Pertanggungjawaban Hukum Notaris Pengganti dalam Pembuatan Akta Melampaui Kewenangan di Indonesia
A substitute notary is a temporary official appointed to perform the duties of a primary notary during their absence, such as during leave or illness. Under Law No. 2 of 2014 concerning the Notary Office, a substitute notary holds the authority to create authentic deeds and manage protocols, similar to a primary notary. However, exceeding this authority poses significant legal risks, potentially invalidating deeds and leading to serious legal consequences. This study examines the legal responsibilities of substitute notaries in ensuring the validity of deeds they produce, emphasizing the importance of adhering to their defined authority and professional ethical standards. It aims to analyze the implications of substitute notaries exceeding their authority in drafting deeds, particularly in terms of deed validity and legal accountability. Furthermore, the research highlights the necessity of limiting substitute notary authority and implementing strict supervision to uphold the integrity of notarial practices. Using a normative legal method (juridical-normative), the study analyzes laws and regulations through a literature review and qualitative analysis of primary, secondary, and tertiary legal sources. The findings reveal that the legal liability of substitute notaries for deeds made beyond their authority encompasses civil, criminal, and administrative aspects. Such actions can render deeds invalid and cause harm to the parties involved. This research contributes to the field by providing a comprehensive understanding of the legal and ethical boundaries that substitute notaries must respect, offering insights for policymakers to enhance regulatory frameworks and supervision mechanisms. It also serves as a reference for legal practitioners and scholars to identify preventive measures and solutions to mitigate the risks associated with notarial misconduct
Praktik Peradilan dan Kesetaraan Gender: Analisis Implementasi PERMA No. 3 Tahun 2017 di Pengadilan Syariah Banda Aceh, Indonesia
Discriminatory treatment and gender stereotypes against women in the justice system are directly related to women's accessibility to justice. The more women experience discrimination and negative stereotypes, the more limited their access to justice becomes. The implementation of Supreme Court Regulation (PERMA) No. 3 of 2017 concerning Guidelines for Adjudicating Cases Involving Women in Conflict with the Law has not been effectively carried out. For instance, some judges in the trial process have not adhered to the guidelines set out in PERMA No. 3 of 2017. In reality, there are still judges who make belittling, blaming, intimidating statements, and use loud voices against women in conflict with the law, which can undermine women's mentality in court. In response to these conditions, the Supreme Court, as the highest judicial institution in Indonesia, has initiated steps to gradually eliminate discriminatory treatment against women in conflict with the law in judicial practices in Indonesia. This study aims to examine the efforts made by judges in implementing PERMA No. 3 of 2017 at the Banda Aceh Sharia Court and to explore the perspectives of Sharia Court judges regarding the implementation of PERMA No. 3 of 2017. The research uses a qualitative method with a field research approach. This study indicates that there are still challenges in implementing PERMA No. 3 of 2017 at the Banda Aceh Sharia Court. However, efforts are being made to reduce discrimination and negative stereotypes against women in conflict with the law. This research contributes to providing insights into the importance of implementing guidelines to reduce discriminatory treatment and offering recommendations to improve the effectiveness of PERMA No. 3 of 2017 in addressing gender discrimination issues in Indonesian courts
HISTORICAL INFLUENCE IN TAFSIR AL-MISHBAH: A HERMENEUTICAL EXPLORATION THROUGH GADAMER'S LENS
An interpretation is inevitably influenced by the interpreter's historical context. This is also true for Quraish Shihab in his Tafsir Al-Misbah. This study aims to examine how history influenced Quraish Shihab's interpretation of Qs. Luqman (31): 6. Employing a qualitative text-based methodology and Hans-Georg Gadamer's hermeneutical analysis, the study reveals that Quraish Shihab's interpretation is shaped by two key factors. First, he was influenced by his father and teachers. Second, his academic background significantly impacted his thought process. These two factors collectively contributed to the construction of Quraish Shihab's moderate approach in interpreting the Qur'an in general, and Qs. Luqman (31): 6 in particular
THE POLITICS OF QIRA’AT: STATE POWER AND THE CANONIZATION OF QUR’ANIC RECITATION IN EARLY ISLAM
The study of qira’at in Islam has traditionally centered on linguistic and phonetic dimensions. However, it also intersects significantly with the dynamics of political authority and canon formation in Islamic history. Using a historical-analytical approach, this study examines the role of political power in the codification and standardization of qira’at, focusing on critical episodes such as the compilation of the mushaf under Caliph ‘Uthman ibn ‘Affan, administrative interventions during the Umayyad dynasty, and the canonization of the seven qira’at by Ibn Mujahid, later expanded to ten by Ibn al-Jazari. Drawing on classical Islamic sources and contemporary academic literature, the study demonstrates that qira’at orthodoxy was shaped not only by scholarly consensus, but also by strategic political interventions in response to socio-political imperatives. By exploring the intersection of religion, power, and the construction of Qur’anic recitational authority, this research contributes to a deeper understanding of how the political construction of religious orthodoxy and the canonization of sacred texts in Islam
Strategi Negara dalam Meningkatkan Moderasi Beragama: Tinjauan atas Pola Komunikasi dan Sosialisasi Otoritatif
This research aims to analyze the state's strategy for promoting religious moderation in Indonesia, specifically through a review of authoritative communication and socialization patterns. The research question raised is how the Indonesian government utilizes authoritative communication strategies to disseminate the values of religious moderation and how effective these efforts are in influencing public perceptions. The research method used is a literature study with a qualitative approach and descriptive analysis, where the primary sources consist of scientific journals published in the last 10 years, alongside secondary references from books, articles, and online media. The research results show that the authoritative communication pattern implemented by the government is quite effective in conveying the message of religious moderation, particularly through education, mass media, and the involvement of religious leaders. As a result, this strategy has succeeded in raising public awareness of the importance of moderation, although challenges such as radicalism and intolerance remain.
 
The Implementation of Religious Tolerance and Moderation Values in Children's Character Building at Madrasah Ibtidaiyyah in Gorontalo, Indonesia
This study explores the implementation of Religious Moderation Tolerance values in shaping children's character at Madrasah Ibtidaiyyah Negeri 1 Kota Gorontalo, as well as the factors influencing its success. Using a qualitative approach, data were collected through in-depth interviews with teachers, students, and parents, classroom observations, and document analysis. The findings indicate tolerance and religious moderation values are implemented through curriculum integration, contextual learning approaches, and extracurricular activities. Success factors include the active role of teachers, parental support, and supportive madrasah policies. Challenges faced include a lack of understanding among some parents and socio-cultural challenges. This study concludes that education based on religious moderation tolerance effectively shapes children's character but requires synergy between schools, families, and the community to overcome obstacles. These findings are expected to serve as a reference for developing character education based on religious moderation values in other madrasahs
Islamic Inheritance Law Reform in Indonesia from the Perspective of Islamic Legal Politics: Strategies and Implications
This research aims to analyze the reform of Islamic inheritance law in Indonesia, with a particular focus on government policies supporting this reform. The study examines legal doctrines in the Compilation of Islamic Law, jurisprudence, Supreme Court guidance letters for religious courts, and fatwas from the Indonesian Ulema Council. Employing a historical and Islamic legal political (fiqh siyasah) approach, it explores the background and dynamics of these reforms. The reform process involves updating legal concepts, norms, and techniques, driven primarily by the executive and judiciary, while legislative bodies are constrained by their inability to pass laws. Non-governmental institutions, particularly the Indonesian Ulema Council, also play a pivotal role. Scientifically grounded methods, such as ijtihad intiqa'i tarjihi and ibda'i insha'i, serve as the foundation for these reforms. The government's strategies within the Islamic legal-political framework (fiqh siyasah) are (1) developing Islamic inheritance law in line with societal practices, (2) codifying it into legislative products, (3) compiling it into unified legal texts, (4) enacting legal products such as presidential instructions, fatwas, and jurisprudence, (5) involving scholars, officials, and judges in shaping reforms, (6) creating regulations for non-litigious inheritance distribution based on Islamic law, and (7) engaging the community in inheritance practices. This research's novelty lies in its comprehensive analysis of both governmental and non-governmental roles in reforming Islamic inheritance law through integrative legal-political strategies. Additionally, it highlights the innovative application of ijtihad intiqa'i tarjihi and ibda'i insha'i, contributing to the modernization and contextualization of Islamic inheritance law in Indonesia. The contribution of this research is its exploration of the interplay between legal reform and societal practices, providing a new understanding of the mechanisms that shape Islamic law in contemporary Indonesia. Furthermore, it offers valuable insights into the role of both religious scholars and government authorities in the legal reform process, offering a model for integrating Islamic law with modern legal systems
Surrogacy Laws in Indonesia, Iran, and India: A Comparative Analysis of Legal Protections for Surrogate Mothers and Children
This study investigates Indonesia’s absence of a comprehensive surrogacy framework, a gap that leaves surrogate mothers and children in legal limbo and social precarity. By contrast, Iran authorizes surrogacy through Shia jurisprudence and enforceable contracts, while India governs the practice via the Surrogacy (Regulation) Act 2021, allowing only altruistic arrangements and banning commercial transactions. Using normative legal research and a comparative approach, the analysis synthesizes statutory provisions, religious edicts, and judicial precedents and evaluates enforcement mechanisms alongside socio-ethical implications across the three systems within diverse cultural, religious, and regulatory environments and illustrates divergent policy rationales. Findings show that Indonesia’s outright prohibition, unaccompanied by detailed implementing rules, denies parties any legal protection, whereas Iran and India offer more structured, coherent safeguards. The study therefore urges Indonesia to draft a rights-based, culturally responsive regulatory framework that harmonizes domestic values with international human rights standards. Such legislation is essential to secure legal certainty, uphold ethical principles, encourage transparent medical practice, and protect the most vulnerable actors, especially surrogate mothers and the children born through surrogacy arrangements
Pengembangan Media Pembelajaran Rumah Ludo Nusantara Pada Muatan Pembelajaran IPS Materi Keberagaman Budaya di Kelas IV Sekolah Dasar
The Rumah Ludo Nusantara learning medium is going to be developed as part of this study with the intention of teaching Cultural Diversity to fourth-grade students in Social Studies. Experts in the fields of media, material, and language participated in the research, which was conducted using the research and development technique in conjunction with the ADDIE development model (Analysis, Design, Development, Implementation, and Evaluation). Additionally, the research was conducted on students in grade IV at SDN Paseban 18. 4 students participated in one-on-one testing, 8 students participated in small group testing, and 18 students participated in field testing. Data were collected using a quantitative descriptive approach, with evaluation scores of 92.18% from media experts, 93.75% from material experts, and 96.87% from language experts. Trial results showed average scores of 96.25% (one-to-one), 93.75% (small group), and 91.27% (field test). These findings indicate that Rumah Ludo Nusantara is highly suitable for use as a Social Studies learning tool on Cultural Diversity in grade IV
Smart Parenting in the Digital Era: A Literature-Based Framework for Enhancing Emotional Development in Early Childhood
This study aims a conceptual framework of Smart Parenting to support emotional development in early childhood within the context of the digital era. Using a qualitative literature review, 20 selected studies published between 2010 and 2023 were analyzed to identify key themes. The findings reveal that Smart Parenting combines emotional responsiveness, digital literacy, and cultural sensitivity. Emotionally attuned parenting, enhanced by appropriate digital tools to fosters emotional intelligence, empathy, and regulation skills in children. However, unsupervised or excessive screen use can hinder emotional bonding. Cultural context also shapes how Smart Parenting is practiced, highlighting the need for adaptable strategies that respect local values and resources. This framework offers a holistic approach to parenting that bridges traditional interaction with modern technology. The study contributes to parenting science by integrating digital tools, emotional neuroscience, and cultural dimensions into a unified model. It offers insights for parents, educators, and policymakers to promote healthy emotional growth in early childhood
