Sharia-Based Public Service Administration in Aceh: A Normative-Conceptual Study from an Islamic Perspective

    No full text
Public service is expected to improve the quality of life for society through efficiency, transparency, and justice. However, in practice, there are still widespread inefficiencies, abuse of authority, and ethical violations that harm the public. In this context, Sharia-based public service offers an alternative approach that is not only normative but also applicable, by integrating Islamic values such as trustworthiness (amanah), justice (‘adl), and public benefit (maslahah). This study aims to develop the concept of Sharia-based public administration through a normative and conceptual approach, using a qualitative descriptive-analytical method based on library research. The principles of Sharia are examined in relation to good governance principles, such as accountability and efficiency, to form a more ethical and responsive service system for societal needs. The findings show that this model holds strong potential for implementation, although it faces structural and cultural challenges, such as value resistance and the dominance of secular bureaucracy. However, opportunities are opening through bureaucratic reform and the growing spiritual awareness among the public. Therefore, strengthening regulations, transforming bureaucratic culture, and enhancing the capacity of public servants are essential steps forward

Criminal Sanctions Against Polyandry Perpetrators: Perspectives of Islamic Law and Positive Law

    No full text
Ideally, Islamic law and positive law in Indonesia prohibit the practice of polyandry as it contradicts the principles of Sharia and Law Number 1 of 1974 on Marriage. However, in reality, cases of polyandry are still found in society, including in Langsa, Aceh, due to low legal awareness and the influence of local culture. This study aims to analyze criminal sanctions against perpetrators of polyandry from the perspective of Islamic law and positive law, as well as to assess the effectiveness of their application. This article is classified as field research with a qualitative approach. The methodology employed is normative legal studies. The research findings show that sanctions for polyandry in Islamic law aim to preserve lineage and family honor, while positive law focuses on protecting the monogamous marriage system. However, the implementation of sanctions is often hindered by social and cultural challenges, as well as weaknesses in law enforcement at the local level. This study provides recommendations to strengthen the synergy between Islamic law and positive law to more effectively prevent the practice of polyandry

Halal Certification Cooperation Between Indonesia and Malaysia: A Legal Analysis of the Principle of Reciprocity

This study was conducted to underscore the need for harmonization of halal certification systems between countries, particularly the challenges in achieving mutual recognition of halal certificates between Indonesia and Malaysia, based on the principle of reciprocity. The research aims to examine and analyze the legal aspects and normative barriers involved in implementing halal product assurance cooperation agreements between the two nations. A qualitative research method was employed, specifically doctrinal legal research, focusing on statutory regulations. The data analyzed were derived from secondary sources, including legal documents related to the international legal framework governing halal product assurance based on reciprocity, such as the Memorandum of Understanding (MoU), Government Regulation No. 39 of 2021, and JAKIM regulations. The findings reveal that a halal product assurance cooperation agreement has been established between Indonesia and Malaysia. Initially, halal certification for foreign products entering Indonesia was conducted through a business-to-business (B2B) mechanism. However, following the formal cooperation between the two countries, Indonesia's Halal Product Assurance Agency (BPJPH) and Malaysia’s Department of Islamic Development (JAKIM) signed a Memorandum of Cooperation (MOC) to facilitate mutual recognition of halal certificates. Notably, Article 123(1) of Government Regulation No. 39 of 2021 explicitly affirms that halal certification can be recognized through mutual agreements between countries, provided such recognition is reciprocal. This study contributes to the development of international legal theory, particularly in reinforcing national halal certification policies and advancing Islamic economic law through cross-border collaboration

    No full text
This study aims to explore the legal awareness of MSME actors in business legalization under the guidance of the UMKM Juara program by the West Java Provincial Government in Kecamatan Cisalak-Tanjungsiang. The research adopts a juridical-empirical method with data collected through semi-structured interviews and literature studies to understand the perceptions and motivations of MSME actors regarding business legality. The findings reveal that although MSME actors generally understand the importance of business legality, they are often reluctant to pursue it, as it is perceived to provide no direct benefits. The primary motivation for legalization is driven by the need for halal certification, rooted in religious values. However, the lack of information on legalization procedures and limited support in guidance are the main obstacles. Social, cultural, and religious factors significantly influence legal awareness and the legalization process among MSMEs in the area

    No full text
This study aims to investigate the role of leverage and liquidity in financial distress, with profitability as a moderating variable in property and real estate companies listed on the Indonesia Stock Exchange (Bursa Efek Indonesia – BEI) during the 2021–2023 period. The research sample was selected using the purposive sampling technique, with criteria requiring companies to publish complete annual financial reports within this period. Based on these criteria, 68 companies were obtained as the research sample. Data analysis was conducted using SPSS 26 with the moderated regression analysis technique. The results indicate that leverage has a negative effect on financial distress, while liquidity has a positive effect on financial distress. However, profitability does not moderate the effect of leverage and liquidity on financial distress. These findings are expected to provide valuable insights for stakeholders in the property and real estate industry in designing strategies and making appropriate decisions to mitigate the risk of financial distress in companies

REDISCOVERING LIFE'S CYCLES: EXPLORING THE MEANING OF NUNAKKISHU IN Q.S. YASIN VERSE 68

This study delves into the concept of nunakkishu in Q.S. Yasin verse 68, which reflects the cyclical nature of human life, from the vulnerability of infancy, the strength of adulthood, to the eventual return to a weakened state in old age. By integrating Quranic exegesis with contemporary scientific perspectives on aging, cognitive decline, and Erik Erikson's psychosocial development theory, this research provides a comprehensive understanding of biological and psychological regression in later life. Utilizing a qualitative library research method, the study examines classical and contemporary interpretations of the verse alongside modern findings on aging. The results reveal that the term nunakkishu embodies not only the physical and cognitive transformations of aging but also serves as a profound reminder of human dependence on the Creator. Furthermore, it underscores the ethical and social dimensions of caregiving for the elderly, rooted in the Quranic values of compassion, respect, and social responsibility. This study contributes to a deeper understanding of life's cycles, offering recommendations to foster empathy and holistic care for the elderly, encompassing their spiritual, physical, and psychological needs
