Get PDF銀行が，利息制限法第1条に定める金利に接近する金利で，極度貸付契約に基づく過剰貸付けを反復継続する行為は，債務者に対する信義則に違反する。銀行は債務者に対し，貸付額のうち信義則に違反する過剰貸付けの部分について，元本の返還および利息の支払を請求することができない。債務者が支払責任を負うべき残元本額を確定するためには，引き直し計算が必要である。保証会社は債務者に対し，予定された賠償額のうち保証料に相当する額について支払を請求することができない。Banks that continuously or repeatedly generate excessive loans under basic revolving credit contracts make debtors’ financial lives worse through such actions.

Furthermore, we examine certain workings that enable the continuation of integration into one existence by opening to the world with overall synthetic dynamic operation. Paying attention to the corresponding characteristic of existence as one person in such continuous working, we perceive and act on it as the working of personal welfare. As mental content in the core of such operation, Whitehead points to the love preached by Christ. An upsurge of love is understood in the form of steps in intentionality exceeding the grasped fact, and love becomes possible through conditions of establishing support for the existence itself of one person. Student Volunteers’ Learning and Roles in the Disaster Reconstruction Period : Practical Support for Reconstruction
Get PDF本研究では，震災復興期における学生ボランティアに焦点を当て，その役割と学びについて調査を基に考察を行った。結果，特徴的な学びとして，「命」への理解と「ボランティア理解」の深まりが見出された。復興期の学びの特徴として，関わる町の歴史・文化等の固有性を理解し，「まちづくりに向けた知識・技術への学び」が深まっていることが明らかになった。さらに，リーダー層の学生たちは，「リーダーシップ」への学びが深まっていた。また，復興期のボランティアには被災者自身の自立の視点と被災者との双方向協働型の関わりが求められているが，学生ボランティアは，その特性故に支援を受ける側の「心理的負債感」を軽減しうる点を指摘した。In this research, we examined student volunteers’ roles and learning by focusing on their practical support during the disaster reconstruction period. Results showed that they recognized “life (living) itself” and deepened their “understanding of what the volunteer is.” Clearly, their recognition of the “knowledge and skills of reconstruction” was enriched by understanding the uniqueness of history and culture etc., of the town in which they volunteered. Furthermore, students in the leader group became aware of leadership through their practical work. In general, volunteer support during the construction period required cooperative interaction between the self-reliance of victims and volunteer supporters. Notably, however, student volunteers may reduce victims’ psychological burden thanks to their characteristics.departmental bulletin pape
