam klaim hak cipta pada platform YouTube serta sejauh mana perlindungan yang diberikan kepada konten kreator dan masyarakat pengguna. Tujuan penulisan jurnal ini adalah agar masyarakat dan konten kreator memahami hak dan kewajiban mereka terkait perlindungan hak cipta di ruang digital. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan perundang-undangan. Sumber data terdiri atas data primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa penerapan monetisasi di YouTube masih menghadapi banyak tantangan, sehingga peran pemerintah dan pembuat kebijakan sangat diperlukan dalam merumuskan pengaturan dan pengawasan yang lebih jelas, tegas, dan adaptif terhadap perkembangan platform digital
