    Narcotics are basically good for development needs in the fields of health, science and technology. As a public prosecutor, the prosecutor not only makes charges against the defendant but also against the items that are evidence, where the demands require that the evidence be destroyed, confiscated for the benefit of the state or returned to its rightful owner. This research is a type of normative research. The results of this research show that the Legality of Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia regarding the Destruction of Narcotics Evidence does not regulate the destruction of Narcotics Evidence. The destruction of Narcotics Evidence is regulated in Law Number 35 of 2009 concerning Narcotics, Government Regulation Number 40 of 2013 concerning Implementation of Law Number 35 of 2009 concerning Narcotics, as well as Regulation of the Head of the National Narcotics Agency Number 7 of 2010 concerning Technical Guidelines for Handling and Safe destruction of confiscated narcotics, narcotics precursors and other chemicals

    Penundaan Kewajiban Pembayaran Utang (PKPU) seharusnya menjadi alternatif dalam menyelesaikan permasalahan utang antara debitor dan kreditor. Selama periode Penundaan Kewajiban Pembayaran Utang, kreditor separatis harus menangguhkan hak eksekusinya. Adanya itikad buruk kreditor separatis yang menjual harta debitor dalam masa Penundaan Kewajiban Pembayaran Utang akan menimbulkan berbagai dampak dalam upaya pembayaran utang. Penulisan penelitian ini bertujuan mengidentifikasi dan menganalisis tanggung jawab hukum kreditor separatis atas harta debitor dalam PKPU yang dijual tanpa persetujuan dari debitor dan pengurus. Metode penelitian penulisan ini termasuk tipe penelitian normatif dengan pendekatan penelitian perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian ini diketahui penjualan harta debitor dalam PKPU oleh kreditor separatis tanpa persetujuan dari debitor dan pengurus tergolong dalam perbuatan melawan hukum sehingga perbuatan tersebut batal demi hukum dan kreditor separatis harus membayar ganti rugi. Dengan demikian, pengaturan mengenai tanggung jawab serta sanksi bagi kreditor separatis yang beritikad buruk pada masa penangguhan PKPU dipandang perlu untuk dirancangkan lebih lanjut demi terwujudnya rencana perdamaian dan terciptanya keamanan dan kesejahteraan bagi para kreditor dalam PKPU

    ANALYSIS OF THE LEGAL AMBIGUITY OF JUDGES' ETHICS VIOLATIONS IN PERMANENT CRIMINAL VERDICT

    The judge's verdict in the judicial system in a legal country has an important meaning in realizing justice and public order. The judge, in carrying out his obligation to decide a criminal case, besides guided by Indonesian Code of Criminal Procedure (KUHAP) and the Indonesian Criminal Code (KUHP) rules, must also be guided by the Code of Ethics and Code of Conduct for Judges (KE and PPH). This article analyzes legal certainty regarding criminal verdicts from judges proven to have violated the code of ethics. This research method uses normative Judicial legal research. The research results show that in recent times, there has been a lot of public news regarding alleged KE and PPH violations. Some of this resulted in verdicts against several judges the Judicial Commission sanctioned. This report also found several reports of alleged violations of the Judge's Code of Ethics related to criminal cases. Apart from that, conditions were also found where the judge's code of ethics was questioned because the judge violated the judge's duties and authority, namely accepting, examining, and deciding criminal cases based on the principles of freedom, honesty, and impartiality in court. The suggestion put forward is the need for regulation in the Criminal Procedure Code regarding the issue of whether a criminal verdict is valid or not if a judge is proven to have violated the code of ethics

    LAW ENFORCEMENT AGAINST PERPETRATORS OF CRIMES AGAINST STREET CHILDREN COMMITTED BY THEIR BIOLOGICAL PARENTS

    Based on the cases in Palembang City, it can be said that law enforcement against perpetrators of crimes against street children committed by biological parents. The formulation of the problem in this study is 1) How is law enforcement against perpetrators of crimes against street children committed by biological parents in the Palembang City Police and 2) What are the factors that influence law enforcement against perpetrators of crimes against street children committed by biological parents in the Palembang City Police? The research method used is a type of empirical juridical research. The sources of data used in this study were primary and secondary data. Based on the results of the study show that law enforcement against the offenders of crimes against street children committed by biological parents in the Palembang City Police Resort, namely by penal measures through imprisonment as in Article 76I Jo Article 88 and Article 76C Jo Article 80 paragraph (1) of Law No. 35 of 2014 concerning amendments to Law no. 23 of 2002, concerning child protection or Article 44 Paragraph (1), Paragraph (4) of the Law of the Republic of Indonesia No. 23 of 2004. Factors that influence law enforcement against perpetrators of crimes against street children committed by biological parents, namely first, the factor of law enforcement officers. Lack of Investigators' Knowledge about Child Protection Law, Second, Community Factors. In cases of crime on the street, children tend to be closed, so it is difficult to socialize with the surrounding environment. Third, cultural factors that do not want to interfere in other people's personal affairs or other people's families or neighbors become a separate problem

Satu ide yang cukupprogresif termasuk mengoptimalkan lembaga mediasi dalam perkara perdata. Pengadilan Agama telah mengajukan mediasisetiap kasus yang kontroversial, tidak ada masalah Perceraian. Jika perdamaian tidak ditemukan oleh kedua belah pihak, pihak keluarga mengambil alihperan menciptakan perdamaian. Namun, ketika perdamaian yang dibuat oleh keluarga tidak berhasil, keputusan ini akan diambillanjut Pengadilan Agama. Dalam hal perceraian, fungsi upaya perdamaian menjadi tanggung jawab Hakimkewajiban sebagai mediator harus dilaksanakan berdasarkan Peraturan Mahkamah Agung Nomor 01 Tahun 2008tentang Tata Cara Mediasi di Pengadilan. Oleh karena itu diusahakan perdamaian melalui mediasi di dalamPengadilan Agama bagi pasangan yang ingin bercerai menyerah dan rujuk. Meskipun ketentuan mengenaiMediasi telah diatur, namun kenyataannya di lapangan belum berjalan maksimal, pelaksanaan upaya perdamaianmelalui mediasi hanya sekedar formalitas dalam perdamaian, jika mediasi tidak dilakukan dengan itikad baik, maka gugatandinyatakan tidak dapat diterima oleh Hakim Pemeriksa Perkara.     Why Did the Adoption of Constitutional Deferral Lead to Unintended Consequences of Freedom of Association in Indonesia?

    A constitutional deferral is an approach utilised by constitutional drafters so that the drafters do not regulate things in detail in the constitution. This approach is believed to provide more opportunity for the constitutional framers to achieve consensus in drafting a constitution. In the end, this helps a constitution last longer. Constitutional deferral also offers some flexibility for the legislative and the judiciary in interpreting the text of the constitution in the future, which may accommodate the original intentions of the constitutional drafters. This paper argues the opposite. In Indonesia, adopting constitutional deferral causes an uncertain future of freedom of association. This paper aims to address two central questions. First, why did the framers of the first constitution adopt constitutional deferral in drafting provisions on freedom of association? Second, what are the consequences of implementing constitutional deferral toward freedom of association in Indonesia? Through historical and doctrinal approaches, the paper concludes (1) that the sharp ideological differences among constitutional drafters when drafting provisions on freedom of association forced them to employ constitutional deferral. (2) The use of constitutional deferral opens more possibilities for inconsistent interpretation by the executive, the lawmakers, and the judiciary when they establish law or adjudicated cases related to freedom of association. Through constitutional deferral, these three branches of government limit freedom of association instead of protecting such freedom

    Does the Reform of the Parliamentary and Presidential Threshold Strengthen the Presidential System in Indonesia?

    The attempt to purify Indonesia's multiparty presidential system was only reflected after the Third Amendment to the 1945 Constitution. However, it took work to implement it. In practice. Various measures have been taken, including party alliances and introducing voting barriers in parliamentary elections. Therefore, analysing the relationship between electoral thresholds and their ideal proportions in the form of legal-political reforms to strengthen the Indonesian presidential system is interesting. This is in line with the purpose of this study, which is to uncover and analyse the legal politics of electoral thresholds in an attempt to strengthen the presidential system of government in Indonesia. The approach adopted in this study is a theoretical approach with legal, conceptual, comparative and historical approaches. This study concludes that the legitimate political renewal of the electoral vote threshold is not closely related to efforts to strengthen Indonesia's system of multiparty presidential government. The ideal way to reform the legal, political threshold for electoral votes would be to set the parliamentary threshold at 2.5%, but at the same time tighten controls over the parties participating in the election, and the 2.5% threshold serves as President to maintain a balance between the parliamentary and presidential thresholds. In addition, it is also important to strengthen consensus (consensus democracy) among coalition political parties. There is still a desire to abolish the presidential threshold through the People's Representative Council (DPR) instead of the Constitutional Court (MK)

    PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENYEBARAN BERITA BOHONG (HOAX) MENGENAI POLITIK MELALUI MEDIA SOSIAL

    Abstrak Politik menjadi salah satu konten yang paling banyak mengandung berita bohong (hoax). Berita tersebut tidak jarang diangkat untuk kepentingan tertentu dengan cara menghasut dan mengajak membenci suatu kalangan. Berdasarkan permasalahan tersebut penelitian ini bertujuan untuk membahas bagaimana penegakan hukum pidana terhadap penyebaran berita bohong mengenai politik melalui media sosial dan apa saja hambatan dalam penegakan hukum pidana terhadap penyebaran berita hoax mengenai politik melalui media sosial. Metode penelitian ini adalah hukum normatif dengan studi kepustakaan. Hasil penelitian menunjukan penanggulangan tindak pidana penyebaran berita hoax mengenai politik melalui media sosial diatur dalam hukum positif yang ada di Indonesia yakni KUHP dan Undang-Undang di Luar KUHP. Dalam implementasinya terdapat hambatan dari faktor substansi, faktor aparat penegak hukum, dan faktor sarana dan prasarana. Upaya penegakan hukum dalam penanggulangan tindak pidana berita bohong mengenai politik melalui media sosial membutuhkan kesadaran dari semua pihak sehingga dengan demikian berita khususnya mengenai politik di Indonesia tidak terdapat unsur negatif.Kata kunci: Penegakan Hukum; Hoax; Politik; Media Sosial AbstractPolitics is one of the contents that contains the most fake news (hoax). The news is not infrequently brought up for certain interests by inciting and inviting hatred among certain groups. Based on these problems, this study aims to discuss how to enforce criminal law against the spread of fake news about politics through social media and what are the obstacles in enforcing criminal law against the spread of hoax news about politics through social media. This research method is normative law with literature study. The results of the study show that tackling the criminal act of spreading hoax news about politics through social media is regulated in positive law in Indonesia, namely the Criminal Code and Laws outside the Criminal Code. In its implementation, there are obstacles from substance factors, law enforcement officials, and facilities and infrastructure factors. Law enforcement efforts in tackling criminal acts of fake news about politics through social media require awareness from all parties so that news, especially about politics in Indonesia, does not contain negative elements.Keywords: Law Enforcement; Hoax; Politics; Social Medi

    Waris atau Hukum warisan adalah hukum yang mengatur apakah dan bagaimanakah hak-hak dan kewajiban-kewajiban tentang harta seseorang ketika pada waktu ia meninggal dunia akan beralih kepada orang lain yang masih hidup. Seringkali suatu pembagian warisan di dalam masyarakat sering menimbulkan perselisihan yang mungkin akan menyebabkan hilangnya keakraban dalam persaudaraan. dalam kenyataannya ada saja sebagian orang yang seharusnya mempunyai dan mendapatkan hak mewaris, tapi ahli waris tersebut tidak mau menerima hak warisnya atau bisa disebut dengan menolak warisan yang diberikan pewaris, karena suatu hal tertentu yang menyebabkan mereka harus berfikir dan menganggap perlu meneliti keadaan harta peninggalan sebelum mengambil keputusan untuk menerimanya. Penelitian ini merupakan jenis penelitian normatif. Hasil penelitian ini menunjukan bahwa menurut Hukum Islam, ahli waris tetap bertanggung jawab dan wajib melakukan pelunasan kredit namun hanya terbatas pada jumlah ataupun nilai harta yang ditinggalkan si pewaris kecuali pembayaran utang tersebut tidak memberi kemudharatan bagi para ahli waris. Sedangkan menurut Hukum Perdata, ahli waris yang menolak warisan tidak dapat dibebani hukum sama sekali, dikarenakan dia dianggap bukan sebagai ahli waris lagi sehingga ia tidak berhak lagi atas dasar harta warisan dan tidak dibebani kewajiban untuk membayar utang – utang pewaris

    In the practice of decision, the judge's consideration in imposing a zero sentence on corruption and money laundering cases according to the Corruption Court Decision at the Central Jakarta District Court Number 50/Pid.Sus-TPK/2021/PN.Jkt.Pst, is because the defendant had previously been sentenced to life imprisonment in another separate but similar case. The next main consideration is because the prosecution for death penalty by the Public Prosecutor cannot be considered by the Judge because it is not in accordance with the Public Prosecutor's Indictment. The criminal law policy in setting the imposition of zero sentences in the future, is the arrangement of concurrent criminal acts and their punishment system according to the provisions of Article 65 of the Criminal Code in the National Criminal Code including Article 67 of the Criminal Code regarding zero crimes which is currently confirmed by legal certainty in Article 131 of Law Number 1 of 2023 concerning the Criminal Code even though it has not yet been promulgated
