    No full text
This article an discusses the Ramadan podcast series Hashtag #LogIndiCloseTheDoor as an example of the Popular Islamic Movement on social media. The series was a huge hit even though it dealt with a delicate subject. It is impossible to consider this truth to be a phenomenon deserving of the widespread success of social media material. This article is a qualitative study employing Talal Asad's Islamic Anthropology method. According to the article's conclusion, the Popular Islam Movement is a group of middle-class Muslims, particularly those in their millennial years, who are using modern and popular culture as a means of self-actualization and self-study. The media portrays him in two ways: dakwahtainment and religiotainment. Ramadan's audio series #LogIndiCloseTheDoor is one of them. The Islamic pretext Raḥmatan lil 'Ālamīn (a mercy to all creation) serves as the basis for the television show. The discussion that goes along with this series focuses on inclusivism in religion as well as the commoditization and commodification of religion. These discourses were communicated and developed into a new religious paradigm by way of the power relations network that Deddy Corbuzier, Habib Ja'far Hussein, and Leonardo da Vinci constructed. This essay contends that the #LogIndiCloseTheDoor Ramadan Hashtag audio series, which combines modern and Islamic ideals, transforms the initially conservative, restrictive, and inflexible perception of Islam into one that is inclusive, tolerant, and dynamic

    Get PDF
This study examines the relationship between Pancasila, Indonesia's foundational ideology, and Islamic Law, focusing on its implementation in Aceh and West Sumatra. Specifically, the research explores how communities perceive, interpret, and integrate Pancasila within the framework of Islamic Law in both legal practices and policy implementation. Employing a qualitative research methodology, data were collected through in-depth interviews with 10 informants, including religious scholars, government officials, and community leaders, as well as observations and document analysis. The data were analyzed using thematic analysis to identify key patterns and challenges in the integration process. The findings reveal that while the implementation of Islamic Law in Aceh follows a formalized legal framework with Sharia-based regulations, in West Sumatra, Islamic values are embedded within customary law under the principle of Adat Basandi Syarak, Syarak Basandi Kitabullah. Despite differences in implementation, both regions demonstrate that Pancasila and Islamic Law are perceived as complementary rather than contradictory. However, challenges remain, including tensions in law enforcement, concerns about human rights, and the need for policy adjustments to balance religious aspirations with national integration. This study contributes to the discourse on legal pluralism in Indonesia by providing empirical insights into how Islamic Law operates within the Pancasila framework, offering a nuanced perspective on the dynamics between religion, state ideology, and governance in a pluralistic society

Contextualization of Polygamy Law; Justification of Islamic Legal Principles against Positive Regulations in Indonesia

    Get PDF
Ideally, polygamy law in Islam sets a maximum limit of four wives, requires the husband to act justly, and considers material and emotional factors, as stipulated in the Qur'an. However, in reality, there are differences in the implementation of the law in Indonesia. Law No. 1 of 1974 does not limit the number of wives, while the Compilation of Islamic Law (KHI) limits it to four wives and requires the wife's consent, which must be proven in court. These differences reflect a discrepancy between Islamic legal principles and current positive regulations. This article aims to provide a deeper understanding of the differences between polygamy law in Islam and positive regulations in Indonesia. This research uses a comparative approach with a literature study method to analyze and compare Islamic legal principles with positive regulations in Indonesia related to polygyny. The results show that over time and with changes in the state system, the contextualization of polygamy law has undergone justification and rationalization, leading to significant changes in its application

    Get PDF
Ideally, legal protection for children born out of wedlock should ensure that they receive civil rights equivalent to those of legitimate children without discrimination. In reality, there are still differences in treatment between positive law in Indonesia, especially after the Constitutional Court Decision No. 46/PUU-VIII/2010, and Islamic law, which holds differing views on the status of children born out of wedlock. The challenge lies in how to harmonize legal protection for these children amidst the differing perspectives between positive law and Islamic law, ensuring that their civil rights are upheld while also minimizing negative social impacts, such as fornication. The purpose of this study is to analyze and compare legal protection for children born out of wedlock according to the Constitutional Court Decision and Islamic law and to seek solutions that can integrate both perspectives to create fair and dignified legal protection. The methodology used in this study is a normative juridical approach, examining various laws, court decisions, and related Islamic legal literature. The results of the research indicate that although there are differences in views between the Constitutional Court's decision and Islamic law, the integration of both approaches can provide more comprehensive legal protection for children born out of wedlock. By balancing both perspectives, it is hoped that it will guarantee the civil rights of these children while also preserving societal morality by minimizing the practice of fornication
