PENYELESAIAN PERKARA TINDAK PIDANA PENGANIAYAAN MELALUI KEADILAN RESTORATIF DI CABANG KEJAKSAAN NEGERI PARIGI MOUTONG
Termination of prosecutions based on restorative justice is a policy established by the Prosecutor's Office as outlined in Prosecutor's Regulation Number 15 of 2020 which supports modern punishment by prioritizing peace and restoration of the original situation. As for the problems taken, what are the obstacles that arise in the application of the principle of restorative justice to the criminal act of persecution in the Parigi Moutong State Prosecutor's Branch and how to apply the principle of restorative justice to the criminal act of persecution in the Parigi Moutong State Prosecutor's Branch in the future The type of research used is Normative-Empirical Research The legal materials in this study consist of primary legal materials, Secondary and Tertiary. From the results of this study, the resolution of cases of criminal acts of persecution can be carried out through Restorative Justice, but it must meet the requirements that have been regulated in the Prosecutor's Regulation of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice, while the obstacles that arise in the application of restorative justice are divided into 2 (two), namely internal barriers and external obstacles, and it is expected that in the future there will be regulations in the future. firmly regulating and accommodating the Implementation of Restorative Justice
KEBIJAKAN PENGUATAN KOORDINASI ANTARA PENYIDIK DENGAN PENUNTUT UMUM DALAM MENERAPKAN RESTITUSI PERKARA KEKERASAN SEKSUAL TERHADAP ANAK
The implementation of coordination between Investigators and Public Prosecutors regarding restitution in cases of child victims of sexual violence is hampered by several factors, namely: first, the legal substance factor, which is according to the Government Regulation concerning the Implementation of Restitution for Children Who Are Victims of Crime (PP on Child Restitution) and the Protection Law Witnesses and Victims, Investigators and Public Prosecutors are passive, limited to only accepting applications for restitution; secondly, the legal structure factor, where the passive nature means that investigators and public prosecutors do not have an obligation to notify the victim regarding the right to restitution; and third, community factors, namely the community does not know that victims have the right to restitution. The policy in the future are : first, revise the PP on Child Restitution regarding notification to child victims to obtain the right to restitution by Investigators and Public Prosecutors as an obligation; second, the Investigator's commitment to attaching the request and amount of restitution to the case file, and the authority of the Public Prosecutor to return the case file with instructions for the Investigator to complete it with an attachment to the request and amount of restitution; and third, outreach to the public by law enforcement and related parties regarding the rights of child victims of sexual violence to restitution and procedures for applying for it
FACTORS AFFECTING THE CRIMINAL ACT OF COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN (ESKA) IN THE COASTAL AREA OF BANDAR LAMPUNG CITY
Commercial sexual exploitation of children (ESKA) is a fundamental violation of children's rights. The offense is in the form of sexual violence by an adult with remuneration to a child, a third person, or other persons. ESKA treats children treated as commercial sexual objects. The problem in this study is what are the factors that affect the crime of Commercial Sexual Exploitation of Children (ESKA) in the coastal area of Bandar Lampung? This study uses normative legal methods. The results obtained are the factors that influence the crime of Commercial Sexual Exploitation of Children (ESKA) in the coastal area of Bandar Lampung, which can be seen by the poor people so that people make this activity a job to meet their living needs. The suggestion in this study is that there must be good coordination between law enforcement officers and the government to prevent the occurrence of criminal acts of Commercial Sexual Exploitation of children from recurring, such as providing decent work and conducting educational activities to the public about criminal acts of Commercial Sexual Exploitation of children. The community must also be able to be open and cooperate with all relevant parties to prevent the re-occurrence of criminal acts of Commercial Sexual Exploitation of children
CRIMINOLOGICAL ANALYSIS OF CYBERBULLYING CRIMES OCCURRING ON SOCIAL MEDIA (STUDY OF COMMENTS ON THE TIKTOK ACCOUNT ELYNAWA21)
This research aims to examine the phenomenon of crime in the social media landscape, particularly cyberbullying, which has become increasingly prevalent. The primary focus is on how the development of information and communication technology has facilitated bullying on social media platforms. Utilizing the social control theory by Travis Hirschi and Michael Gottfredson, this study emphasizes that individuals with weak attachments to social institutions, such as family, school, or community, are more susceptible to engaging in criminal behavior, including cyberbullying. This study analyzes comments targeting the physical appearance of individuals, where the lack of social supervision and weak self-control are identified as key factors contributing to cyberbullying behavior. Additionally, a low awareness of legal frameworks, such as the ITE Law governing online harassment, further intensifies this issue. The novelty of this research lies in applying social control theory within the context of cyberbullying on social media, highlighting the importance of strengthening social bonds and implementing social control mechanisms as preventive strategies. The study also provides valuable insights into the need for more effective law enforcement and educational efforts to mitigate and address the rising cases of cyberbullying in the digital age
IDENTIFYING THE CRIME OF INSIDER TRADING FERIENJOB IN GERMANY AND LEGAL PROTECTION FOR INDONESIAN STUDENTS
The phenomenon of ferienjob (seasonal work) in Germany is increasingly attractive to international students, including those from Indonesia, as it offers income opportunities and work experience abroad. However, behind the legality and attractiveness of this work, some loopholes can be used for exploitation, which in some instances can lead to the crime of trafficking in persons. This study aims to identify modes of exploitation in the context of ferienjob and evaluate the level of legal protection available to Indonesian students, both from German and Indonesian law perspectives. The study reveals the existence of covert forced labor practices, violations of labor rights, and a lack of supervision of employment agencies facilitating Indonesian students. In addition, the different legal regimes in the two countries often cause uncertainty regarding legal protection, mainly when violations occur outside the home country's jurisdiction. The results show that despite applicable legal instruments, the implementation of protection for Indonesian students working in Germany still needs to be improved
ANALISIS PERLINDUNGAN HUKUM TERHADAP KORBAN PENYEBARAN BERITA BOHONG MELALUI MEDIA SOSIAL FACEBOOK
The widespread circulation of fake news can have a bad impact on the development of the Indonesian state. Fake news can cause arguments and even end friendships. Moreover, fake news contains ethnicity, religion, race and inter-group (SARA) which are very vulnerable to inviting friction between communities, disrupting state stability and diversity. Apart from having a crime aspect (perpetrator of crime), fake news also has a crime victim aspect. Victims in various fake news cases in Indonesia have not received more attention, even though this is an important matter in Indonesian law enforcement. The aim of this research is to find out and explain legal protection for victims of spreading fake news on social media (Facebook), and also the legal efforts that can be taken by victims of spreading fake news on social media (Facebook). The type of legal research that is carried out normatively is where law is conceptualized as what is written in statutory regulations (law in the books) or law is conceptualized as rules or norms which are benchmarks for human behavior that is considered appropriate. Based on the research results, it is understood that legal protection for victims of spreading fake news on social media (Facebook) means that victims receive legal protection from the Witness and Victim Protection Agency (LPSK) in the form of medical assistance, psychological rehabilitation, psychosocial rehabilitation, post-traumatic psychological recovery, compensation/ compensation, restitution. Legal remedies that can be taken by victims of spreading fake news on social media (Facebook) are reporting the incident to the authorities, asking for protection from the Witness and Victim Protection Agency (LPSK), retaliation through criminal or civil law
The Indonesian Land Border Security System: A Strategic Decision Making for National Security
Securing the border of a nation is identical with upholding the nation’s sovereignty. Therefore, it is very important to ensure the role of securing the land border area through maximum security according to its needs. Several violations often occur in land border areas between two countries, so it is necessary to maintain strict security along the borders of the two countries. But the problem is, the borders between countries are very long, and it is impossible to deploy TNI troops along these borders. Apart from the difficult terrain conditions in the border areas, there are also a large number of TNI soldiers needed to guard the borders, so this is not an effective and efficient thing to do. This research was conducted based on data on violations in the border areas between the Republic of Indonesia and other countries, namely Malaysia, the Democratic Republic of Timor Leste and Papua New Guinea, which are represented in the distribution of cases during the second semester of 2020 and the first semester of 2021. Based on data collection data from respondents/field practitioners who have been directly involved in securing border areas and with the help of the Analytical Hierarchy Process (AHP) method and the Strengths, Weakness, Opportunities and Threats (SWOT) method, a decision with optimal value regarding the security of land border areas can be determined. appropriate to current and future conditions. Analysis using AHP resulted in the best alternative being a Non-Traditional Deployment (53%) with a consistency ratio value of 0.0136 (1.36%). Likewise, analysis using SWOT produces the best alternative, namely Non-Traditional Deployment with an IFAS score of 0.12 and EFAS 0.90. So, the best alternative that should be taken by decision makers in order to realize land border security in order to strengthen Indonesia's defense strategy is to use the Non-Traditional Deployment system
KETIDAKPASTIAN HUKUM PADA REGULASI BLOCKCHAIN TERHADAP BISNIS DAN KEAMANAN TRANSAKSI
Saat ini teknologi berkembang dengan begitu pesat. Salah satu bukti nyata dalam perkembagan teknologi ialah perkembangan teknologi keuangan digital, salah satunya blockhian. Blockchain dapat dikatakan sebagai open source system karena kebanyakan implementasi blockchain menggunakan perangkat lunak sumber terbuka. Teknologi berbasis blockchain memberikan transparansi kepada semua orang di jaringan, dengan transaksi yang terlihat oleh semua komputer yang terhubung. Blockchain menghilangkan kebutuhan akan pihak ketiga alam transaksi dengan menggunakan teknologi desentralisasi dan kecerdasan kolektif jaringan. Regulasi dibutuhkan untuk memberikan perlindungan konsumen dalam pemanfaatan teknologi blockchain yang semakin populer di Indonesia. Blockchain sendiri menawarkan teknologi baru dalam penyimpanan data digital. Ketidakpastian dalam regulasi blockchain dapat muncul dalam berbagai bentuk, termasuk ketidakpastian hukum, manajerial, dan teknis. Sehingga dari ketidakpastian hukum ini berdampak pada bisnis dan keamanan transaksi. Tujuan penelitian ini adalah untuk menganalisis ketidakpastian hukum pada regulasi blockchain terhadap keamanan bisnis dan kemanan transaksi. Untuk mencpai tujuan penelitian tersebut dilkukan penelitian dengan metode normatif penelitian hukum yang dilaukan dengan cara memeliti pustaka untuk menemukan aturan hukum, prinsip-prinsip maupun doktrin – doktrin huku guna menjawab permasalahan hukum yang dihadapi. Hasil penelitian menunjukkan bahwa ketidakpastian hukum pada terjadi karena blockchain merupakan produk baru dan masih perlu dikaji ulang serta pemerintah beserta pihak terkait diharapakn dapat memformulasi peraturan yang memayungi mekanisme blockchain agar tidak terjadi kesimpangsiuran kedepannya.Currenly technology is developing so rapidly. One clear proof of techonological development is the development digital of financial technology, one of which is blokchain. Blockchain can be said to be an open source system because most blockchain implementations use open source software. Blokchain -based technology provides transoarancy to everyone on the network, with transactions visible to all conected computers. Blockchain eliminates the need for third-party transactions by using decentralized technology and the colective itelligence of the network. Regulations are needed to provide consumer protection in the use of blokchain technology which is increasingly popular in Indonesia. Blockchain it self offers new technology in digital data storage. Uncertainly in blockchain regulation can appear in various forms, including legal managerial, and technical uncertainly. So this legal uncertainly has an impact on bussines and transaction security. The aim of this research is to analyze legal uncernainly in blokchain regulations regarding bussines security and transaction security. To achive tge research objectives, research was carried out using normative legal research methods which were carried out by researching the literature to find legal rules, principles and legal doctrines in order to answer the legal problems faced. The resecarch results show thatlegal uncertainly occurs because blokchin is a new product and still to be able to formulate regulations that cover the blokchain mechanism so that there is no confusion in the future
KEWENANGAN KEJAKSAAN DALAM MENYELESAIKAN SENGKETA NON LITIGASI
ABSTRAK : Proses penyelesaian sengketa melalui Non Litigasi bukanlah sesuatu yang baru dalam nilai-nilai budaya bangsa dan kooperatif dalam menyelesaikan masalah. Diperlukan pengaturan khusus mengenai penyelesian sengketa non litigasi yang dilakukan oleh Jaksa pengacara negara untuk menjadi tolak ukur dalam keberhasilan penyelesaian sengketa tersebut dengan mengacu dalam pengeturan mengenai kejaksaan di atur dalam Undang-Undang Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-Undang Nomor Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia. Penulisan penelitian ini bertujuan mengidentifikasi dan menganalisis penerapan upaya sengketa non litigasi oleh Jaksa Pengacara Negara di Kejaksaan Negeri Penukal Abab Lematang Ilir serta menggagas idealnya upaya penyelesian sengketa non litigasi oleh Kejaksaan Negeri dimasa yang akan datang. Metode penelitian penulisan ini termasuk tipe penelitian normatif dengan pendekatan penelitian perundng-Undangan, pendekatan kasus dan pendekatan futuristik. Hasil penelitian ini diketahui Pengaturan kewenangan kejaksaan secara abstracto penyelesaian sengketa non litigasi dalam melakukan mediasi di Kejaksaan Negeri Penukal Abab Lematang Ilir yakni memiliki unsur keadilan para pihak dengan berpedoman pada Undang-Undang Republik Indonesia Nomor 11 Tahun 2021 Tentang Perubahan Atas Undang-Undang Nomor 16 Tahun 2004 Tentang Kejaksaan Republik Indonesia meskipun secara khusus belum mengatur mengenai mediasi. Selain itu untuk meningkatkan profesionalisme Jaksa Pengacara Negara melalui berbagai metode antara lain; mengikutkan Jaksa Pengacara Negara pendidikan tehnis DATUN; mewajibkan para jaksa untuk menghadiri sidang perkara perdata dan Tata Usaha negara di Pengadilan Negeri sehingga mengetahui dan memahami prosedur dan tata cara beracara Perdata dan TUN di Pengadilan bukan hanya memahami beracara Pidana di Pengadilan; mempelajari tehnik-tehnik bernegosiasi dan terampil membuat legal opinion. Kata Kunci : Kewenangan, Jaksa Pengacara Negara, Sengketa ABSTRACT : The process of resolving disputes through non-litigation is not something new in the nation's cultural values and is cooperative in solving problems. Special arrangements are needed regarding the resolution of non-litigation disputes carried out by state prosecutors to become a benchmark in the success of the settlement of these disputes with reference to the arrangements regarding the Attorney stipulated in Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Attorney of the Republic of Indonesia. This study aims to identify and analyze the implementation of non-litigation dispute efforts by State Prosecutors at the Penukal Abab Lematang Ilir District and to initiate ideal efforts in resolving non-litigation disputes by State Prosecutors in the future. This is normative research with statutory, case and futuristic approaches. The results of this study showed that the arrangement of the prosecutor's authority in abstracto non-litigation dispute resolution in conducting mediation at the District Attorney of Penukal Abab Lematang Ilir fulfilled the elements of justice for all parties guided by the Law of the Republic of Indonesia Number 11 of 2021 concerning Amendments to Law Number 16 2004 concerning the Attorney of the Republic of Indonesia, although it does not specifically regulate mediation. In addition, in increasing the professionalism of State Prosecutors, the following methods can be carried out: enrolling them in civil and state administrative technical education, requiring them to obtain a special certificate for mediation prosecutors and to learn negotiation techniques, and be skillful in making legal opinions. PELAKSANAAN UNDANG-UNDANG NOMOR 41 TAHUN 1999 TENTANG KEHUTANAN STUDI KASUS TENTANG KEBAKARAN LAHAN DI SUMATERA SELATAN
Kebakaran Hutan dan Lahan diatur dalam Pasal 50 ayat (3) Huruf d Undang-Undang Nomor 41 Tahun 1999 Tentang Kehutanan. Tujuan dari penelitian ini adalah untuk menganalisis dan menjelaskan Bagaimana Pencegahan Kebakaran Hutan dan Lahan Supaya Tidak Terjadi Lagi di Sumatera Selatan, dan untuk menganalisis dan menjelaskan Bagaimana Penegakan Hukum Pidana Kepada Pelaku Kebakaran Hutan dan Lahan di Sumsel. Metode Penelitian yang digunakan penulis adalah penelitian Normatif yang di dukung dengan Data Empiris. Hasil Penelitian Bahwa Pencegahan kebakaran hutan dan lahan di Provinsi Sumatera Selatan dapat di lakukan dengan dua tindakan yaitu Tindakan Preventif dan Tindakan Represif. Penegakan Hukum Pidana terhadap pelaku kebakaran hutan dan lahan di Sumatera Selatan adalah dengan melakukan upaya penegakan hukum pidana melalui putusan hakim dalam persidangan. Saran dari penulis yaitu Pencegahan kebakaran lahan dilakukan oleh Pemerintah Provinsi Sumatera Selatan untuk selalu meningkatkan pengawasan terhadap kawasan hutan dengan melibatkan masyarakat sekitar
