Thariqah al-Sam'iyyah wa al-syafahiyyah fi sharf: Tathbiquha, Tahaddiyatuha wa Hilluha

    No full text
This study aims to find out the implementation of the sam'iyah wa shafahiyyah method in sharf learning at Ma'had Bakkah Martapura, where initial observations showed students' difficulties in tashrif, particularly in translating the concept of time. For example, the sentence “Aku meminta ampun†(I ask for forgiveness) is sometimes translated incorrectly using fi'il madhi or fi'il mudhori', which can interfere with students' understanding of the meaning and proper use of fi'il in different contexts. This study is a qualitative research with descriptive narrative method. The research subjects were 4 sharf teachers and the students. The object of the research is the implementation of the sam'iyah wa shafahiyyah method. Data collection techniques used observation, interviews, and documentation. Data analysis was done by data reduction, data presentation, and conclusion drawing. The results showed three main stages: planning (lesson plans, objectives, materials), implementation (routine activities, muroja'ah, tashrif practice, punishment), and evaluation (process and learning outcomes). The findings indicate the need for further emphasis on understanding the concept of time in sharf learning. Further research can be conducted to develop more effective learning strategies

Dhikr relaxation for middle-aged hypertensive patients to reduce insomnia

    No full text
Insomnia is a prevalent comorbidity among middle-aged individuals with hypertension. Dhikr relaxation, an Islamic spirituality-based intervention, has been proposed as a non-pharmacological approach to improve sleep quality. This study aimed to examine the effectiveness of dhikr relaxation therapy in reducing insomnia among middle-aged hypertensive patients. The study involved 18 participants aged 40–59 years diagnosed with stage 2 hypertension. Participants were randomly assigned to either an experimental group (n = 9) that received dhikr relaxation therapy or a control group (n = 9) that received no treatment. Insomnia was measured using the Athens Insomnia Scale (AIS) at the posttest and the two-week follow-up. Data were analyzed using paired t-tests and the Mann-Whitney U test, based on assumptions of normality and homogeneity. The results showed no statistically significant difference in insomnia scores between the experimental and control groups at both posttest and follow-up (p > 0.05). Additionally, there was no significant within-group change in insomnia scores over time. Dhikr relaxation therapy did not demonstrate effectiveness in reducing insomnia among middle-aged hypertensive patients. Potential confounding factors such as gender imbalance and participant background may have affected the results. Further studies with larger, more diverse samples and refined methodology are recommended

    No full text
This study investigated the effects of play-based learning on teacher satisfaction, stress levels, and collaborative learning among primary education learners. Employing a descriptive survey design, the study sampled 200 early childhood education practitioners in Ilorin South Local Government Area, Kwara State, Nigeria, selected through simple random sampling. Data were collected using a validated instrument—the "Questionnaire on Play-Based Learning, Teacher Satisfaction, Stress, and Student Collaboration in the Classroom" (QPBLTSSSC), with a reliability coefficient of .81. Descriptive statistics were used to analyze responses related to play-based learning's impact on teachers' job satisfaction, stress reduction, collaborative learning, and child development. The findings revealed that play-based learning significantly enhanced teacher satisfaction and reduced stress by promoting enjoyment, fulfilment, and a relaxed teaching atmosphere. It also fostered collaborative learning by improving teamwork, peer interaction, and inclusive learning environments. Moreover, play-based pedagogy significantly contributed to children's cognitive, language, problem-solving, motor, and socio-emotional development. These outcomes underscore the critical value of integrating play-based methods into early childhood curricula. The study recommends professional development programs that emphasize both guided and free play strategies, as well as public awareness of home-based play practices and stress-reduction training for educators, to support holistic child development and teacher well-being

Legal Analysis of Bai' Maushuf Fi Dzimmah Contract in Sale and Purchase Transactions in Langsa City: Implications of Unilateral Cancellation

    No full text
Bai' Maushuf fi Dzimmah Contract in sales transactions ideally creates a clear agreement between the seller and the buyer, prioritizing the principles of justice and consumer protection. However, in practice, transactions that have been agreed upon often face unilateral cancellations, which can harm both the buyer and the seller, especially if there is a discrepancy in the goods or if the agreement is unilaterally altered. This study aims to analyze the application of the Bai' Maushuf fi Dzimmah contract in sales transactions in Langsa City, as well as the legal implications of unilateral cancellations from an Islamic law perspective. Using a normative-empirical approach, this research combines legal theory with practical field observations. The method used is descriptive qualitative, relying on primary data obtained through observation, interviews, and documentation, as well as secondary data in the form of relevant literature related to the research topic. The research findings show that the Bai' Maushuf fi Dzimmah contract is valid in Islamic law if it meets the specified conditions, including an agreement on the specifications of the goods to be delivered in the future. Unilateral cancellations are only allowed if there is a valid reason and mutual agreement from both parties. Unilateral cancellations without clear grounds contradict the principles of justice in Islam and may lead to harm for both the buyer and the seller

Interfaith Marriage in Indonesia: Juridical Challenges and Human Rights Perspectives

Interfaith marriage refers to a union between two individuals who adhere to different religions and remains a complex issue within the Indonesian legal system. Legally, Law No. 1 of 1974 on Marriage does not explicitly regulate interfaith unions. However, Article 2(1) of the law states that a marriage is valid if conducted by the religious laws and beliefs of the parties involved. This commonly means that interfaith marriages lack legal recognition in Indonesia. This interpretation is further reinforced by the issuance of Supreme Court Circular Letter (SEMA) No. 2 of 2023. This study adopts a normative juridical method with a descriptive qualitative approach. Primary data were obtained from the Marriage Law, the Compilation of Islamic Law, fatwas issued by the Indonesian Ulema Council (MUI), Muhammadiyah, Nahdlatul Ulama (NU), and SEMA No. 2 of 2023. Secondary data were gathered from legal literature, court decisions, and scholarly articles. The findings indicate that, under Article 2(1) of the Marriage Law, interfaith marriages are deemed invalid under Indonesian national law. However, from a human rights perspective—as stipulated in Article 16 of the Universal Declaration of Human Rights (UDHR) and Article 28B(1) of the 1945 Constitution—every individual has the right to marry regardless of religious affiliation. This study also outlines several legal alternatives available to interfaith couples seeking to formalize their marriage, including filing a court petition, temporarily adhering to one partner’s religious law, or marrying abroad. The legal implications of interfaith marriage include issues related to its validity, administrative registration, children's legal status, and both spouses' civil rights

Incestuous Sexual Violence Against Girls and Family Dysfunction in Coastal Indonesia: Causes, Consequences, and Legal Handling Effectiveness

This study examines cases of incestuous sexual violence against girls perpetrated by biological fathers within the family structure. The primary focus is to identify the underlying causes and consequences of incest, as well as to analyze the effectiveness of the legal responses. Employing a case study approach and utilizing Focus Group Discussions (FGDs), data were collected through engagements involving the Office for the Empowerment of Women and Child Protection (P3A), the National Commission on Violence Against Women (Komnas Perempuan), and various women’s and child protection organizations. The findings reveal that incestuous sexual violence against girls is driven by a combination of structural and cultural factors, particularly poverty, lack of privacy within the household, communal living arrangements, and dysfunctional family relationships. These conditions create an environment of heightened vulnerability for girls. In practice, legal handling of incest cases has not received adequate attention from the government. In contrast, civil society organizations focused on women and child protection have demonstrated a more proactive response, although their efforts are often hindered by the absence of clear legal regulations and insufficient institutional coordination. The presence of the state in ensuring legal protection for victims is thus critically important. This study underscores the need for strengthening a victim-oriented legal system, as well as the importance of preventive strategies through Islamic family law education. Such education is expected to foster collective awareness regarding the protection of girls within the family structure, particularly in coastal communities across Indonesia

Bridging the Gap in Employee Zakat Deductions: A Fiqh-Based Examination of Corporate Zakat Practices in Medan, Indonesia

    No full text
This study aims to analyze the obligation of employee zakat, which is directly deducted by companies, based on the provisions of the Fiqh of Corporate Zakat as formulated by BAZNAS and PERBAZNAS. The study focuses on the inconsistency of the liability principle in calculating corporate zakat, which is typically based on net assets, compared to the practice of employee zakat, which is often deducted from gross income without considering the employee's personal zakat obligations. This research adopts a qualitative approach with a case study design, examining several companies in the Medan area, including BRI, BNI, Bank Sumut Syariah, and BMI. Data were collected through in-depth interviews, document analysis, and non-participatory observations and were analyzed using the interactive model developed by Miles and Huberman. The results show that most of the companies studied (BRI, BNI, and Bank Sumut) failed to apply the liability reduction principle in employee zakat deductions as required. In contrast, one company (BMI) adhered to the liability principle in its employee zakat deductions, as outlined in corporate zakat guidelines. These findings highlight regulatory gaps and injustices in the treatment of employee zakat and emphasize the need for harmonizing Fiqh principles, technical policies, and field practices to create a fairer zakat system in accordance with the Maqasid Shari

Regulatory Dynamics and Socio-Legal Impacts of Interfaith Marriages in Indonesia Post-SEMA Number 2 of 2023

Interfaith marriage in Indonesia ideally requires a clear and harmonious legal framework aligned with societal values and religious principles. However, in reality, the absence of explicit regulation in Law Number 1 of 1974 on Marriage has created legal uncertainty and social challenges, particularly prior to the issuance of SEMA Number 2 of 2023. This study aims to analyze the implementation of interfaith marriage regulations, their socio-legal impacts, and efforts to harmonize the legal framework in Indonesia. Using normative legal research methods with a juridical approach, this study is based on library research analysis. The findings reveal that SEMA Number 2 of 2023 has provided a clearer legal framework for the registration of interfaith marriages, although technical challenges persist. Socially, the regulation has shifted societal paradigms, while legally, it has increased legal certainty. Legal harmonization requires an integrated approach that considers legal pluralism, religious values, and the realities of Indonesian society
