This study explores the legitimacy of the dismissal of a village official as adjudicated in the Administrative Court Decision No. 180/G/2020/PTUN-MDN, analyzing the issue through the lens of Administrative Law and Fiqh Siyasah (Islamic political jurisprudence). The research addresses the central question: to what extent is the dismissal legally valid within the framework of state administrative law and Islamic governance principles? Employing a normative juridical method, this study examines statutory regulations, court documents, and relevant scholarly interpretations. The findings indicate that the dismissal violated procedural principles of good governance as stipulated in Indonesian administrative law, including principles of due process and legal certainty. Furthermore, from a Fiqh Siyasah perspective, the decision reflects a misuse of authority, contradicting the values of justice (‘adl) and public accountability (maslahah). The court's ruling to annul the dismissal reinforces the imperative of administrative justice and the ethical exercise of public power. This study concludes that harmonizing positive law with Islamic governance principles can enrich legal interpretations and strengthen the rule of law in village administration

LEGAL PROTECTION OF CONSUMERS IN ELECTRONIC TRANSACTIONS: ITS IMPLEMENTATION IN THE LOCAL ECONOMIC SECTOR OF TOMOHON: Perlindungan Hukum Konsumen dalam Transaksi Elektronik: Implementasinya di Sektor Ekonomi Lokal Tomohon

    No full text
This study aims to examine the implementation of legal consumer protection in electronic transactions within the local economic sector of Tomohon City. With the increasing use of digital platforms for commercial activities, it is essential to assess how existing regulations are understood and applied by both consumers and business actors in small urban areas. A mixed-methods approach was employed, combining quantitative data from a closed-ended questionnaire completed by 20 consumer respondents and qualitative data obtained through in-depth interviews with 10 MSME operators. The findings reveal a low level of consumer awareness regarding their rights under national laws such as Law No. 8 of 1999. Most consumers did not file formal complaints despite experiencing transactional issues, often due to lack of knowledge or perceived complexity of the process. On the business side, many MSMEs lacked understanding of their legal obligations and relied on platform-specific policies without verifying compliance with national regulations. Informal dispute resolution remained the preferred method among both parties. The study highlights a significant gap between regulatory frameworks and actual practices, emphasizing the need for targeted education and institutional support. To improve the digital transaction environment in Tomohon, local authorities should enhance consumer literacy and provide guidance for MSMEs on legal compliance. This research contributes to the understanding of digital consumer law implementation in non-metropolitan contexts and offers insights for policy development and capacity-building initiatives

    No full text
This article examines the 1976 Semarang City expansion policy in response to the population surge and socio-economic disparities that emerged in the early New Order era. The study uses a historical-critical approach, drawing on local newspaper archives (Suara Merdeka and Kartika), statistical data from 1973 to 1977, and official regulations (Government Regulation No. 16 of 1976). The research findings reveal that the expansion was initiated locally by Mayor Soepardjo Roestam and later received official approval from the central government. The policy expanded the city's administrative area from approximately 9,742 hectares to 37,366 hectares through the addition of seven new sub-districts. While the expansion succeeded in opening up space for growth and redistributing urban density, it also posed substantial administrative, social, and fiscal challenges. Contemporary media reports highlighted gaps between planning and implementation, including administrative overload at the sub-district level, under-served rural areas, and delayed infrastructure development in newly integrated zones. This article concludes that the expansion of Semarang City in 1976 was a complex spatial planning policy, reflecting the top-down development model of the New Order regime, which prioritized regional expansion as a solution to urban pressures
