    Merek adalah suatu tanda yang digunakan untuk membedakan barang dan jasa dengan ciri khas berupa gambar, nama, kata, huruf, angka, corak warna, atau kombinasi dari unsur-unsur tersebut untuk kepentingan perdagangan yang dibuat oleh suatu perusahaan. Sesuai ketentuan Pasal 74 Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, apabila terjadi pelanggaran, maka merek tersebut dapat dihapuskan. Salah satu kasus perdebatan merek dagang ini terjadi antara merek dagang Produk Kecap Babon milik Penggugat dengan merek dagang Babon milik Tergugat berdasarkan Putusan Nomor 1/Pdt.Sus.HKI/Merek/2023/PN.     Exploring the Discourse of Subject in Intellectual Property Rights: Communal Rights in Indonesia

    The objective of this study is to expound on the discourse surrounding the categorization of intellectual property rights (IPR) under public and private international law, which has been a topic of contention among legal experts. Through an in-depth analysis of the IPR debate, including public and private case examples, and the contrast between traditional and communal IPR, this study intends to explore Indonesia's perspective towards IPR and communal rights. Indonesia acknowledges communal rights within IPR and has implemented various legal and policy instruments to safeguard them. It is envisaged that the research findings will advance the ongoing discourse on the classification of IPR under public or private international law, and enhance the comprehension of the legal framework governing IPR in Indonesia. This study will also bring into focus the recognition and protection of communal rights in IPR, which is a crucial subject in modern international law

    The crime of human trafficking is a transnational crime and become a global concern for countries in all around the world. Indonesia has Law No. 21 Of 2007 concerning Detention of Persons Trafficking Offenders. The purpose of this researchis to find out criminological point of view of human trafficking. The research uses normative methods with doctrine and statutory approaches. The results of the research show that the problem of human trafficking does not only affect one institution, but must involve all community actors, namely. state agencies, non-governmental organizations, municipal organizations joining the state-enhanced partnership, decrees and ministerial decrees together to solve human trafficking problems

    The Legal Importance of Registering Intellectual Property for Creative Economy Stakeholder as Loan Collateral

    Intellectual Property as the foundation of the creative economy can provide massive economic benefits with the intellectual capacity of the nation, the design and development of intellectual property-based financing schemes. however, the utilization of intellectual property resulting from the creativity of creative economy practitioners in the application of intellectual property-based financing schemes must have record or certificate of intellectual property. The awareness of creative economy practitioner in Indonesia is currently low when it comes to registering intellectual property products. This research is a normative legal study based on primary legal sources consisting of legislative regulation. It is further supported by secondary data obtained through literature reviews and an analysis of various related literature regarding the core issue of this study. Registration and recording of intellectual property in Indonesia remain low because the public, especially creative economy practitioners have limited knowledge about the intricacies of registration and recording. Additionally, the public perceives registering and recording as futile due to the weak enforcement of intellectual property laws. Creative economy practitioners also lack awareness of the benefits of registration or recording as a requirement for obtaining capital through intellectual property-based financing schemes. Efforts made by the government include improving the enforcement of intellectual property laws and simplifying and reducing the cost of intellectual property registration and recording. The support of the intellectual property recording mechanism as collateral for loans can assist creative economy practitioners in obtaining funding

    Addressing the Challenges in Protecting Child Victims of Sexual Violence within Non-Formal Education Institutions

    In recent years, violence against women and children has markedly increased in the Special Region of Yogyakarta, Indonesia. Numerous cases underscore a significant potential for sexual violence against children, particularly those enrolled in non-formal education institutions. This pressing issue necessitates a thorough examination of current implementation practices, the identification of existing constraints, and the formulation of prospective criminal policies aimed at protecting children from sexual violence in these educational settings. This study utilises a socio-legal framework with a normative-empirical approach, drawing on data from Bantul Regency and Yogyakarta City. It also critically reviews pertinent regulatory frameworks and implementation practices within this context. Findings indicate that both preventive and repressive measures have been enacted to combat sexual violence against children, primarily through the empowerment of law enforcement officials and related government officers at the district, city, and provincial levels. However, the effectiveness of preventive measures is impeded by current regulations and prevailing social norms. Future initiatives to protect children from sexual violence in non-formal education institutions should prioritise non-penal approaches, including the enhancement and harmonisation of the Criminal Acts of Sexual Violence legislation at both national and regional levels. Furthermore, it reveals that local government agencies have yet to establish effective coordination mechanisms to promote better norms for preventing sexual violence in these institutions. Enhancing community empowerment and bolstering the coordination and roles of stakeholders will be pivotal in mitigating the stigma faced by child victims of sexual violence

    Putusan Mahkamah Konstitusi atas pengujian undang-undang haruslah dipatuhi oleh semua pihak, termasuk pembentuk undang-undang. Namun kenyataannya, masih ditemukan pengabaian terhadap putusan Mahkamah Konstitusi oleh pembentuk undang-undang. Penelitian ini bertujuan untuk mengkaji konsep kewajiban yang melekat pada pembentuk undang-undang dalam menindaklanjuti putusan Mahkamah Konstitusi, dan implikasi dari diabaikannya putusan Mahkamah Konstitusi oleh pembentuk undang-undang. Jenis penelitian ini adalah penelitian normatif dengan menggunakan metode pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa pembentuk undang-undang mempunyai kewajiban dalam menindaklanjuti putusan Mahkamah Konstitusi yang di antaranya sebagai bentuk perwujudan supremasi konstitusi, syarat keberlakuan yuridis suatu undang-undang yang harus berdasarkan konstitusi, dan fungsi sosiologis yang terkandung dalam putusan Mahkamah Konstitusi. Adapun diabaikannya putusan Mahkamah Konstitusi oleh pembentuk undang-undang dapat berimplikasi kepada penyelenggara negara, warga negara, serta peraturan perundang-undangan

    IMPLEMENTATION OF PANCASILA VALUES IN ALTERNATIVE DISPUTE RESOLUTION IN THE FORM OF NEGOTIATIONS

    Courts that accommodate dispute resolution are still not optimal in implementing fair decisions for the parties. Not only has it not created justice, but it has not been able to resolve the dispute quickly. In the end, there was a backlog of cases, so the simple, fast, low-cost justice principle was difficult to realize. Alternative Dispute Resolution is one of the efforts that can be implemented to assist the court in reducing the number of cases piling up, one of which is in the form of negotiations as regulated in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. In principle, negotiations are concerned with implementing the Principle of Deliberation and Consensus as implied in the Preamble to the 1945 Constitution as stipulated in the Alternative Dispute Resolution Act. The problematic legal issues in its implementation are compiled in this article, analyzing the weaknesses of Negotiation as an Alternative for Resolving Business Law Disputes in Indonesia as well as the context for the Implementation of Pancasila Values. The type of research used is normative juridical with descriptive research type. The results that will be discussed explain the technical weaknesses of Alternative Dispute Resolution through Negotiations, which are generally linked to business law events in Indonesia in applying Pancasila values, especially the values of Humanity and Deliberation to Consensus. This writing concludes that Alternative Dispute Resolution must continue to be pursued in resolving disputes and in minimizing the weaknesses of the process, including opinions are submitted systematically, politely, and creatively, looking for common ground wisely, viewing the other party as family to create a family atmosphere, and accommodating Pancasila values as a guide to implementing written law

     Provinsi Kepulauan Bangka Belitung dikenal sebagai daerah penghasil timah terbesar dan menduduki peringkat pertama di antara seluruh daerah di Indonesia. Seiring dengan maraknya penambangan timah, ada kisah menarik namun menyedihkan. Bagi komunitas penambang timah, melibatkan anak-anak dalam kegiatan pertambangan untuk membantu pekerjaan dianggap normal dan memang telah diakui sebagai profesi turun-temurun yang telah mereka geluti sejak dahulu kala. Peran serta anak-anak dalam dunia pertambangan tentu memiliki dampak tersendiri. Banyak anak putus sekolah karena pertambangan, apalagi jika harga timah terus naik. Situasi ini tidak dapat dipungkiri, karena sejak kecil anak-anak sering bermain di area pertambangan. Anak-anak akan menghadapi banyak risiko ketika melakukan kegiatan pertambangan. Hal ini lebih mengkhawatirkan untuk melibatkan anak-anak dalam kegiatan pertambangan. Anak pada hakikatnya membutuhkan pendidikan, perlindungan hukum, perlindungan ekonomi dan sebagainya. Penelitian ini menggunakan metode yuridis empiris yang memerlukan data primer dan data sekunder. Yuridis empiris dilakukan dengan melihat realitas yang ada dalam praktik di lapangan. Penelitian ini menarik dilakukan karena berdasarkan observasi lapangan, kami menemukan bahwa masih banyak anak-anak penambang yang terlibat dalam kegiatan penambangan timah, terutama di Desa Belo Laut dan Desa Air Putih, Kecamatan Mentok, Kabupaten Bangka Barat, Provinsi Kepulauan Bangka Belitung. Seperti apa perlindungan hukum dan ekonomi untuk pekerja anak di lingkungan hukum Indonesia? Apakah hukum di Indonesia akan tegas dalam menangani masalah ini?     Chapter 1 article 1 of the Regulation of the Supreme Court of the Republic of Indonesia number 3 of 2017 has clearly defined that women having cases before the law consist of women who violate the law, women who testify in court, female crime victims, and women who stands as a party in a case. They have the right to get protection, access to justice, and receive fair treatment without discrimination. In addition, they are also entitled to receive recovery and restitution from the damage caused by a crime. Protection during the judicial process must also be provided because of the potential threats they may face in cases involving them. Therefore, it is very important to provide trustworthy escorts while they are following the judicial process so that their rights can be fulfilled and properly accommodated
