    The land policy in Yogyakarta Special Province, especially the one related to land ownership by the Indonesian-Chinese blood, is different from that of another region. It is stated on the Governor’s Instruction No. K. 898/I/A/1975 aboutThe Uniformity of Giving the Right on Land Policy to Non Indonesian citizens, Indonesian-Chinese blood which states that theyare not allowed to own the land. The policy is called the affirmative action that is the positive discrimination having theideological purpose of reaching the justice and similarity for The Indonesian origins in Yogyakarta.     The Agrarian Reform or The Program of National Renewal Reform on Agrarian Affairs was carried out in 2007. Bythe implementation of the program, the agrarian structure which used to be unbalanced was expected to be balanced and just.By the new structure it was hoped that the poverty in villages and problems of peasants’ welfares could be overcome. However,the implementation of the policy was still considered as not fulfilling the people’s hopes. The research was aimed at describingthe agrarian reform using the site approach.     Abstrack: Pluralism of agrarian law is a consequence of the choice of society law that has a diversity of culture, ethnicity, customs and religion. This condition creates the selection to use legal norms beside national laws defined by the state. The philosophy is to find and to acquire the most appropriate legal order and provide justice for the people. This concept consistent with the progressive nature of the law that led to a dynamic legal system and was processed  following the dynamics of the community responsive to the needs and aspirations of justice in society. By using non state law as a complement of the state law, the chance of the state to quickly respons every dynamics of the community is possible, making the law progressive and responsive. This paper is a normative article with descriptive analytic  from the perspective of philosophy of jurisprudence.Intisari :Intisari Intisari Intisari IntisariPluralisme hukum agraria adalah sebuah kondisi yang menjadi konsekuensi atas pilihan hukum masyarakat yang memiliki keragaman budaya, suku, adat istiadat serta agama. Kondisi ini menciptakan adanya pilihan norma hukum yang digunakan selain hukum nasional yang ditetapkan negara. Filosofinya adalah menemukan dan memperoleh tatanan hukum yang paling sesuai dan memberikan keadilan bagi masyarakat. Konsep ini sejalan dengan hakikat hukum progresif yang mengarah pada sebuah sistem hukum yang dinamis dan berproses mengikuti dinamika masyarakat sehingga responsif terhadap kebutuhan dan cita keadilan dalam masyarakat. Dengan menempatkan hukum masyarakat sebagai pelengkap hukum negara, maka peluang negara untuk merespon setiap dinamika dalam masyarakat secara cepat dapat dilakukan sehingga terwujud hukum progresif dan responsif.     Abstract: The article bases on agrarian politic perspective to show the significance to consider the changing forces of “spatialreorganization” to expand capitalists mode of production for producing global commodities. Urbanized Indonesians are accustomedto fill their needs through market transaction. They take for granted that the transaction is natural. Moreover, for thosewho have interest to get profit, the transaction is the normalized mechanism. Different from the general view which assumingthat the market mechanism is treated as opportunity, the article considers a market as an imperative force. Referring to Wood(1994, 2002) which promote market-as-imperative approach, the paper shows various mechanisms of deploying violence,including to change property relations in terms of land, natural resource, and territory.Keywords: spatial reorganization, capitalist production, market as imperativeAbstrak: Naskah ini mempergunakan perspektif politik agraria ini untuk menunjukkan pentingnya kita mempertimbangkan perubahandari waktu kewaktu kekuatan-kekuatan pembentuk “reorganisasi ruang” untuk perluasan cara/ system produksi kapitalis yangmenghasilkan komoditas-komoditas global. Banyak orang kota Indonesia sudah terbiasa dan dibiasakan memenuhi kebutuhanhidupnya melalui transaksi jual beli. Semua cenderung menganggap transaksi jual-beli itu adalah alamiah. Lebih dari itu, untukberhasil memenuhi kepentingan memperoleh pendapatan atau keuntungan, cara jual beli merupakan sesuatu yang sudah lazimditempuh. Berbeda dengan pandangan umum bahwa pasar sebagai penyedia kesempatan, naskah ini menganggap pasar sebagaikekuatan yang memaksa. Merujuk pada karya Wood (1994, 2002) yang promosikan pendekatan market-as-imperative (pasarsebagai-paksaan), naskah ini menunjukkan berbagai mekanisme operasi-operasi paksa reorganisasi ruang tersebut, termasukmekanisme pemutusan hubungan kepemilikan rakyat terhadap tanah, sumberdaya alam dan wilayahnya.Kata Kunci: reorganisasi ruang, produksi kapitalis, pasar sebagai pemaks

    The research is aimed at answering three related questions, either directly or indirectly on the program of large-scaleland acquisition on Mamminasata Program in South Sulawesi. These questions are: 1) How does the space structure change afterMamminasata project on land acquisitions at three villages: Samata, Pacci’nongang and Romang Polong?; 2) How does the processand dynamic land acquisition at three village take place?; 3) How does the possibility of conflict take place after the project wasdone. Those questions will be answered by descriptive qualitative research method. The result shows that there was a correlationbetween large scale land acquisition on Mamminasata program with spatial change, the rise of land and extensive agrarian conflict.Keywords: development program, Mamminasata, spatial change, land acquisition

    PETANI MELAWAN PERKEBUNAN: PERJUANGAN AGRARIA DI JAWA TENGAH

    One of current agrarian struggles in Central Java is between peasants against plantation estates. This paperexplicates four land conflict cases, and discusses varied responses of the state institutions to deal with land conflicts. This paperstart by showing the ways in which, after the fall of the authoritarian regime of Suharto in 1998, rural poor took the land back,which previously controlled by plantations. They believed the reclaimed lands belong to them as heirs. The Reformasi providedpolitical opportunity for rural poor in various regions to do Aksi Reklaiming, and got legitimacy for their actions. However, theplantation companies fought back, including by using legal and non-legal strategies. The paper shows in detail the trajectory ofeach conflict and efforts to handle it, and put them in comparison one to another.Keywords: agrarian conflicts, reclaiming action, Central Java

    PETA P4T HASIL PEMETAAN PARTISIPATIF SEBAGAI INSTRUMEN IDENTIFIKASI TANAH ABSENTEE

    Abstract: An absentee land is one of the pieces of land for a Land Reform Object Tanah needed for distribution. Data of landsderived from absentee lands have not been available up to the present moment. The government needs to publish a policy toidentify and enlist the above mentioned absentee lands. Those lands can be identified by Maps on Land Ownership, LandTenure, Land Use and Land Utilization (P4T) made through Participative Mapping on Community-based Land Management(MPBM)..The data base of the MPBM activity are in the forms of Book A on land Register, Book B on spatial data resulted fromparcel measurement, Book C on notes of transfer and cases, Book D on spatial planning, land use, water use and buildingconstruction planning. The main data needed for IP4T mapping is Book A. The change of Article 3 on The GovernmentRegulation No. 224 of 1961 is required to make the identification more effective.Keywords: participative mapping, absentee lands, IP4T maps.Abstrak: Tanah absentee merupakan salah satu Tanah Obyek Landreform yang diperlukan dalam rangka kegiatan redistribusitanah. Data tanah obyek landreform yang berasal dari tanah absentee sampai saat ini belum tersedia. Pemerintah perlu melakukankebijakan untuk mengidentifikasi dan menginventarisir data tanah absentee tersebut. Tanah absentee dapat diidentifikasi melaluiPeta Pemilikan Penguasaan Penggunaan dan Pemanfaatan Tanah (P4T) yang dibuat melalui Pemetaan Partisipatif kegiatanManajemen Pertanahan Bernbasis Masyarakat (MPBM). Data base kegiatan MPBM berupa Buku A tentang daftar tanah, BukuB tentang data spasial hasil pengukuran bidang tanah, Data C tentang catatan mutasi dan masalah tanah, Buku D tentangpenataan ruang, penggunaan tanah, tata guna air dan tata bangunan. Sedangkan data pokok yang diperlukan dalam membuatpeta IP4T adalah Buku A yang berisi daftar tanah dan data spasial mengenai bidang tanah di Buku B. Berdasarkan peta P4Ttersebut dapat diidentifikasi tanah pertanian absentee. Perlu perubahan Pasal 3 Peraturan Pemerintah Nomor 224 Tahun 1961agar identifikasi tanah absentee dapat lebih efektif.Kata kunci: pemetaan partisipatif, tanah absentee, peta IP4

    Konstruksi Mitos dan Kelokalan Sebagai Alat Eksklusi (Akses Masyarakat Lokal dan Imigran Terhadap SDA di Desa Lempur Kerinci-Jambi)

    Abstract: This paper explains how the community of Lempur Village living in the forest area have a high dependence with nature. The position of the community is considered to interfere with the conservation program, that they must accept losing access to the forest area that has become the state property (TNKS). The loss of access to forest resources, pushed them to be more protective with the land that already allocated to them by the local government. Their openness to migrants began to fade and they did not tolerate new migrants who cleared land, reinforced by the ancestors history to reinforce the concept of localization to see who has the right to access land in Lempur Village. Moreover, other form of their resistance is by reconstruct the myths,  addressed to immigrants, corporations, and tourists. Intisari: Tulisan ini menjelaskan bagaimana masyarakat Desa Lempur yang tinggal berbatasan dengan hutan sangat menggantungkan hidupnya terhadap alam. Posisi masyarakat desa dianggap mengganggu program konservasi sehingga mereka harus menerima kehilangan akses di area hutan yang sudah menjadi milik negara (TNKS). Dengan hilangnya akses mereka terhadap sumber daya hutan yang kini dijadikan area konservasi, menuntut mereka untuk lebih protektif terhadap sisa lahan yang memang sudah diperuntukan bagi mereka oleh pemerintah daerah. Keterbukaan mereka terhadap pendatang mulai pudar dan tidak lagi dapat mentoleransi pendatang membuka lahan. Diperkuat dengan sejarah nenek moyang mereka untuk mengukuhkan konsep kelokalan guna melihat siapa yang memiliki hak untuk mengakses tanah di Desa Lempur ini. Selain itu bentuk lain dari perlawanan mereka ialah dengan merekonstruksi kembali mitos-mitos yang sangat kuat digaungkan kepada pendatang, baik imigran, perusahaan, maupun wisatawan
