    The Influence of Transformational Leadership and Work Environment on Employee Performance with Work Engagement as an Intervening Variable

    This study investigates the impact of transformational leadership, work environment, and work engagement on employee performance at PT Berau Coal. Using a quantitative approach with Partial Least Squares–Structural Equation Modeling (PLS-SEM) through SmartPLS 4, the study analyzed data collected from employees in the transhipment area, selected through purposive and non-probability sampling methods. The research model included transformational leadership (X1) and work environment (X2) as independent variables, work engagement (Z) as a mediating variable, and employee performance (Y) as the dependent variable. The findings indicate that the work environment significantly and positively influences employee performance, whereas transformational leadership and work engagement, although positive, do not show significant effects. Additionally, work engagement fails to mediate the relationship between transformational leadership and performance as well as between the work environment and performance. These results suggest that the work environment is the most critical factor driving employee performance in this context. The study emphasizes the importance of creating a supportive, safe, and conducive workplace to optimize productivity. The findings provide practical insights for management in developing strategies to enhance employee outcomes, while also contributing to the theoretical understanding of human resource management practices in the mining industry

    THE INFLUENCE OF PERCEIVED USEFULNESS, PERCEIVED EASE OF USE AND DIGITAL FINANCIAL LITERACY ON USE BEHAVIOR IN DIGITAL PAYMENT

    Objectives -   This study aims to analyze the effect of perceptions of use, perception of ease of use, and digital financial literacy on the behavior of use in the use of digital payment services among students of the University of Indo Global Mandiri Palembang. Novelty -   In previous studies the brand only focuses on the influence of digital payment while in this study it was further developed, namely the effect of perceived usefulness, perceived ease of use and digital financial literacy on Use Behavior on Digital Payment among students, especially at Indo Global Mandiri University. Methods -   This research uses a quantitative approach with data collection techniques through questionnaires distributed to 176 selected respondents using the purposive sampling method. Data analysis was carried out using the Partial Least Squares-Structural Equation Modeling (PLS-SEM) method using SmartPLS 4 software. Findings -   The results showed that the perception of ease of use and digital financial literacy had a positive and significant effect on the behavior of the use of digital payment services, while the perception of use did not show a significant effect. These findings provide theoretical implications by expanding the application of Technology Acceptance Model (TAM) through the integration of digital financial literacy variables, as well as practical implications for digital payment service providers in designing strategies to increase sustainable use. Limitations and Implications -   This research is limited only to the student sector, especially only students of Indo Global Mandiri University. The implications of this study can make the basis for all students from various universities.     &nbsp

    The Concept of Reconstruction of Cohabitation Regulations in the National Criminal Code Based on the Principle of Legal Certainty

    Provisions regarding living together as husband and wife outside of marriage, known as cohabitation, were introduced in Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code). However, the regulation has many problems, including philosophical, sociological and juridical problems, as well as inappropriate norms, not reflecting justice and ignoring religious and customary norms. This research aims to analyze and find a reconstruction of the formulation of cohabitation norms in the National Criminal Code based on principle of legal certainty. The formulation of the problem proposed is How to reconstruct the formulation of cohabitation norms in the National Criminal Code, based on the principle of legal certainty. The research method uses normative legal research, namely a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced. The approaches used are the statutory approach, the comparative approach and the conceptual approach. Sources of legal materials are primary legal materials, secondary legal materials and tertiary legal materials. The results obtained from this research, Article 412 of the National Criminal Code needs to be reconstructed regarding cohabitation norms, namely living together not as husband and wife because it is not based on a legal marriage, the cohabitation offense is also not a complaint offense but is an ordinary offense, and because cohabitation behavior is not in accordance with The spirit of Pancasila is contrary to religious customs and norms, so we must receive heavier sanctions so that between criminal penalties and fines are accumulative punishments

    Limitations on the Authority of the Constitutional Court as a Positive Legislator

    The authority of the Constitutional Court in Indonesia’s constitutional system has shifted from merely being a negative legislator to a tendency toward becoming a positive legislator. This phenomenon is reflected in various decisions that not only invalidate norms that contradict the Constitution but also establish new legal norms. This study aims to examine the urgency of limiting the Constitutional Court’s authority in acting as a positive legislator and to formulate a limitation model that prevents the Court from exceeding legislative boundaries. This research uses a normative legal method with statutory, case, and conceptual approaches and is analyzed prescriptively and critically based on primary and secondary legal materials. The findings show that the Constitutional Court’s expansive role as a positive legislator has the potential to lead to judicial supremacy and juristocracy, which are inconsistent with the principle of separation of powers. Therefore, limiting the Constitutional Court’s authority is necessary to maintain the constitutional balance among branches of state power. This study proposes the use of Mahfud MD’s “Ten Limiting Guidelines” as a normative framework, complemented by two original models: the Constitutionally Bounded Interpretation Protocol, which emphasizes that judicial interpretation must remain confined to the text, structure, and principles of the Constitution; and the Institutional Dialogue Model, which encourages legislative involvement in the follow-up to Constitutional Court decisions. The research method used is normative juridical library materials or secondary data as basic material for research by conducting a search for regulations and literature related to the problem being studied. The results of this study are that legal protection for trademark certificates issued by the Directorate General of Intellectual Property of the Ministry of Law and Human Rights of the Republic of Indonesia is retroactive from the date of submission of the application, not from when the certificate was issued. In the Decision of this trademark dispute case, there was negligence in providing legal protection to the applicant or trademark registrant, the author does not agree with the decision of the panel of judges at the first level and the high court level and concludes that trademark disputes should be resolved first through civil channels, while criminal channels are used as a last resort in resolving trademark disputes

    Study aims to evaluate the Sukabumi City Pelita Market Revitalization Program. The main focus is to understand the revitalization program, its implementation, and its impact on both traders and the local public. Evaluation steps include identifying program successes, challenges faced, and responses to feedback from various stakeholders. Research methods involve descriptive qualitative analysis using techniques such as interviews, observations, and documentation. Informants include the Head of the Sukabumi City Trade Service, PT. Fortunindo Artha Perkasa, and Pelita Market traders. Data is analyzed through reduction, presentation, and drawing conclusions. Research results show the effectiveness of related programs in enhancing the number of traders, sales turnover, and quality of market facilities, although there are diverse views from stakeholders. Efficiency in resource utilization, particularly in technology and optimal budget management, is a primary focus, although challenges in budget management and engagement with third-party parties remain. Adequate support for merchants, including facilities and training, is essential, along with attention to temporary access paths and additional support needs. Economic alignment in the market is crucial, but concerns regarding costs and accessibility persist. Responsibility for addressing trader and public feedback is important for sustainable repair, including market cleanliness and safety. The accuracy of the revitalization program must align with the needs of local traders, society, and aspirational goals, with room for increased responsibility and sustainability in the program, hoping for the involvement of all parties concerned

    IMPLEMENTATION OF BANDUNG CITY REGIONAL REGULATIONS CONCERNING PUBLIC ORDER, PEACE AND COMMUNITY PROTECTION: Study: Motorcycle Gang Violence in 2021-2023

    The fundamental problem in the research is that even with the presence of Bandung City Regional Regulation Number 9 of 2019 concerning Public Order, Peace and Community Protection, basically the majority of the community does not feel safe because of the disturbing actions carried out by motorbike gangs. This research uses a qualitative approach with a descriptive approach. The data collection techniques in this research are observation and literature study, while the data analysis techniques are through data reduction, presentation and drawing conclusions. The results of research in the field show that the implementation of Bandung City Regional Regulation Number 9 of 2019 concerning Public Order, Peace and Community Protection has not run optimally. This is because the crime rate, one of which is committed by motorbike gangs in the city of Bandung, is still increasing to this day. Data from the Bandung City Central Statistics Agency shows that of the 1,707 crimes that occurred during 2023, at least around 775 cases were caused by other criminal cases, one of which included street violence involving motorbike gangs. Furthermore, based on data that researchers obtained regarding the number of violence committed by motorbike gangs in the city of Bandung in the last three years, the highest number occurred in 2023 with 54 cases

    This research is a qualitative descriptive type study, aiming to analyze and explain the picture of Policy Implementation of marriage management information system at the Office of Religious Affairs Baguala District, Ambon City. The informants in this study numbered 8 people. Data collection techniques used in the form of observation, interviews and documentation as well as analytical techniques used using interactive analysis models from Miles and Huberman, namely using data reduction, data presentation and conclusions. The results of this study show that the implementation of the web-based marriage management information system policy in realizing the improvement of the quality of public services at the Baguala Sub-District Religious Affairs Office has been effective but still not optimal. This can be seen from the indicators of successful policy implementation according to Edward III, namely communication, resources, disposition and bureaucratic structure. The four indicators are influenced by supporting and inhibiting factors that affect the implementation of the marriage management information system in KUA, Baguala District, Ambon City

BPM methodologies can aff ord substantial advantages, encompassing enhanced operational productivity, increased customer satisfaction, and improved market fl exibility. Nonetheless, SMEs frequently encounter obstacles such as constrained resources, insuffi cient expertise, and resistance to change when endeavoring to implement BPM frameworks. This review consolidates fi ndings from empirical investigations regarding the principal advantages and challenges of BPM in SMEs, emphasizing the necessity for customized BPM solutions that take into account the distinctive characteristics of SMEs. The review further delineates gaps within the existing literature, particularly in relation to the longitudinal impacts of BPM adoption and the assimilation of digital technologies within BPM practices. Subsequent research should concentrate on formulating cost-eff ective, scalable BPM frameworks and investigating the convergence of BPM and digital transformation for SMEs
