Agrarian Conflict in Aceh: The Intersection of Corporate Interests, Farmers' Rights, and Government Governance
Ideally, agrarian conflicts in Aceh could be resolved with a fair and sustainable approach that accommodates the interests of companies, farmers' rights, and the role of the government in transparent governance. However, in reality, these conflicts are often triggered by inequalities in land rights distribution, injustice in the treatment of farmers, and the lack of effective oversight of companies, as well as government policies that do not always favor local communities' interests. This study aims to analyze the dynamics of agrarian conflicts in Aceh, focusing on the interactions between the interests of companies, farmers' rights, and the role of government governance, as well as identifying the factors influencing the inequality in land dispute resolution. The methodology used in this study is qualitative literature-based research with a descriptive analysis approach. The results of the study conclude that agrarian conflicts in Aceh are caused by imbalances in land control between companies, farmers, and the government, with the interests of companies often clashing with farmers' rights, while government governance has not yet been able to accommodate all parties fairly. Resolving these conflicts requires a holistic approach that strengthens agrarian reform policies, oversight of companies, and transparent dispute resolution mechanisms, followed by the active role of indigenous communities and advocacy organizations in protecting farmers' rights
Certainty of Fulfilling the Subjective Requirements of an Agreement in the Case of PPJB; Analysis of Decision Number 697/PDT.G/2021/PN.TNG
Ideally, the fulfillment of subjective conditions in an agreement, such as the competence of the parties and free will, serves as the basis for the legal validity of the agreement. However, in reality, as seen in Case Decision Number 697/PDT.G/2021/PN.TNG, non-formal factors such as unequal bargaining positions and emotional pressures also influence the annulment of the Sale and Purchase Agreement (PPJB). This study aims to analyze the legal certainty of fulfilling the subjective conditions of agreements and the judge's considerations in this case. A normative juridical approach was employed, analyzing the court's decision and contract law theory. The research findings indicate that while subjective conditions were formally met, the judge annulled the PPJB by considering substantive justice. Unequal bargaining positions and psychological pressures were the main reasons for the annulment. This study emphasizes that the protection of individual rights and balanced justice is the primary principle in contract annulments, surpassing the mere fulfillment of formal conditions
Legal Liability of Business Actors for Prohibited Products: A Juridical Review of the Consumer Protection Law and the Health Law
Ideally, business actors are obligated to ensure that all products they manufacture and distribute meet quality, safety, and legality standards in accordance with the provisions of the Consumer Protection Law (UUPK) and the Health Law. In reality, there are still business actors who distribute prohibited products that endanger consumer health and safety, such as the circulation of pharmaceutical preparations contaminated with hazardous substances. This study aims to analyze the forms and legal basis of business actors' liability for prohibited products within the framework of positive law in Indonesia. The method used is normative juridical with a descriptive qualitative approach through analysis of legislation and relevant case studies. The findings indicate that business actors can be held accountable under civil, criminal, and administrative law, applying the principles of strict liability and shifting the burden of proof, which strengthen the legal position of consumers. The study also highlights the necessity of active supervision by regulatory bodies such as BPOM to prevent the circulation of prohibited products
The Legislative Mechanism of the Sugar Excise Law: An Effort to Prevent Diabetes in Indonesia
Ideally, excessive sugar consumption should be systematically controlled through state regulations, one of which is the imposition of excise taxes on sugar-sweetened beverages (SSBs). However, in reality, the implementation of this policy in Indonesia still faces complex legislative challenges and resistance from various parties, making diabetes prevention efforts less than optimal. This study aims to analyze the legislative mechanism of the Sugar Excise Law as a legal instrument to prevent the rising prevalence of non-communicable diseases, particularly diabetes, in Indonesia. This research employs a normative legal approach using a qualitative descriptive analysis method. Primary data is obtained from statutory regulations, while secondary data is drawn from scientific journals and official government documents. The findings indicate that although the legal basis for sugar excise legislation already exists, the legislative process requires intersectoral coordination, public legitimacy, and strengthened political commitment to ensure that the excise policy can be effectively implemented as a diabetes prevention strategy
Pengaruh CAR, NPF, FDR Terhadap Profitabilitas di Bank BTPN Syariah Tahun 2014-2024
This study aims to analyze the effect of Capital Adequacy Ratio (CAR), Non-Performing Financing (NPF), and Financing to Deposit Ratio (FDR) on the profitability of Bank BTPN Syariah during the 2014–2024 period. The main focus of this research is how these three variables influence Return on Assets (ROA) as an indicator of bank profitability. The research employs a quantitative method with a multiple linear regression analysis approach. The data analyzed is secondary data obtained from the quarterly financial statements of Bank BTPN Syariah over the 2014–2024 period. The dependent variable in this study is ROA, while the independent variables include CAR, NPF, and FDR. Data analysis is conducted using SPSS and Microsoft Excel software. The results show that CAR has a positive and significant effect on ROA, whereas NPF has a negative and significant effect on ROA. Meanwhile, FDR does not have a significant impact on ROA. Simultaneously, CAR, NPF, and FDR significantly affect the profitability of Bank BTPN Syariah. This study contributes by strengthening empirical evidence regarding the effect of CAR, NPF, and FDR on the profitability of Islamic banks, particularly in Indonesia
Analisis Determinan Kemiskinan Di Provinsi Aceh Dengan Pertumbuhan Ekonomi Sebagai Variabel Intervening
Poverty in Aceh Province is a multidimensional problem that is influenced by education, health, and labor force participation. This study aims to analyze the effect of average years of schooling, life expectancy, and labor force participation rate on poverty, either directly or through economic growth as a mediating variable. The data used is secondary data from 2011-2023 which is analyzed using path analysis techniques. The results show that average years of schooling have a significant negative effect on poverty, both directly and indirectly through economic growth. In contrast, life expectancy and labor force participation rate do not show a significant effect on economic growth and poverty. Economic growth, although fluctuating, does not significantly affect the poverty rate in Aceh Province. These findings emphasize the importance of improving education as a key poverty alleviation strategy and the need for formal sector development to maximize labor force participation
