    PENGAWASAN KEKUASAAN KEHAKIMAN DALAM NEGARA HUKUM INDONESIA

    Abstract : Research on the supervision of judicial power in Indonesian legal state, is based on the normative research method. The problem is about the external control of the legislative power over the judicial authorities in Indonesia. From this research, it has been found that within the perspective of the state law, Judicial Power or Judicial Power (Yudiciare) has authoritative powers in overseeing the implementation of the Act implemented by the Executive. General oversight both in the strict sense and loosely equally have internal controls on judicial performance and functionally oversees the Judiciary institutions. External Oversight of Judicial Power exercised by the executive is relatively small, precisely the performance of the judicial power of the past a lot of supervision in the form of interpretation and even changes to the legislation Legislative Product. This happens as an implementation of the theory of separation of power which is constitutionally regulated. Internal control within which there is an ethical dimension is the supervision of the freedom of Judicial Power based on moral rules (ethics) which must be ignored by the exercise of Judicial Power (Judge) in performing Judicial functions even though it is outside the Law but there is a connection with the normative and institutional external limits.     TINJAUAN YURIDIS PENYELESAIAN SENGKETA KEPAILITAN TERHADAP ADANYA KLAUSUL ARBITRASE

    Abstract : Research review of juridical dispute resolution bankruptcy against the existence of the arbitration clause, have the problem of how the basic dispute resolution Authority Bankruptcy and Insolvency with dispute resolution arbitration clause based on the principle of Pacta Sunt Servanda. This research uses the normative research methods to analyze legislation related to bankruptcy dispute resolution in Indonesia. From this research it can be noted that with the enactment of Act No. 37 of the year 2004, then bankruptcy dispute resolution authority is the authority of the courts of Commerce according to article 1 of law No. 37 number 7 Year 2004 where it determines that the article in question in court in Act No. 37 of the year 2004 is the Commerce Court. Furthermore, problems associated with the bankruptcy dispute resolution based on the existence of an agreement between the two sides in agreement that acknowledged the existence of the arbitration clause as an attempt of dispute resolution in accordance with the principle of pacta sunt servanda, then the issue of dispute settlement, bankruptcy court but no longer authorized commercial arbitration institutions is authorized. This is because as one form of high penjunjungan the legal principles of the agreement, namely the principle of pacta sunt servanda that diimpelementasikan in the provision of article article 3 Law Number 30 of 1999 on alternative dispute resolution and Arbitration, stating that the State Court is not uthorized to adjudicate disputes of parties who have been bound in the arbitration agreement.     PENINGKATAN KESEGARAN JASMANI SISWA DENGAN MENGGUNAKAN PERMAINAN TRADISIONAL SEPAK SAWUT DI SD NEGERI 2 PALANGKA

    This study aims to determine there is an increase in physical fitness through the traditional game of class V students SD Negeri 2 Palangka. The design used in this research is quasi experiment (pre exsperimen). The subjects of this study are the students of grade V SD Negeri 2 Palangka, with a total of 18 students consisting of 8 male students and 10 female students. Taking data using the test, with instruments in the form of TKJI for ages 10-12 years. The data analysis technique uses t-test analysis, through the prerequisite test of normality and homogeneity. The result of hypothesis testing using t-test get t count equal to - 3,630 bigger than t table equal to 1,740 (-3,630> 1,740), so there is significant difference between data before and after given treatment. The average increase was noticeable because there was an increase of 1.45 from 13.83 to 15.28. If depicted in percentage, the increase is 10,48%. Thus it can be concluded that there is an increase in physical fitness through the traditional game of class V students SD Negeri 2 Palangka in Academic Year 2016/2017

    Perubahan (dikenal juga dengan istilah Amandemen) Undang-Undang Dasar Negara  Republik Indonesia Tahun 1945 (selanjutnya disingkat UUDNRI 1945) sudah mengalami 4 (empat) kali perubahan yakni pada tahun 1999, 2000, 2001 dan 2002. Model pemerintahan yang feodal, otoriter dan sentralistik beralih ke model yang lebih demokratis yang transparan dan akuntabel dengan mengedepankan supremasi hukum dan Hak Asasi Manusia (HAM). Perubahan-Perubahan tersebut tidak lepas dari perkembangan politik hukum yang pada saat itu masih terpengaruh oleh suasana gegap gempita dan hirup pikuk reformasi yang ditandai dengan lengsernya Presiden Soeharto dari tampuk kekuasaan. Pada perubahan ketiga pasal 24 yang mengatur mengenai kekuasaan kehakiman pun mengalami perubahan yang ditandai dengan lahirnya dua (2) lembaga negara yakni Komisi Yudisial (KY) dan Mahkamah Konstitusi (MK) sebagai anak kandung reformasi untuk melengkapi Mahkamah Agung yang sudah ada sebelumnya. Persoalan kemudian timbul ketika beberapa kewenangan yang dimiliki oleh ketiga lembaga tersebut masih belum cukup mengakomodir berbagai permasalahan hukum yang muncul beberapa tahun terakhir, sebagai contoh maraknya praktik suap termasuk jual beli putusan, keterlibatan mafia hukum yang dibuktikan dengan cukup banyak hakim yang melanggar kode etik akibat rendahnya integritas, sehingga perlu perbaikan mengenai rekrutmen hakim, yang cukup penting terkait perlindungan hak konstitusional warga. Persoalan semacam ini memerlukan kajian mendalam untuk mengevaluasi UUDNRI 1945 terutama Pasal 24 mengenai Kekuasaan Kehakiman

    Tujuan penelitian ini adalah (1) mengetahui implementasi kebijakan penyelenggaraan pendidikan inklusif di SDN 9 Palangka, (2) mengetahui tingkat kesiapan Guru dalam penyelenggaraan pendidikan inklusif dikota Palangka Raya, (3) Untuk mengetahui dan mendeskripsikan hambatan yang mempengaruhi implementasi kebijakan pendidikan inklusif di Palangka Raya. Jenis Penelitian yang digunakan adalah deskriptif Kualitatif,Lokasi Penelitian bertempat di SDN 9 Palangka kota Palangka Raya. Metode penarikan sampel adalah purposive sampling..Sumber Data berasal dari Informen,Dokumen,atau arsip. Teknik Pengumpulan Data berupa Observasi, Wawancara dan Dokumentasi. Analisis Data menggunakan Analisis Interaktif Miles-Huberman sedangkan Validitas Datanya menggunakan triangulasi teknik atau Triangulasi sumber. Hasil penelitian implementasi kebijakan pendidikan inklusif adalah (1) Pada dimensi komunikasi atau sosialisasi tentang penyelenggaraan pendidikan inklusif bahwa implementasi pelaksanaan pendidikan inklusif belum sepenuhnya berjalan dengan baik. (2) Sumber daya dari aspek yang belum memadai misalnya sarana dan prasarana dan jumlah guru pembimbing khusus yang masih kurang untuk menangani anak berkebutuhan khusus (3) Pada dimensi disposisi penerimaan guru terhadap anak berkebutuhan khusus sangat baik, namum dari aspek pemberian insentif oleh (Direktorat atau Dinas pendidikan Kota Palangka Raya) sangat belum memadai baik insentif untuk guru maupun untuk sekolah. Sedangkan pada dimensi struktur birokrasi juga kurang memadai, hal ini terlihat belum adanya tim khusus yang menangani anak berkebutuhan khusus, seperti : guru pembimbing khusus, tim ahli dari berbagai disiplin ilmu (dokter,psikolog, dll)

    Abstract : Corruption is one of white collar crime or white collar crime where corruption case is done by state apparatus whether civil servant or state official indicates that not only poverty is the cause of the crime, but the prosperity factor because of corruption concerning moral aspect, rotten nature and circumstances, positions in government agencies or apparatuses, abuse of power in office. The problems that occur are what are the factors causing the criminal act of corruption of abuse of authority in the office and how the effort to overcome the corruption crime of abuse of authority in government office in Palangkaraya. The problem approach used to answer the above problems is the juridical normative and juridical empirical approach. Based on the results of research and discussion, factors causing criminal corruption abuse of authority in government office consists of two factors, namely internal factors and external factors. Internal factors (derived from within the human), namely the personality factor (greedy nature) while the external factors of opportunity factors, economic factors (consumptive lifestyle), religious factors and occupational factors. Efforts to tackle criminal acts of corruption in office abuse are preventive measures by increasing supervision of state apparatus.     Abstract : This research to determine the performance of office employees Technical Implementation Unit of Education Office of Kapuas District. This research uses kuntitatif method with descriptive and inferential design. Samples in this research are employees of Technical Implementation Unit of Education Office of Kapuas Regency which amounts to 76 people (total sampling). Factors affecting the performance of staff of Technical Implementation Unit of Education Office of Kapuas Regency is Motivation, Leadership, and Organizational Culture. The most influential factor is Motivation (beta 0.831). The results of employee performance performance of Technical Implementation Unit of Education Office performs quite well. Modernisasi, menunjukkan suatu proses dari serangkaian upaya untuk menuju atau menciptakan nilai-nilai (fisik, material dan sosial) yang bersifat atau berkualifikasi universal, rasional, dan fungsional.     Abstract : Compotence is a unified whole that describes the potential, knowledge, skills, and attitudes assessed in relation to a particular profession with regard to the part that can beactualized and manifested in the form of action or performance to perform a particular profession. According to Law no. Law No. 14 of 2005 on Teachers and Lecturers Article 1 paragraph (10), competence is a set of knowledge, skills, and behaviors that must be owned, experienced and mastered by teachers or lecturers in performing professional duties. Professionalism is a skill possessed by a person in a particular field and has been able to contribute his profession (science) to a needy society. Professional teachers are teachers who are truly experts in the field and able to perform their duties well as well as having the competence and high commitment in carrying out its duties and responsibilities. Certification for Teachers and Lecturers is a mandate of our National Education System Act (article 42) requiring every educator to have minimum qualifications and certification in accordance with the level of teaching authority he possesses. In short, certification is needed to reinforce the competency standards that teachers and lecturers need to have in their respective fields of science. With the certification it does not make the teacher the most competent, knowing, and most truthful person. Teachers are required to always follow the dynamic development of science, technology, and information. As educators, teachers should have to learn for life (long life education).
