Sobre el concepto de privacidad: la relación entre privacidad e intimidad
Get PDFThe right to privacy is at the heart of many contemporary public controversies. However, despite the vast philosophical and legal literature on the subject, we do not have a proper account of the meaning and value of privacy. This lack of agreement on conceptual and normative issues has led some author to talk about the ‘chaos of privacy’. This article is focused on the conceptual exploration of privacy. First, I will consider how the right to privacy was first formulated in the classic article by Warren and Brandeis. Secondly, as in Spanish the right to privacy is regularly translated by ‘derecho a la intimidad’ it is crucial to analyze carefully the confused relation between intimacy and privacy. To this purpose I will discuss in the last two sections some explanations about how to draw the distinction between the two notions and how to understand their intrincate relation.El derecho a la privacidad está en el centro de muchos de los debates públicos actuales. Sin embargo, a pesar de la extensa literatura filosófica y jurídica sobre el tema, no contamos con una explicación adecuada del sentido y del valor de la privacidad. Esta falta de acuerdo sobre cuestiones conceptuales y normativas ha llevado a algún autor a hablar del ‘caos de la privacidad’. Este artículo se centra en la exploración conceptual de la privacidad. Para ello, en primer lugar, consideraré cómo el derecho a la privacidad fue formulado por primera vez en el célebre artículo de Warren y Brandeis. Segundo, en la medida en que el derecho a la privacidad es sistemáticamente traducido en español como ‘derecho a la intimidad’, resulta crucial analizar con cuidado la confusa relación entre intimidad y privacidad. Necesitamos una reflexión crítica sobre la modernidad y la globalización actual. Esta crítica permitirá proponer una nueva Ilustración donde lo global pueda vincularse con el cosmopolitismo y el universalismo moral. Get PDFButlerian notion of politics as resistance stands out for its originality, as it includes performativity and, at the same time, an openness to alliances. In this text I will argued that its singularity comes from the materialistic theoretical framework elaborated by Butler, since she portrays human beings as being socially tied by their mutual dependence and vulnerability. Finally, I will comment on three confused or problematic aspects of Butler’s proposal: the first related to reconciliation, the second with emancipation and the third with universality.La noción butleriana de política como resistencia destaca por su originalidad, pues se dobla de performatividad y, al mismo tiempo, está abierta a las alianzas. En este texto se argumenta que su singularidad proviene del marco teórico materialista elaborado por Butler, pues ofrece una caracterización de los seres humanos que los vincula socialmente por su mutua dependencia y vulnerabilidad. Finalmente, comentaré tres aspectos confusos o problemáticos de la propuesta butleriana: el primero relacionado con la reconciliación, el segundo con la emancipación y el tercero con la universalidad

The state of crisis, in which our society is envolved nowadays, demands the neccesity to increase the phylosofical activity. This task needs to be approached not only from the academic environment but also it must be indissolubly linked to the real social situation, this with the purpose to promote accurate ethical and political solutions. The different perspectives that conforms the Environmental Ethics lie at this level. However, the ideas generated could be biased if they do not take into account the gender issues that are associated with the environmental concerns. The ecofeminist phylosophical reflection explores this lack of knowledge and makes valuable contributions to these political theories and proposals.Una de las formas en que la Filosofía se convierte en pensamiento crítico comprometido con su tiempo es cuando atiende a las cuestiones relacionadas con los movimientos sociales. Las diversas crisis en que nos encontramos actualmente requieren un quehacer filosófico que, sin abandonar el ámbito de la erudición académica, se acerque a los problemas sociales, aportando soluciones éticas y políticas. Las distintas formas de la Ética Ambiental se sitúan a este nivel. No obstante, sus propuestas serán sesgadas si no atienden a las cuestiones de género asociadas a la problemática ambiental. La reflexión filosófica ecofeminista explora estas ausencias y realiza valiosas aportaciones a estas teorías y propuestas políticas
La biología sintética en el panorama de las patentes biotecnológicas
Get PDFRecently, the intended positive effects of the current patent system in biotechnological research have been widely questioned. As part of this review, it is discussed here one of the foundations of the model. The assumption of the indispensability of patents is examined through the analysis of their expected benefits; namely, that patents are suitable to ensure access to information, access to and use of inventions and, finally, that they should promote both creativity and research. Applied to synthetic biology, in spite of newly discovered techniques and promising products, this approach reveals that this discipline also encounters similar issues. However, it also offers a new vision of intellectual property rights and their effects on research, which is based on a different conception of the commons and its relationship with private ownership of intangible assets in the knowledge economy.Los pretendidos efectos positivos del actual sistema de patentes en la investigación biotecnológica han sido ampliamente cuestionados. En el marco de esta crítica, se discute aquí uno de los cimientos del modelo. La tesis de la indispensabilidad de las patentes es examinada a través de tres de sus presupuestos: el acceso a la información, el acceso y uso de las invenciones y el incremento de la creatividad y de la investigación que se suponen garantizados a través de las biopatentes. Aplicado a la biología sintética, este enfoque revela que, junto a nuevas técnicas y prometedores productos potenciales, esta disciplina brinda igualmente muestra de tal problemática. Sin embargo, ofrece también una nueva visión de la propiedad industrial y de sus efectos en la investigación, basada en una concepción diferente del commons y de sus relaciones con la propiedad privada sobre los bienes inmateriales en la economía del conocimiento
¿Triunfará el nuevo gnosticismo? Notas sobre biología sintética, nanotecnologías y manipulación genética en el Siglo de la Gran Prueba
Get PDFTechnological utopianism seduces many people, from the very origins of Western modernity –remember Francis Bacon’s island of Bensalem in his New Atlantis–, with the temptation of complete mastery over nature (which includes human immortality). Today, the prevailing mentality in the West, which tends to become a universal worldview, has much in common with the beliefs of the ancient Gnostics. According to this mindset, science and technology can allow the human mind to escape the limitations that characterize its natural state, releasing the anchor to biological stuff and escaping the human condition. In short, we would become gods –gods thought of as Immortal Super-Engineers. We must resist these destructive illusions and delusions, which means: technical rationality has to make his own critique of utopian reason (in the sense of Franz Hinkelammert). Without this self-criticism, a judicious use of techniques and technologies will be out of reach –and they do have an enormous potential for improving the human condition–, while avoiding –if it were still possible– the exterminist, nihilistic and suicidal drift of industrial civilization.La tentación con que seduce el utopismo tecnológico, desde los mismos orígenes de la Modernidad occidental –recordemos la isla de Bensalem de Francis Bacon en su New Atlantis–, es el completo dominio sobre la naturaleza (que incluiría la inmortalidad humana). Hoy, la mentalidad dominante en occidente –que tiende a convertirse en una cosmovisión universal– tiene mucho en común con las creencias de los antiguos gnósticos. Se piensa que la ciencia y la técnica pueden permitir a la mente humana escapar de las limitaciones que caracterizan su estado natural, liberándose del anclaje a la materia biológica y escapando de la condición humana. En definitiva, ser dioses –dioses pensados como Superingenieros Inmortales. hemos de resistir frente a esas ilusiones destructivas, lo cual significa: la racionalidad técnica tiene que realizar su propia crítica de la razón utópica (en el sentido de Franz Hinkelammert). Sin esta autocrítica será inviable un uso sensato de las técnicas y tecnologías, con su enorme potencial para la mejora de la condición humana, al tiempo que evitamos –si aún fuese posible– la deriva exterminista, nihilista y suicida de la civilización industrial
