Hak Berserikat dan Berkumpul Menurut UUD Pasal 28E Ayat 3 dan Pasal 21 Ayat 1 DUHAM; Tinjauan Aktivitas Ekonomi Islam
Ideally, the right to associate and assemble, as guaranteed in Article 28E Paragraph 3 of the 1945 Constitution of Indonesia and Article 21 Paragraph 1 of the Universal Declaration of Human Rights (UDHR), provides freedom for individuals and groups to participate in social, political, and economic life. However, in reality, the implementation of this freedom still faces challenges, especially in the context of Islamic economics in Indonesia, where existing regulations sometimes limit the development of this sector. The aim of this research is to analyze the role of the right to associate and assemble in strengthening Islamic economic activities in Indonesia. This study uses a normative legal approach with qualitative analysis, focusing on secondary data from relevant literature and legal documents. The results of the study indicate that the right to associate and assemble plays a crucial role in strengthening Islamic economics. This freedom allows the formation of Islamic-based economic organizations that support the principles of justice and transparency. The implementation of this right, although hindered by several regulations that are less supportive, still provides a strong foundation for society to collaborate in the development of a more inclusive and just economy.Gsgs
Perampasan Tanah dan Kerusakan Lingkungan Hidup atas Nama Hilirisasi; Problematika dan Urgensi Penegakkan Hukum
This study aims to analyze the practices of land grabbing and environmental degradation occurring in downstream processing projects of natural resources in Indonesia, as well as the urgency of legal enforcement to address these issues. The methodology employed is normative legal research with a qualitative approach, based on literature review of legislation, court decisions, and relevant academic sources. The findings indicate that downstream processing is often used as a justification for forced land acquisition and ecological destruction, violating Articles 28H and 33 of the 1945 Constitution, as well as Law No. 5 of 1960 and Law No. 32 of 2009. The study concludes that weak law enforcement is a key factor contributing to structural injustice, thus highlighting the need for regulatory reform, stronger oversight, and a legal system that is fair, transparent, and participatory
Development and validation of the parasocial relationships with religious figures scale
The current study aimed to develop and validate the Parasocial Relationships with Religious Figures (PSR-R) scale, a multidimensional instrument designed to assess individuals' parasocial relationships with their idolized religious figures. A total of 301 participants aged 18–29 were recruited using convenience sampling, representing six religious groups in Indonesia. The scale development process involved item generation, expert evaluation, and confirmatory factor analysis to establish the structural validity of the scale. The final 25-item PSR-R scale demonstrated robust model fit (CFI = .908, RMSEA = .062, and SRMR = .607), capturing four dimensions: interest in, knowledge of, identification with, and interaction with. Internal consistency was high (? = .922), with dimension-level reliabilities ranging from .711 to .855 and significant intercorrelations among its four dimensions, supporting its validity as a multidimensional construct. Convergent validity was supported by a significant positive correlation with a measure of celebrity worship (r = .544, p < .001), suggesting that shared psychological processes underlie parasocial relationships across different domains. These findings support the PSR-R scale as a reliable and valid instrument for assessing parasocial relationships in religious contexts. By introducing a validated measurement tool, this study provides a foundation for further exploration of parasocial relationships with religious figures and their psychological implications. The scale offers theoretical and applied value for examining the psychological impact of mediated religious engagement. Future research should assess the cross-cultural generalizability of this approach, its role in identity development, and its potential applications in religious education, counseling, and mental health settings
Jual Beli Cacing Rubella untuk Pengobatan di Karang Baru Aceh Tamiang Tinjauan Maqashid Al-Syariah
Transaksi jual beli cacing rubella untuk pengobatan di Desa Tanjung Karang, Kec. Karang Baru, Kab. Aceh Tamiang merupakan kegiatan yang dilakukan penjual dan pembeli untuk Hifdzudn nafs (menjaga jiwa). Mereka menjadikan cacing rubella untuk pengobatan penyakit seperti demam, step dan tifus yang harus dilakukan dalam keadaan dharurat (terpaksa), sehingga menjadikan mereka mengkonsumsi cacing untuk mengobati penyakitnya. Padahal, cacing merupakan hewan yang diharamkan untuk di konsumsi. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan normative, lokasi penelitian ini dilakukan di Desa Karang Baru Kabupaten Aceh Tamiang. Hasil penelitian menunjukkan bahwa Jika mereka tidak menggunakan cacing rubella untuk pengobatan, maka eksistensi jiwa mereka akan terancam. Mengkonsumsi cacing rubella yang digunakan untuk pengobatan merupakan pemikiran di luar dari tingkat dharuriyyat dan hajiyat. Tinjauan maqasid syariah terhadap jual beli cacing rubella untuk pengobatan dijadikan sebagai upaya penyembuhan penyakit, jadi dapat disimpulkan bahwa dalam mengkonsumsinya adalah mubah
Analysis Of Time-Term Wifi Password Buying and Selling Practices And Their Implications For Justice in Desa Perdamaian: Islamic Law Perspective
Wifi buyers don't fully get the time they've set up; they're just playing for a few hours to enjoy the wifi. The wifi seller must give a clear explanation and must not cover up the information he sells, so that in the transaction, he can avoid any fraud and give justice to the buyer, so no party feels harmed. The kind of research that is involved is qualitative research. Data collection techniques use the techniques of interviews, observations, and documentation. In technical data analysis, researchers collect all forms of information already collected. The results of the research showed that 1) in the practice of selling wifi passwords carried out in the Peace Village of Aceh Kab Tamiang, the buyers did not get the full rights obtained, not in accordance with what was promised initially. In this case, it makes the wifi buyer feel injured because there is no conformity promised with the application. 2) In the practice of selling wifi passwords, this applies shame and shame conditions that are not applied in accordance with what has been agreed upon jointly. In the shame the seller covered the information that has been known and within the terms of the agreed time is not fully obtained by the party of the wifi buyers. In Islamic law, there must be honesty in transactions, no concealment in the communication of information, and no fraud in the transaction, because it will make the buyer feel injured and disappointed, and Allah forbids in transactions any element of iniquity.
 
Pandangan Para Fuqaha tentang Akad Qardh dalam Masyarakat
Manusia merupakan makhluk sosial yang hidup berkelompok dengan saling berinteraksi, salah satu interaksi manusia dalam bermuamalah yaitu kegiatan pinjam meminjam. Dalam fiqh muamalah, pinjam meminjam dikenal dengan akad qardh yang tergolong tabbaru’ (tolong menolong). Para ulama memiliki pandangan berbeda mengenai penerimaan lebih dari pinjaman pokok yang diberikan peminjam kepada penerima pinjaman. Metode yang digunakan dalam penelitian ini yaitu pendekatan kualitatif dengan metode studi pustaka (library research). Metode studi pustaka adalah serangkaian kegiatan yang melibatkan pengumpulan data dari sumber-sumber pustaka, diikuti dengan proses membaca dan mengelola bahan yang telah terkumpul, untuk mendapatkan kesimpulan yang diinginkan. Pinjam meminjam (qardh) menurut jumhur ulama diperbolehkan dengan tidak melibatkan unsur yang dilarang dalam syariat, seperti terhindar dari unsur riba, maysir, dan lain-lain. Akad qardh dalam pelaksanaannya harus memenuhi rukun dan syarat yang telah ditetapkan, objek akad qardh dapat dipertanggungjawabkan oleh pihak yang meminjam atau yang memberikan pinjaman. Pengembalian yang berlebih dalam akad qardh para ulama berbeda dalam penetapan hukumnya. Hal tersebut perlu diketahui karena praktik tersebut banyak dilakukan dimasyarakat sekitar dengan tidak memperhatikan rukun dan syarat akad qardh
Implementasi Undang-undang No 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (Studi Kasus Persepsi Masyarakat Kota Langsa terhadap Sanksi Tilang)
Penelitian ini berjudul “Implementasi UU No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan: Studi Kasus Persepsi Masyarakat Kota Langsa terhadap Sanksi Tilang”. Penelitian ini bertujuan untuk mengevaluasi penerapan sanksi tilang dalam Undang-Undang Nomor 22 Tahun 2009 serta mengkaji persepsi masyarakat Kota Langsa mengenai efektivitas dan keadilan sanksi tersebut, dengan fokus pada permasalahan pungutan liar yang dilakukan oleh sebagian oknum petugas. Secara konseptual, undang-undang ini diharapkan dapat menciptakan sistem lalu lintas yang tertib, aman, dan transparan. Namun, kenyataan di lapangan menunjukkan adanya ketidaksesuaian antara ketentuan hukum dengan pelaksanaannya, khususnya terkait praktik pungutan liar yang meresahkan masyarakat. Penelitian ini menggunakan pendekatan kualitatif (Sugiyono, 2016) dengan teknik pengumpulan data berupa wawancara mendalam, observasi, dan studi dokumentasi. Responden terdiri atas masyarakat pengguna jalan dan aparat penegak hukum yang berkaitan langsung dengan pelaksanaan sanksi tilang. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Nomor 22 Tahun 2009 (Undang-Undang Nomor 22 Tahun 2009, Tentang Lalu Lintas Dan Angkutan Jalan., n.d.) memiliki landasan hukum yang kuat, implementasinya di lapangan masih terkendala oleh praktik pungutan liar yang dilakukan oleh oknum petugas. Hal ini menimbulkan ketidakpercayaan masyarakat terhadap sistem penegakan hukum yang berlaku. Kesimpulan dari penelitian ini adalah bahwa meskipun tujuan utama undang-undang tersebut adalah untuk menciptakan ketertiban lalu lintas, pelaksanaannya menghadapi berbagai kendala, seperti ketidaksesuaian antara norma dan praktik di lapangan, lemahnya pengawasan dan penegakan etika terhadap aparat, serta kurangnya sosialisasi kepada masyarakat
Optimizing Teacher Working Groups in Improving the Competence of Islamic Religion Teachers in Rantau Selamat, East Aceh
Teachers as the main actors of educational success need to continuously improve their competence in order to innovate and be creative in teaching and learning to improve the quality of education in general. This study aims to find out the optimization strategy of the Teachers Working Group (KKG) of Rantau Selamat Sub-district and analyze how the success rate of KKG in improving the competence of PAI teachers in Rantau Selamat Sub-district? Through a qualitative approach, primary data were extracted from 8 informants. Data collection techniques were observation and structured interviews. The results showed that the optimization of the teachers' working group strategy in Rantau Selamat was carried out by strengthening the vision and mission of the organization, sharing knowledge and experience between senior and junior teachers, and training learning models such as calligraphy and music in PAI teaching. Optimizing KKG has had an impact on improving teachers' professionalism, pedagogical competence and skills. The teachers' working groups have been able to improve teachers' mastery of learning materials, syllabus preparation, learning methods, maximizing the use of facilities and infrastructure, and utilizing learning resources from Information Communication Technology (ICT). The implication of this research is that teachers' working groups need to be optimized to change the work culture and improve teachers' knowledge, competencies and performance so that the quality of education and learning processes in Aceh continues to improve
Examining Monogamy Through the Lens of Jamaluddin Athiyyah's Maqashid Syariah
Monogamy, as a form of marriage between one man and one woman, is widely considered the ideal norm in many cultures as it is associated with stability, commitment, and fidelity. In the Islamic context, monogamy is preferred as it is considered more manageable and conducive to domestic harmony. However, Islam also allows polygamy under certain conditions, which has led to an ongoing scholarly debate regarding its ethical and practical implications. While there has been much discussion regarding monogamy and polygamy in Islam, there has been little research using a maqashid sharia approach, particularly from the perspective of Jamaluddin Athiyyah. This research seeks to do so by assessing how monogamy aligns with the objectives of Islamic law compared to polygamy. This research uses a normative qualitative method with a conceptual approach. Primary data is obtained from Jamaluddin Athiyyah's works on maqashid sharia, while secondary data includes relevant journals, articles, and previous research on monogamy and polygamy. The qualitative analysis evaluates the role of monogamy in fulfilling the values of maqashid sharia, particularly in the domains of personal well-being, family stability, community harmony, and overall human well-being. The findings show that monogamy is more supportive of justice, tranquility, and well-being in family life than polygamy. From the perspective of Jamaluddin Athiyyah's maqashid sharia, monogamy significantly contributes to preserving the soul, reason, religion, honor, and. In addition, monogamy enhances social stability and promotes the welfare of the ummah, which is in line with the basic objectives of Islamic law, which are to achieve prosperity and prevent societal breakdown. Therefore, these findings will be useful for Muslim policymakers, academics, and society in understanding monogamy as a marriage framework that is more supportive of social justice and welfare
Reconstructing Legal Protection for Child Victims of Neglect under Law No. 23 of 2004 on the Elimination of Domestic Violence
Violence against children is extremely dangerous and must be addressed immediately. Therefore, scientific research is needed on the reconstruction of legal protection for child victims of child neglect under Law No. 23 of 2004. The issue to be discussed is how to reconstruct legal protection for child victims of child neglect crimes under Law No. 23 of 2004 on the Elimination of Domestic Violence. Previous research has discussed the reconstruction of legal protection for children who have come into contact with the law after diversion based on the principle of justice. This research focused on reconstructing specific regulations on the protection of children who have committed criminal offenses after diversion while maintaining the principle of justice. This study differs in that it focuses on the reconstruction of legal protection for children as victims of child abandonment crimes based on Law No. 23 of 2004. The purpose of this study is to provide solutions to research problems concerning the concept of legal protection of children from child neglect crimes. The research method used is normative legal research through a conceptual approach and a legislative approach. Through this research method, the results obtained indicate that children's rights must be properly considered and protected through criminal law and legislation. Research findings on the reconstruction of legal protection for child victims of child neglect based on Law No. 23 of 2004 on the Prevention and Handling of Domestic Violence indicate that the protection of children's rights remains a top priority. This research emphasizes the need for commitment from all law enforcement officials and the community to jointly enforce legal provisions to protect Indonesian children from neglect and violations of children's rights based on justice for children and human values
